Terms & Conditions
Important Notice: Your booking for these vacations
involves an agreement between you and those who
provide the services. The tour operator does not
own, manage, control or operate any transportation
vehicle, hotel, resort, cruise ship, restaurant or other
supplier of services and is not responsible for their
acts or omissions.
How To Make A Booking: Bookings are confirmed
on a first-come first-served basis. Early reservations
are recommended. Call or visit your travel agent
who will contact the tour operator for reservations.
Bookings will only be confirmed if payments are
received in accordance with the Payments section.
Payments:
Bookings made, 1) between 45 days and departure
– full payment is due immediately,
or
2) more than 45 days from
departure – a non-refundable
deposit plus applicable insurance
are due immediately and the
balance (“final payment”) is due no
less than 45 days prior to departure.

The Tour Operator reserves the right to cancel a
booking where any payment is not received within
5 days of its due date.
Acceptable forms of payment: cash, credit card or
cheque.
Credit Cards: When using a credit card to confirm
or pay for a booking, the passenger and/or the
cardholder give their consent to the tour operator
for the cards use.
Cancellations: If you intend to cancel, notify your
travel agent immediately. Cancellation charges will
be calculated based on the date the tour operator
receives notice of cancellation.

*The cancellation charge is a liquidated damage to
compensate the Tour Operator for prepayments
made on advance booking of travel services and for
administrative costs involved in processing a
cancellation and is a genuine estimate thereof and
is not a penalty.
**Total price is all money due and/or paid to the
tour operator. Cancellation charges may vary
depending on airline.
Changes to a Booking: A passenger wishing to make
any change to their booking must notify the Tour
Operator outside 45 days from departure. An
administration charge of $25 per person plus GST
(where applicable) will apply. Any changes made
within 45 days to the departure makes the booking
subject to full applicable cancellation charges.
*In the event the initial room occupancy changes
due to the cancellation of one or more passengers,
the remaining passenger will be responsible for the
new occupancy rate. Name change requests may
be denied due to hotel policies and conditions.
Special Requests: Special requests, for example,
room locations, adjoining rooms, bed preferences,
in-flight meal requirements, in-flight seating
requirements, sky cots, etc., cannot be guaranteed
by the Tour Operator. While the Tour Operator
will attempt to accommodate such special requests,
the Tour Operator cannot be held responsible if
such special requests cannot be fulfilled.
Children: Unless stated otherwise, children’s prices
are restricted to children 2-11 years of age at the
time of departure, sharing a room with 2 full paying
passengers.
To qualify as an infant: Infants must be under the
age of 2 for the duration of their holiday.
Tickets:
1) Tickets are sent to agents two weeks prior to
flight departure. For bookings that include hotel
arrangements and/or car rental, a voucher is provided
with the tickets and is required in order for you to
receive the services booked. (See Documentation.)
2) Bookings made within 14 days of flight
departure will be available from our representative
at the airport prior to departure.
3) All tickets are valid only for the flight purchased
and cannot be exchanged for other flights.
4) A charge of $25 per person (in Canada), $50 per
person (at airport and in destination) will be levied
for the reissue of any ticket documentation.
Customs and Immigration: Customs and/or
immigration officials can, at their own discretion,
deny the passenger entry into their country. A
previous criminal record could be an obstacle in
international travel, leading to denied entry. The
Tour Operator cannot be held responsible for
denied entry under any circumstances.
