Yours sincerely, Malcolm Brunyee Mr M Brunyee Senior Training Manager 2 Foreword With an ever increasing emphasis on Health and safety in the workplace, there is increased pressure on employers to ensure that their employees have adequate evidence of training to meet the standards set by legislation. It is sometimes difficult for employers to ensure compliance, simply because the regulations are open to interpretation and misconception. For example, companies often advertise for staff who have a forklift licence. There is no such thing as a Fork Lift Licence. Employers are responsible for having evidence to prove that any employee is adequately trained for the task they perform. As with any product cost is important, however, with Work placed transport it is also extremely important for the training to be fully compliant with the requirements of the Provision and use of Work Equipment Regulations and the Rider-operated lift trucks: Operator Training (L117) Approved Code of Practice and Guidance. The simplest method of compliance with this Acop is to ensure that any training of workplace transport is carried out by training providers who are ACCREDITED by one of the organisations listed in the aforementioned Acop. Generally providers who are not accredited are not any cheaper. However, they are more likely to cut corners and less likely to be able to give an employer the evidence that is needed to prove compliance with the Acop. Whilst we pride ourselves in the standards to which our instructors deliver our vocational training courses, we cannot emphasise enough the effort which you will need to put into your course in order to achieve your desired result. Try our short self assessment questionnaire, at the centre of this pamphlet, to identify any training needs your company may have. 3 A GUIDE TO AN EMPLOYERS OBLIGATIONS AND TRAINING REQUIREMENTS FOR FORKLIFT OPERATORS. ANY PERSON WHO OPERATES FORKLIFTS MUST BE ADEQUATELY TRAINED. As an employer there are a number of legal obligations that apply, with regards to the training of forklift operators. The basic obligations are set out here. DID YOU KNOW? Under the PROVISION AND USE OF WORK EQUIPMENT REGULATIONS 1998 (PUWER). Approved Code Of Practice And Guidance. REGULATION 9. 1. Every employer shall ensure that all persons who use work equipment have received adequate training for purposes of health and safety, including training in the methods, which may be adopted when using the work equipment, any risks, which such use may entail, and precautions to be taken. 2. Every employer shall ensure that any of his employees who supervises or manages the use of work equipment has received adequate training for purposes of health and Safety, including training in the methods, which may be adopted when using the work Equipment, any risks, which such use may entail, and precautions to be taken. TRAINING SHOULD BE OF A MINIMUM STANDARD AND CONTENT. These requirements are explained in the Approved Code of Practice and Guidance: RIDER- OPERATED LIFT TRUCKS: OPERATOR TRAINING (L117) This document issues guidance on the standards of training for forklift operators, also who should carry out this training. REQUIREMENTS GOVERNING THE SAFE USE OF FORKLIFT TRUCKS ARE LAID DOWN IN APPROVED CODES OF PRACTICE AND GUIDANCE. WHAT IS AN ACOP? Practical guidance on how to comply with the law. If you follow the advice in an ACOP you will be doing enough to ensure compliance with the law on matters that it covers. ACOP material has special legal status. If you are prosecuted for a breach of health and safety law and it is proved that you did not follow the relevant provisions of the ACOP, you will need to show that you have complied with the law in some other way or a court find you at fault. 4 WHAT IS GUIDANCE? Guidance material describes practical means of complying with regulations. It does not have special status in law, but is seen as best practice. Following the guidance is not compulsory and you are free to take other action. But if you do follow the guidance you will normally be doing enough to comply with the law. Health and safety inspectors seek to secure compliance with the law and may refer to this guidance as illustrating good practice. HOW DO YOU KNOW THAT YOUR TRAINING COMPLIES WITH THESE REQUIREMENTS? (ITSSAR) Independent Training Scheme and Register BY CHOOSING A TRAINING ORGANISATION WHOSE COURSES ARE ACCREDITED BY ONE OF THE ABOVE BODIES. THE TRAINING THAT IS DELIVERED IS GUARANTEED TO COMPLY WITH THE NECESSARY ACOPS. It is the responsibility of the employer to ensure that any training is adequate and relevant. To this end it is advisable to check the suitability of any provider or course offered by a provider with one of the organisations listed above. 