The Secret of Success is not to be a Secret

April Launch for High Energy
The record-breaking Bournemouth Air Festival was sensationally
launched recently at the Odeon cinema, in Bournemouth. Attended by
local business people and with members of the Royal Navy and the
Royal Air Force, the launch was the exclusive chance for guests to find
out what can be expected at this summer’s most anticipated event.
From 19th-22nd August, holiday makers, residents and day visitors
will be encouraged to stay longer and see more of the UK’s leading
resort – with more great aircraft planned, new additions to the Night Air
evening programme and increased support from the Armed Forces.
Ready to demonstrate their capabilities both out at sea and onshore,
the Royal Navy is set to be bigger and better. Royal Marine Reserve and
Royal Marine Commando Display Team will be mounting an amphibious
assault on the beach, RFA Largs Bay and HMS Bangor (open to visitors)
will be in the bay and onshore at the Royal Navy village, there will be
more kit, more activity, more music and more people.
In the skies the Royal Navy Black Cat Helicopter Team, lead by the
first female leader Lt Becky Frater, will be impressing the crowds.
The much anticipated Red Arrows will be making three displays at the
provisional times of 4.30pm on Friday, 12noon on Saturday and 4pm
Sunday. The world-renowned team, this year with their first female pilot
Flt Lt Kirsty Moore, will be joined in the display programme by the heart
pounding Eurofighter Typhoon, Battle of Britain Memorial Flight which
this year celebrates its 70th anniversary, Hawk jet, Tucano and Tutor all
ready to take to the skies.
Air Festival Director Jon Weaver said, ‘Last year we were bigger and
better, but 2010 will see so much more happening to the festival itself
– from greater military support to the technological advances and the
new patrons scheme launched to get business involved and supporting
the Festival. We are certainly taking the UK’s biggest free aviation
event to new levels of interaction and visitor experience.’

Bournemouth
Airport’s passengers can now get into holiday
mode as soon as they walk through the new
look departures terminal.
The terminal redevelopment has seen the
size of the departures building double in size,
and the amount of catering and retail space
tripled. Passengers can now enjoy shopping in
the World Duty Free area where they can buy
anything from perfumes, wines and spirits to
handbags and sunglasses. Three new catering
outlets have been incorporated into the new
terminal – Joe’s Coffee House, The Olive Tree
restaurant and an Estpresso coffee bar. The
brands have been carefully selected to offer
passengers the widest possible choice of food
and drinks, at any time of the day.
To coincide with the changes at the Airport,
two major airlines have decided to start
operating from Bournemouth this summer:
bmi baby (flying three times
a week to Jersey) and Flybe
(flying six times a week to
Manchester). In addition,
Thomson/First Choice will be
replacing the existing aircraft
that they have based at
Bournemouth with a brand
new, larger aircraft, and
Ryanair will be basing two
aircraft at the Airport this summer.
It means that the choice of destinations
from Bournemouth is rapidly expanding.
Passengers can now fly to over 45
destinations throughout Europe as well as
Turkey, Egypt and North Africa.
‘It’s wonderful to see the airport of
the future now starting to take shape,’
commented Managing Director, Rob
Goldsmith. ‘The recession has obviously had
an effect on passenger numbers over the past
year, but it’s a great sign of confidence that our
owners, the Manchester Airports Group, are
looking to the future and are fully committed to
developing Bournemouth Airport.’

HMRC Headache for Companies
New premises, a bigger team,
more business and award
nominations – it’s all been
happening for Wallis Agency in
the last year.
Buoyed by acquiring new work,
the Dorchester-based design and
communications company moved
into a larger studio last July. In
September and January they
made appointments to freshen
up the team and were nominated
for the Open4Business awards in
October.
This year has seen them
design large format collateral for
an events marketing company
at Mobile World Congress in
Barcelona. They’ve also created
a logo and marketing material
for the Dorset County Hospital
Charity while consolidating work
for local clients like Kingston
Maurward College and national
enterprises like the Denholm
group.
‘We’re celebrating a busy year,’
says new Business Manager Nick
Morris, ‘and we’re really looking
forward to meeting new people
and making new relationships in
the coming months.’

