WEST VIRGINIA FLOOD RELIEF EFFORTS; ROAD DAMAGE UP TO $36 MILLION
The West Virginia counties devastated by last week’s record flooding have begun the
challenging task of opening roads, restoring utilities and cleaning up. The CAWV applauds the
efforts of first responders, West Virginia Division of Highways (WVDOH), West Virginia National
Guard, American Red Cross, and other local, state and national groups helping with the effort.
The flood waters have claimed 23 lives.
The CAWV has provided agencies looking for construction resources and help with recovery
efforts with CAWV member contact information. They can also refer to the CAWV website
where they can search for contractors, materials, equipment, etc., through the CAWV website
under the “Find a Member” – Advanced Search. We encourage CAWV members to visit
www.cawv.org and verify that your company information is correct. Members can sign in to
edit/update the company listing. The CAWV staff can provide you with your log-in info or make

Estimates of damage to state’s roads have doubled in recent days to $36 million. Clay County
has the most road damage so far, estimated to be $8.7 million, followed by Nicholas at $6.7
million, then Kanawha at $5.8 million and Greenbrier at $5.1 million. A number of CAWV
members are already helping with relief and recovery efforts. Agencies are still looking to
contract for equipment and construction resources, therefore members may be contacted. The
WVDOH will be releasing more information in the very near future regarding their emergency
projects and contracting procedures. The CAWV will keep members posted on these

U.S. Sens. Joe Manchin and Shelley Moore Capito announced $5.7 million in U.S. Department
of Transportation funding for road work necessary in the wake of last week’s floods. The money
was made available through the DOT’s Quick Release program to clear federal highways and
perform other emergency work. “Last week’s thunderstorms devastated parts of central and
southeastern West Virginia, destroying and severely damaging many roads, bridges and
highways,” Sen. Capito said in a statement. “For some of the hardest hit areas, these
thoroughfares are essential for residents who need to get to work or travel to receive medical
care.” “I am pleased the Department of Transportation has stepped up to provide much
needed relief to West Virginia as we begin to recover from this devastating flood,” Sen. Manchin
said. “This historic flooding has completely devastated 44 West Virginia counties.”
A number of schools and water and sewer facilities also received extensive damages. Officials
are assessing the situation and future information will be included in future Building and
Municipal Utilities bulletins.
FLOOD RELIEF VOLUNTEERING / DONATING OPPORTUNITIES
A number of members have asked about making flood relief contributions. As flood recovery
efforts continue, the CAWV wanted to remind and update members on ways to help. Volunteers
are needed in the field for a variety of tasks. There are several different groups coordinating
clean-up/reconstruction/donation efforts:


West Virginia Voluntary Organizations Active in Disaster (WVVOAD) – WV VOAD consists of
organizations active in disaster response throughout the state of West Virginia. The VOAD’s role is to
bring organizations together and enable them to understand each other and work together during
times of disaster preparedness, response, relief and recovery. To donate or to volunteer, visit

#WVFLOOD - This website was created by volunteers in West Virginia to help with the relief effort
during the June 2016 flood throughout the state. The site helps to connect the dots between those
donating and those who need to receive the donations. They have created this site as a portal to give
people access to information, events, drop off locations, fundraisers, and relief efforts. Visit

