reversed their positions and
had 7.7 million to Maglio’s
5.5 million. Then the final,
fatal, hand played out.

It has been one full month
since the New Jersey
Division of Gaming
Enforcement ordered the
Borgata Casino to cancel the
opening event of its annual
Winter Poker Open, but
New Jersey regulators have
yet to reach a conclusion to
their investigation of bogus
chips that were introduced
into the competition. The
extended delay has led to
escalating agitation among
players according to Bruce
Licausi attorney for Jeffrey
Musterel, plaintiff in a lawsuit filed last Friday against
the Borgata.

Egg Harbor Township, near
Atlantic City. He is among
the 4000+ players who par-

holders. Joe McKeehen has
two rings, one of which is a
Main Event Championship
ring from Caesar’s Atlantic
City in 2013. He finished
4th. The only other player
at the final table with a ring
was Luke Graham, who
made back-to-back final
tables here, finishing 8th this
year and 6th last year. He has
a circuit ring from Harrah’s
New Orleans in 2013.
In this event, Dykshteyn
bested a field of 658 entrants
to earn the lion’s share of
the $987,000 prize pool. The
final 72 players got paid and
it was a packed field. Mukul
Pahuja, who has nearly $1.9
million in tournament earnings, just missed the unofficial final table, busting out
11th for $15,220. He followed Aaron Massey to the
rail after Massey busted in
12th place ($15,220). Massey
has over $1.5 million in earnings.
The last woman sitting
in this event was Claudia
Crawford. She finished 15th
for $12,387. WSOP bracelet holders in the money:
Josh Arieh, 17th ($10,206);
Robert Cheung, $56th
($3,010) and David Diaz,
62nd ($3,010).

City and rarely plays tournaments. He has one large tournament score prior to today,
which is a 3rd place finish
in the 2012 Borgata Spring
Poker Open Championship,
good for $112,950.
In addition to the prize
money and gold ring,
Dykshteyn also earns a

Pennsylvania State Senators Seek
to Criminalize Online Poker Playing

Of course, later I helped

the sit-and-wait era of winning was finally over. But
it’s important to realize that
playing tight often still wins
by itself. It doesn’t win as
much as my power poker
tactics (a term I coined in
1978 for Doyle Brunson
to use with his poker bible
Super/System — A Course
in Power Poker). But it wins
marginally.

