the year, we promised it
would focus on you and
your professional accomplishments and promote
your professional development. That’s why this
entire issue features REALTORS® who are the driving
force behind our association’s 2004 successes and
those who will lead us to new victories in 2005.
We are pleased to showcase the very best and

And in a farewell address, 2004 President Bruce
Kammer, CRS, GRI, offers his thoughts on the state of
our association, highlighting strategic goals met and
new initiatives launched during his term of office. I
watched and admired Bruce throughout his presidency and appreciated his focus on empowering us as
REALTORS® – and as an association. I look forward to
the challenges that my year as your president will

Mortgage rates expected to rise,
employment rates to improve in 2005
The National Association of REALTORS® forecasts 30-year mortgage rates to average 6.5 percent
in 2005, despite the fact that rates have hovered around six percent for the past three years.
However, NAR expects improved new employment rates to balance any decrease in sales due to
interest rate increases. During the past 12 months, nearly 1.7 million jobs were
added to non-farm payrolls across the country, which is a 1.3 percent increase
from 2003. The South, in particular, boasts the lowest unemployment rate in
the nation: 4.9 percent from 5.9 percent a year ago. Home sales in the South
also have increased and are now contributing a larger share of total national
home sales than in 2003.

NAR debuts new credit history brochure
A new credit history brochure is now available for REALTORS® to distribute
to their clients. Developed by the National Association of REALTORS® in
partnership with the Federal Trade Commission, the brochure helps consumers understand their credit scores, how to contact credit bureaus for
credit reports, and other beneficial information pertaining to credit and
insurance applications. The brochure was developed following 2003 passage of legislation
reauthorizing the Fair Credit Reporting Act and it contains updated information reflective of
amendments to the Act. Visit www.realtor.org/creditreports to download a copy today.

On the hook: Legal Hotline calls
have familiar ring
E
very time MAR’s legal hotline rings, it’s a new adventure. Judging by the
dozens of calls I receive each month from REALTORS® across the state,
the old saying holds true: no two real estate deals are the same. Still, I’ve
received a heavy call volume during the past year on three particularly pertinent transactional issues: procuring cause and getting paid, earnest money,
and criminal disclosure. Following is a summary of useful legal information on
these hot topics that will help reduce your risks and get your clients to the closing table with as little hassle as possible:
Procuring cause and getting paid
Recent arbitration hearings between REALTORS® have proven that no one
likes to be on the back end of a deal where they’ve performed some of the
functions of an agent but do not receive compensation for their services. But
it’s important to note that there are only three viable ways to get paid in a real
estate transaction:
1. Have an agreement with your client, the buyer or seller. This is by far
the easiest route. Buyer Representation Agreements should be better utilized by
REALTORS® and are readily available through MAR’s ZipForms Standard Forms
software at www.msrealtors.org.
2. Arrange for a referral fee. REALTORS® who work together to mutually
produce a ready, willing and able consumer to the other side of a transaction
can and should agree to a shared fee. Doing so protects the interests of the
client for whom both REALTORS® are working and helps maintain a positive
working relationship between REALTORS®.
3. The most difficult route to payment is to prove “procuring cause”.
Procuring cause is not an objective test. You must be able to prove through an
uninterrupted series of events that you are the reason that led to the sale. A
hearing panel is required to delve into the mind of the consumer to determine
when the consumer decided to buy the particular property.

Statement” form (also available at www.msrealtors.org). Although the circumstances would dictate a court ruling, the general rule of law is that REALTORS®
have a duty to disclose known defects but not discover them.

While MAR is unable to represent any party to a real estate transaction, we do
offer legal information relevant to a particular situation. Call our legal hotline
(800-747-1103, ext. 25) by 3:00 p.m. Monday through Friday, and in most cases,
I will return your call by close of business. Even when I am out of the office, I generally remain available for hotline calls. Just ask REALTOR® Gwen James of
Hattiesburg. She called me on New Year’s Day this year while I was watching Eli
Manning play in the Cotton Bowl in Dallas. I was able to answer her questions in
between the roars of rowdy Rebel fans. n

Earnest money
Mississippi’s earnest money statute does not give a real estate broker the
latitude to choose who should receive funds. It simply gives a broker the power
to disburse funds at the proper time. For this reason, we encourage all REALTORS® to interplead the funds in a Justice Court (if the amount in controversy
is less than $2,500) or Chancery Court and allow the Court to determine rightful owner of the funds. This process should be used if the rightful owner of the
funds cannot be determined or the contract does not explicitly describe who is
to receive the funds under the circumstances. (Download a copy of an

