Zoning Committee meeting minutes of June 9, 2014. Voice vote taken. All ayes. Motion

NEW BUSINESS
1.
Request by Stadt Group, Ltd. (contract purchaser) for a courtesy review for
site and building renovations at the Salem Ridge Apartments on the
southwest corner of Salem Drive and Bode Road.

Mr. Peter Gerhold and Mr. Justin Ohrmundt with Stadt Group, Ltd. addressed the Conunittee and
reviewed a proposed plan to purchase the Salem Ridge Apartments and make significant
improvements to the buildings and property. All roofs would be replaced with pitched roofs and
significant exterior upgrades would be constructed including a new clubhouse, in-ground pool
and park area, garage buildings and park areas. All apartments would be upgraded with new
kitchens, baths and flooring. Rents would be increased to market levels.
The Committee had several questions including construction schedule, size of pool and fencing,
parking spaces, and security. The Committee encouraged the petitioner to work with
surrounding property owners and the homeowners association to keep them informed of plans.
2.
Request by GiGi's Playhouse, Inc. (tenant) and Caruso Development (agent
for property owner) for a site plan amendment for outdoor seating at 2350
W. Higgins Road (Barrington Square Town Center).

Motion by Trustee Gaeta, seconded by Trustee Stanton, to approve a site plan amendment for

Request approval of the Community Development Block Grant (CDBG)
Annual Action Plan 2014, for Program Year 9, Consolidated Plan 2011-2015.

Conunittee.
Trustee Stanton inquired about putting a street light in at Illinois and Kingman. Mr. Norris
indicated that staff would look into this.
Motion by Mayor McLeod, seconded by Trustee Gaeta, a approve the Community Development
Block Grant (CDBG) Annual Action Plan 2014, for Program Year 9, Consolidated Plan 20112015. Voice vote taken. All ayes. Motion carried.

BACKGROUND:
Bradwell Estates Subdivision was approved as a 17 lot
single-family subdivision on January 20, 2014. The developer
(Bradwell Estates LLC) has not started any work on the
subdivision post approval.

Due to other projects currently under development by the original
developer (Bradwell Estates LLC), they have looked for another
builder to construct the majority of the subdivision, including the
infrastructure and most of the homes. The original developer has
entered into a contract with K. Hovnanian Homes to develop
Bradwell Estates with the same land plan as was approved earlier
this year.
One of the conditions of the final site approval for the subdivision
was that "Approval of Bradwell Estates is granted based on the
proposal that Bradwell Estates LLC (d.b.a. Projx Construction
Group) will construct all homes within this unit consistent with the
home plans provided in the packet. Any proposed house
construction by any other builder, or any significant change in the
house models to be constructed, will require Village review and
approval, in accordance with Village Code."
DISCUSSION:
Bradwell Estates LLC has contracted with K. Hovnanian Homes, a
nationally recognized homebuilder, to commence and coordinate
the development of Bradwell Estates. K. Hovnanian will post
required security, contract and manage the installation of all public
infrastructure and comply with all the previously approved plans
including plat, engineering and landscape. All obligations outlined
within the Annexation Agreement will be assumed by K.
Hovnanian Homes.
Bradwell Estates LLC (d.b.a. Projx
Construction Group) will retain the ability to build some homes in
the subdivision, but the vast majority will be constructed by K.
Hovnanian Homes.

