Motion made by Mr. Concannon, seconded by Mr. Himtington, that' same be approved as read. Wo discussion. Motion passed - 6 ayes, no nays. • Mr. Bannes said that there have-been-occasional questions asked of the -staff in past meetings, where the staff is to do seme research, and then report back to the Board. He wondered if it-might not be appropriate to have a notation to that effect under "Unfinished Business" on the agenda until such a report is made. This would remind the Board of such pending items. I It was the consensus of the Board that this be done, and Chairraan O'Toole so directed. Chairman O'Toole announced that Mr. Kaiser had requested that the Board consider certain items out of order, as he needed to leave early for the airport, as he was going to Washington for a conference with a federal agency about grants. Mr. Fiorito was to drive him to the airport. I ADOPTIOW OF PROPOSED ORDIWANCE WO. 77-74 EXTEWDIWG THE BOUWDARIES OF THE METROPOLITAW ST. LOUIS SEWER DISTRICT AWD THE MISSISSIPPI RIVER ' SUBDISTRICT TO IWCLUDE AW AREA OF ST. LOUIS COUNTY (E. SIDE OF 1-244, SOUTH OF CLAYTON HILLS DRI'VE) (IWTRO. 1/23/74) ; Proposed Ordinance No. 77-74 was again presented and read, to extend the boundaries of The Metropolitan St. Louis Sewer District and the Mississippi River Subdistrict to include an area of s"t. Louis Coimty, Missouri, which could be efficiently served by the sewer or drainage facilities of the District and the Mississippi River Subdistrict. This proposed Ordinance Wo. 77-74 was introduced January 23, 1974 by the following Trustees: Messrs. O'Toole, Himtington, Barmes, Concannon, Lee and Young. Mr. Fiorito showed on a wall map the location of "the property proposed to be annexed. He said at includes a portion of Interstate 244 and a 22-acre tract of ground, which lies about midway between Manchester-and Clayton Roads. The tract is to be developed by the owners, Mr. and Mrs. Harold Jenkins, into a subdivision of about 20 lots. FOR THE COWSTRUCTIOW OF SANITARY SEWERS IN SUBDISTRICT WO. 366 (UNIVERSITY CITY BRANCH OF RIVER DES PERES, WITH ATTACHED DOCUMENT FROM THE MARYLAND CASUALTY CO. PROVIDING FOR THEM TO PAY ADDITIONAL COST OVER ORIGIWAL COWTRACT Proposed Ordinance Wo. 100-74 was presented and read, confirming a contract with J. S. Alberici Construction Co., Inc. with an attached agreement between The Metropolitan St. Louis Sewer District I I and the'Maryland Casualty Company, "for the completion of all work remaining to be d'one under Contract Letting No. C-387 dated April 30, 1973 by and between E. J. Fischer, Inc. as contractor and The Metropolitan St. Louis Sewer District, owner, in the project known as the Wellston Sanitary Lateral Subdistrict, in St. Louis Coimty, Missouri, with an emergency clause. Mr. Kaiser said that this and the fbll'owing item which concerns the Wellston lateral sewers were originally contracts -with E. J, Fischer, Inc. Fischer was more than 75'^ finished with this, contract, but barely started on the other when he went bankrupt. The Maryland Casualty Co. was on his bond with both 'jobs, and we have been in negotiation with them. The bankruptcy judge has now allowed the bonding company to proceed, and it took bids on both jobs. The Alberici Construction Company was' their low bidder. The District will pay on the remaining items to be completed at' the contract rate with Fischer. .Any additional cost will be borne by Maryland Casualty Co. We have entered into a contract with Alberici to complete these two projects and are very eager to 'proceed. The former contractor left several 'conditions which we are arrxio'us to correct. I In response to a question from Mr. Concannon, Mr. Kaiser said that Alberici had contracted with the District to finish the job because of a government loan, and that the D'istrict will be better protected because its own inspectors will be on the job-and nb change will be made until they approve each item. -Additionally, he said that the Aetna Casualty Company is now bonding the' Alberici Construction Co. for the job. Mr. Young said that if the District doesn't pay any more and the quality of the work will be up to our standard, that he was satisfied. Messrs. Mattei and Kaiser both recommended that the contracts be awarded. There was a great deal of discussion about this and the following item among the Trustees and Messrs. Matte'i and Kaiser. LOUIS (UWIOW STATIOW) m Resolution Wo. 138I was presented and read, authorizing encroachments on easements in City Blocks 221, 444w, 444s,.450, 451, 457,'458, 459, 1669, 1670, 1671, 1673, 1692W, 1692s, 1695E', I696E and I697E. Mr. Sears showed on a--wall map the-location-of the site of Union Station and its yards, which are to be redeveloped. This lies priraarily between Market.Street, .and Highway 40, from•21st Street east to 18th Stre.et north of Clark Avenue, and to 17th S.treet south; of Clark Av.e.nue.. He showed some sewers which, were