The Board of Directors consists of five (5) members. Members will cast their votes for three (2 year) positions on the Board of Directors. The terms of Jane Snow, Ed Lanigar and Lee Bernstein are expiring. Any Desert Shores owner who is in good standing with the Association and who receives the number of votes necessary for election to the Board may serve. Board members are required to attend bimonthly board meetings held on the third Wednesday of January, March, May, July, September and November to conduct the business affairs of the Association. Attendance is also required at the April Budget Ratification meeting. Board members are responsible for the maintenance of the common areas, the administration of the Association’s governing documents and the general supervision of the Association’s affairs as they relate to officers’ activities, administrative policy decisions, financial decisions and organization changes. Board members are volunteers and serve without compensation. Board members have a fiduciary duty to the Association and owe the duty of care, undivided loyalty, honesty and full disclosure. Effective October 1, 2003 Nevada Revised Statute 116.31034(5) requires that “each person whose name is placed on the ballot as a candidate for a member of the executive board must make a good faith effort to disclose any financial, business, professional or personal relationship or interest that would result or would appear to a reasonable person to result in a potential conflict of interest for the candidate if the candidate were to be elected to serve as a member of the executive board. The candidate must make the disclosure, in writing, to each member of the Association.” The Candidacy Form that is enclosed provides space for any such disclosures. Candidacy Forms must be postmarked or received by the office no later than October 7, 2011. Heard homeowner comments for agenda items: Lake Shore owner reported recent crime in the area. Officer E. Calata, METRO, Northwest Area Command discussed neighborhood crime. Received Year End Water Report from Par 3 Landscape & Maintenance. Action taken on the following: 4Minutes of the May 25, 2011 Board of Directors meeting approved. 4Minutes of the May 2, 2011 and June 6, 2011 Community Relations Committee accepted. 4Treasurer’s Report for the month ending June 30, 2011 accepted subject to audit. 4Heard July 27, 2011 Management Report that included: • Par 3 Landscape & Maintenance May and June maintenance reports. • Aged Owner Balances as of June 30, 2011. • Work Order History 4Heard Legislative Update. Discussed impact of Assembly Bill 271 on HOA’s. 4Reviewed request from Spinnaker Cove HOA to add screening to greenbelt fencing at northwest end of Lake Jacqueline. No action taken. 4Receive correspondence from resident at 8120 Neptune Beach asking that consideration be given to providing 24-hour private security. The Board of Directors will solicit an opinion from legal counsel as to whether or not they have a duty to provide security service. 4 Scheduled next Board of Directors meeting for Wednesday, September 28, 2011. Homeowner Comments: Received request from homeowner at 7616 Belmondo Lane to dock personal boat at community dock. Board Meeting Calendar Desert Shores Community Association, 2500 Regatta Dr. Board of Directors Meeting Wednesday, September 28 at 6:00 p.m. A unit owner has the right to: • Have a copy of the audio recording, the minutes or a summary of the minutes of the meeting distributed to him upon request and upon payment to the association for the cost of making the distribution. • Speak to the Board of Directors at the beginning and the end of each meeting. During the period devoted to comments by the units’ owners and discussion of those comments at the beginning of each meeting, those comments must be limited to items listed on the agenda. September/October 2011 Seventh Annual Desert Shores Fishing Clinic and Derby Desert Shores Community Association is hosting a kid’s fishing clinic/derby on Saturday, September 17, 9:00 a.m. to 12:00 noon, at Lake Lindsey (corner of Breakwater & Mariner). This clinic/derby is open to Desert Shores kids ages 5 through 12. The clinic, presented by Ivy Santee of the Nevada Department of Wildlife, will run from 9:00 a.m. to about 10:00 a.m. and teach such topics as choosing bait and tackle, tying knots, identifying fish, casting, releasing and more! The fishing derby will start immediately after the clinic and run until noon. Please enroll my child/children in the fishing clinic/derby to be held September 17, at 9:00 a.m. I understand that I must accompany my child/children and I assume all responsibility for supervision of my child/children. Delegates are elected by the owners of their district on an annual basis. Term of office is one year from the date of election, or until