Sex offenders, meth labs and stigmatized properties
When it comes to sex offenders, meth labs or other stigmas, the best advice
I can give is to disclose all information you know about but do not attempt to
discover information that is not within the purview of a REALTOR®. There are
certain responsibilities better left to law enforcement officials and home
inspectors. At the same time, you are under an obligation to compel your client

with a GRI designation
Mississippi REALTOR® Institute to offer
designation and CE all in one in 2005
D
id you know that research shows that REALTORS® holding a professional designation earn $33,200 more annually than those who do
not? That’s why the Mississippi REALTOR® Institute is launching new
coursework to help you earn the Graduate REALTOR® Institute (GRI) designation and put you ahead of your competition. The GRI designation is
nationally recognized and offered exclusively through our real estate school.
Successful completion of our classroom Salesperson Pre-Licensing
course satisfies two-thirds of the GRI designation requirement. Then, you
can choose to take the remaining 30 hours of coursework by either completing our Broker A course or our new GRI
Advanced Track Program, a series of
four courses that also include CE credit. The courses can be taken consecutively all in the same week or separately and
in any order at your leisure. The courses will be offered at
least twice this year. And even if you already have your GRI
designation, you can take GRI courses for CE credit.
The first GRI Advanced Track series will be held February 7-10 in
Jackson. Coursework includes:
GRI Course A: Accredited Buyer Representation (ABR) ($249)
This two-day course satisfies the educational requirement to earn the coveted ABR designation, counts for half of the hours needed to earn the GRI
designation and satisfies the requirement for four hours of required
Agency CE.
GRI Course B: Technology & Real Estate ($65)
Earn four hours of elective CE credit and learn how technology can plug
you into greater profits and productivity.
GRI Course C: From Contract to Closing ($65)
Earn four hours of elective CE and learn how to read a credit report, determine a credit score, create net sheets for the buyer and seller and identify
various agencies that offer loan programs for particular buyer profiles.
GRI Course D: Standard Forms for Dummies ($129)
Reduce your risks through the proper use of the Mississippi Association of
REALTORS®’ 32+ Standard Forms. This fun and information-packed course
will keep you in the know and out of court. The course includes two hours
of required Contract Law CE and six hours elective CE.

LeadershipMAR, the Mississippi Association of REALTORS®’ leadership development program, has opened doors, shed new light on old ideas and brought
new people into my life. It has taught me to reach higher, be open to fresh concepts and not to be afraid to leave my comfort zone. I have established friendships that will last a lifetime and acquired skills that will enhance me professionally as well as personally. To be a part of LMAR is an experience I treasure
and I will continue to reap the benefits of the knowledge and skills that I have
learned. n
As a 2001 graduate of LeadershipMAR, I can honestly say that I gained confidence from learning leadership skills. I also learned a lot about myself. This
confidence enabled me to venture out and start a new company in a new market! I could not have done this had I not been through this awesome experience. Learning about the Mississippi and National Associations of REALTORS®
made me understand the importance of giving back to the association that truly

If you want a sure fire way to bring fourteen complete strangers together, simply give them a huge project to complete, a short period of time in which to complete it, no money to work with and the added logistical challenge of all the participants being scattered from one end of the state to the other. That’s exactly what
happened to our class, the LeadershipMAR class of 2004, when we were presented (or sentenced to) our class project.
We were to fund and produce a video that would be used as a recruiting tool
for LMAR. Who does what? Where do we start? What was your name again? We
had just met each other, for goodness sake! We took the first step necessary and
headed straight to the nearest happy hour. We quickly determined which class
members possessed which strengths, and we divided ourselves into two groups:
introverts and extroverts (otherwise known as fundraisers and a production
committee). The fundraisers went to work raising money, and the production
committee searched for and hired a production company to help with the video.
Time flew by. Retreats came and went. Money rolled in (to our many contributors…THANK YOU!). And, before we knew it, we had a stellar video and had developed friendships that will last a lifetime as well. We had a great time, as evidenced
in our video. Our hope is that by viewing our video project fellow REALTORS® can
see the importance of LMAR both to the individual who participates and to our association….and just maybe they’ll want to be
a part of it. (Each local board has a copy of the video.) n