“Rebuild West Virginia” Telethon - Celebrities from music, movies, television and sports will come
together from 7-9 p.m. tonight, July 1, to help raise funds for flood recovery efforts in West Virginia.
The telethon will air on WVVA-TV, WSAZ, WVPB and on other stations statewide, as well as
nationwide. The telethon will also be repeated from 9-11 p.m. on the West Virginia Channel. The live
broadcast will be available from 7-9 p.m. on the MetroNews Channel at www.wvmetronews.com. All
proceeds will go directly to the American Red Cross in West Virginia to help victims and communities
impacted by last week’s floods. During the telethon, viewers will be able to make donations by calling
1-800-273-0511 or by visiting www.rebuildwestvirginia.com. A $10 donation can be made by texting
the word WVFLOODS to 909999.
The CAWV will be also be seeing what the needs are going forward and will keep members
informed. Members can also drop off cleaning supplies and other supplies at the CAWV office at
2114 Kanawha Boulevard, East. Members can donate to their local charities.
CAWV ANNUAL MEETING UPDATE
One of the hardest hit areas of last week’s flooding was Greenbrier County. Numerous roads,
homes and structures were wiped out. Greenbrier County suffered the largest loss of life. The
Greenbrier Resort, site of the CAWV Annual Meeting, was not spared. Greenbrier owner Jim
Justice cancelled the Greenbrier Classic Golf Tournament that was scheduled to begin Monday
due to flooding on the Old White Course. The resort is closed as repairs are being made.
The CAWV Annual Meeting is scheduled for July 14-17. The CAWV has been in constant
contact with the hotel to offer any help the CAWV and its members can provide, and to
determine the status of the association’s annual meeting. In today’s briefing, the CAWV learned
that the hotel will be fully operational July 10, with the exception of golf. It is hoped the
Greenbrier Course will be available. The Old White, Meadows and Snead courses are closed.
The hotel will provide free transportation to guests who wish to play golf at Glade Springs
Resort. Dining facilities, the pool, the casino and other functions will be open and fully
operational, we are told.
There was discussion about rescheduling this year’s Annual Meeting but the CAWV Board
wants to support the thousands of management and service personnel at The Greenbrier who
have provided tremendous service to CAWV members over the years. Members attending the
meeting will receive a mailing Tuesday detailing final plans, activities and an update on the
hotel.
WEBINAR TO BE HELD ON JULY 13 ON NEW RIGHT TO WORK LAW
West Virginia today becomes the 26th right to work state in the nation. Many CAWV members
who are signatory to collective bargaining agreements have asked how this affects their current
and future operations. “The West Virginia Workplace Freedom Act,” S.B. 1, vetoed by Gov.
Tomblin and overridden by the West Virginia House and Senate, states that a person may not
be required, as a condition of employment, to either become or remain a member of a labor
organization, or pay any dues, fees, assessments or other similar charges of any kind or
amount to any labor organization. Most members are aware that the act does not change a
contract currently in place between an employer and a union. Nor does it change an employer’s
obligation to bargain under that contract. The West Virginia Workplace Freedom Act will apply
to any contract that is entered into, modified, renewed or extended after July 1, 2016.
A webinar will be held on Wednesday, July 13, at 10:00 a.m. to address the new bill and to take
questions from CAWV members. The webinar is part of the CAWV/BrickStreet Educational
Series and will be presented by attorneys from Jackson Kelly. The webinar will discuss
employers’ responsibilities under current and future union contracts, employees’ obligation to
pay union dues, hiring hall practices and provisions, dues checkoff authorization and penalties
and remedies for violation. There will also be an active question and answer period to give
CAWV members practical tips for complying with the new act.
Nearly a dozen labor unions in West Virginia filed an injunction and lawsuit Monday to halt the
state's right-to-work law from going into effect today. The labor unions argue the law is
unconstitutional because it takes property away without due process. The lawsuit argues
The Workplace Freedom Act hinders union membership by enabling nonmembers to receive
union benefits and services at no cost. Proponents of S.B. 1 say West Virginia’s law is based
on Indiana’s law. The courts upheld that state’s right to work legislation.

HAPPY FOURTH OF JULY!
Last week’s devastating floods in West Virginia have brought out the best part of West Virginia;
her people. From the first responders who rescued people to the thousands of volunteers who
have since pitched in, West Virginians are helping their friends, neighbors and strangers
recover. Local, state and federal government agencies, along with numerous charitable
organizations, have marshaled a remarkable range of resources to help victims. CAWV
members have been hard at work this week repairing flood damaged roads, water and sewer
systems and other facilities and with volunteering with their time and resources. The CAWV
commends all for their dedication and service and wishes everyone a happy Fourth of July. The
CAWV office will be closed Monday, July 4th in observance of Independence Day.

