If a licensee has entered into a written listing agreement or any other written agency agreement, the licensee must do all of the following: 1. Accept all written offers 2. Accept all earnest deposits 3. Assist the principal in developing, communicating, negotiating and presenting offers and counter-offers, AND 4. Answer the principal’s questions relating to offers and counteroffers. Jefferson County Floodplain Maps to Change As you may be aware the Metropolitan Sewer District (MSD) is in the process of updating the floodplain maps. Concern has been expressed by some of our members about the Realtors® legal liability should the status of properties they represent change. The association’s legal counsel and the legal counsel of the Kentucky Real Estate Commission recommend that licensees be the “source of the source.” In other words, do not tell your client whether or not the property will or will not be in the floodplain on the revised map, but tell your client where they can go to find this information for themselves. The link to the preliminary maps is http://gis.fmsm.com/metrodfirm. It is IMPORTANT that all Realtors® understand that these are preliminary maps and are subject to change. As our computer programs will automatically start using the new year of 2006, it’s only we humans that must now overcome “User error” and remember to drop the “5” and get in the habit of 2006. I am pleased to report that the entire MSI board has been diligently at work to maintain and improve our MLS system. Your input is not only welcomed but needed. In recent board meetings, which are open to all members, it is worth noting a few agenda items including; 1. Supra boxes - In an effort to retire the old units and get the new electronic I-boxes into the field we have had promotions for exchanging old for new with a $ 50 incentive on each box. This program has been extended until February 28th. Please bring in your old boxes. They wear out. We are experiencing more failures, and members are having to call a locksmith to come out and open or cut them off. 2. We continue to explore opportunities to provide our services to adjoining boards to see if there might be opportunities for a more regionalized network, being mutually beneficial to members of both boards. 3. Fines / penalties / compliance. The association continues to reinforce that we are a membership organization and it is not our job, nor desire, to be a burden, but rather an asset to the member. However, in order to maintain a degree of order and fairness, MSI has in place “Rules and Regulations.” Copies are available on-line or by contacting GLAR. We seem to have had an increase in members not complying with the system, which has fines ($ 250) for those members who, having been notified, do not make the necessary corrections to their listings within two business days. Please refresh yourself on these Rules & Regs, or call Lenroy Campbell or Linda Edrington at GLAR who are there to assist you. 4. We have a “MLS” Improvement Task Force who always welcomes your input and suggestions. 5. We are pleased to report a financially healthy MSI Corporation with over 4,300 members participating. 6. We would like to acknowledge our fellow members who offered a full day and a half of their time to help develop a long term Strategic Plan to be considered by the GLAR and MSI boards. This process is occurring about every two years. This plan is still in a working stage, but a few themes that seem to be surfacing are; more specific and meaningful communication to the membership, and “Professionalism” among members. Unfortunately, we seem to have a few members whose conduct is sometimes seen as lacking in respect or consideration toward their fellow members. This can be as simple as keeping your listings in order and current, or by courteous phone calls to keep all parties informed of developments. 7. The Commercial Group is working on implementing a Commercial Information Exchange (CIE), which would make us about the twentieth state to do so. A CIE would be a platform for Commercial properties only and has the ability to be more state-wide, allow for listings from developers, major owners, other licensees, etc. A CIE would be a separate program that would parallel the MLS. Both programs would be available to all members. This CIE would have an impact on the commercial activity of List It. You will be kept abreast as this CIE develops. Contined next page... Letter from MSI President continued.. 8. Requirements are being drafted that will require photographs on listings. Details to follow... as per land, timing, what if they don’t have a photo, etc. Effective date is February 1st. Please contact MLS staff if you need help on photos. They have classes, they can sit down and assist you, and they also have a list of people for hire to go take your photos for you. Again, on behalf of the MSI board and staff we are excited about the new year and the opportunities to provide better tools to assist members in providing better service to your clients. FHA Limits To Increase As a result of the increase in the conforming loan limit announced by the GSEs, the FHA floor limit will automatically increase for those loans insured on or after January 1, 2006. The new FHA limit will be $200,160 which is 48 percent of the new conforming limit (i.e. $417,000). The high cost limit will be increased to as high as $362,790, which is 87 percent of the new conforming loan limit. However, since under the FHA program there is no nationwide limit, HUD will have to compute the individual limits for over 3200 US counties. HUD is expected to publish a new mortgagee letter announcing the areas that will be affected before the end of December. On November 29, 2005, Fannie Mae and Freddie Mac increased conforming loan limits on single family properties from $359,650 to $417,000, effective January 1, 2006. This loan limit increase reflects the October-to-October changes in average house prices, as published by the Federal Housing Finance Board, and complies with the Supervisory Guidance issued by the Office of Federal Housing Enterprise Oversight (OFHEO).
