LONG ISLAND CHAPTER summer 2012 Mark Your Calendars! The meeting schedule for the 2012-2013 Chapter Year has been set. The monthly dinner meetings will take place on the second Tuesday of each month beginning September 11, 2012. They will begin with a cocktail hour at 6 p.m. at The Milleridge Cottage in Jericho followed by dinner. The quarterly breakfast meetings will take place on the dates noted below in the LIE/Melville Corridor (locations may vary). This year’s recipient was C. Michael Stoehr, Senior Vice President and Chief Financial Officer of VOXX International Corporation. This prestigious award honors the accomplishments and contributions of a financial executive from a Long Island organization. As guests entered the atrium for the cocktail hour they enjoyed the beautiful music of a local pianist. During the cocktail hour, professionals from the Long Island business community both networked and congratulated the 2012 honoree. As guests entered the dining room they were delighted to find an MP3 player on their chair which was donated by VOXX International in honor of their CFO receiving this prestigious FEY award. Michael Stoehr was introduced by Pat Lavelle, President and CEO of VOXX International. Pat’s introduction of Michael was in the format of a Roast. Instead of a traditional business speech, Pat told a number of funny stories about Michael and himself during their early days at the Company. He also did not hesitate to tease Michael as much as he could during the allotted time. However, one could easily see the love and respect that Pat had for Michael. Pat ended his introduction by recognizing the many contributions that Michael made to VOXX since joining the Company. The audience of approximately 180 people gave Michael a standing ovation when he was introduced. Michael was very humble and appreciative in his remarks, thanking both his colleagues, staff, outside professionals and banks that supported him throughout his tenure at VOXX. Michael also thanked his wife and children for encouragement and support over the years. Michael received proclamations from IMA Global, New York State Senator, Dean Skelos and a number of proclamations from various townships throughout Long Island. Most employers know that if an employee is covered by the Family and Medical Leave Act, the employee is entitled to up to 12 weeks of unpaid leave. But what if the employee is not eligible for FMLA, or the FMLA benefit has been exhausted and the employee still needs time away from work? In most every case where a medical condition is involved, the employer and employee are required to engage in an interactive process to determine if the employee is entitled to a reasonable accommodation - which could be more time off from work. The obligation arises under the federal Americans With Disabilities Act as well as parallel New York State and New York City laws. A recent court decision in New York highlights that an employer’s lack of participation in this process could result in liability to the employer. reasonableness of the accommodation requested.” The court noted that not all requests for leave are necessarily reasonable. For example, one year or an indefinite time period likely would not be reasonable. However, regardless of the length of the request, the employer must interact with the employee and determine (such as through the request for medical documentation) whether any accommodation is possible. As a final note, the court pointed out that employers have an independent duty to reasonably accommodate an employee if the employer knew or should have known that the employee was disabled, even if the employee did not make a specific request. In the court case, an employee was injured in a bus accident. His mother contacted the company on his behalf and notified the company that the employee would be out from 3 to 6 months. Shortly after this notice, the company terminated the employee, concluding that 3 to 6 months would be too long to hold the position. The court noted that “the first step in providing a reasonable accommodation is to engage in a good faith interactive process that assesses the needs of the disabled individual and the Gail L. Trugman-Nikol (516) 935-5641 | Gail@UBSassociates.com The lesson for employers is clear: a request for an extended leave of absence mandates some form of interaction with the employee to determine whether a reasonable accommodation is an available option. Employers should analyze their business needs to determine how long the employee can be out without causing undue hardship. Employers also should request medical documentation demonstrating how long the employee is expected to be out of work.