PENNSYLVANIA POLS ANNOUNCE
SUPPORT FOR ONLINE-GAMBLING BAN
Three Pennsylvania state legislators have announced
support for a yet-to-be-introduced piece of legislation
that would criminalize the playing of online poker and other forms of online
gambling. The statements by State Sen. Mario Scavello and two others propose
summary fines and misdemeanor penalties for playing poker and other forms
of gambling online, and if enacted would make Pennsylvania only the second
US state where playing online poker is regarded as criminal. (The state of
Washington passed a felony law in 2006.) The LV Sands-funded Coalition to Stop
Internet Gambling (CSIG) immediately hailed Scavello’s proposal; Scavello’s PA
district, coincidentally, is adjacent to the one where the Sands-owned Sands
Bethlehem casino is located.
BORGATA CHIP COUNTERFEITER CHARGED IN
BOOTLEG DVD OPERATION
The problems facing alleged Borgata chip counterfeiter Christian Lusardi continue to deepen after authorities charged him with an ongoing bootleg-DVD
scheme following a search of his North Carolina home. New Jersey and North
Carolina media outlets reported that investigators seized 37,000 fake DVDs in
addition to manufacturing and packaging equipment, in addition to evidence
of overseas shipments of the DVDs from China. Lusardi remains in a Jersey jail
cell on charges connected to his alleged Borgata chip counterfeiting, wherein
authorities claim he added roughly 100 fake chips to a major tournament, eventually causing its cancellation.
PRO-ONLINE GAMBLING LOBBYING GROUP C4COP
DEBUTS
A new lobbying group favoring the regulated oversight of online poker and
gambling has debuted. The new Coalition for Consumer and Online Protection
(C4COP) is funded by MGM International with support from the American
Gaming Association. C4COP was created to counteract the anti-online push of
CSIG, with C4COP immediately announcing a $250,000 media buy, primarily
around Washington, D.C., to promote a pro-online political agenda. Among the
political figures already signed to front the group are former GOP Congressmen
Mike Oxley and Mary Bono and former Obama administrative staffer Jim
Messina.
LV SANDS WEBSITES TARGETED BY HACKERS
The internet homes of prominent Las Vegas casino resorts Venetian and Palazzo
were knocked off line for several days in February following attacks by internet
hackers. The attacks appeared motivated by the pro-Israel politics of LV Sands
CEO Sheldon Adelson, and text left by the hackers included a reference to an
oblique recommendation Adelson made last year about bombing the Iranian
desert as a show of strength supporting Israel. The hacking included the publication of private information of LV Sands employees. The LV Sands corporate
website was also affected, as were the sites of its other casino properties, in
Pennsylvania and Macau.
PRO-ONLINE POKER CALIFORNIA POLITICIAN
CONVICTED OF VOTER FRAUD, PERJURY
California’s online-poker proponents lost one their major legislative supporters
when California State Sen. Roderick Wright was convicted on unrelated charges
of perjury and fraudulent voting. In recent years, Wright had submitted several
proposals to create and regulate California intrastate online poker, plans for
which must now re-develop under alternate sponsors. Wright faces as much as
eight years in prison on his eight-count conviction, pending appeal. If left standing, Wright would become a felon and be unable to vote, though he remained an
active Senate member at last report.
BLACK FRIDAY DEFENDANT LOSES CIVIL CASE
AGAINST GAMING ATTORNEY
Convicted “Black Friday” online-poker payment processor Chad Elie suffered
another legal setback when his malpractice lawsuit prominent gaming attorney A. Jeff Ifrah was dismissed. Elie saw all eight of his allegations dismissed,
including claims of malpractice, misrepresentation, and fraud. Elie had claimed
that Ifrah had enriched himself while providing misleading legal opinions to Elie
regarding payment processing legality. Elie’s claims were tossed by a US District
judge in Nevada, largely because of Elie’s own admissions of guilt in securing a
plea deal for a reduced sentence for his own role in the Black Friday affair.

Simple profit
That’s why tight play should
be the foundation of every
poker player’s training. You
need to have a solid, uncomplicated strategy to fall back
on. And you need to be willing to return to it from time
to time.
I teach that this is like
having a buoy in the middle
of the ocean. You can grab
onto it for survival, while
waiting to be rescued. You
can also swim away from it
to explore or for exercise.
But you must never forget
where it is.
Most poker players lose
because they swim away
from their buoys and can’t
remember where to find
them. Maybe they never had
one to begin with, merely
splashing around in an
empty ocean without any
sense of direction. Whatever.
You need a buoy. And
that buoy is simply a tight,
cautious strategy that you
can cling to when necessary.
It turns out that you can
beat most poker games
against amateurs, simply by
using that strategy — just by
returning to your buoy. You
won’t add finesse and make
maximum profit, but you’ll
survive. And you’ll win a
little. It’s the simplest profit
available.
Add more hands
So, when can you add more
hands? When can you swim
away from your buoy tied
tightly to the ocean floor?
Actually, you can do it
most of the time. You will
take more risk by adding
hands to your playlist, but
those additional risky hands
will increase your profit,
when added together over
time.
Playing extremely tight is
the safest strategy in most
poker games against weak
opponents who enter too
many pots. Period. Fact.
Don’t argue. But, wait!
Being safe isn’t why you
play poker, assuming your
objective is to win. Taking
risk is why you play poker.
You win by inviting risk
when you have an advantage.
That great truth is why
it’s almost always wrong
to raise in order to “protect
a hand.” You don’t want
to protect hands. You want
to put hands at risk when
the odds are in your favor.
That’s important, so I’ll
repeat it. Don’t try to protect hands; put your hands
enthusiastically at risk.
That’s the key to winning.
And that’s why you can
add hands to your safe, tight
strategy. If your opponents
are playing many more
hands than they reasonably
should, that means they’re
averaging weaker hands.
Sure, they’ll still have their
share of powerful hands,
but the average strength is
less, because it’s diluted by
unprofitable cards. When
their average target hand is
weak, you can play hands
you wouldn’t play against
skillful opponents and still
win. That’s because, even
though you’re relaxing your
standards, your hands will
remain stronger than theirs,
on average. So, you have
more hands that you can
play with an advantage.
Return
But you should always feel
secure knowing that you can
return to your basic tight
strategy at any moment.
When? Well, if you’re conspicuously losing, that’s a
good time.
When the cards haven’t
been friendly, opponents
think you’re vulnerable
and are inspired. They play
better against you, because
they have the illusion that
you’re on a bad streak of
cards and are vulnerable.
Of course, you and I know
that what’s already happened has no influence on
the next deal. You still have
the same chance of getting
good cards as you always
did. But your opponents