2004 MAR President sums up the year

T
ogether, I believe we’ve made 2004 a
banner year for REALTORS® in
Mississippi. We’ve harnessed our
collective power and built an even stronger
MAR – one positioned upon the steady
foundation of tradition, ethics, member representation and service. The
state of our association is strong.
We’ve experienced significant membership growth and now boast more
than 5,400 members. This is due, in part, to a booming real estate market
and increased opportunities for pre-licensing education offered by your Mississippi
REALTOR® Institute.
We thank you for supporting our official
real estate school, our association’s primary source of non-dues revenue.
Your loyalty to the REALTOR® Institute is critical, particularly in the coming
year, as we face some significant revenue challenges. Know that every dollar
you spend with our school is used to serve you, our members, in ways that
add value to your business and your professional expertise. An investment
in us is an investment in your own success.
And REALTORS® who are investing time and service into this association
are reaping the rewards. They’re better informed, better educated and better prepared to handle the issues and trends impacting the business of real
estate in Mississippi. Business moves at such a rapid pace these days, and
meeting the ever-changing needs of our membership has been our top priority.
To this end, we proposed some strategic governance changes at our general membership meeting in October that will allow us to respond swiftly
and more effectively at the speed our membership demands. I am happy to
report that those changes were approved by the membership and have
already gone into effect (Visit www.msrealtors.org for complete details).
In addition to governance changes, we’ve launched some powerful new
member services this year. We believe it’s a critical part of our association’s
mission to advance our profession. And that’s why we started this new magazine, Real Estate LEADER, that empowers, inspires and nurtures a leadership spirit among our members. The magazine focuses less on MAR as an
association and more on you as REALTORS®. Special thanks to the many
advertisers who have supported this new endeavor.
In 2004, we also launched a new MAROnline (www.msrealtors.org),
which is now a robust site that contains important association information, industry news and member
resources. You should also be
receiving MARDigest, our semi-monthly e-newsletter. Look for the Digest
monthly in the coming year. Make sure we have your current e-mail address on file so you don’t miss out on this
valuable information.
In this year, we’ve also developed risk management
tools and resources for brokers and their agents as well
as a REALTOR® Guide to Etiquette and Safety. All of
these are available for download at www.msrealtors.org.

We’ve also updated
our MAR Standard
Forms software available through ZipForms.
As a member benefit, we
offer the first download FREE
to first-time users – a $149
dollar value. Then future
annual downloads, including all updates, cost only
$59 dollars.
We’ve also had major
legislative victories in
2004. Every priority legislative issue
advocated by MAR this year was signed by Governor Haley Barbour. Our
REALTOR® agenda included
measures to ease financial, regulatory and education barriers to
homeownership in Mississippi.
We thank our legislators for moving forward with responsible state policies
that provide for broader housing opportunity. These legislative successes are
the direct result of members’ grassroots lobbying initiatives, calls to action,
MARPAC investments and conversations with legislators by our members.
These accomplishments continue to move Mississippi forward and reaffirm
that the REALTOR® perspective is being heard by the state’s elected officials,
and our influence is strong.
To build on our momentum, we’ve also launched our REALTOR® Key
Contact Network, a new initiative designed to help you target and communicate with our state legislators and government
officials. MAR members who have existing relationships with state legislators and/or key government officials are invited to participate. By
establishing a network of contacts with key legislators and government officials, we can mobilize quickly when issues of importance to REALTORS® arise. Visit www.msrealtors.org for complete details.
In every aspect of our association, your involvement truly makes a difference. When I became your president, I said I wanted to ask three important questions at the end of my term of office: Did we make a difference? Are
the members better off? Did we have fun along the way? I feel confident that
the answer to all three is “yes.” Thank you for providing me with this powerful opportunity to serve you – and our profession. n

EALTORS® across the state are working
stronger and accomplishing more than
ever before, thanks to the unity the
Mississippi Association of REALTORS® provides,
says Nancy Lane, CCIM, MAR’s newly installed
president. Lane wants to achieve even greater successes in the coming year by focusing on what she
calls the three U’s:
1. “U” for you, MAR members;
2. “U” for university, MAR’s own REALTOR®
Institute
3. “U” for unity in purpose.
“It’s all about YOU,” she told attendees at her
installation ceremony held in October, where she
encouraged members to provide feedback about
how MAR can improve services.
Her hope is to involve more REALTORS® in the
policy issues that affect real estate, particularly private property rights. “The average person doesn’t
realize the constant legal pressures against private
property rights because they don’t see all the bad
legislation that comes forth. And the average
REALTOR® can’t spend time following legislation
because that’s not how REALTORS® make a living,” Lane explains.
That’s where MAR and MARPAC play a critical
role. “We, as individual REALTORS®, should raise
the red flag if we see something in our communities that doesn’t seem right,” she says. “Sound the
alarm to MAR, then let the association carry the
banner for all our members.” She believes some
REALTORS® “hold back” because they think
someone else has more experience on these
issues. “But it’s usually the people with less experience who have the most creative ideas. They
really do bring something to the table.”
Bringing something to the table
Lane admits she hasn’t always felt she was bringing anything to the table, especially as she began
making her way up the ladder in the male-dominated world of commercial real estate in 1979.
But working in groups helped her gain confidence
and expertise as a team player. “It can be hard
sometimes to prove yourself, but I grew up with
four brothers, so it never occurred to me to feel
intimidated. It’s just a lot more fun if you’re work-

