Cultivating Builder Relationships

"If you build it, they will come." While that line from the movie Field
of Dreams may have referred to a baseball field, after last week's
news it could also apply to the housing market! The housing sector
continues to improve despite the recent rise in home loan rates, as
housing starts rose 5.9 percent from June to July to 896,000 on an
annualized basis. This was in line with estimates. Building permits,
a sign of future construction, were up 2.7 percent, coming in above
expectations. In addition, the National Association of Home Builders
Housing Market Index rose to 59 in August from the 57 recorded in
July. This is the best level in nearly eight years.

What does all this mean to us as agents in Fresno, California?
We've had a long-standing relationship with many builders here in the greater
Fresno/Clovis MLS area. Yes, we are often competing in the same buyer pool, but our
relationships can and should be a "win - win" for agents, builders and clients alike. We are
all in the housing business, so our businesses feed off of each other. A robust
construction industry propels the resale market and vice versa. In most cases the "old
house" needs to be sold before closing the "new home". Our builder friends recognize this
and rely on us to facilitate the "down leg" sale.
On the flip side, we agents are challenged with a very low supply of homes to show our
frustrated buyers. A continual stream of new home inventory can help satisfy that
frustration and offer fresh new options to our clients.
The key component to all of this is COOPERATION. Many Fresno/Clovis area home
builders recognize the value of exposing their new homes to the Fresno MLS, and many
are already REALTOR® members or MLS-only members. Others opt to list their homes
with our REALTOR® MLS members.
As long as the offer of compensation as shown in MLS is in compliance with MLS rule
7.12 (a percentage of the gross selling price; or a definite dollar amount) the Fresno MLS
welcomes the building industry will open arms. When contemplating showing new homes
it's crucial that you read the agent comments carefully. Procedures for "broker
cooperation" vary from builder to builder. It's also a good idea to remind your clients to
allow you to accompany them to the new home tracts so they can be "registered" under
your name.

Guide to Loan Disclosures: This guide is intended to give a description of disclosure
requirements for loans and extensions of credit. When a disclosure form is available, the
form is either cited or linked to. When no disclosure form is available, the substantive
requirements of the disclosure are listed.
Property Managers and the Contractor's Licensing Law: Property managers of both
residential and commercial rentals, acting in their capacity as agents for the owners, will
typically contractually assume responsibility to help maintain those rental properties,
identify problems with the pro and help arrange for the repair or improvement of the
properties. When undertaking those duties, property managers need to be careful not to
perform actions that are only to be performed by licensed contractors. California law has
an exemption from the contractor's licensing law for real estate licensees, but it is limited.
This article will review the contractor's licensing and real estate laws applicable to a
property manager's duties.
Fictitious Business Names: A "fictitious business name" is the name a person uses to
conduct business if that person is not using his or her own legal name. (Cal. Bus. & Prof.
Code § 17900.) For example, if John Doe runs a sole proprietorship under the name "ABC
Real Estate" rather than as "John Doe Real Estate," he is using a fictitious business name.

C.A.R. conducted a REALTOR® survey and recently found that 85 percent of buyers used
a mobile device during the home buying process, with the majority of buyers (70 percent)
accessing the Internet from their smart phones and 15 percent accessing it from their
tablets
While the majority of buyers (61 percent) found their home through an agent, the
percentage who found their home online more than doubled from 16 percent in 2012 to a
record high of 37 percent in 2013.
