ATV bill seeks to raise penalties
Lawmakers want to crack down on trespassing through farmland.
Governor George Pataki’s signature could raise the penalties for riding ATV’s on
private farmland. Currently the law states that a maximum $250 dollar fine may be
imposed on violators. This current law has been rarely imposed on violators and are
usually released with nothing more than a warning.
The new bill has been approved by the Senate 60-1 and the Assembly 134-0, so
the likelihood of Governor Pataki’s signature is an ideal high. If sign the punishment
would be increased as followed:

1st Offense
~ up to $250 fine and 15 days in jail
2nd Offense
~ up to $400 fine and 45 days in jail within 18 months of the first
offense
Continuous Offense
~up to $550 in fines and 90 days in jail for infractions within the
18 month period
All offenses on an ATV are considered traffic violations. Traffic violations are
usually pleaded down to lesser offense in court, which in fact turn into a warning with no
fine. With the new bill passed it would insure a fine would be imposed to the violators.
If Governor Pataki does in fact sign the bill it would be taken effect as of
November 1st of 2005. However, the bill hasn’t reached the governor’s office but they
will certainly take a look at it once it’s sent to them said spokeswoman Jennifer Meicht.

The Tri-County Quad fest is July 15th-17th in PA. If you

The Eastern Chapter has a Rodeo July 10 and needs some
help running things. If you could help they would appreciated the support.

We had Aprils meeting, a ride and a clean up at Pine Hill ATV
Park. !8 members showed up to help. We had a nice time and
asked us if we could have a fall clean up too. If you got a coffee
cup that day and the cap doesn’t fit the cup contact Joanne for
replacements!

The DEC draft policy meeting at the Museum & Science Center
went well; about a 100 showed. The rally in Syracuse was also a
good turn out with about 250 people who attended.
•
We need representative from our chapter at the NYTRO, Inc.
annual meeting in Syracuse on October 2nd. Please contact
Joanne if interested.

New Business
•
TrailPass has insurance that we can purchase. It was voted on and
everybody said yes, so we now will have club insurance as soon as
the papers go through. The cost for the year was $750 for our
chapter. Any specific questions about the insurance please contact
Joanne

We are looking for somebody to head up some fundraisers. The
yearly due for the year does not cover what we need to keep the
chapter operating. So PLEASE HELP! Joanne is waiting for your
HELP and IDEA’S.
•
The Western Chapter has reorganized and has new officers. They
are on the cover of this month’s newsletter. They said that the
Cuba property needed some maintaining and would like some of
us to help. Please contact Joanne if you’re available to help.
•
Our Adopt-a-Highway is coming up on July 17 at 8:30 am. We
will meet at the VFW in Palmyra on Rt. 31. For more information
contact Joanne at 315-986-0966. We will be riding afterwards at
Whispering Pines. Please bring gloves. We will supply the safety
hats and vests.

Great news! The Central Chapter website is now up
and running! I would like to give a big THANK YOU to
members Craig Robillard and Dan Moyer for getting
this project started and putting it together for us! Craig

NYTRO Northern Chapter

On June 11 , we had our monthly meeting at the home of Ralph and
Pat Miller. We had about fifteen members show up for this
meeting/ride. VP Mike Bellinger called the meeting to order at 3:30
pm. The treasurer’s report, from the June newsletter, was re-read and
approved. We had a short discussion on the parades that we had gone
to in the last couple of weeks. We definitely notice the lack of
participation from our members in these two parades. For the Lacona
Firemen’s Field days we had a total of 6 members on ATV’s and for
the Orwell Old Home Days parade, we at least doubled that and had
12 members on ATV’s. We sure hope that more members start
becoming more involved with this club or we may risk losing all that
we’ve accomplished thus far and what we can do in the future. It may
seem like the parades don’t do anything for our sport, but they
certainly do. Showing the public how organized and responsible we
actually are, helps our club and our sport.
VP Bellinger informed us of a couple of important meetings that were
coming up. One would be on the 16th of June at 7:00 pm for the
Jefferson County ATV Association. This would be held at the garage
of the ambulance service of Gulfolye, where he works. He said that he
would be attending that meeting. He also informed us of some
meetings that would be taking place on the 21st of June. The
NYSORVA Region 6 meeting would be held at the Harrisville Gun
Club in Harrisville at 7:00 pm and the other would be held at the
Jefferson County Legislature Building in Watertown, also at 7:00 pm.
Mike said that he would attend the Jefferson County meeting, but he
needed someone else to try and make the Region 6 meeting. Ralph and
Pat Miller said that they would go to that meeting.
Our membership coordinator, Faron Cronk, read off the names of the
members who still owed their dues to the club and he asked that those
present try to contact them and see if they plan on staying with our
club or not. We also decided to extend the deadline to the end of July,
as we felt that some of those that owed their dues would more than
likely be paying them up at Brasher Falls. Faron also informed us that
he would be stepping down from the duties that he has been doing for
our club, at the time of election of officers at Brasher Falls. We talked
about separating his duties among the other elected board members.
Our secretary, whom he has been filling the vacated spot for since
November of last year, would be responsible for doing the newsletter
and the treasurer would handle the membership base. Faron said that
he is the last of the original starting board members of this club and he
felt that it was time for some new faces to take over.
The meeting was adjourned at 4:15 pm.