ing with people instead of competing against them,”
Lane explains.
Lane spent 18 years as Director of Real Estate for
the McCarty Holman Company, overseeing five family-owned partnerships, 15 shopping centers and
numerous investment properties, including the
Jitney Jungle grocery chain. Later, she joined Cook
Commercial Properties. In 2003, she opened her
own commercial real estate firm, where she handles
management, leasing, site selection and brokerage
for companies all over the U.S. She’s also a partner
in several shopping center ventures in the Jackson
area.
The Mississippi Commercial Association of REALTORS® named her REALTOR® of the Year in 2003.
She was also named to NAR’s Commercial Alliance
Committee in 2002 and 2004. Yet for all her professional accomplishments, Lane is not without certain
personal scars that will always make her see things
from a different perspective.
In April 1999, Lane had just returned from a
LeadershipMAR retreat when her 20-year old son
died suddenly. The loss was devastating. “It was
something that brought our family together and at
the same time separated us into our own grief,” she
recalls. “To go forward and find a reason to live was
the greatest personal challenge I’ve ever faced,” she
remembers painfully. The support of Lane’s fellow
LMAR colleagues, other REALTORS® and friends
carried her through that difficult time. “I had two
choices: live or die. I finally decided to live, and live
to the fullest. I continue to search for ways that God
can use my experience to help others through trying
times in their lives,” Lane says.
Learning to prioritize
Lane’s personal tragedy makes her “stop sometimes and ask how important this task is and
whether it will be important ten years from now,”
she explains. That trait served her well during her
tenure as MAR’s Education Trustee Chairman in
2001 and 2002.
Education remains a primary focus of Lane’s presidential platform. “Practitioners who bring knowledge, honor and respect to our profession make us
all better. But to do that, practitioners have to stay
educated and informed because this business
changes every day,” Lane firmly believes.
“Supporting your school [the Mississippi REALTOR®
Institute] means you’re supporting a better
informed community of REALTORS®,” Lane says.
She wants the Institute to continue raising the bar
for excellence in the profession.
Strength in numbers
Lane also wants to further unite REALTORS® across
the state, producing strength in numbers never
before seen in Mississippi real estate. For example,

strength
last year,

tackled.

“Sometimes
political
strength is
mistaken as
political pressure. But political power can be used
positively. We’ve done that over the last
several years and will continue to build
our political power,” Lane forecasts.
Recent MAR collaborations with industry groups and government agencies
addressed affordable housing and economic development concerns. Lane
says MAR’s work on a financial curriculum for high school students ties
directly into Governor Barbour’s plans
to improve statewide education. “We’re
seeing kids graduate from school and
immediately ruin their credit because they
don’t have any understanding of how to
balance a checkbook or manage their
money,” Lane says. “This has a devastating
impact on their long-term ability to
reclaim their good credit, become self-
sustaining, and achieve most of the goals independent citizens want to reach at some point in their
lives, like own a car or buy a house.”
It’s issues like these that will define the coming
year for Lane. “People who don’t know us often
think REALTORS® are all about a commission, but
that’s just not true,” says Lane, who believes
Mississippi REALTORS® take on so many other
issues and make a positive difference because
they’re unified. “I’ve

Brunner, CAE. Jones couldn’t have been more surprised when he was named 2004 Mississippi REALTOR® of the Year, but his colleagues say that
description of ethics and integrity fits him to a tee.
A real estate professional since 1986, Jones is widely esteemed for not just honoring, but living the
REALTOR® Code of Ethics. His exemplary record of

Mississippi.

What’s your philosophy of leadership? “A
good leader never asks somebody to do something
he wouldn’t do himself. I also don’t think you can be
a good leader unless you know how to be a good
follower. My sister-in-law cross-stitched a wall-hanging for me several years ago for Christmas. It hangs
on my office wall, and I look at it every day because
I really believe what it says: ‘…my life belongs to the
whole community…I want to be thoroughly used up
when I die, for the harder I work, the more I live’.”
Who most inspires you as a leader? “Author
Og Mandino, who wrote The World’s Greatest
Salesman. The premise of the book is that you can’t
out-give God; the more you give, the more it comes
back to you. I first read that book sometime in the
1970’s. It had a big influence on my life because it
made me understand that what I have is a lot more
than what others may have and that I should share.”

What’s your most memorable leadership
experience? “Serving as Chairman of MAR’s
Education Trustees. Education was and always will be
the focus of my energy and interest. My involvement
with REALTOR® education over many years is really
my biggest contribution and holds the best memories
for me. We fought some battles, but the education
committee has always been at the heart of MAR, and
education was always at the heart of my existence.”
Who most inspires you as a leader? “This
answer may surprise you, but it’s my best friend:
Sonja Dunaway. We’ve shared so many goals for
MAR over the years and worked together to make
the organization grow. Sonja was always at the forefront of MAR, leading and encouraging new people
to join our association. I’ve always admired her as a
person and as a leader.”
How could you tell when you were making
a difference? “I realized my work had made a difference one day when I had a business transaction
with a REALTOR® who had once been one of my
students. Then it happened more frequently … I
was doing business with the people I’d taught how
to do business! It was funny at first, but it made me
very proud. It was so rewarding to see students grow
and become successful REALTORS®.”