HM Revenue & Customs (HMRC) will require all companies to change
the way they file their Corporation Tax Returns and Financial Accounts
online.
For accounting periods ending after 31st March 2010, HMRC will
only accept corporation tax returns and company accounts in the new
eXtensible Business Reporting Language (XBRL) format. HMRC has
already stated that anything filed in a non XRBL format will be rejected.
Many large companies produce their own financial statements in
Microsoft Excel or Word formats. The change will certainly cause
concern where companies need to maintain control over their own
reporting.
Companies are now questioning the use of XBRL when they approach
the preparation of accounts for tax purposes as they need to know that
they can produce them in an acceptable format.
To be ready for this change call Ian Rodd on 01202 875900.
Its Beach Hut inspired stand at International Confex really made
Bournemouth stand out this year, and meant it won Best Stand in the
UK venues and destinations section.
The stand is based on a tongue in cheek beach hut theme that ties
in with Bournemouth’s marketing campaign for this year; it plays on
the idea that rather than using a beach hut, ‘there’s an easier way to
have your meeting by the beach’, be it at the BIC or one of the many
other suitable hotels or venues in Bournemouth, facilitated by the
Bournemouth International Conference Bureau.
Clive Tyers, Head of Conferences, Exhibitions and Events at the BIC
said, ‘We know how great Bournemouth is as a destination for business
visitors and we wanted to get this message across in a fun way – we
had real lemonade and New Forest Ice Cream to enjoy with clients new
and old.’
It is the third time that the BIC has won this particular award, having
won it in 2008 and 2005, as well as winning Best Stand in Show
in 2005 with a construction inspired theme based on the £22m
redevelopment that the BIC was undergoing at the time.

Students are greeted with an infectious enthusiasm whilst

commented, ‘Tasty Marketing’s open minded approach allows them

Money Talks
A recent survey commissioned by Tate revealed that the majority of
people looking for a job would leave their current employer if offered
more money. Unfortunately for those motivated by money, the Office
for National Statistics shows that the average weekly earnings growth
including bonuses was unchanged from 0.8% up until December 2009,
so gaining salary increases would be minimal.
The survey examined other motivators and the results, ranked
in order of importance, were threat of redundancy (13%), career
progression (11%), location (9%) and benefit packages (0.5%).

to provide a new state-of-theart operating theatre and
administrative facilities.
The contract includes
alterations to the existing hospital
building on Victoria Road.
Midas has also been carrying
out enabling works, which has
involved relocating services and
staff within the site.
A remarkable £2.7m – 90%
of the overall cost – has been
raised by the ‘Friends of Victoria
Hospital’ for the project. To mark
the start of construction, June
L-r: June Tripp with Dr David Pope,
Tripp, Chairman of the ‘Friends’,
President and Trustee at The
took the controls of an excavator Friends of Wimborne Hospital
to begin the demolition works.
The need to rebuild the operating theatre has been prompted by
innovations in surgery, particularly the introduction of less invasive
operations requiring shorter hospital stays. These demand not only
different facilities, but also more space for equipment and for patients
to recover following surgery.
The team involved in the construction project includes Qurorum
Partnership, architects; McPhersons, surveyors; Aspley Associates,
engineers and Houghton Greenlees, mechanical & engineering
consultants.
The Drewitt Group
Celebrates Building in
Bournemouth for 100 Years!
The building maintenance and electrical services group, has
discovered in its archive that the Drewitt family originally
moved to Bournemouth in 1910.
Gillian Drewitt, Managing Director said, ‘I was researching some
information on another matter and came across some documents that
showed James Drewitt moved to the town from New Malden in Surrey
in 1910. It occurred to me that this was a coincidence with the Borough
of Bournemouth celebrating its bicentenary.’
James Drewitt came to Bournemouth, which was at the time fast
developing into a premier resort, to earn a better living for his family.
They moved to the Southbourne area of the town and the business
flourished from house building to commercial contracts and major civil
engineering projects.
In 1957 the
company, now
James Drewitt & Son
Ltd, moved to new
purpose built offices
at 865, Ringwood
Road where the
group’s offices still
are today.