Documentation: It is the passenger’s responsibility to
obtain, at his own expense, all documentation
required by all relevant government authorities, and
this may vary depending on citizenship status.
Special documentation may be required for minors
travelling alone or for children who carry a different
surname than their travelling companions and for
single parents travelling with children. It is
suggested that prior to departure, the passenger
ascertains the documentation required. In the event
that the passenger does not possess the
documentation required by the destination or the
carrier, the carrier reserves the right to refuse
passage.
Flights and Carriers: All flight times, flight itineraries
and carriers are subject to change with or without
prior notice. We recommend that you contact the
airline within 24 hours of departure to confirm your
departure time. The Tour Operator recommends that
you check-in 3-4 hours prior to departure. The tour
operator cannot be held responsible if you miss your
flight or are denied boarding. Cut-off times vary
between 30-60 minutes. Carriage and services
performed and tickets issued by the air carrier are
subject to the rules relating to liability by the Warsaw
Convention and the terms and conditions herein.
The Tour Operator makes arrangements with the
air services of Skyservice, WestJet, Air Transat and
CanJet. Any amendments or changes to Air
Transat’s general terms and conditions of carriage once filed with and approved by federal regulatory
authorities - are not subject to additional public
notice and are legally binding.
Notice to Travellers:
Travellers should be aware that different living
standards and practices may exist outside of
Canada including but not limited to: provision of
utilities, eg. water and electricity;
accommodations; services of all kinds; food; food
preparation and water quality. The Tour Operator
shall not be responsible for any loss, damage,
illness or injury resulting from different living
standards. All hotels undergo routine maintenance
and renovation. Certain resort areas are
undergoing major growth with considerable
ongoing construction.
Connecting Flights: Passengers connecting with the
Tour Operator’s flights are advised to allow ample
time (minimum 3 hours/recommend overnight)
between flights. The Tour Operator cannot accept
any responsibility for additional charges incurred
for air fares or other expenses as a result of
irregular airline operations which result in changes
to flight times and/or subsequent misconnections
(see Travel Insurance).
Tour Operator’s Representative and Problem
Handling: You will be met on arrival at the
destination by the Tour Operator’s representative.
After arrival, your representative will give a
welcome briefing during which you will be provided
with important information about your package and
the resort area. If you have any queries or problems,
please contact your representative and/or the hotel.
Please address your complaint with the hotel and/or
the Tour Operator’s representative. Do not wait until
you return home.
Accommodation and Services: The Tour Operator
cannot be held responsible if some of the services,
bonus features or facilities described in this brochure,
cease to be available or are not working. Hotels may
curtail or alter some facilities without notice, usually
for purposes of ongoing maintenance and
improvement. Use of recreation equipment and
facilities which may be included in your holiday
package is subject to availability. All the Tour
Operator’s hotel rooms are contracted on a “run of
the house” basis. Specific requirements with regard to
room and other special requests cannot be
guaranteed, and in most cases, cannot be confirmed
prior to departure. The Tour Operator reserves the
right to restrict the number of single, double, triple,
quad and child bookings it will accept at a particular
property.
Baggage: Each person is entitled to two normal
sized pieces of checked luggage. Weight restrictions
vary between 10 and 20 kilos per person, consult
your airline prior to departure.

