Basic information required to request a copy of a renewal application is: • Organization name • Organization’s 11-digit tax number • License type (Conductor, Lessor, Manufacturer, Distributor) • License expiration date • Name of contact person • Mailing address or fax number for providing a copy of the renewal application Information on license renewal mail-out dates is also available online. IRS Phone Forum Program: Gaming and Exempt Organizations The Internal Revenue Service (IRS) invites tax professionals and representatives of tax-exempt organizations to participate in a Phone Forum on “Gaming and Exempt Organizations.” Two sessions will be held during the month of May 2007. As soon as the dates are finalized, they will be posted to the Exempt Organizations Calendar of Events Web page (see below). The 60-minute forums will cover the following areas: impact of gaming on tax-exempt status; internal controls and recordkeeping; return filing requirements; unrelated business income; and payments to individuals. The forums are being offered at no charge to participants, although space is limited and will be reserved on a first-come, first-served basis. Organizations with multiple representatives interested in participating are encouraged to call in as a group, rather than individually. To attend, organizations should pre-register via AT&T Teleconference Services using the link provided on the Exempt Organizations Calendar of Events page (see below). Participants who have not previously used the AT&T Teleconference Service will need to create a user profile, including username and password, in order to register. JANUARY/FEBRUARY/MARCH 2007 Tentative Dates for 2007 Bingo Advisory Committee Meetings Announced Dates for the 2007 Bingo Advisory Committee meetings are tentatively scheduled as follows: Wednesday, May 2, 2007 Wednesday, August 1, 2007 Wednesday, November 7, 2007 All meetings are tentatively scheduled to begin at 10 a.m. in the first floor auditorium of the Texas Lottery Commission at 611 E. 6th Street, Austin, Texas. Texas Attorney General Issues an Opinion Related to Payment of Health Insurance from Bingo Accounts On January 12, 2007, the Texas Attorney General issued an opinion on whether Occupations Code Section 2001.458(b) prohibits an organization licensed to conduct bingo from paying or incurring an expense in connection with the conduct of bingo to provide health care insurance or a health benefit for its employees or their dependents. The summary of the opinion is as follows: Occupations Code section 2001.458(b) prohibits an authorized organization licensed to conduct bingo games from incurring or paying from a bingo account the costs of health insurance of benefits for the organization’s employees or their dependents. 2007 Interest Rate on Delinquent Prize Fees and Rental Tax Effective January 2, 2007, the interest rate on delinquent tax (prize fee and rental tax) is 9.25 (0.0925) percent per annum. Delinquent taxes accrue interest beginning 60 days after the due date. The rate of interest is based on the prime rate plus one percent, as published in The Wall Street Journal on the first day of each calendar year, that is not Saturday, Sunday, or a legal holiday. Interactive Forms Seventy-one new or revised interactive bingo forms are now on the Web site at www.txbingo.org. Interactive forms are convenient to use as they allow you to save the form on your computer, complete it electronically, and print it. A bold “I,” as shown in the example below, identifies interactive forms. The bold “I” indicates an Interactive Form. Texas Application to Amend a License to Conduct Charitable Bingo Application If you have questions about interactive forms, please contact us by calling 1-800-246-46777 and we will be happy to assist you. Allocations for the Fourth Quarter of 2006 On February 28, 2007, 73 local jurisdictions were mailed their bingo allocation checks for the fourth quarter of 2006 and another 87 local jurisdictions received their allocation by direct deposit. From 1982 through 2006, charitable distributions generated from charitable bingo activities exceeded $835.9 million dollars. Before the end of each calendar quarter, a licensed authorized conductor organization must disburse an amount not less than 35 percent of the organization’s adjusted gross receipts, derived from charitable bingo activities from the preceding quarter, less the amount of authorized expenses, not to exceed six percent of the gross receipts. The charitable distribution must be used for the purposes and objectives of the non-profit organization. Since 1982, when the first licenses to conduct bingo were issued, the Charitable Bingo Operations Division has been tallying distributions to charities from bingo activities. With over $31.8 million in distributions made in 2006, the total charities have received since 1982 is more than $835.9 million. Reminder – Keeping the Bingo Operator Training Program Certification Current Sec. 2001.107 of the Bingo Enabling Act (Act) requires an active member of the organization who is responsible for the conduct of bingo (operator) to attend the Bingo Operator Training Program and §§2001.437(h) and 2001.438(e) of the Act requires unit managers and designated agents to attend the Bingo Operator Training Program. Other officers and members may also attend the Bingo Operator Training Program. All attendees must read the Bingo Enabling Act and the Charitable Bingo Administrative Rules prior to the training session. The number of participants is limited, and registration will be confirmed on a first-come, first-served basis. At all times, at least one of the persons designated by each licensed authorized organization under §2001.102(b)(10) must be an individual who has completed the training. Individuals required to complete training must do so every two years. At least one of the persons designated under §2001.102(b)(10) of the Act must have completed the training within 24 months prior to the date of expiration of the license or the renewal license cannot be issued until a designated individual completes training. A person may complete training for one licensed authorized organization only.