“It took a whole network of people to put me where
I am. It was the Womens’ Council of REALTORS ®

ous positions further up the ladder of success.”
What leadership characteristics are most
important? “Patience and the ability to navigate
around different personalities. Smart leaders surround themselves with people who are smarter than
they are, but you’ve got to be patient enough to work
with all kinds of people.”
From where do you derive your strength? “I
thought my mother totally depended on me, but it
wasn’t until after she died and I came unraveled that
I realized how much of my strength came from her.
She taught me that women shouldn’t be restricted by
any barriers created in their own minds or by other
people. Anybody – male or female – can accomplish amazing things if they just set themselves to it.”

a leader? “It’s given me more confidence. There
was a time when the only active members in MAR
were all from big city firms, but that’s changed in the
last several years. Now, REALTORS® from all over the
state take part. If a small-time broker like me from
a provincial town like Laurel can play a leadership
role, then any REALTOR® can make a positive difference, no matter where they’re from.”

What’s your secret to success? “You have to
define the priorities in your life. Everybody’s out to
make money, but I’m out to take care of people. My
original goal was to be successful enough so my wife
wouldn’t have to work full time and could be there
when our son got home from school every afternoon. I worked hard, took care of my customers,
and they helped me reach my goal. You’ll reach
your goals if you take care of theirs.”
What’s the most valuable leadership lesson
you’ve learned? “Treat everybody the same way. I
learned that lesson from my mother, who never met
a stranger in her life. Then I watched my father-inlaw (who owned a restaurant) and my uncle (a college professor) model it in their own lives.”

UPDATE ON LEGISLATIVE ISSUES IMPORTANT TO YOUR BUSINESS
Legislative & public policy preview:
What issues will define Mississippi REALTORS® in 2005?

W
ith a remarkable year of legislative and
regulatory victories behind them,
Mississippi REALTORS® now turn to 2005
with a fresh agenda of pressing concerns that could
define new relationships and business practices
throughout the real estate profession. MAR
President Nancy Lane, CCIM, says the focus is on
advancing issues that will bring more homeownership and economic development into the state.
To that end, MAR will partner with the
Mississippi Economic Council, Mississippi
Development Authority and the Mississippi
Municipal League to host the state’s first Smart
Growth Conference scheduled for March 2 in
Jackson. The conference will bring together developers, business leaders, elected officials, and real
estate professionals to address the process of
growth in Mississippi communities and how to
avoid negative effects of urban and exurban sprawl.
MAR also plans continued involvement with the
Mississippi Housing Opportunity Coalition, created
last year to brainstorm ideas for making homeownership more accessible to all Mississippians.
Other issues MAR will focus on in 2005 include:
Agency relationships
Heading the list is the issue of agency reform. A
working group, chaired by former Real Estate
Commissioner Joe Stedman of Natchez, began meeting last year to discuss problems in the current
structure and practice of agency relationships.
The working group met and talked with REALTORS® throughout the state and found a widespread
misunderstanding of agency rules. That was especially true in disclosed dual
agency relationships. Carlene
Alfonso, vice-chair of the
working group, believes
there’s “a huge misunderstanding” among agents and
the public about dual agency.
“This is one of our greatest
challenges,” she says.

among REALTORS® is that we
need to do something regarding agency,” Stedman says.
“Everybody tries to play by the
rules, but the rules on agency
relationships are just too confusing. It’s a total nightmare.”

Mississippi Real Estate
Commission (MREC) understands the problem and has
been supportive. He expects
the working group will meet
again early in 2005 and develop recommendations that will
ultimately satisfy both MAR
and MREC.