DISCUSSION: (Continued)
K. Hovnanian Homes is proposing to offer four home plans from 2,500- 3,400 square feet as the
base models with each plan offering 3-5 distinct elevations. All front elevations will feature
masonry (stone or brick) in some form and are similar in character to the previously approved
homes. K. Hovnanian Homes anticipates home revenues ranging between $500,000-$750,000
for the subdivision. As allowed by the Annexation Agreement, K. Hovnanian Homes may opt to
construct a model home on the site.
K. Hovnanian Homes will still be bound by the original approvals for the Bradwell Estates
Subdivision with respect to landscaping, engineering, on-site and off-site improvements, and all
conditions of approval. They will not be seeking to change the previously approved plat of
subdivision or final engineering.
K. Hovnanian Homes is currently working on an agreement with the Hoffman Estates Park
District to amend their previous agreement with Bradwell Estates LLC that will transfer all
obligations and requirements to K. Hovnanian Homes as part of this approval. The Park District
is expected to approve the amended agreement.
RECOMMENDATION:
Approval of a request by Bradwell Estates LLC and K. Hovnanian Homes for a site plan
amendment for a new owner/builder to construct different home models in a previously approved
single family subdivision (Bradwell Estates); subject to the following conditions (includes
previous conditions of approval):
1.
The final plat of subdivision shall be recorded within nine months of Village Board
action or prior to obtaining the first building permit, whichever occurs first.
2.
No individual lot shall be subsequently re-subdivided within the subdivision.
3.
The development is subject to the terms of the Bradwell Estates Annexation Agreement.
4.
A permit shall be secured from Cook County prior to commencing any work in the
Bradwell Road right of way.
5.
Approval of Bradwell Estates is granted based on the proposal that Bradwell Estates LLC
(d.b.a. Projx Construction Group) or K. Hovnanian Homes will construct all homes
within this unit consistent with the home plans provided in the packet. Any proposed
house construction by any other builder, or any significant change in the house models to
be constructed, will require Village review and approval, in accordance with Village
Code.
6.
The following Subdivision Code waivers are granted with this approval:
a.
A waiver from the Subdivision Code (Section 10-3-2-C-1) to allow a centerline
radius of 55 feet with a minimum back of curb radius of 41.5 feet instead of the
required a 200 foot radius for the centerline of a horizontal curve for a minor
street.

b.
A waiver from the Subdivision Code (Section 10-3-2-C-8) to allow a street jog
with an offset of 115 feet instead of the required minimum of 125 feet.
c.
A waiver from the Subdivision Code (Section 10-4-7) to allow all the trees on the
site to be removed.
7. The following Zoning Code variations are granted with this approval:
a.
A variance from the Zoning Code (Section 9-5-6-D-1) to allow subject property
of 4.78 acres to be zoned R-6 instead of the required 25 acre minimum.
b.
A variance from the Zoning Code (Section 9-5-6-F) to waive the requirement that
all new residential subdivisions in the R-6 district provide for permanent public
and permanent private open space equal to 40% of the total land area.
c.
A variance from the Zoning Code (Section 9-5-6-D-3) to allow the lot width at the
front setback line to be 63 feet on Lots 3, 4, 5, 9, 10, II, and 12 and 63.7 feet on
Lot 13.
8.
As shown on the landscape plan, the landscape buffer plantings behind Lots 1-12 and in
the lots along Bradwell Road shall be installed in entirety at one time and shall be in
place prior to the issuance of the first certificate of occupancy for any house in this
subdivision.
9.
Building permits for dwelling units shall not be issued by the Village prior to the paving
and installation of streets with the binder course in place which meet Village
requirements as reasonably determined by the Village, including but not limited to
emergency vehicle needs. No building construction beyond the concrete foundation may
occur without the installation of looped water mains and associated improvements which
meet Village requirements for fire suppression as determined by the Village.
10.
Prior to installation of any private utilities including, but not limited to, the CornEd boxes
the petitioner shall provide a minimum 24-hour notification to the Village to allow
on-site inspection by a Village representative to ensure that the approved plans are
followed.
11.
As part of recording the final plat of subdivision, a Statement of Awareness, provided by
the Village, shall be recorded for the entire property. The statement shall be required to
be signed by all prospective purchasers at time of contract prior to the closing signing.
Copies of the signed Statement of Awareness must be provided to the Code Enforcement
Division of the Development Services Department prior to the issuance of a building
permit. If no purchaser has been identified at the time of building permit, then the
developer shall provide a copy when a contract is signed. In addition to the signed letter,
a board with the Statement of Awareness enlarged to a size not less than 24x36 inches
shall be posted in the sales office, and additional copies shall be available to be taken
away by the customer with the other materials provided at the sales office. The posted
notice and additional copies shall be located in a conspicuous area that is accessible to the
public.