The Drewitt Group
April 2010
How times have changed… In 1910 a horse and cart stood
outside James Drewitt’s yard in Pokesdown compared to the
group’s offices and works today.
The Drewitt name is synonymous with many of Bournemouth’s
landmark buildings such as the Pier Theatre and Beales, department
store. However, like the town the company has undergone many
changes since 1910.
The Drewitt Group, which can trace its trading history back to
1877, has now developed into a commercial building maintenance
organisation, which can offer occupiers a complete resource for all
their facilities management needs through group companies, Drewsons
Building Maintenance and Drewlec Electrical Services.
Richard Drewitt, Operations Director, says, ‘The Drewitt Group
can offer commercial occupiers, their architects, building surveyors
or facilities managers, a comprehensive service whether it be
for additional electrical sockets in a factory or a full re-wire to a
refurbishment of an office, and decorations & repairs under a schedule
of dilapidations. A 24 hour emergency call out service is also available
to our clients.’
Drewlec also offers expertise in the installation and servicing of
fire alarm and emergency lighting systems. The firm is an appointed
specialist for Autronica Fire Alarms.
2010 sees the launch of the new Drewitt Group website.

Filing VAT Returns Online
Poole-based tax and accountancy adviser Martin Tapley
gives advice on financial matters to small businesses.
Q I recently received a letter from HM Revenue & Customs
informing me that I am now required to submit my VAT returns
online. Can you explain further?
A From the 1st April 2010 all business with an annual turnover of
£100,000 (excluding VAT) and any newly VAT registered business
will be required to submit their VAT returns online, and pay any VAT
electronically.
The online VAT Return is very similar to the paper version and there
has been no change to the rules on how you complete your return
or how you calculate VAT. Also, you won’t have to change your
existing record keeping system - you can still keep your records on
paper if you prefer.
Any business which is required to file online must sign up to the VAT
online service through the HMRC website. Signing up to do your
VAT online is straightforward and you don’t have to be a computer
expert. The service is designed to make the process easier, more
secure and more efficient for small businesses.
Further advantages of using the VAT online service system include
setting up an email reminder service to advise when your next online
VAT Return is due. Another benefit as you are required to make
payments electronically either through Direct Debit, internet banking,
telephone banking, is that you receive a further seven extra calendar
days (in addition to the usual one month deadline) to file your return
and for the payment to reach the HMRC bank account.
If you are concerned about any aspect of this new requirement,
please contact your local TaxAssist Accountant, who can assist with
submission of your VAT returns online.

managing tax and accountancy affairs for small business owners.

Mark Liddle
RSM Tenon
Whatever your political persuasion, it’s ‘the
economy’ which is going to be the big issue
for the electorate.
The Conservative party recently announced
that, should they be elected to Government,
they would pass legislation increasing the level by which a creditor can
issue a winding up and/or bankruptcy petition from £750 to £2,000. Presumably the thought behind such a proposal is, that by increasing the
petitioning level there will be fewer creditors who can issue petitions and
therefore, fewer businesses and/or individuals who shall subsequently be
declared insolvent.
Perhaps somewhat surprisingly, despite suffering from inflation, the
petitioning level has remained at £750 for a number of years. A change
in the petitioning level is perhaps well overdue.
However, the Insolvency Service recently reviewed the number of
winding up and bankruptcy petitions which had been issued.
They found that the proposed change mentioned above would actually
only effect 3% of all such petitions issued. Accordingly whilst a change
in the petitioning level is a move in the right direction, it perhaps doesn’t have the impact which had been hoped for.
One of a number of measures implemented by the current Government
has been to allow businesses and individuals to enter into ‘time to pay’
arrangements with HM Revenue & Customs with regard to outstanding
PAYE/NIC, VAT and corporation tax. According to figures recently released
by HMRC, over 303,000 time to pay arrangements have been agreed since
the launch of the scheme with a total value of £5.2 billion. Approximately
£4 billion has been repaid to date leaving around £1.16 billion outstanding,
which is under repayment schedules by participants in the scheme.
Furthermore, 60% of time to pay arrangements are for a period of 3
months or less, and over 90% of the arrangements are adhered to.
The current Government and HMRC in particular, have therefore played
a huge part in ensuring that a large number of local businesses will
survive during this recession.
Whoever wins the election has clearly got a difficult job to do – I just
hope their policies are good for the local economy.