To NYSORVA List members,
At minimum to let you know that the NYSORVA News
List is not dormant, we're sending out this note with some basic
items to share.
With the end of the Legislative Session (June 24; which
had the most disappointing outcome, since the 1990 State Budget
which repealed & raided the first ATV Trail Fund), and the end of
the DEC Draft ATV Policy public process, there is not a lot to of
great substance to report in NY.
Some things do continue to happen at local/regional
levels - and we'll report on developments as they are shared with
us by local activists.
Those interested in NY snowmobiling should check out
http://www.nyssnowassoc.org/ to learn about the landmark bill
("SRRA") passed affecting registration and a state speed limit
(pending Governor's signature or veto).
A reminder: The NYS ATV Registration Fee increases
to $25 on July 11. Register now at $10 if you are going to
register.
With failure of the Legislature to pass the promised
Program and Spending Authority legislation, we will once again
see no return on registration fees - and therefore no new incentive
to register, even with the increase originally marketed to us as
destined to be returned to trails.
Until a legislative surprise/miracle unfolds, that promise remains
broken. It's up to the riders and benefiting industries to combine
to fix this, and not much is happening on that front.

TrailPass has finally signed on the new insurance policy. We have the certificates for both properties in
hand. Pam will forward the club roster to LeeAnn Harris.
We may be able to acquire trail maintenance equipment through TrailPass. They have a deal with Tucker
Rocky, and may soon have one with Swisher. We hope
to acquire a disc set to groom some of the ruts out of
the trails at a reduced price, or possibly for free via a
TrailPass grant. Pam is following up on this.

SUSQUEHANNOCK AND SPROUL STATE FORESTS IN PA
Southern Tier members attended a ride in PA.
They come back with some
information that is helpful to all when
considering
Susquehannock and Sproul
State Forests.
Club ride at Susquehannock and Sproul
State Forests in PA:
•
Susquehannock is good for beginners or those
looking for a relaxing, easy ride. It’s all two-way
logging roads, very smooth.
•
Sproul is more for intermediate to advance riders.
Rougher riding, all trails. Lots of rocks. Old strip
mines with crazy hill climbs!
•
Note on kids riding in PA: kids 10-15 must take
the ATV Safety Course and carry their certificate
of completion with them. Under 10 not allowed on
public property.
•
It costs nothing to ride at these State Forests!
•
Camping is a small fee, $5.00 per night, I think.
•

Northeast Powersports Rally Sept 23-25, 2005
We will have approximately 5,000-6,000 ATVers at this year's event (we had 3,000 at our first event, last year).
The biggest news is that we've moved most of our riding events to a new, great location: West Mountain Ski
Area, and the thousands of acres of forest behind the ski center. Lots of riding, lots of parking,
onsite restaurant, bathrooms, ATV wash, etc.
Our events at this year's rally:
John Deere Poker Run - Grand Prize is a $6,499 2005 ATV. We have a brand new trail system, with about 25
miles of terrain with great views of the Adirondack mountains and the Adirondack Hot Air Balloon Festival.
Kenda Mud Bog - Winners receive sets of Kenda Tires. Note,
we have dramatically increased the size of this year's bog.
ATV Rodeo, sponsored by Answer/MSR/Protaper ATV Uphill Giant Slalom, sponsored by Tucker Rocky ATV
Trail Riding, sponsored by TrailPass Northeast Powersports Expo,
with 30,000 sq ft of ATV machines, parts and accessories.