a successor is elected. If no other candidate steps forward, the current Delegate continues to serve until replaced by a vote of the owners within the District. September/October 2011 3 Community Relations Committee L et’s Talk Trash! By now, all of the homes in Desert Shores have received and are using their new trash and recycle bins. There will only be one trash and recycle pickup each week now, and the day assigned to Desert Shores is Friday. Windy days will now be much better without having trash blowing down the street and this new system should help with the birds breaking into trash bags and causing a mess. The CC&Rs, Article VIII, Section 8.07 Unsightly Articles states: No unsightly articles, including clotheslines, shall be permitted to remain on any lot or condominium in a residential area or apartment area so as to be visible from any street or from any other lot or condominium. Without limiting the generality of foregoing, refuse, garbage and trash shall be kept at all times in covered, sanitary containers, sealed containers or enclosed areas designed for such purpose. Such containers shall be exposed to the view of neighboring lots or condominiums only when set out for a reasonable period of time (not to exceed twelve (12) hours before and after scheduled trash collection hours). This regulation has not changed, therefore residents still need to store their trash and recycle bins in their closed garage, or in their back yard, out of sight. Please keep in mind that you don’t want to look at your neighbor’s trash any more than they want to look at yours. If you have palm fronds (bundled) or any household appliances, furniture, etc, these are considered bulk items and require a bulk pick up. The bulk pick up days for Desert Shores are every other week, for example, September 2, 16 and 30. We follow Calendar H. Please make arrangements to store your palm fronds or other items until your assigned bulk pick up day. They are not allowed to be left at the sidewalk for two weeks, just overnight. In the last issue of the Shore Talk there was a Republic Services insert explaining this new system. It also includes some good suggestions and answers a lot of the frequently asked questions. If you need another copy of this flyer, you can access it online at www.desertshores.org under Shore Talk or pick up a copy in the DSCA office. If you need an additional bin or a different size bin, call Republic Services at 702-599-5559 to place an order or to arrange for your old trash bins to be picked up for recycling. We know that change is never easy, but we all need to give this program a chance! To review ARC submittals as necessary. 4 September/October 2011 The Real (Estate) Facts By Shirley Kelly-Harold Do I qualify for a short sale? S ometimes, to avoid going through the costs of foreclosure, a lender will sanction a short sale by allowing a buyer to purchase the home for less than the mortgage balance while the home is in the pre-foreclosure stage. Consider the following to determine whether you may qualify for a short sale. If you cannot answer yes to all four requirements, you may not qualify. • The Home’s Market Value has Dropped. Hard comparable sales must substantiate that the home is worth less than the unpaid balance due the lender. The unpaid balance may include a prepayment penalty. • The Mortgage is in or Near Default Status. It used to be that lenders would not consider a short sale if the payments were current, but that’s no longer the case. Realizing that other factors contribute to a potential default, many lenders are eager to head off future problems at the pass. • The Seller has Fallen on Hard Times. The seller must submit a letter of hardship that explains why the seller has or will stop making the monthly payments. A few examples that do NOT constitute a hardship are: Bad purchase decisions, unhappy with the neighbors, buying another home, pregnancy or moving into an apartment. • The Seller has no Assets. The lender will probably want to see a copy of the seller’s tax returns and/or a financial statement. A short sale is dependent on a buyer making an offer to purchase. Even if you meet all the criteria, it is possible that no one will buy the short sale. It is also dependent on the lender accepting the buyer’s offer. If the lender rejects the offer, a short sale will not take place. As always, to ensure that you don’t run afoul of the IRS, you should seek professional tax advice regarding the possible tax consequences of a short sale. DESERT SHORES SALES UPDATE * Total sales of single family, condominiums and townhomes equaled 238. Short sales at 48 and bank owned properties at 89 comprised 58% of the total sales. Regular sales amount to 101 properties. Mar-A-Lago and Broadstone accounted for the largest percent of short sales and bank owned properties.