Sex offender/drug laws
The Department of Public Safety plans to offer
legislative revisions to strengthen Mississippi’s sex
offender (Megan’s Law) and drug enforcement laws
this year. Law enforcement officials say meth labs,
used to make the illegal drug methamphetamine,
are springing up in rental properties around the
state, especially in rural areas where privacy is easily assured. Tighter drug enforcement laws are
needed to stop the spread.
MAR believes these laws are crucial to maintaining safe communities because they trigger serious legal concerns for REALTORS®, including questions about privacy, disclosure and a host of liability issues. By contributing to the legislative revisions,
MAR intends to clarify that real estate professionals
have no affirmative duty to discover these offenses, but
are obligated to disclose information (if any is known)
to consumers and the proper legal authorities.
Governor Haley Barbour has added his support
for the effort. "I realize that REALTORS® take risks in
doing their jobs. We should offer them protection
and take this matter seriously. REALTORS® are the
eyes and ears of most properties in our state, and
we need their help in reducing the rampant rise in
meth labs that are affecting people of all race, age,
and gender," Barbour said.
Gwen James, President of the Residential
Division, Coldwell Banker Don Nance in
Hattiesburg, said the goal is to build better, stronger
communities. “We can’t put the burden of discovery
on REALTORS®, but it only makes sense for REALTORS® to support those who are combating crime
in our neighborhoods.”
Education standards
MAR also hopes to recommend a means of
developing reasonable education curriculum standards for the Mississippi Real Estate Commission to
use when evaluating potential real estate education
providers prior to granting teaching approval.
Earlier revisions to the License Law gave MREC
authority to adopt education standards, but none
exist yet. Establishing an advisory counsel to review
curriculum and require certain minimum levels of
content in each class could be a first step.
“I would love to see the real estate profession
receive the respect it deserves as a business and as a
career," says Lane. "One of the best ways to do that is
to make sure we hold our standards high and promote knowledge, honor and respect for the profession.” n

“After-the-fact” referrals aren’t always after-the-fact
Tips for avoiding referral fee surprises
Several Mississippi REALTORS® report exorbitant referral fees charged recently by relocation companies after REALTORS® assisted clients in real estate transactions. Did you know that after-the-fact referral
fees are not allowed in Mississippi?
According to the Mississippi Real Estate Commission, the following rules apply:
1. Payment of a referral fee to an unlicensed person is prohibited in Mississippi.
2. A licensee should not demand a referral unless a legal basis for payment of that referral fee exists.
3. A licensee should not interfere with the brokerage relationship of another licensee.
If you find yourself in a situation in which a relocation company is attempting to enforce a true afterthe-fact referral, your first call should be to MREC.
But things aren’t always as they may seem. Frequently, an unpleasant surprise that looks like an afterthe-fact referral (and feels like extortion!) can be avoided if REALTORS® will simply ask a few pertinent
questions on the front end of the relationship.
Brokers should adopt and enforce an office policy that includes the following requirements:
1. That the licensee make actual inquiry of potential customers concerning the specifics of the transaction before accepting the engagement, including inquiries as to: "who is the customer’s employer", "is
the move at the request of the employer", and "is the move covered by them employer’s relocation policy",
where appropriate
2. That the licensee notify the broker of the requirement of a referral fee in the transaction
By making inquiries at the beginning of the relationship, you can easily determine whether a relocation company – and likely referral fee – will be involved, and can negotiate and proceed accordingly.

Governor weighs in on issues important to REALTORS®

We asked Governor Haley Barbour how he regards the work of Mississippi REALTORS® in the state’s policy arena. His answers leave no doubt that we will continue playing a crucial role in defining and advocating the issues critical to the real estate profession and to our communities across the state.
Q: How do Mississippi REALTORS® contribute to your job creation and economic development goals?
A: Homeownership is the cornerstone of the American dream. Every day, Mississippi REALTORS® work
hard to ensure that families reach their goal of purchasing a home. With citizens who are educated and
properly trained, and a business climate that is good for commerce, all Mississippians are one step closer to making their dream a reality. Job creation is my number one priority, and I appreciate the efforts of
the Mississippi REALTORS® for hosting economic development forums and partnering with developers and
builders. In addition, I think a regulatory agency that encourages economic development and partners
with groups interested in doing business here is parallel with my plans for progress. I enjoy having a good
working relationship with REALTORS®, and I appreciate their support.

Commercial REALTORS® unite to defend property rights,
clarify cooperating broker agreement
F
rom impact fees to tree ordinances to property maintenance and inspection requirements, the Mississippi Commercial Association of REALTORS® is joining forces with the Mississippi Association of REALTORS®
and the state’s economic development officials to weigh in on issues of importance to commercial development.
Defense of property rights is at the forefront of these efforts, but commercial REALTORS® also recognize the importance of community planning and
appropriate regulation of growth. MCAR hopes to work closely with local governments to craft solutions that ensure development that benefits the community without being too costly or cumbersome.
Also in 2005, an MCAR working group will begin researching the placement of liens on a property in order to ensure payment of commissions when
a written contract is in existence. Such commercial lien laws have been passed
in many other states as a solution to this potential problem in commercial
transactions.
Finally, MCAR will work in the coming year to make sure members are
aware and complying with the Mississippi Real Estate Commission’s mandatory "Cooperating Agreement with Non-Resident Principal Broker." A new form

became effective on July 1, 2004. The form includes the following statement:
“The Non-Resident Principal Broker MUST be present at all times if one of
his/her real estate agents, who is NOT licensed by the state of Mississippi, has
a physical presence in Mississippi in connection with any real property transaction.”
While the new form provides important safeguards for residential practitioners, many commercial REALTORS® feared that it might have a significant
impact on commercial real estate practice. Several MCAR members met with
MREC Administrator Robert Praytor to express their concerns, and he has
been very helpful in clarifying the requirements of the new form. His primary
point is that the requirement is in effect only if the salesperson not licensed in
Mississippi is physically present in Mississippi with a client. In such cases, the
principal broker must be present, but in the absence of the client, the requirement for the broker’s presence is not in effect. n