Insure4Retirement
n the one hand, the recession has shocked many with its
catastrophic effects on well known and long established
companies, but, it has also highlighted companies that have
quietly kept chipping away and who are now in a position
to celebrate their success through these difficult financial
times. Nestled in the heart of Bournemouth is one such
company, Insure4Retirement – it is perhaps one of Dorset’s
best kept secrets…until now!
Insure4Retirement (the trading name of Insurance Dialogue Ltd)
specialises in providing insurance for the over 50s and it is a company
to watch out for in 2010.
Recruitment drive 2010
Based in Heron House, Christchurch Road, Bournemouth, 50’s
Insure4Retirement has announced plans for expansion and has
commenced a major recruitment drive to increase its head count by at
least 25%, which equates to nearly 80 new positions being created in
the next 10 months.
Insure4Retirement was founded in 2004 and has become one of the
fastest growing local businesses in Dorset. David Holden, Managing
Director of the insurance company explains, ‘With a growing population
of people in the UK living longer our business is stronger than ever
because we can offer high quality insurance to the over 50s at low
cost rates. As a result of our competitive prices and excellent customer
service, we have managed to rise above many of the problems
associated with the recession, and our growth recently has been
amazing.’
Insure4Retirement is majority owned by Equity Insurance Holdings
and its ultimate parent company Insurance Australia Group (IAG), a
very large Australian insurance group. IAG’s businesses underwrite
around $7.8 bn of premium per annum and employ around 15,000
around the globe. At the Insure4Retirement office nearly 200 people
are working in inbound and outbound telemarketing alone which is
then further supported by IT, marketing and business support staff.
Insure4Retirement prides itself on its retention of staff.
Kelli Crockard, Insure4Retirements HR and Development Manager
believes that the secret of their success lies in the fact the company’s
ethos is to nurture, train and support its staff, leading to a fulfilling
and rewarding career. This investment in people provides excellent
prospects for employees many of whom are internally promoted. ‘We
look for dedicated people who want to be part of our team, people
who want a career rather than just a job. The reward for staff loyalty
includes attractive benefits, such as competitive salaries, an uncapped
bonus scheme and up to 25 days annual holiday.’
On a day to day level, Kelli explains, ‘We believe that a friendly, happy
working environment is important to maintain within the company,
as a result, Insure4retirement pay attention to the suggestions
and voices of their employees. We are proud to say that we are an
equal opportunities employer and a family friendly one too! With our
“Listening Lunches” the company tries to reward, implement and
improve policies for the better, such as our recent “On Yer Bike” green
bicycle purchase initiative.’

David Holden, Managing Director of Insure 4 Retirement
Encouraging staff to cycle to work
Insure4Retirement has recently launched a scheme to help fulfil its
Corporate Social Responsibility – with resounding success.
The ‘On Yer Bike’ scheme was the brain child of a member of staff
at the company’s head office in Bournemouth. The scheme is about
encouraging more staff based in Lansdowne to cycle to work.
Not only is the scheme about saving the environment and leading
a healthier lifestyle, it’s also about saving money for staff working in
Bournemouth; with parking fees and the cost of petrol forever rising,
this really is a scheme that benefits all concerned.
Kelli Crockard, Insure4Retirements HR and Development Manager
explains how the scheme works, ‘It’s very simple really; the member
of staff can go to ‘On Yer Bike’ shop in Charminster, select the
bike that they would like and pay a very small holding deposit
themselves, and we will pay the rest (up to £500) as a loan which
the employee then pays off over the next three months from their
monthly salary*.’
Kelli goes on to say, ‘We thought it was a great idea, and jumped
at the chance when we first heard about it. We always encourage
our staff to come up with new ideas that we can implement here at
Insure4Retirement, and this is just one of the many successful ones
we’ve recently implemented.’
It is vital that large employers such as Insure4Retirement are
fulfilling their Corporate Social Responsibility, promoting green
initiatives and engaging with the local community – all of which
Insure4Retirement is working towards.
Kelli adds, ‘The “On Yer Bike” scheme has had over 70% of our
work force show an interest in the scheme, with a lot of those taking
it further and ‘peddling’ their way to a healthier lifestyle as well as
a pocket full of savings – and we’re happy to help and encourage
that.’
David Holden, Managing Director of Insure4Retirement says,
‘We love hearing from the staff, and always listen to their thoughts
and ideas – and we reward it as much as possible. We work hard
to develop our activities as a responsible employer and local
company. It’s great to see staff come up with their own ideas on
how to continually improve our green credentials – as well as saving
themselves money.’

