Introduction
Section 10(2)(f) of the Planning and Development Act 2000, as
amended, states that the Development Plan shall contain objectives
for: “The protection of structure, or parts of structures, which are of
special architectural, historical, archaeological, artistic, cultural,
scientific, social or technical interest.”
Section 51(1) of the Planning and Development Act indicates the
rationale for providing a Record of Structures, stating that
“ For the purposes of protecting structures, or parts of structures,
which form part of the architectural, historical, archaeological,
artistic, cultural, scientific, social or technical interest, every
development plan shall include a record of protected structures, and
shall include in that record every structure which is, in the opinion
of the planning authority, of such interest within its functional area.”
These structures play an integral part in the life of the County and
the daily lives of its citizens. These structures are often inhabited or
used as places of work, commerce, worship, education, recreation,
and contribute positively to the character our towns, villages and
countryside.
What is a Protected Structure?
A protected structure is a building or other feature, (such as a
bridge, memorial or castle), which, in the opinion of Clare County
Council, is of such special architectural, artistic, archaeological,
cultural, social, scientific or technical interest that it should be
afforded
legal
protection
so
that
its
intrinsic
value
can
be
appreciated by future generations. Such structures can range from
the humblest thatched cottage to the largest country house.

Under the Planning and Development Act 2000, as amended, a
Protected Structure incorporates the following: (a)
The interior of the structure,
(b)
The land lying within the curtilage of the structure,
(c)
Any other structures lying within the curtilage and their
interiors, and
(d)
All fixtures and features, which form part of the interior or
exterior of any structure(s), referred to in subparagraph (a)
or (c).
“Where a structure is protected, the protection includes the
structure, its interior and the land within its curtilage (including
their interiors) and all fixtures and features which form part of the
interior or exterior of all these structures.” (Architectural Heritage
Protection - Guidelines for Planning Authorities, Department of
Environment, Heritage and Local Government 2005).
Provision is also made for protection to be extended to include
features such as gate lodges, gazebos, etc., which have passed into
new ownership through the break-up of an estate or the division of
a property.
Responsibilities
Under the provisions of the Planning and Development Act 2000, as
amended “each owner and each occupier shall, to the extent
consistent with the rights and obligations arising out of their
respective interests in a protected structure or a proposed protected
structure, ensure that the structure, or any element of it which
contributes to its special architectural, historical, archaeological,
artistic, cultural, scientific, social or technical interest, is not
endangered”. Section 58 of the Planning Act further indicates that
“Any person without lawful authority causes damage to a protected

structure or a proposed protected structure shall be guilty of
offence”

and
the
Conservation Officer is in a position to offer advice, guidance, help
and information to the stakeholders in the county’s built heritage,
be they owners, occupiers, auctioneers, architects, solicitors,
builders or members of the general public.

Development affecting a Protected Structure
Due to a number of factors, not least the fact that many modern
building materials and techniques are often harmful to the fabric of
old buildings, more consideration must be given to the use of
appropriate materials and methods when undertaking works on
Protected Structures. Special provisions have been made in the
Planning and Development Act 2000, as amended, to address the
issue of developments that affect Protected Structures. These
provisions include the removal of the usual categories of ‘exempted
development’.
In order to undertake works on a Protected Structure, an owner or
occupier must be in possession of either:

Planning Permission, if the proposed works will materially
alter the character of the structure.

A Section 57 Declaration – This is a document available from
the Planning Department of Clare County Council which
states the nature and scope of works that may be
undertaken which will not affect the character of the
building.
Conservation Grant Schemes
Financial
assistance
towards
the
conservation
of
protected
structures may be available under various grants schemes such as
Structures at Risk, Heritage Council grants, Thatching grants and
the Built Heritage Job Leverage Scheme 2014. There are also tax
incentives available from the revenue commissioners. For further

Planning Permission Procedures for Protected
Structures
Any works to a Protected Structures, which would be normally
considered to be ‘exempted development’, will require planning
permission. Such works include extensions to the rear, or front or
internal or external changes.
Where the application relates to a development which would consist
or comprise the carrying out of works to a protected structure or
proposed protected structure (including the grounds in which the
building is located) newspaper advertisements and site notices must
state that fact. Planning Applications for such developments must
be accompanied by sufficient plans, drawings and particulars to
show how the proposed development would affect the character of

the structure. It is not possible to apply for outline planning
permission for development work on a protected structure.
Where a Protected Structure is also designated a Recorded
Monument, the National Monuments Service must be informed in
writing, detailing the proposed work and how it will be completed.
No work shall commence unless and until the National Monuments
Service have given consent. (National Monuments (Amendment)
Act, 1994: Section 12.

Historical Background
The name Ennis is derived form Inis Cluain Rámha Fhada (The
Island Meadow of the Long Rowing), as boats had to be rowed,
against the current, from the Fergus Estuary to the island.
This area and name was later divided into Ennis and Clonroad. The
mediaeval town of Ennis developed around O’ Brien’s Castle at
Clonroad and the nearby Franciscan Friary of Ennis, during the mid
thirteenth century.
The present streets of Abbey Street (formerly Church St.), O’
Connell Street (Gaol St.) and Parnell Street (Mill St.) originally
linked the Square or “The Height” with the Friary, the Tower-house
(Old Ground Hotel) and the Mill, respectively.
Although much of the late mediaeval fabric of Ennis was demolished
during the 1960s and 70s many buildings, features and artefacts
remain to indicate its early origins. Among these are:

The geographical distribution of the above items shows that Ennis
was well developed in its present form by the early 17th century,
despite being burned twice by Aodh Ó Domhaill during the nine
years war (1594-1603). The town received its first Royal Charter in
1613 and Ennis Corporation was established.
During the following centuries Ennis continued to expand and
prosper, in spite of the Cromwellian and Jacobite wars of the mid to
late 17th century. A huge increase in population during the late 18th
and early 19th centuries saw the town expand into neighbouring
townlands, mainly in the form of rows of single-storey, thatched
cottages at Drumbiggle, the Turnpike and the Galway Road, known
as the “Bóithrín”. During the same period many large three-storey,
early Georgian houses were erected by the merchant and
professional classes. Among these are The Old Ground Hotel and
Mannion's Travel Agents, O’Connell St., The “Clare People” building,
Carmody St. and Abbey Field House, Abbey St. The finest building
dating from this period in Ennis is probably “The Erasmus Smith
Academy” 1775, College Rd. now part of Coláiste Muire School.
Prosperity, derived mainly from the export of corn, butter, meat and
hides led to the construction of Bindon Street, 1830s and Bank
Place, 1850s, while impressive public buildings e.g. The County
Gaol, The Ennis Workhouse, The Fever Hospital (later Old Military
Barracks), Our Lady’s Psychiatric Hospital, The Court House, St.
Flannan’s College, The Mercy Convent, The Christian Brothers’
Schools and three Neo-Gothic churches were erected in the town
during the 19th century.
Although The County Gaol, The Workhouse and most of the Fever
Hospital and Convent have been demolished since 1950, the town
of Ennis still retains much of its late mediaeval and early modern
character. It is important that we preserve and enhance what
remains of Old Ennis for the benefit and amenity of future
generations and the Record of Protected Structures is designed to
facilitate owners, occupiers, their agents and the Planning Authority
to promote this aim and comply with the relevant legislation.

Summary Description
Limestone Monument to Daniel O'Connell, erected 1867, c. 20m in height, in the
form of a Roman Doric column set on a square-plan base having inset panels and
surmounted with a limestone statue of a cloaked figure with raised hand facing
up O'Connell Street. The statue stands on a drum decorated with a scroll of
shamrocks. Set on the site of former 17th century courthouse, demolished 1852.

pedimented ionic hexastyle portico reached by nine steps, surrounded by
balustrade, end bays advanced, as are end bays of side elevation to form flanked
tower effect. Replaced 17thc Courthouse formerly on O’Connell Square. Beside it
stands “The Russian Gun”, a cannon from the Crimean War presented to the town
in gratitude for the contribution made by Ennis men in the war. Courthouse
extensively restored 2005.

Pile of large limestone boulders rising above the flow of the river close to the
access steps, with three large painted shields with lion carved on each face.
Erected c. 1870 to the memory of “Honest Tom” Steele, landlord, inventor,
engineer, soldier, author and staunch supporter of Catholic Emancipation. It is
said that he spent much time sitting on this rock opposite Abbeyfield - the home
of his beloved Miss Crowe.

Detached multi-bay two-storey former refectory and dormitory, built c. 1550,
with gable end addressing street, incorporating late mediaeval fabric of
Franciscan Friary. Three-bay two-storey wing to north at slight angle, possibly
eighteenth century in date, and having late nineteenth century three-bay
single-storey wing. In use as coach factory in 1841. Now in use as restaurant
and public house. Pitched 17th century slate roof. Rendered, red brick chimney
stacks. Ornate mullioned limestone windows on rear gable. Rendered facade
with plaster quoins. Extensively renovated 2008 retaining 17th century roof and
staircase.

1900 shop front to ground floor and separate side entrance off Chapel Lane at
rear of gable wall; severely bowed gable wall carrying massive triple diamond
Jacobean, stone chimney stack of late 16th or early 17th century, was rebuilt in
2012. Many of the buildings in this street contain late mediaeval fabric. This
house is reputed to have been the Catholic Bishop’s Palace during the 18th
century and early home of the opera singer Harriet Smithson, wife of French
composer Hector Berlioz. In Nov. 2011 the gable was carefully dismantled for reconstruction revealing unique half-timbered internal walls. Restored 2012.

Detached 18th century two-storey, two-bay derelict flour mill comprised of rubble
stone walls with Killaloe slate roof. Cut stone mill race/head race (now filled in)
directly south of bridge. Remains of stone axle shaft grooves to mill race. Bridge is
comprised of a single arch rubble stone bridge with cut stone arch. Parapet wall
with upright stone coping. Parapet wall shows a number of concrete repairs. Metal
plate with the letters AV on it has been inserted into the north parapet wall. Bridge
marked on 1787 Grand Jury Map. Marked flour mill and Gaurus Bridge on 1st edition
(1842) OS map. No longer marked as mill on 1920 OS map suggesting that mill
had fallen into disuse at an early date however Gaurus Bridge is still marked.

Coor Spa wells near Beechpark House. Dressed limestone ashlar spa wells, one
dated May 1825 with inscribed lintel and vaulted roof set into rock face. Well now
filled up. Situated directly opposite is a derelict three-bay single-story stone gabled
well keeper’s house with Killaloe slate roof and single chimney. Adjacent to the
above well is another crude rubble stone well covered by large crude lintel set into
rock face obscured by dense vegetation. Marked on 1st edition OS Map surveyed

return to the rear. Yard and utility buildings to west and southwest. There is a
walled garden and a miniature three-bay gate lodge on the east side of the
entrance gate. Marked on 1st edition OS map and is named Hermitage. The house is