5 The training of lift truck operators is be divided into three stages. Basic training the basic skills and knowledge required for safe operation. Specific job training knowledge of workplace and experience of any special needs and handling attachments. Familiarization training operation on the job under close supervision; These stages can be taken separately, or they may be combined or integrated, particularly where training is carried out on an employer’s premises. In either case, it is essential that each stage be covered fully, with due regard to the experience, if any, of the trainees and The type or types of the truck they will be expected to operate. The first two stages need to be carried out off the job, ie sheltered from production and other pressures. The third stage needs to be carried out on the job, but under close supervision. Other areas of consideration are operator selection and the employer’s issue of authorisation to operate specified types of vehicles The ACOP and guidance relate to stacking rider-operated lift trucks, including articulated steering truck types. ‘Rider-operated’ means any truck capable of carrying an operator and includes trucks controlled from both seated and stand-on positions, which may be fixed or foldaway. This also applies to powered pedestrian pallet trucks. As the various types of trucks have different characteristics each truck should be treated separately, meaning basic or conversion training for each type. EXPENSE: IN ADDITION TO THE COST OF DAMAGE, OTHER COSTS INCURED WOULD INCLUDE SICK PAY, COMPENSATION CLAIMS AND INCREASED INSURANCE PREMIUMS AND POSSIBLY FINES. The reasons for operator training, the risks associated with lift truck operations and the causes of lift truck accidents. 2. The responsibilities of operators to themselves and others, including their duties under 7 and 8 of the HSAWA 1974. 3. Identify the basic construction and main components of the lift truck, including its principles of operations and load handling capabilities and capacities. 4. Identify, as appropriate, any handling attachments that may be used with a lift truck. 5. Locate and state the purpose and method of use of all controls and instruments. 6. Pick up and place loads, drive and manoeuvre the machine in forward and reverse motions laden and unladen on inclines, in restricted spaces and on level ground following correct procedures and precautions. 7. Place the forks or other handling attachments in pre-determined positions employing the appropriate controls. 8. Identify various forms of load, and the procedures for their stacking, destacking and separation; assess the weight, the load centre of the load and determine if the load is within the trucks capacity. 9. The factors that which affect machine stability, including: turning, especially related to speed and sharpness of turn; load security and integrity; rated capacity and related load centres; centres of gravity; and speed and smoothness of operation. 10.Correct procedure for loading or unloading vehicles. 11.Visual checks to ascertain the safety, soundness and rating of structures designed to receive loads, and place and remove loads on and from those structures at various heights. 12.Park the machine, following correct procedures and precautions. 13.Use of safety devices including stabilisers, level indicators or load indicators where fitted. 14.Carry out inspections and maintenance tasks appropriate to operators as required by the machine manufacturers and any relevant legislation. 15.The actions to be taken in an emergency while in control of a lift truck, ie, action to be taken in the event of tip over. 16. RTITB accreditation is dependant upon the candidate being registered onto the National Operators Registration Scheme. (The full list can be found in the ACOP. Rider – Operated Lift Trucks: Operator Training.) Only a maximum of 3 trainees can be trained at any one time with 1 Instructor. From our well equipped training centre in Peterborough we are able to offer training on most types of forklift trucks from Pedestrian, Counterbalance and Reach to the more specialist vehicles such as Rough terrain telescopic, HIAB, and Scissor lifts etc. We can also offer accredited training, on your premises using your own vehicles, using our experienced instructors and. at discounted rates. All appropriate certificates and training records are included in the price. The courses commence at 8.30 am and finish approximately 4.30 pm each day. As stipulated by the governing bodies the duration of the course is dependent on the current experience of the candidate and the type of truck they wish to operate Typical Examples of training requirements: A max of 3 candidates allowed only 5 Days - for a candidate with no previous or very limited knowledge of forklifts. 3 Days - for a candidate, who is an experienced operator of forklifts but with no proof of training? 1 Day - for a candidate who already holds a certificate of training. (Refresher course) 3 Days - for candidates requiring a conversion to another truck type, (Reach or Counterbalance). Registration for NORS (compulsory) £9.95 + VAT Certificate, ID card and registration with RTITB Accommodation Expenses: A fee of £75.00 per night can be charged outside a radius of 40 miles from Peterborough, as this reduces the travel expenses. 