What’s the poker capitol of the world? For my money, the honors
have to go to the entire state of California. This state’s rich poker
legacy goes back to the 1930s, a time when gambling was banned
everywhere in the United States, but in Nevada. But in California,
poker clubs were legal and thrived in those municipalities that
allowed them (if only for draw poker games).
Poker continues to thrive in California today, with 104 rooms
listed on www.pokeratlas.com. Having played in just about all of the
poker rooms in Southern California, I decided to explore the vast
sea of poker rooms in the northern and central part of the state. My
buddy Andrei (a limit hold’em specialist) and I managed to hit about
25 of them on this five day trip. In this and my next few articles, I
will tell you, at least briefly, about the rooms we visited—as well as
a few of the highlights and lowlights of our excursion.
We flew into San Francisco and immediately rented a car and
left the Bay Area. We could have played in the four rooms that ring
San Francisco: The Oaks in Emeryville, Artichoke Joe’s in San
Bruno, Palace Poker in Hayward, and Lucky Chances in Colma. All
are fine rooms, worthy of at least a visit. But I had played in each
of them in the past and decided that we would spend our limited
time in rooms to the east that I had yet to visit. So off we were for
points east.
Our first stop was the California Grand (5988 Pacheco Blvd,
Pacheco, 925-685-8397) about 45 minutes east of San Francisco.
This is a very nice room. It dates back to 1979 but has been in the
current building for five years (the older one is now an historic
landmark). Owned and operated by the Wilkinson family, it retains
the touches of the original card rooms that have their roots in the
early days of draw and low ball, with numerous house-funded jackpots and promotions (like $50 in chips for $20 for new players), as
well as nearly free food for seated players ($2 breakfast and lunch
specials). Their 14 poker tables were full when we arrived at 3:00
PM on a Saturday, with $3/6, $6/12 and $15/30 limit games; $2/2/3
blind and $2/3/5 no limit hold’em; and a $4/8 Omaha8 game with a
½ kill. The house drops $4 on the lower staked games and $5 on the
bigger ones, but funds all of the promotions themselves—including
a bad beat that was up to $85K when I was there. The room was
filled with locals. From my limited sample size and conversation, I’d
say that at the no limit and lower limit tables, there were an average of one or two very good players per game, making this a profitable place for the skilled poker player.
We left the Grand and drove to Casino Royale, (500 Leisure
Lane Sacramento, CA, inside the Red Lion Hotel (916) 9297529) one of three rooms in Sacramento. This is a new space for
them, having moved in August from their downtown location. It
is a very convenient for a poker traveler, as it is one of very few
California card rooms with a hotel for guests, as well as a fine dining restaurant. (I can attest to lakeside beauty of the setting and
the skill of the chef, who prepared a magnificent sea bass for me).
The poker itself is just beginning to rebuild, with lots of house-funded promotions including Aces cracked, bad beats, $1 an hour comps
for seated players, and a $500 for bonus 200 hours of play (with
lots of ways of earning additional hours at different hours and with
different hands). My impression is that this is a room that’s doing
everything it can to attract a strong customer base for the future. I
saw the hands-on attention from the floor that all players enjoyed
(there was just one game going when I was there on Saturday
night). The players seemed to be there to enjoy themselves more
than to play skillful poker. With the hotel and fine restaurant—as
well as the plethora of promotions, this would be an ideal place to
come for a weekend of poker and relaxation.