WV SCHOOL BUILDING AUTHORITY AWARDS FUNDS FOR IMPROVEMENT PROJECTS
The West Virginia School Building Authority's board recently awarded $7.7 million to 13 school
systems for improvement projects. The board provided funding for projects in Barbour,
Berkeley, Cabell, Fayette, Grant, Mason, Mercer, Monongalia, Nicholas, Putnam, Randolph,
Ritchie and Tyler counties. One of the projects includes a $1 million fund for Fayette County to
build a six-classroom addition to Midland Trail High School that will then allow for the closure of
Ansted Middle School. The board denied funding to Kanawha, Gilmer, Lincoln and Summers
counties. The counties made requests ranging from $875,000 to $1 million. SBA officials also
announced that it is at the ready with some $4.6 million in emergency funds to help schools
affected by the recent flooding in West Virginia. However, it was stated that before any school
system applies for funds from that emergency fund, they must show they have exhausted all
other funding routes: FEMA, flood insurance, local funding. The school systems have 30 days to
notify the SBA they plan to apply for emergency funds.
UPSHUR COUNTY COURTHOUSE CHIMNEY REPAIR, BUCKHANNON
Bids will be accepted until 9:00 AM on 7/21/2016 for Upshur County Courthouse chimney
repairs, Buckhannon, West Virginia. A mandatory pre-bid conference will be held at 3:00 PM
on 7/7/2016 at 40 West Main Street, Buckhannon, WV 26201. Bids will be received at the office
of the Upshur County Commission, Carrie L. Wallace, County Administrator, 38 West Main

Lightning Awareness Week
Policy for Outdoor Work Sites

While June 21 is the official start of Summer, June 22 is the official start of Lightning Awareness Week.
According to the National Weather Service, there were 26 fatalities in 2014 resulting from lightning strikes
in 14 states. Workers account for about one-third of the total number of people struck by lightning;
roofers, construction workers, road crews, pipe fitters and farm workers are especially at high risk.
Lightning typically strikes tall objects, including people standing on open ground or a roof. Work sites
should have a plan in place to keep workers safe in case of a lightning storm.
•
Monitor weather conditions in the early morning hours for reports of impending severe weather in
your area. If warranted, continue to monitor weather conditions throughout the day. An
inexpensive portable weather radio can provide timely storm data from local weather forecasts.
•
All employees should understand what lightning safety plans are in place, which includes what
shelters are available to them at that particular work site.(SEE BELOW)
•
It’s easy to determine when to take shelter. If you hear thunder, the associated lightning is within
8 miles. Suspend activities, allowing sufficient time to get to shelter. A good lightning safety motto
is: “If you can see it (lightning), flee it; if you can hear it (thunder), clear it.”
•
If you feel your hair standing on end, and/or hear “crackling noises,” you are in the lightning
electrical field. If caught outside during a lightning storm, immediately remove all metal objects
(including hats), place your feet together, duck your head, and crouch down low in baseball
catcher’s stance with hands covering your ears.
•
Wait a minimum of 30 minutes from the last observed lightning or thunder before
resuming normal work activities. Be extra cautious during this phase, as the storm may not be
over.
•
If someone has been struck by lightning, get emergency help promptly and apply first aid. It is a
myth that lightning victims carry a charge after the strike—they are safe to handle and may need
first aid immediately.