10 From April 2006 all candidates for accredited forklift training, with an accredited training organisation are required, by RTITB, to be registered with the National Operator Registration Scheme. The aim is to improve the standards of training within the accredited scheme and at the same time to ensure that customers are not being defrauded by organisations claiming accredited status. Benefits for employers and operators will include authentic and checkable certificates and ID cards issued by RTITB. Registration onto the national database of qualified operators. FEES FOR REGISTRATION ARE £9.95 + VAT TOTAL COST £11.69 11 TERMS AND CONDITIONS FOR CANDIDATES ON TRAINING COURSES Terms and Conditions on Agreement by you with Apex Training Centres to undertake training course as arranged on your assessment (where applicable) or by other means. This contract should be signed and returned to us before any course can be booked. Courses are only provisional until we have received a signed acceptance form. PAYMENT Payment must be made no later than 10 working days before commencement of course. (Unless prior agreement has been made in writing.) DATES / START TIMES Your appointment card is issued which shows the date of commencement of your course. If in the event of any changes you will be notified by phone or post (where possible) or at the time you start your training course. IN THE EVENT OF A VEHICLE BREAKDOWN Should a vehicle breakdown occur during your training course, Apex will make every effort to either: ◊ Repair the fault ◊ Replace the vehicle with another training vehicle (where possible) ◊ Hire a vehicle (where or if possible). This vehicle may not be the same make or model as your previous training vehicle. ◊ Make up time lost during training (where possible) ◊ Refund lost time SHOULD TRAINING TIME BE LOST DUE TO A BREAKDOWN You may be asked to come in on alternative dates or times due to a vehicle breakdown. Should this not be possible you will receive a refund for the training you did not receive or discount on any future training with Apex. INSTRUCTORS UNABLE TO ATTEND You will stay with the same instructor throughout the duration of your course, unless of: ILL HEALTH CIRCUMSTANCES BEYOND OUR CONTROL YOU ARE NOT SATISFIED WITH THE APPOINTED INSTRUCTOR 12 FAIL A PRACTICAL TEST DUE TO A VEHICLE BREAKDOWN Should a breakdown occur during your test appointment then Apex will refund or pay for your next test date. You will also receive 1 days training prior to your next appointment plus the day of your test FREE OF ANY CHARGES. RE-TESTS Due to the nature of driving tests being allocated by the DSA it may not be possible to re-allocate the same vehicle or instructor to the candidate on sitting a re-test. Apex will not be held responsible in the event that the candidate is changed to another instructor or vehicle on re-tests. However Apex will endeavour to re-allocate the same vehicle and instructor wherever possible. APEX SAFETY POLICY Apex operates a strict safety policy of which must be adhered to at all times. ∗ Once entering Apex premises please drive carefully of speeds no more than 5MPH. ∗ Once arriving at Apex please go into reception at the front of the building where your instructor will be appointed. ∗ Should you hear the fire warning then leave the building immediately and wait near the main gate to receive further instructions. ∗ Do not enter any part of the building unless told to do so. ∗ In the event you are injured please report your injury to reception for first aid treatment. ∗ Under no circumstances may alcohol be consumed on the premises ∗ Please be aware of vehicles manoeuvring whilst on company premises at ALL times. ∗ YOU MUST inform Apex of any medication / prescribed drugs that you are on as they may effect your driving ability. ON YOUR FIRST DAY (please arrive a minimum of 15 minutes before your allocated start times) On the first day of commencement of your course you will be informed of several things: ⇒ Start Times and Finish Times (should you have not received them) ⇒ Your instructors name PARKING Please park your vehicle sensibly at the centre ensuring that you are not blocking the way for other vehicles including training vehicles. Please park in the designated spaces at the centre or as instructed by centre staff. Apex will not be held responsible for any loss or damage to your vehicle whilst on company premises. Please ensure that all your personal possessions are locked away and out of sight. PERSONAL BELONGINGS Apex Training services cannot be held responsible for the loss or damage of any personal belongings or property whilst on our premises. ADVERSE WEATHER CONDITIONS It may become necessary to change your appointment dates and times during your course. This may be caused by adverse weather conditions (Fog, Snow etc.) CANCELLATION Cancellation or postponement of training courses must be notified to the office 12 clear working days prior to commencement of the course (excluding bank holidays and weekends) Failure to do so will mean: • Except in extenuating circumstances the full cost of the course WILL be charged • Any test fees or deposits paid will be non-refundable.