12.
The property is subject to the school donation requirements as mandated by Section 10,
Article 9 of the Village's Municipal Code.
13.
The property is subject to the Development and Easement Agreement between the
developer and the Hoffman Estates Park District and the Intergovernmental Agreement
between the Developer, the Hoffman Estates Park District and the Palatine Park District.

Dear Mr. Gugliotta:
Thank you for the opportunity to present K. Hovnanian's home plans for consideration for inclusion in
Bradwell Estates Annexation Agreement. In addition, K. Hovnanian will be seeking Village approval all
necessary assignments from Bradwell Estates, LLC to permit K. Hovnanian to step into the role of
Developer. Currently K. Hovnanian has an agreement to purchase Bradwell Estates from Bradwell
Estates, LLC. However, K. Hovnanian and Bradwell Estates, LLC have formed a partnership of sorts that
would allow Projx Construction Group the ability to build homes at Bradwell Estates, though the large
majority is expected to be built by K. Hovnanian. I have included in this application a letter from Projx
Construction detailing why this partnership has been formed. Below you will find a narrative description
of K. Hovnanian's intentions related to Bardwell Place. Also included as part of this application are the
attachments detailed below.

K. Hovnanian® Homes® is a nationally recognized homebuilder that has been committed to excellence
since 1959. Locally K. Hovnanian is the 4th largest homebuilder in the Chicagoland area, build ing and
closing more than 250 homes in 2013. K. Hovnanian has extensive experience in site development,
developing more than 250 lots over the past 12-18 months. Please reference additional included
attachments for more information.
Site Deve lopment
K. Hovnanian plans take all the necessary steps to complete the development of Bradwell Estates,
including posting security with the Village of Hoffman Estates, contracting and managing the installation
of public infrastructure and completing turn over to the Village. Providing the necessary assignments
and approvals are received, K. Hovnanian currently intends to develop Bradwell Estates in the fall of
2014.

Product Offering and Sales Program
K. Hovnanian seeks to incorporate the conceptual color renderings, elevations and floor plans detailed in
attachment 1. The elevations all feature masonry in some form and are in the similar in character to the
elevations previously approved. Homes will range in size from approximately 2,500-3,400 square feet
with available options. K. Hovnanian plans may choose to complete a model home at Bradwell Estates,
but has yet to finalize a lot or home design. Currently K. Hovnanian is building the same home plans at
Park Avenue Estates, located just south of Dundee road at Park Ave in Palatine, IL. A model of the
Morton plan is open in Glen Ellyn, IL located at 22W101 Busch Road. K. Hovnanian anticipates home
revenues will range between $500K-$750K at Bradwell Estates.
Site plan
K. Hovnanian has no intentions of changing the currently approved final plat, final engineering or final
landscape plan. K. Hovnanian will work directly with Todd Schaefer of Haeger engineering to ensure the
site is developed as it was designed. We have included the currently approved site plan for reference as
attachment 2.

Subject: Bradwell Estates
First I would like to thank Hoffman Estates in working with me and my team on planning and approving Bradwell
Estates. We have worked on the project for over two years and are very close to having all of the permits in hand to
be able to start the land development. Over the last few years my company, Projx Construction Group, has been
working on a few different interesting projects including Bradwell Estates and a very unique project called Breakwater
Chicago. I have attached a photo and summary of this project. Projx was awarded the contract to build this project
about a year ago with the hopes of the project being approved. Breakwater is a unique floating entertainment facility
about the size of a football field to be located near Navy Pier on Lake Michigan. The project has recently been
approved and a formal announcement to the public is scheduled to happen on June 10, 2014. Based upon this
recent development, I have been trying to plan out the next year to handle commitments that Projx Construction
Group has made to their clients.
In the best interest for our clients and Hoffman Estates, I am proposing that I bring on a builder partner for Bradwell
Estates. I have discussed this arrangement with a number of home builders and have determined that the best fit
would be with K. Hovnanian Homes. K. Hovnanian a national home builder with a secure financial backing and a
good reputation . I had met with the village of Palatine as part of my decision making process and they confirmed that
K. Hovnanian has been a responsible builder in their town. I propose that K. Hovnanian would act as the developer,
improve the lots per the approved engineering, secure the guarantee and build homes for their customers. Projx
would build homes for their customers and maintain commitments that they have for current clients and any future
clients. I hope staff and the board would give their blessing to this arrangement. I want to make sure we fulfill our
obligations to our clients by providing good service, quality and value.
I would appreciate the opportunity to work with Hoffman Estates to make any necessary changes to the annexation
agreement and additional architecture to be added to the product mix.