CALLING ALL ATV ENTHUSIASTS!
ESPN WANTS YOU….
Catch all the heart-pumping, adrenaline-rushing action as ESPN presents the premiere of two action-packed ATV events during the
2005 Great Outdoor Games presented by Dodge.
ATVs will be roaring, soaring and racing to the checkered flag in two new competitions — FOUR WHEEL FRENZY and TERRACROSS.
Here’s how it all goes down.
FOUR WHEEL FRENZY tests riders' ability to hold down their 450cc engine ATV as it hugs corners, flies over jumps and
screams into the backstretch. In the final round of competition, 16 riders will face-off, battling straightaways, turns, jumps, water
hazards and other obstacles as they race towards the finish line.
TERRACROSS combines archery and ATV racing over rugged terrain. To avoid penalty, riders must hit targets, avoid obstacle
spills and cargo drops during the course of the race. Eight riders will face off in the final round with the fastest and most accurate
competitor taking home the gold. Motocross freestyle superstar Chuck Carothers is in the field!

DIRT BIKE VOLUNTEER FINDS MISSING UTAH BOY SCOUT
Search gains national attention; rescuer credits everyone involved for happy conclusion
Thousands of volunteers searched the Uintah
Mountains for Brennan Hawkins two weekends ago
with nearly 3,000 on Father's Day alone. Four days
after his disappearance in the Uintah Mountains, 11year-old Boy Scout Brennan Hawkins was found
alive and well by a volunteer on a dirt bike.
Hawkins was found, dehydrated but in good health,
around noon near Lily Lake, five miles from the
climbing wall where he was last seen. Summit
County Sheriff Dave Edmunds said Hawkins didn’t
talk much but he wanted food and water, and asked
to see his mom.
“The heavens are not closed, prayers are answered,
and children come home,” said the boy’s mother,
Jodi Hawkins, to reporters outside Primary
Children’s Medical Center in Salt Lake City where
her son was admitted Tuesday afternoon.
Since the Bountiful boy’s disappearance Friday night,
thousands of volunteers – almost 3,000 on Father’s Day
alone – hiked the rugged wilderness about 50 miles east of
Kamas in Summit County.
Volunteers were given GPS
trackers and assigned grid areas to scour. Search efforts centered on the Boy Scout camp and the search radius expanded
each day until he was found.
Among the volunteers was Kevin Bardsley, father of 12year-old Garrett, who disappeared last August in the Uinta
Mountains not far from where Hawkins was lost. The search
for Garrett was called off nine days after his disappearance.
Edmunds said the rescuers were “prepared for the worst,”
with the chance of Hawkin’s survival diminishing each day.
He said Hawkin’s reunion with his parents Tuesday was “the
most touching moment he had ever seen in his life.”
The Associated Press identified Forrest Nunley, a
43-year-old house painter from Salt Lake City, as the
volunteer who first saw Brennan. Nunley said the
boy was “standing in the middle of the trail… all
muddy and wet.”
After his rescue, Hawkins reportedly ate granola bars
and drank water and asked a volunteer if he could
play a video game on the volunteer’s cell phone.
Hawkins also complained to rescuers he was cold; he
was wearing the same nylon shorts, blue sweatshirt
and tennis shoes he had since Friday.
Nunley said the boy had seen some of the search
horses earlier Tuesday but was too afraid to approach
them, possibly disoriented after four days without
food or water.
The volunteer who discovered Hawkins initially did
not want to talk to the press or be identified as a
hero, Edmunds said. “I see him as a hero,” he said.
The thousands who have scoured the wilderness
looking for Hawkins the past four days are all
heroes, he continued, crediting their help and the
calm weather to the successful find.
Search teams identified Lily Lake as a “low probability area” for finding Hawkins because of the distance from the Bear River Boy Scout Camp where he
was staying with his friend. To arrive at the area,
Hawkins had to scale a steep mountain ridge and
walk several miles.