REALTORS® across Mississippi were shocked and saddened to hear of REALTOR® Janell Hatton’s murder last
month. Hatton was broker/owner of Hatton Real Estate in
Hatton the Bunker Hill community north of Columbia and a
member of the Hattiesburg Area Association of REALTORS®. At press time, eight suspects had been arrested in conjunction with
the case, according to The Clarion Ledger. Our prayers and condolences
go out to her family, friends, agents and colleagues.
Whitwell to join law practice in Southaven
MAR’s Vice President of Public Policy Quentin Whitwell
has left his MAR post to become a partner in the
Southaven law firm of Stroud, Harper & Whitwell, P.C. He
is expected to continue to serve as MAR’s lobbyist on a

In our neck of the woods it has been a great year!
With our 2005 board officers’ election complete,
we’re now looking forward to the holidays. It is a
busy time for association executives trying to coordinate members and close out the year with plaques
and other recognitions for good work.
Golden Triangle
GTAR members donated toys to be distributed to
needy children at Christmas. Production of a
Lowndes County map will be completed soon. The
map is widely used locally and is an association
fundraiser. The project is also a great community
service. Large laminated copies are provided for
emergency rescue and fire departments, and many
maps are given to relief organizations during area
storms.
Greenville
For “Make A Difference Day”, October 23, the
largest national day of helping others and your community, a group of our members planted 200 daffodil bulbs in our local ‘Adopt-A-Spot’ at the corner
of Reed Rd. and Hwy. 1 for the beautification of
Greenville. What a difference a day makes!
Greenwood

Grenada
In 2004, our Board has grown from 37 members to
44 members! We are excited about our new members and hope 2005 brings us even more. We have
supported various causes throughout the year (the
most recent being “Grenada Supporting our
Troops”). May you all have a Merry Christmas and a

Gulf Coast
2004 has been a year of worthwhile accomplishments for the Gulf Coast Association. Our
Community Development Committee raised
$24,451 for two local charities at our 2nd Annual

Charity Golf Tournament event, $26,972 was raised
for RPAC with over 50% member participation. And
the merger of Gulf Coast Association and East Gulf
Coast Board was approved by NAR.
Hattiesburg
The Hattiesburg Area Association of REALTORS®
merged its separately incorporated MLS with the
HAAR which now operates as one entity. Hattiesburg
set a record for Sterling R contributions to MARPAC
in the state. Community service projects are ongoing
throughout December. Several continuing education courses were provided to members. The association grew in numbers as has been the case almost
every year, and real estate sales were at a peak again
this year. Many important decisions were made
under 2004 President Jim Stroo and we thank him
for his leadership.
Jackson
The Jackson Association of REALTORS® will install
its 2005 Board of Directors in January and kick off
the year with another great team of elected leadership. Plans are underway for regular continuing
education classes at the Board Office, along with
specialized technical/technology classes. A schedule of classes will be completed and posted on the
Jackson Association of REALTORS® website
(http://www.jacksonrealtor.com) in mid-January.
Members from any Mississippi board are welcome
at any of our classes.
Laurel
The Laurel Board of REALTORS® supports
LeadershipMAR! In 2003 & 2004 our board has
had a representative graduate from the program.
We are proud of Tanya Gray (outgoing president)
and Sandra Vaughn! Presdient-Elect Vaughn states
that the key to effective leadership is interest and
involvement in many areas. Our board is also
involved in several local charities and recently
donated $1,300 to help recent hurricane victims in
Alabama.
Meridian
Thanks for supporting our Habitat event, despite the
weather. Our food drive for Victory Outreach ended
November 9 to ensure delivery for holiday baskets
and toy collection ended December 14th for the
Wesley House Holiday program. Dues may be paid

Mississippi Commercial Association
MCAR is proud to recognize several of its members
who were honored recently. Sonja Dunaway was
inducted into the MAR Hall of Fame and MCAR Past

the Year, Chris Wilson of Laurel, also received the
President’s Award. Steve Young of Jackson was recognized as MCAR’s 2004 Affiliate of the Year. MCAR