to be relocated, and the balance to be built over. This Resolution would be followed by the License with our usual inderanity pro-visions. Kaiser and Fiorito, Mr. O'Toole requested the Secretary-Treasurer to read the proposed District Policy Statement supplementing the existing one on possible District Boundary Expansion. There -was some little discussion wherein there were some changes made in the verbiage. Motion made by Mr. Huntington, seconded by Mr. Lee, that this Policy Statement (Copy in Se.cre"tary-Treasurer's File) be adopted as a supplement to the existing P.olicy •Statement of-August 13', 1970 as supplemented on April l4, 1971 Wo further discussion. O'Toole, Jr. - aye A proposed Resolution which was to accompany the Policy Statement when it was given to the St. Louis County Council, to be considered by the Council, was presented and discussed. (Copy in Secretary-Treasurer's File.) With some changes, it was the consensus of the Board members that the proposed Resolution be sent with the Policy-Statement to-the St. Louis County Council for its consideration. I BOUWDARY HEARIWG REPORT - SUBDISTRICT NO. 383 (LA-VENTA-LA SIERRA) Report of Boundary Hearing, addressed to the Board of Trustees, dated February 6, 1974, signed by Patrick L. Brady, Engineer, Subdistrict Developmen"t (Subdistrict Report Book, Vol.XIII, Page 9) was presented and read. Mr. Sears showed on a wall map the location of the Subdistrict, as being in the north part of St. Louis County, and extending from Lindbergh northwestwardly almost to Howdershell Road north, and from Lindsay Lane southwest-wardly to Charbonnier Road on the east and Keeven on the west. He said the hearing was held at the Florissant City Hall where the boundaries were sho-wn to the four people present, two of whom were property o-wners, to determine'if there were any discrepancies. The purpose of the subdistrict is to improve an-- . -open' channel - partly by paving and partly by siclosure. Those present were told that the District's Board would consider a lOifi tax on the hundred dollars of valuation. There are 755 lots, 730 of which are improved. BOUNDARY HEARING REPORT - SUBDISTRICT NO. 400 (CRYSTAL VIEW & WEST POINT) , Report of . Boundary Hearing, addressed to the Board of Trustees, dated' February 6, 1974, signed by Patrick L. Brady, Engineer, Subdistrict Development (Subdistrict Report Book, Vol. XIII, Page 10) was presented and read. Mr.- Sears showed on a wallraapthe location of the Subdistrict as lying generally between Ballas and Bopp Roads, and adjacent to the Crystal Lake- Country Club golf course-- on -its- north.- - He sai'd that it consists of six-lots, all improved. At Mr. 0'Toole's request, Mr. Clardy read a letter from the St. Louis Flood Control Association (copy in Secretary-Treasurer's File) dated January 30, 1974, addressed to Mr. Mattei. It was the consensus of the Board that Messrs. Mattei and Braun prepare "an appropriate reply. Mr. O'Toole read a letter froni Mr. Del L. Bannister, dated January 30, 1974 in which he requested retirement from his position as Directbr of Finance. (Copy in Secretary-Treasurer's File) The Board accepted with regret Mr. Bannister's letter •announcing his decision to retire. I Mr. Concannon said that he would like to Mr. Bannister for his years of faithful and exemplary District. He said that he had previously been informed that it- was for the benefit- of the Frisco Railroad, but it is - in fact a substation for an area from Kingshighway to the City L'imits, and from Oakland to Chippewa. Mr. Enger said that the appropriation-is for a sewer line to by-pass a lagoon. -If this is not done, there will be have to be a considerable expenditure of funds for electricity, with no satisfactory solution to the problem. Since the item had been thoroughly considered previously, there was no additional discussion. He said that when .the Mississippi River floods, it backs up into the River -des Peres Drainage Channel and into the sewers which flow into it. During the last flooding situation, we blocked the sewers with air bags, but it was not completely successful. We propose to build these pump wells and put pumps in them so "that in times of rain, the yrater can be pumped from the sewer itself up irito the river, while the sewer is blocked against the -flood waters, then in-the River des Peres. . Contract PA-4l, which dealt with the modifications of the Salisbury sewer, specified that the steel sheet piling would be removed. Representatives of MSD and Alberici and Garapco met on the job site to examine the soil conditions - a saturated clay-silt soil of an unstable quality. It was determined that the most effective procedure to contain the soil would be to leave the sheet piling and beams in place. The $17,090 is the cost of leaving in place the steel sheet piling and bracing beams, less extraction costs. We recommend that this be approved as an extra to the contract.