REMAINS AT THE OWNER’S RISK
THROUGHOUT THE TRIP.
Refunds: NO REFUNDS OR ADJUSTMENTS WILL BE
MADE FOR PORTIONS OF THE TRIP OR ATTENDANT
SERVICES NOT TAKEN OR USED.
Air Only: These are advanced booking charter flights
operated pursuant to the rules of the Canadian
Transportation Agency. Payment and cancellation
details for ABC flights are the same as outlined in
How to Book and Cancellation Charges.
Prices: All prices, unless otherwise stated are per
person based on two adults sharing a hotel room.
All prices advertised in this brochure are in
Canadian dollars. Prices do not include G.S.T.
(where applicable) and transportation taxes.
Special Needs Passengers: The Tour Operator
cannot guarantee that destination airport, coaches,
transfer vehicles and accommodation will be
wheelchair accessible. Services required for
passengers with special needs are not included in
the package price and may not be available.
Increase in Costs: The prices advertised in this
brochure are based on fixed costs at the time of going
to press. These costs are dependent on fuel costs,
rates of exchange and other factors. Should these
costs increase, the Tour Operator reserves the right to
increase the price. Should the price increase greater
than 7%, the consumer has the right to cancel the
contract for the travel service and obtain a full refund
of all amounts paid to the Tour Operator, unless the
price increase is the result of government taxation or
a fuel surcharge allowed by the Canadian
Transportation Agency. Every effort will be made to
advise your travel agent of any price increase at least
15 days prior to your holiday departure date.
Compliance: The passenger agrees to comply with
any reasonable instructions issued by the Tour
Operator or its representative relating to the tour.
The passenger waives any claim against the Tour
Operator for loss, damages or injury for any reason
or by any result of the rendering of any of the
services contained in this brochure.
Interpretation of the Contract: This contract,
regardless of where it is performed, shall be
interpreted in accordance with the laws of the place
of departure from Canada and international
conventions and agreements contained herein.
Notice: No agent or representative of the Tour
Operator has the authority to modify or waive any
provision of these terms and conditions.
Severability: The invalidity of any provision
contained herein shall not affect the validity of any
other provision.
Premier Service: This upgrade is available in conjunction with
Skyservice and CanJet Flights only. This offer is non-transferable
and not redeemable for cash. To book seat selection on line, visit
www.sunquest.ca or call 416-482-5949 or 1-877-256-7966 at
least 2 business days before departure. Seating requests are
subject to availability. Administration Fee will be at no charge when
making a change outside 45 days before departure (limit 1 change
per booking and not applicable to Christmas, New Years, March
Break and Easter). Priority airport check-in applicable to Skyservice
or CanJet outbound flights at designated counter. Check-in is
recommended to be no later than 2 hours prior to departure. Free
Drinks onboard is to a maximum of 4 per person, must be of legal

Claims: The passenger agrees that any claim
against the Tour Operator shall be made by the
passenger in writing and received by the Tour
Operator no later than 30 days after the event
causing the claim. Claims or demands made after

writing and sent by registered mail to the address of
the Tour Operator, below, prior to the
commencement of any legal proceeding and under
no circumstances shall you claim from the Tour
Operator an amount in excess of the costs of the
vacation paid by you.
Cancellation of Services: In the event that certain
services are cancelled, the Tour Operator will have
no responsibility beyond the refund of all monies
received by the Tour Operator, which will be
deemed to constitute full settlement.
Tour Operator’s Responsibility: The Tour Operator
makes arrangements with airlines, coach companies,
transfer operators, shore excursion operators, hotels
and other independent parties to provide you with
the travel services and other services you purchase.
Although the Tour Operator takes reasonable care in
selecting these suppliers, the Tour Operator is unable
and does not have any control over them and
therefore cannot be responsible for their acts or
omissions. The travel services provided are subject to
the Travel Industry Act (Ont.), Travel Agent’s Act
(BC) and Regulations thereunder and are subject to
the conditions imposed by the suppliers and their
liability is limited by their tariffs, conditions of
carriage, tickets and vouchers and international
conventions and agreements (eg; The Warsaw
Convention, The Athens Convention & The
London Convention).
The Tour Operator shall not be responsible for any
loss, damage, injury or illness whether physical or
mental, resulting from any delay, substitution of
equipment, or any act, omission, negligence or
commission of any party supplying any of the
services or accommodation herein, its agents,
servants, employees, subcontractors, or for any
claims for such loss, damage or injury, whether
physical or mental, arising therefrom, or from any
cause that arises by reason of actions of parties other
than the Tour Operator. The Tour Operator reserves
the right to decline any passenger as a member of
these tours at any time.
Government Approval: All Inclusive Tour Charter
holidays and ABC flights are operated pursuant to
the rules of the Canadian Transportation Agency
and have been approved by the Agency on behalf of
the Tour Operator.
Privacy Policy: Sunquest is compliant with the
Personal Information Protection and Electronic
Document Act (P.I.P.E.D.A.) that went into effect
