In January, Louisville Magazine mailed a survey to all active members of
the Louisville Bar Association who reside in metro Louisville. Te survey
asked this question: “If you or a member of your family were in need of
legal services, who among Louisville-area attorneys would you choose to
provide services in the following practice categories?” Once again this year,
we asked attorneys to list the top lawyers in two separate divisions, “large”
frms and “small/medium” (all other) frms. For the purposes of this survey,
“large” frms are defned as those having 50 or more local attorneys. In each
of the categories of services listed on the survey we asked the LBA members
to name two attorneys in order of preference. In categories in which all
“Top Lawyers” are in “large” or “small/medium” frms, we include only that
frm size.
Each lawyer receiving a frst-place mention in the survey was awarded
two points; second-place mentions received one point. We then tabulated the
results in each category to arrive at the listings of “Top Lawyers” presented
on the following pages. Te number of lawyers listed in each category difers
depending on the total number of lawyers mentioned in a given category.
Te survey was mailed to 2,694 attorneys and we received 432
completed surveys. Te number in parentheses following each practice
category is the number of surveys received on which that particular category
had at least one name entered.
Te top-scoring lawyers in each practice category are listed alphabetically,
not in order of points received.

You have an interesting background of degrees. Not
many lawyers have a Ph.D., right?
“I am a biologist, and that is my great love. When I came
home to Kentucky (after receiving his B.S. from Santa
Clara University in California), I wanted to continue my
education in biology, which I did, and when I got my degrees
I decided to become an expert in the biology of my home
and I didn’t want to leave. So the opportunity arose to go
to law school and I took it. And then when I got out of law
school in 1979, the environmental movement was picking
up steam and there were new laws coming on-line. The only
place I could fnd a job doing law and the environment was
with the state’s (Department for Natural Resources and
Environmental Protection), so I got my start working for the
state as an environmental prosecutor. Back in those days,
half of their load was coal and strip-mining cases, and the
other half, in my case, was waste-management issues and
Clean Water Act cases.”
Are you noticing trends in your feld?
“To fnd, purchase and protect the sensitive landforms and
habitats in the state, country and the world. And along
those lines, I work with the Kentucky Natural Lands Trust to
raise funds to purchase large portions of Pine Mountain in
southeast Kentucky. A lot of people want to do something
about the love of their environment, and one thing that can
be done is to participate in the purchase of natural habitat.
That’s nationally and internationally. We’re coming to
recognize that we’re losing the diversity of our life forms,
and we must act to preserve those things as best we can.”
I know you work from your horse farm in Shelbyville.
What would you do if you weren’t a lawyer?
“Well, I would be teaching biology, and I would be hoping to
have a career at some level in music. I’m a singer/songwriter
and I write what you’d have to call Americana music. And
I also write fction — stories of magic realism. I’ve got two
short stories and two novels up on Amazon right now, and
one of them’s set in Louisville. I was also part of a bluegrass
band called Funky Groundwater.”

What are some of the trends you see in
your feld?
“I think because there haven’t been major
changes to U.S. immigration laws in so long, a
lot of immigrants and refugees are stuck in the
system and need attorneys to try to fgure out
how they can remain in the U.S. I would say in
Louisville and Kentucky specifcally, there is a
high demand for immigration lawyers. Because
I work at a nonproft, the services we provide
are at a low cost. We are so unbelievably busy,
and there seems to be no end to the need for
our services. Other cities — maybe even cities
comparable (in size) to Louisville — probably
have more resources, but in Louisville there are
not many low-cost options for immigrants and
refugees. There are only two (Catholic Charities
of Louisville and KRM) that offer lawyers in
immigration law. I handle a lot of asylum cases
for people from Iraq or Syria, for instance. We
also handle special immigrant juvenile cases —
unaccompanied minors in the United States.”

“Learning something new, whether it’s about an
area of law or about another culture or country.
I was just sitting here with my co-worker
trying to pick out the right word from Arabic to
English.”

What do you make of popular TV shows
like Making a Murderer and The Jinx and the
podcast Serial?
“I watched Making a Murderer. Of course, I don’t
practice criminal law, but I will say the two
defense attorneys for Steven Avery, watching
them — it’s like watching anyone at the top
of a profession. I loved watching the level of
skill and talent they brought to the case. It
was inspiring to me and a reminder of what
a difference a good attorney can make in a
person’s life.”

What cases are more prevalent in Louisville today?
“There’s obviously a lot more heroin-related cases that I
come across, and there’s also an uptick in frearm-possession
cases. People seem to feel the need to have frearms to
protect themselves. And when it comes to heroin, for
whatever reason, it’s become a more popular drug and it’s
affecting a lot of lives negatively. In my practice, I try really
hard to get help for people who want it. Treatment is an
obviously better option than going to prison or jail.”
Has a particular case stuck with you over the years?
“About eight years ago I had a case where a client was
charged with robbery, and he had confessed to the crime
after a 10-hour interrogation and had been identifed by a
witness out of a photopack lineup, so the proof was really
strong against him. But when gathering the evidence,
we were able to fnd video footage of the robbery that
exculpated my client. My client had a tattoo on his arm and
the video clearly showed the robber had no tattoo. It was a
pretty memorable case, and we were able to get him out of
jail based on that evidence.”

“At least 20 of my clients sending me a text message. In
criminal defense, you have to be readily available and
personal, because if someone is arrested, you might be
needed in court in 24 hours.”
What do you make of popular TV shows like Making a
Murderer and The Jinx and the podcast Serial?
“I have not seen Making a Murderer, but I’ve received many
comments and messages about it. But I do like the show
Death Row Stories on CNN. It talks about exonerated deathrow inmates.
“People who aren’t exposed to the criminal-justice system
might think it works perfectly, but that can’t be further from
the truth; (innocent people being convicted) does happen,
and it’s important for people to understand that, so they
can also understand that it’s important for them to have a
representative looking out for their best interest. I think it’s
a good thing that those shows are out there to give people
a different perspective on criminal justice, rather than a
fctional show like Law & Order.”

Can you talk about a memorable case?
“I’ve had several people come to me
when their information has been put on
the Internet and they want it down. And
those are always interesting in dealing
with how you get that information back
from cyberspace. And, knowing that the
interim providers (Facebook, Twitter,
etc.) have immunity, trying to get around
that to get to the person who is providing
information inappropriately and getting
the provider to cooperate with you is
always interesting.”
What’s something about privacy people
would be surprised to learn?
“Things are not as heavily regulated as
you might expect.”
What would you do if you weren’t a
lawyer?
“Oh, gosh. Well, at one point I was going
to go to flm school and become a big
movie producer. So who knows? Maybe
something in the arts like that. Maybe a
computer animator.”