Player Lawsuit Against Borgata
received their share of prize
monies before the tournament was cancelled. By all
accounts from players in this
group, they have no gripes.
Several lawyers consulted
for this article say paid players have no worries as to
their rights to keep the monies they have received. .
A few players who
reached the money, did not
pick up their winnings in
a timely fashion—notably
including 28th place finisher,
Men (“the Master”) Nguyen.
They are expected to receive
their monies as soon as the
frozen monies are released
for distribution, according to
tournament officials.
The rest of the Winter
Open tournament series was
permitted to go forward,
once all of the chips were
examined and found to be
bona fide tournament currency. There were record-breaking fields for many of the
remaining events. The WPT
Borgata Open Championship
was the 2nd largest field in
the Tour’s history.
The big question about
the compromised event,
these days, focuses on the
4000+ participants who did
not cash in the event. Their
fate as to possible refunds
of buy-ins, buy-in fees, and
incidental expenses has thus
far been left in limbo by
both DGE and the Borgata.
The casino says it is precluded from responding to
questions regarding money
matters during the DGE’s
active investigation and
deliberations on the casino’s
obligations.
From Tournament
Cancellation to Player
Lawsuit
At the time the tournament
was cancelled, an estimated
1.4 million dollars in unpaid
prize monies were frozen and
placed in a trust on orders of
the DGE, pending its further
resolution. According to
Licausi and several players,
the DGE’s unexplained and
continuing delay, in reaching
an ultimate resolution on the
Borgata’s obligations, has
amplified player outrage.
The complaint alleges
that players were entitled to
a properly protected tournament environment. Legal
pundits raise questions as
to whether bettors have the
right to remedies as pleaded
in Licausi’s papers, indicating such assertions could
become hotly contested.
The case, if won (by the
plaintiff or as a class action
suit), would be unprecedented, say several lawyers
who specialize in the gaming industry in different
parts of the country. Licausi
is not deterred in his pursuit
of making things right for
his client. He insists that he
seeks justice for all players
affected by “Chipgate.”
The Lawsuit: Musterel
v. Marina District
Finance Co. Inc.
The lawsuit notably accuses
the Borgata of negligence
and fraud, asserting among
other forms of relief, that
players have rights to full
refunds of their buy-ins, fees
and related travel and lodging disbursements.
The suit claims at its core
that the “integrity of the
event was compromised.”
On this point there seems to
be no dispute between the
parties. A key issue to be
resolved, however, is that of
liability on the part of the
Borgata.
The complaint also alleges
a panoply of other legal
infractions. Licausi ticks off
a list of them: violations of
the New Jersey Consumer
Fraud Act, breach of contract, unjust enrichment,
breach of implied good faith
and fair dealing, promissory estoppel, and equitable
estoppel,
Additionally, as is customary in these types of cases,
the suit also seeks compensatory damages, treble damages and attorney fees.
The action was filed in
New Jersey State Court
(rather than federal court
where class actions are
generally taken). Licausi
believes the case should
reside in Atlantic County.

