CITY OF BARTOW HISTORIC ARCHITECTURAL REVIEW BOARD MEETING AGENDA Thursday, December 2, 2010 MINUTES The City of Bartow Historic Architectural Review Board held a meeting on Thursday, December 2, 2010 at 4:00 p.m. in the City Commission Chambers located at City Hall, 450 N. Wilson Avenue. Notice of this meeting was posted at City Hall and the city’s website www.cityofbartow.net 1. CALL MEETING TO ORDER The meeting was called to order by Chairperson Crisman at 4:00 p.m. 2. CLERK TO CALL ROLL The roll was called by City Clerk Linda Culpepper and attendance was as follows: 3. NEW BUSINESS A. Public Hearings: 1. Application #CA-10-18 Frank Powell, Owner Of The Property Located At 1105 Martin Luther King Jr. Blvd, Requests Approval Of A Certificate Of Appropriateness To Construct An Addition To An Existing Commercial Building In A Designated Historic District Pursuant To Section 2.02.01 Of The ULDC. Chairman Crisman introduced the case by title as listed above and opened the public hearing. Planning Director Wiegers reported that he gave a complete packet of information to clerk for the public record. An advertisement for this meeting was published in the Polk County Democrat on November 21st. He also mailed 18 notices to surrounding property owners within the required radius. He received no comments or phone calls as a result of the notices. Mr. Wiegers said that there is nothing unusual about this request. The facility was built before historic guidelines were established. Mr. Powell’s plans are to convert the existing day care center into a community learning center which he had tried to build on two other properties that he owns in the area. The request is for approval to construct an addition on the south side of the existing building. With no further comments, Chairman Crisman closed the public hearing. MOTION was made by Board Member Clark, seconded by Board Member Miller to approve the request as proposed and to issue a Certificate of Appropriateness allowing an addition on the existing building located at 1105 Martin Luther King, Jr. Boulevard. Julie Clark Real Estate Sales and Activities Board Member Clark reported that 27 properties have sold since September 1, 2010 citywide. The first fifteen sales were cash sales and the rest were normal conventional sales. The average price is $60 per square foot without regard to whether the property is new of existing. B. Gregg Lamb Permit Update Building Official Gregg Lamb reported that the city has permitted one new home and 10 townhouses on Clower Street being built by Highland Homes in the last month. He said that there is some interest in property located on Hwy. 555 for an assisted living facility. Publix Historical Architectural Review Board Minutes Thursday, December 02, 2010 Page 3 of 3 Supermarkets will bring in plans for its expansion this week. Walgreens will also bring their plans for review within the same time frame. Board Member Miller asked for an update on the Cigar Factory. Mr. Lamb said that Public Works Director Pickard has developed a list of things that need to be done to dry in the building. A group of private citizens will have to secure funds to mothball the building until restoration can be done. The funds needed for securing the building will be approximately $50,000. There will be no city funds used for this project. Commissioner Jackson reported that there is a phase one environmental assessment that will be done in the very near future to determine if a phase two assessment is needed. 8. NEXT MEETING DATE - January 6, 2011 Planning Director Wiegers said that he has no application at this time for the January 6, 2011 meeting. He will notify the board if that meeting is necessary. Board Member Miller asked about the lighting and new signage at the old John’s Restaurant. Her concern was that this is at one gateway into the city and is not an attractive entryway. Building Official Lamb said that the owners have submitted plans to add an insurance company and pawn shop to the existing club. Those are not ready to open because they have not been through the inspection process. They also plan to open a tire shop in the separate building but that may not happen. At this point, they have 30 days to install a fire alarm and sprinkler system to separate the two new businesses from the club. Main Street Director Mikel Dorminy said that they also requested a CRA façade improvement grant at their last meeting but were denied. 9. It was listed in the Florida Master Site file as part of the 1990 update study. Services/Infrastructure: The site will continue to utilize City services and infrastructure. Development History: None STAFF ANALYSIS The Historic Architectural Review Board shall be responsible for identifying and maintaining Bartow’s historic buildings and structures for the benefit of its residents, both now and in the future, through the development and administration of a comprehensive historic architectural preservation program. The Board shall have the authority to review and render a decision on all proposed alterations, demolitions, relocations for contributing property, and to review new construction within the boundaries designated. The following criteria shall be the basis on which the Board approves or denies an application for a Certificate of Appropriateness for a building located within the City’s historic district. Demolition Criteria: 1. The City may not prohibit the demolition of a building under the criteria of this ordinance. Demolition of an historic structure may be delayed for the purposes of finding a buyer for the structure willing to rehabilitate the structure rather than tear it down, as described further below. 2 Demolition of a designated building, structure, improvement or site may occur pursuant to an order of a government agency or a court of competent jurisdiction or pursuant to an approved application by the owner for a Certificate of Appropriateness. Once an application has been approved, the owner may proceed to obtain a demolition permit. 3. Government agencies having the authority to demolish unsafe structures shall receive notice of designation of individual sites or districts by being provided with a map from the Board. The Board shall be deemed an interested party and shall be entitled to receive notice of any public hearings conducted by said government agency regarding demolition of any designated property. The Board may make recommendations and suggestions to the government agency and the owner(s) relative to the feasibility of and the public interest in preserving the designated property. 4. No permit for voluntary demolition of a designated historic building, structure, improvement or site shall be issued to the owner(s) thereof until an application for a Certificate of Appropriateness has been submitted and approved pursuant to the procedures of this chapter. The Board shall be guided by the criteria contained in part (3)(e)(1-4) below. The Board may grant a Certificate of Appropriateness which may provide for a delayed effective date of up to six (6) months. The effective date shall be determined by the Board based upon the relative significance of the structure and the probable time required to arrange a possible alternative to demolition. During the demolition delay period, the Board may take such steps as it deems necessary to preserve the structure concerned, in accordance with the purposes of this chapter. Such steps may include, but shall not be limited to, consultation with civic groups, public agencies and interested citizens, recommendations for acquisition of property by public or private bodies or agencies, and exploration of the possibility of moving one or more structures or other features. In addition to all other provisions of this chapter, the Board shall note the following for each property considered for demolition: Case #CA-10-18 /Frank Powell December 2, 2010 Page 3 of 3 1. The historic or historic architectural significance of the building or structure; whether the building or structure would reasonably meet national, state or local criteria for designation as an historic or architectural landmark. 2. The difficulty or impossibility of reproducing such a building or structure because of its design, texture, material, detail, or unique location; whether reasonable measures can be taken to save the building or structure. 3. The importance of the building or structure to the designated historic district; and, whether the building or structure is one of the last remaining examples of its kind in the neighborhood or in the City. 4. The definite plans for reuse of the site if the proposed demolition is carried out, including any replacement buildings or structures, and the effect on the surrounding area. New Construction Criteria 1. New construction shall be visually compatible with the buildings and environment with which it is visually related, including, but not limited to: the height; the floor-to-area ratio; the proportion between width and height of the exterior; the proportions and relationships between doors and windows; the relationship of solids to voids created by openings in the façade; the materials used in the façade; the texture inherent in the façade; the colors, pattern and trim used in the façade; and the design of the roof. 2. The relationship of building masses and spaces between them shall be visually compatible with the buildings and environment around them. 3. The site and landscape plan shall be sensitive to the individual building, its occupants and needs and shall be visually compatible with the buildings and environment with which it is visually related. 4. A new street façade shall relate to adjacent buildings. 5. Architectural features shall be incorporated, whenever possible, to relate the new with the old, and to preserve and enhance the characteristics of the district. Attachments 1. Application Package 2.
