Though Labor made great strides in the 2014
election that led to a settlement on the City’s
Measure B pension reform, we need to continue that momentum in this election. Many
critical issues will face the City Council — implementing Measure B’s pension reform;
boosting revenues and City services; improving employee compensation and morale to
restore recruitment and retention of a skilled
workforce; and affordable housing.
Join other Local 21 Members in May and June
as we reach out to voters, encouraging them
to vote. Phone banking and precinct walking
are more effective than the dozens of mailers
voters will be/already are receiving .

Sean has spent the last 18 years with the California Association of Professional Employees
(CAPE, AFL-CIO) where he gained extensive
experience organizing and representing supervisory and non-supervisory engineers, engineering technicians, planners, appraisers and
numerous other professional and technical job
categories at Los Angeles County— all of
which makes him a natural fit for IFPTE’s professional membership.

Representative for Local 21's AEA, AMSP and
CAMP Chapters.

San Jose City Council Removes Measure B from the Books
As you'll remember from last month's report, former San Jose City Councilman and Pension-Cutting Posterboy Pete Constant joined with the Silicon
Valley Taxpayers Association in filing an appeal to the City's negotiated
settlement. That case went to court in April, and the judge decided against
Constant. Also, Santa Clara County Superior Court Judge Beth McGowen
announced that she approved and signed the Police Officers Association’s
Order and Final Judgment in the quo warranto action which declares
Measure B null and void. All these steps set up the move taken by the City
Council May 10 — the Council voted 10-1 to remove Measure B from the City
Charter. It will be replaced by ordinances agreed to in a global Settlement
Framework. It has been a very long and painful road we have embarked upon
together in our fight against Measure B and its destructive effects on the City of
San Jose. But this major development means that Measure B will be removed
from the books. This is a major victory for all the litigant Unions and our Leaders
who have spent countless hours over the past couple of years resolving this illconceived attack on public employees. Read more here.

Interim CEO a Breath of Fresh Air for Employee Relations
A big win for the Bargaining Units at the Water District! Last year, we reached a
settlement over Limited Term positions. We negotiated that they fall under the ES
and PMA MOUs with Union rights under our contracts. The former CEO refused
labeling the workers permanent, but Interim CEO Norma Camacho gave direction to
Labor Relations to make these 18 positions permanent, full-time employees eligible
for protections under the MOU and state and federal labor laws.
Another victory — for our Associate members in ES. The District finally decided to drop their proposal to change the “Fair Labor
Standards Act” status of about 62 of our Associate Engineers. This means that the status quo will remain keeping them nonexempt so that they are still eligible for overtime compensation.
In addition, all three Bargaining Unit Officers recently met with Camacho, her chiefs, and labor relations to discuss a wide range of
issues at the District. Topics ranged from a staffing plan to an employee survey about trust in leadership. We are encouraged by
the change of direction by the interim CEO. This meetings are quarterly and we look forward to the next one.

that to Labor Relations and the County agreed with all of our technical edits to the class spec.
Some of our Members only had one objection to the salary of the new position which will be
noted in the legislative file when submitted to the Board of Supervisors. Overall, we are pleased to have this in our Bargaining Unit
instead of being poached by CEMA if the title was Chief Engineer.

MOU Bargaining Starts
Our TAEA Bargaining Team consists of Officers Manjit Khalsa, Raj Sehdev, and James
Esoimeme. We had a very general prelude to negotiations, meeting the VTA management team. Director of Business Services Alberto Lara will be the Chief Negotiator for the VTA side along with Local 21 Staffer Stanley Young for the Union
side. We are reviewing Member input from a bargaining survey.