Named after Spitfire Designer
Southampton Airport has marked the 74th anniversary of the first flight of
the Spitfire with the completion of a new airport restaurant. In recognition
of the airport’s famous aviation history, the restaurant has been aptly
named ‘Mitchell’s Bar & Kitchen’ after the local aircraft designer who built
and test flew the legendary Spitfire aircraft. The prototype aircraft took its
first test flight from Southampton Airport on 5th March 1936, and by the
end of WWII over 22,000 Spitfires had been produced, demonstrating the
crucial role of the Eastleigh airfield during the war.
The brasserie-style restaurant provides a fresh new feel with bespoke menus
from all-day breakfasts to hearty comfort food to light tapas style dishes.
It has been specifically designed with the time-conscious traveller in mind,
meaning the dishes are created and delivered in under 10 minutes, using
the freshest ingredients. Mitchell’s also has a full bar including a range of
continental beers, wines and premium spirits.
Next to Mitchell’s is a brand new Costa Coffee, providing a large area for
passengers to sit and relax with comfy sofas and soft seating.
The restaurant is the first project to be completed as part of the £7m
investment programme throughout this year. The improvements will
continue in 2010, with a second new restaurant opening in the departure
lounge this summer.

Set out the ground rules
From the outset, agree a plan for what you expect from your
relationship with your chosen advisers. This should include the
services you want (and what you don’t want) and the fees in respect
of these. You should expect to sign a letter of engagement which
formalises this agreement.
Review the basics
Have your advisers review the structure of your business and

Does your accounting system provide you with relevant and timely

you can answer yes to each of these, great, but if not your advisers

which will help you to make better business decisions.

Don’t Care About IT Reuse
While the ‘reduce, reuse, recycle’ mantra is becoming second nature in our everyday lives both at home and at work, more
than 90% of IT decision-makers don’t appear to care whether their computers could be used again once their organisation has
finished with them.
Companies may be complying with the EU’s Waste Electrical and Electronic Equipment (WEEE) Directive, which demands the amount of
IT waste sent to landfill is reduced, but research conducted by IT refurbisher Remploy e-cycle reveals this is more likely to be from recycling
component parts rather than from ensuring computers are able to be used again.
Asked what their considerations were when disposing of their old IT, only 8% said they were concerned about making sure computers could be
put to a positive use by someone else where as nearly three quarters (73%) claimed to recycle old equipment.
Remploy e-cycle commissioned the study for the launch of its new Re-use IT campaign which aims to reduce the levels of IT waste being sent
to landfill by encouraging the re-use of otherwise redundant equipment once all pre-existing data has been securely erased.

Social Media Seminar

The
With communication via the internet and the onset of social media
as an important way to communicate with your clients, the time for
positioning your business for the ongoing developments taking place
online has never been so important.
The way we use the internet has changed considerably and whereas
years ago, your website was almost an online brochure for the services
you provided, these days it has to be so much more and allow a
more fluid, two way process of communicating for both you and your
prospects.
People spend a great deal of time on their computers and effectively
this has resulted in a cultural shift as we are now communicating
not only by e-mail, but with things like LinkedIn, Facebook, Twitter
and blogs. Gaining the right tools to apply the right social media to
your business and making sure you have a website that fits with the
way we use the internet today, is going to be crucial for businesses,
both as survival and as a way to differentiate themselves from their
competition.
Steve Harrington of Bournemouth-based social media and web
solutions company Webmatters, is now holding two events to educate,
promote and allow attendees to actually learn something about social
media and how it can work for their business.
Webmatters is offering a social media and LinkedIn seminar in
Central Bournemouth at the end of April and will also follow the
seminar up with a live Facebook broadcast.
Steve says, ‘We want to be able to share with people the benefits of
social media and not treat the information like a big secret. We know
we can help businesses by showing them the kind of websites they
need as well as the social media applications that will apply to them in
growing their prospects as well as allowing them to stand out against
their competitors.’