We moved into our brand new office and education

Fair share investments lead to greater income, quality of life

W
ould you like to increase your sales? Have more home buyers in the
market? Your fair share investment in MARPAC helps you accomplish
these objectives.
Like REALTORS®, officials in the Legislature, the Governor’s office, and the
courts understand that economic development is the key to providing additional better paying jobs for our citizens. Adding higher paying jobs to
our state is good for REALTORS®
because it brings more well-paid
people into the housing market.
Also, higher paying jobs lead to
more state revenues without
increasing taxes to pay for things
that better our communities.
This past year, we have seen the
tide turn toward an improved economic base. REALTORS® helped
elect Governor Haley Barbour and
Lieutenant Governor Amy Tuck as
well as many legislators committed
to economic change. Under their leadership, we’ve seen several positive outcomes including:
• Passage of tort reform
• Insurance companies coming back to Mississippi to conduct business
• A new economic development team that knows how to acquire opportunities for growth in existing employers and how to find new ones
• New laws that REALTORS® support were written, sponsored, and passed
into law by friends in the Legislature
• The election of Mississippi Supreme Court justices who will bring integrity, balance and fairness to the state’s highest court
We now have bridges for communication with close friends in elected positions who will listen to our concerns and needs. When problems arise with
taxes, regulatory issues or license law improvements, we know that our collective REALTOR® voice will be heard.
All of this is possible because of your support of our MARPAC Fair Share
Investment program,
a program that exceeded all of its member participation and financial goals
in 2004. I report to you today that Mississippi REALTORS® are leading the nation
in participation, and the nation is watching. Please invest your share in 2005.
Let’s keep the momentum going. And perhaps one day homes will sell themselves, we’ll be able to take some credit in Mississippi’s
improved quality of life – and we’ll get paid more commissions, too. n

Poinsettias I never tasted
Perception, reality, and the burden of disproof

t began with a childhood altercation with a poinsettia…or rather, an altercation involving a poinsettia. The altercation actually was with my grandmother.
I was maybe six years old at the time, and despite what she’ll tell you, I was
NOT trying to eat her poinsettia. I may have been young, but I did know better
than to nibble on the houseplants.
The thing was large, maybe four feet tall, the kind of prosaic poinsettia seldom seen these days, this one having survived multiple seasons, and now, having matured, it stood blood-red, gothic, a darkness-craving Bela Lugosi en vegetable, before the window in a musty front bedroom of my grandparents’ modest farmhouse.
There, on a crisp December afternoon, I leaned forward to sniff the thing,
right at the moment my grandmother passed by the door and spied me. She let
fly a shriek and barrelled across the room to snatch me away from a supposed
death.
“Spit it out, son, them’s poisonous!” she wheezed, and commenced to rummaging her finger around in my horrified, gaping mouth in hopes of fetching
out any remaining poinsettia residue from the bite she was certain I’d just
taken.
There was no ipecac in the house, so she gave me a laxative, figuring, I suppose, that there was more than one way to rid my system of Poinsettia toxins,
and even the milky white poison (purported poison, I should say) that swam in
the veins of that dreaded plant surely would be no match for the world’s meanest home remedy: castor oil. (If I had to pick a leitmotif for my childhood, by
the way, it surely would be castor oil…but that’s another story.)
And even at that, it could have been just another in what was to be a long
line of childhood learning experiences. But no. By the telling and retelling of it
among aunts and uncles and cousins, it soon became family legend – how
Scotty was saved from certain death-by-poinsettia, thanks to Mamaw’s
omnipresence and quick thinking.
Truth is…whatever people think it is. Perception is reality.
In particular, when you’re six years old – or forty – the truth happens to be
whatever your grandmother believes, and no amount of protesting on your part
– not the fog of passing time or even latter-day scientific research that in fact renders her concerns mute – can convince her to the contrary.
I confronted MaMaw with Norman’s nugget of truth, and what I got in return
was a disgusted "Pshaw…”, followed by a pause, and then, quietly: “A feller
that’ll eat a houseplant’ll believe anything, I reckon." n

And so my life came to be haunted by a poinsettia I’d not tasted. That is, until
one crisp morning last December when, motoring to the office, my dialed tuned
to Public Radio, I heard Norman Winter, the Southern Gardener, utter words
that for me spoke truth and justice and redress.
According to researchers at Ohio State University, Norman said breezily,
Poinsettias, are not poisonous. I gasped and swerved and stared at the radio.
But there it was: the fiction of poinsettia toxicity unmasked at last. That evillooking queen of Christmas might be the holiday’s fiercest flower, but the legend of her more insidious powers – i.e., to poison – was debunked.
Now, for the average person, unsullied by the burden of false accusation,
this would have been just another innocuous tidbit, one more old wives’ tale
controverted by modern government-funded research. For me, though, it was
something else: vindication. Or so I thought.