My column entitled, “How Do You Rule?” in the
Feb. 10 issue of PPN, had so many great responses
that we awarded seven valuable prizes (copies of the Hold’em
Algorithm) instead of one as planned! All raised salient issues; many
offered thoughtful suggestions. Some described personal experiences. I’ll summarize their comments and quote several in this and
the next column (Part II). After studying the responses and consulting with others, I have drawn conclusions that I will share with you
in Part III. (You may be surprised!)
Reminder: We described a hand where James bet on the river;
then, after Bill called, James shouted, “Full-House.” Bill promptly
mucked his hand. But, when James showed his hand, all he had was
A-K high. An argument erupted. Bill claimed he had the better hand.
James insisted that, having gone into the discards, Bill’s hand was
dead. The floorman settled the controversy by retrieving what presumably was Bill’s hand from the edge of the muck and declaring Bill
the winner with a better hand.
Response Highlights. Several referred to Robert’s Rules of Poker
(developed by poker pro Bob Ciaffone) that are more or less used in
casinos. We will focus on these rules as they apply to this situation
at the showdown. (See Part 3.)
Jan Fisher of CardPlayer Cruises, who is listed in the Women
in Poker Hall of Fame, cited the general rules of the Tournament
Directors Association. (Note: Jan participated in drawing them up.)
According to these rules, “cards speak to determine the winner;
verbal declarations of hand value are not binding at showdown; and
deliberately miscalling a hand may be penalized.”
Jan commented: “Bottom line is that the players are adults and
must fend for themselves whether against ‘shot takers or those making errors’.” Then she added, “How gentlemanly it would have been
of the player who miscalled his hand to voluntarily give up the pot?”
Speaking directly to the incident we described, Ashley Adams, a
featured columnist in this publication, would rule that, since Bill’s
hand was retrievable and beat James’ hand, the house should award
the pot to Bill, although he recognizes that “there is a clear rule
that a hand that hits the muck is dead and cannot win.” On the other
hand, “there is a sense of decency that seems violated by enforcing
that rule.” It’s plain wrong “to reward someone for a move (angleshooting) that, while not technically cheating, is clearly against the
spirit of the game.” The “integrity of the game” is at stake. It is well
that the poker room manager “retains this power of discretion in
the best interests of the game.”
On the other hand, if Bill’s hand was not retrievable, Ashley would
award the pot to James – and then banish him from the poker room
for a period of time. However, if James “legitimately misread” his
hand, then Ashley would follow the mucked-hand rule, declare Bill’s
hand as dead, and award the pot to James.
Daniel Sverdlin of Redondo Beach cited a similar situation he had
observed while playing in the Bicycle Casino. The floorman awarded
the pot to the mucked hand to “preserve the integrity of the game.”
Dan questions that ruling based on:
(1) It was a mistake for the player to muck his hand before seeing the opposing hand; and,
(2) The game is under the rule of “cards speak,” emphasizing
that “cards thrown into the muck cannot speak.” Dan queried floormen at other casinos; all agreed that the muckedhand did not deserve the pot.
There may be reasons other than angle-shooting for misstating
a hand, he explained. And he cautioned, “In a ‘cards speak’ game,
always show your hand.”
Dan offers an intriguing analogy: “In the boxing ring, you must
defend yourself at all times. The person who mucked his hand failed
to protect his interests and should have suffered defeat.”

reports received by this
reporter, it would appear
that the Borgata’s suspicions of a tainted tournament evolved into a wellinformed conclusion the
morning of the third scheduled day of play. The DGE
suspended the tournament
that day and cancelled it a
day later.
Last Friday following
the filing of the lawsuit by
Musterel, the DGE said
it expected to complete
its investigation, shortly.
For now, it is a continued
guessing game.
As the litigation moves
ahead, casinos and poker
players may be given much
food for thought about the
duties of poker management and the efficacy of a
casino taking responsibility for insuring a risk-free
tournament environment for
their bettors.