JOINT UTILITY COMMITTEE RECEIVES FUNDING UPDATES, DISCUSSES INDUSTRY
ISSUES
The CAWV Joint Utility Committee met on Wednesday, June 29, to discuss several industry
issues and receive updates from funding agencies. A report supplied by Jim Ellars, Executive
Director, West Virginia Infrastructure and Jobs Development Council (WVIJDC), showed that
the agency has $54,969,465 currently committed to 27 projects. It was also noted that the
legislature took half, or $20 million, from last year’s funding and an additional $10 million from
this year’s funding to help balance the budget.
Kathy Emery, WV Department of Environmental Protection, reported that the WVDEP has
several projects expected to bid in the near future. Mrs. Emery also reported that most of the
Chesapeake Bay Projects are finished the WVDEP’s funding has returned to a normal cycle.
Mrs. Emery also asked if any contractors have pumps or other emergency equipment that they
would be willing to loan a local PSD affected by the flood to call her office at (304) 926-0499.
Bob Decrease, Unit Manager for the Bureau for Public Health, reported that his office has
several projects coming up that have dollars already committed. Mr. Decrease noted that they
have committed all their available funding for 2016-2017 but are still looking for a few for 2018.
Harry Taylor P.E., United States Department of Agriculture (USDA), reported that all of USDA’s
available funds have been committed for this fiscal year. He added that grant money is very
competitive and if a project is asking for a one million dollar grant they should be asking for a
four to five million dollar loan in addition. He noted that interest rates on the loans are very low.
He also noted that his year starts on October 1 for new funding but most of that money is
allocated to projects already.
Several other industry issues were discussed at the meeting, including a recent decision by the
WVDOH Traffic Engineering Division to stop locating its own underground utilities on WVDOH
right-of-ways. Committee members noted that this will have an impact on project costs and a
task force will continue to look for a solution for the issue.
Kelly Workman, West Virginia Development Office, reported that several projects that have
received Small City Block Grants as part of their funding package should be going to bid soon.
She noted that even though the West Virginia Prevailing Wage has been repealed, any project
that has funding from Small City Block Grants would fall under the federal Davis-Bacon Wage
Act.
The next meeting of the Joint Utilities Committee will be scheduled at a later date. Look for

FLOODS DAMAGES MANY UTILITY TREATMENT FACILITIES
On Friday, officials with the West Virginia Department of Environmental Protection’s Division of
Water and Waste Management were continuing to evaluate flood effects on wastewater
treatment plants and collection systems with county and other local officials. “There’s a lot more
in the floodwaters than just sediment,” said Kathy Emery, program manager for the DEP’s Clean

WVDOH REVENUES DOWN $51.5 MILLION OVER PREVIOUS YEAR
Revenues for the WV Division of Highways continue to decline as the department ended its
Fiscal Year 2016 on June 30, 2016 with total revenues of $691.5 million. This is $11.4 million
under the Governor’s FY2016 estimate. More disturbing is that this year’s actual revenue is
$51.5 million under 2015 actual revenues of $743 million.
Compared to FY 2015, actual Motor Fuel tax collection was down $38.5 million. Motor Fuel
collection projections for 2016 were conservative but this year’s actual collections were $23.4
million, or 5.57 percent under the Governor’s estimate. Registration Fees were below the
Governor’s estimate and last year’s actual collections. Registration Fees totaled $87 million this
year compared to $100.6 million last year, or $13.6 million less. The Privilege Tax on vehicle
sales were 9 percent above estimates but only $221 above last year’s revenues. Registration
Fees were $13.6 million under FY 2015 collections of $97.3 million.
A major reason for the $38.5 million decline in Motor Fuel collection is the declining price of
gasoline. The state’s wholesale gas tax, which is based on the wholesale price of gas, dropped
1.1 cents per gallon in 2015 and another 1.4 cents per gallon in 2016. Each cent of the
wholesale tax generates about $15 million. At the current price of gas, the wholesale tax could
drop another 1 cent in 2017. S.B. 555, passed this year by the Senate and defeated in the
House of Delegates, would have restored the revenue lost from the wholesale gas tax drop.
The total revenue created by S.B. 555 would have been about $315 million annually.
Revenues to the WVDOH have been stagnant for a number of years. This year there is a
significant reduction in actual dollars to the Road Fund.

WVDOH’S RAPID RESPONSE TO FLOOD RAVAGED INFRASTRUCTURE; ASSESSING
FUTURE REPAIR PROJECTS
The WVDOH realized last week that they had many challenges facing them as they surveyed flood
damage in various counties. They rapidly went to work remediating the damage. The WVDOH
evoked emergency contracting procedures and selected contractors to immediately begin work on a
handful of projects in Districts One and Nine utilizing force account provisions. Contractors quickly
mobilized to begin the process of opening and rebuilding roads and bridges that, in most cases,
were completely washed away.
The next phase of restoring roadway infrastructure will reportedly revolve around use of
construction contracts (BidX) that will utilize expedited bidding procedures for both federal aid and
state funded projects. The WVDOH has identified at least $36 million in roadway damage, a
number that will likely be expanded. Many of the products are expected to be eligible for
reimbursement by FHWA and FEMA.