Town & Country Homes was founded 1958 by William G. Ryan. The first home was delivered on August
19, 1960 on S. Michigan Avenue in Chicago IL. From that first home Mr. Ryan grew his operations on the
south side of Chicago and nearby suburbs including Oak Lawn, Tinley Park and Orland Park among
others. Over the decades Town & Country grew to become a market leader and one of the largest home
builders in the Chicago through the 1990s and early 2000s, closing more than 1,230 homes in 2005. In
total Town & Country Homes has built and closed more than 20,000 homes in the Chicagoland market

Some of the highlights from our second quarter results are detailed below.

Total revenues were $449.9 million for the second quarter ended April 30, 2014, an increase of
6.4% compared with $423.0 million in the fiscal 2013 second quarter. For the six months ended
April 30, 2014, total revenues increased 4.2% to $814.0 million compared with $781.2 million in
the first half of the prior year.

Homebuilding cash was $243.3 million as of April 30, 2014, including $5.2 million of restricted
cash required to collateralize letters of credit.
•
During the second quarter of fiscal 2014, $105.3 million was spent on land and land
development compared with an average quarterly land and land development spend of $143.5
million for each of the first two quarters of fiscal 2013.
•
Pre-tax loss for the second quarter ended April 30, 2014 was $5.6 million.

Staff prepared a draft Annual Action Plan for Program Year 9, released June lOth through July lOth for public
comment. A public hearing to receive comments was held and the Action Plan was approved by the Board on
July 7th.
North West Housing Partnership (NWHP), acting as the Village's subrecipient, is actively seeking additional
homeowners for the loan and construction application process for single family home rehabilitation projects. Two
homes have completed construction. Two prior loans were repaid due to the properties being sold - this program
income will be available for new projects. The July Citizen featured an article about this program, focusing on
possible accommodation improvements for seniors and homeowners with disabilities.

A new automated report has been created to allow the payment information for backflow inspections entered by
the front counter to be viewed instantly by Public Works staff through the computer system. This change will
eliminate significant time manually calling between departments/buildings to check on payment status.
New automated reports are being created to streamline communications with various departments who need to
know when certain permit types are issued. Using these automated reports will greatly increase efficiency.
Improvements are being worked on to improve efficiency in the processing of building contractor insurance and
bond documents.

RENTAL HOUSING LICENSE AND INSPECTION PROGRAM

At the end of July, there were a total of 1,543 rental applications submitted and paid.
In July, a new automated inspection letter process was implemented which allows batches of inspection letters to
be sent based on geographic location. Based on the total number of registered properties, there will be
approximately 100-150 letters mailed each month to notifY owners it is time to call for their inspection.
Code Officers have completed 166 inspections so far based on manual calls to owners with multiple properties.
This number is expected to increase significantly in the coming months as the formal inspection notification
process is implemented.
A process is being developed to ensure the collection of any outstanding fees owed to the Village before any
rental licenses are issued to an owner/address. The Village Sungard computer system will be used to the greatest
extent possible. Notification of unpaid money is being included in the automated inspection letters being sent.

•
Updated the Village's available properties database through Location One Information System
(LOIS) . The properties are updated weekly.
•
Continued working with Ala Carte Entertainment on the initial steps to propose a TIF
amendment to include the restaurant mall properties as contributing to the TIF. Met with their
TIF attorney to move the process along. The two restaurants, Moretti' s Ristorante & Pizzeria
and Whiskey River received their site plan approval in July. They hope to open both locations by
the end of the year.
•
Continued to follow-up with meetings and conversations from the ICSC RECon show in May.
Talked to several potential entertainment and restaurant users for the Poplar Creek at 59/90
Entertainment District.
•
Communicated with local brokers and property owners to answer questions and help fill their
vacant properties.
•
Continued work with the Arts Commission to continue to provide quality events for the
residents and businesses, like the Summer Concerts in the Park. Continued work with the
Platzkonzert Commission to plan for the September event.
•
Ongoing phone calls and emails with shopping center owners in town to receive updates on
properties and assist in improving the properties. Also met with several properties owners in
town to talk about the status oftheir projects and brainstorm best ways to market their land.
•
Met with residential developers and discussed possible sites for developments. One developer
showed serious interested on the Menards-owned property for single-family, attached and
detached, residential. Staff will follow-up with the developer for a possible courtesy review.
•
Attended a Chamber of Commerce meeting to update the group on projects within the Village
and different ways the organizations can work together to promote Hoffman Estates businesses.
•
Attended grand opening and ribbon cuttings of various Hoffman Estates businesses. Also spoke
with the owners and managers of the new businesses to help maximize their exposure and
promote their stores.
•
Met with a staff member from the Cook County Economic Development Bureau to talk about
ways the county can help Village businesses grow and prosper. Staff talked about the new Class
7c property tax incentive, the Colden Corridor workforce initiative, and several other topics. It
was a very good meeting to connect with county representatives.

to fill vacancy and make site upgrades
to the site, including new signage.

This year we saw a big increase in number
of running event participants thanks to the
local marketing assistance from the
Hoffman Estates Park District (final
numbers not available at this writing}.
Heroic Fitness from Hoffman Estates was
on-site to provide warm ups (dancing and
fitness routines}. Alexian Network did
approve a $5,500 increase to our existing
$25,000 annual sponsorship from them but
it was tagged to pay for a printed
supplement with Daily Herald that would
feature the various nonprofits that benefit
from this year's FFA. Unfortunately, by the
time the sponsorship was confirmed, there
was no time to create the supplement so
we reverted to last year's sponsorship level

($25,000). This year we offered 4 nonprofits (GiGi's Playhouse, Children's Advocacy
Center, Hoffman Estates Park District Foundation, and Heart of a Marine) the
opportunity to participate in this world class event with teams to raise funds and
awareness of their cause at NO COST to them. Superheroes walk had a separate start
time. Each group was required to have at least 10 members that would each raise a
minimum of $100. We also asked that they wear costumes that best identify their
heroes ($1,000 prize awarded to the best). Unfortunately, none of the non profits we
reached out to (each was a partner of Alexian Healthcare) was able to put a team
together, however, Huntington's Disease Team (Team HD) jumped on the opportunity
and raised over $8,000 for their cause.
Meetings:
• Met with Ben Gibbs, Ashley Monroe, and Mark Koplin to write grant for SCA (Village)
to receive financial assistance to host the Davis Cup World Group Playoff September
11-14, 2014, for $82,655.63.

Toured Davis Cup Event coordinators through Hoffman Estates locations for their VIP
events and draw ceremony.
•
Working with Musky Expo organizer (January 2015 at SCA) to secure contracts for
lodging and additional sponsors from the Village.
•
Toured new sales leader from Chicago Marriott NW through top/targeted accounts
and pointing out potential leads for new business.
•
Attended grand opening of Ditka's restaurant at Arlington Park Trackside with Hilton
Garden Inn sales team.

Attended grand re-opening of Red Roof Inn.
•
Attended HE Chamber Business After Hours (BMO/Harris Bank).
•
Attended HECPAAA organizational meeting to assist in raising sponsorships and
providing vendor contacts for annual softball Game Fundraiser "Shootz & Ladderz".

Met with Elgin/Fox Valley Convention and Visitors Bureau to review completed Davis
Cup Grant, seek their support, and ask that they advocate with the Illinois Tourism
Office on behalf of SCA.