Child Safety Goes Mobile
Mobile telecommunications firm aql along with specialist child safety

The product will be launched under several partner brands. Parents

Voice Over IP (VoIP) –
Low Cost and Great Features
Working with HSC is
Child’s Play
C
ompared to conventional telephone systems, there are two
major areas where VoIP has a huge advantage – cost and
features.
This year’s entry takes the values
of HSC and highlights its ease of
working with each customer, and
its straightforward, open approach
to create an almost childlike
presentation.
ID Group helped to produce the
HSC 2010 Annual, ‘top trump’ cards
and a ‘play’ box to contain all of the
entry materials.
Whether youth represents Eagle
Annuals or Pokemon cards, we all
love a bit of nostalgia.

Delivery Message
Small and medium-sized businesses who
send their products to home addresses
can now look forward to a better delivery
service thanks to a one hour time slot from
parcel carrier Interlink Express.
The new service means an end to
customers waiting at home for a courier
to arrive, because Interlink Express will
now send recipients an SMS text message
or e-mail giving them a precise one hour
delivery window in which to expect their
parcel.
Interlink Express is the first parcel
company to offer this service which is
designed to make home delivery easier than ever for online retailers.

Businesses are lured to the
technology not only by the
competitive call plans but by the
additional benefit of call features
which have previously cost
thousands of pounds.
Traditionally, the ability
to forward calls to multiple
locations within a business
required a PBX box which
needed to be wired into
the office’s phone system,
maintained and periodically
replaced.
With VoIP the ability to set
up multiple extensions, direct
dial numbers and conference in
several employees and clients can
be provided for very little cost.
By changing to VoIP businesses
of all sizes can change the way
they portray themselves to the
outside world.

the trickery used by some existing suppliers to prevent your new

where providers take over your lines/calls without your express

enter a contract with anyone.
My argument is that if the product, service and price are right
continuously, the customer should not need to be tied to a contract

Check that suppliers are financially
healthy and your business has an alternative source of supply
if required (a right to terminate contracts immediately or source

extended if the solvency of a supplier is in question, to ensure that
goods or services are not paid for too early. Check whether provisions
within supply agreements protect the company if the supplier fails and
that any exclusivity provisions are reviewed and amended accordingly.
If a supplier fails, a business may not be able to meet the demands of
its customers and many force majeure clauses will not offer protection
in this instance.

Delivering smart
business solutions
important for a company to ensure that it has rights of access to key
assets and to their continued use. Companies should consider making
the creation of any adverse interests over key assets subject to its
consent. Where there is an exclusivity arrangement this should be
reviewed if there is a possibility that the provider of the asset could be
in financial difficulty.
Price cuts:
Businesses may be tempted to sell off assets at an undervalue in
order to free up much needed cash. However, the Insolvency Act 1986
should be considered, as a transfer at an undervalue may be set aside
if the seller of the asset was insolvent at the time or became insolvent
as a result. The impact of this is that the assets may have to be
returned, or the price made up. Caution is advised in such price cutting
circumstances and advice should be sought.
Customers in financial difficulty:
Customers may be unable to pay due to their own financial difficulties
and companies should adjust payment terms so that payment is made
in advance. Companies should also consider taking security over
monies/ assets and obtaining guarantees from third parties or letters
of credit.
It is advisable to increase due diligence checks prior to entering into
contracts.
Exclusivity should be looked at if the company is tied to one customer.
The business should look to protect itself by engaging with new
customers if it is possible that its existing customer is in financial
jeopardy. Such exclusivity provisions should be amended to ensure that
exclusivity terminates well in advance of the termination of the contract
if there are certain specified ‘events’, namely where the customer runs
into financial difficulty or fails to make payment.
Insurance:
Insurance should be considered carefully and companies should make
sure that they are covered appropriately for their type of business.

It has been widely publicised that the Companies Act 2006 formalised
directors’ duties and directors should seek advice in relation to their
duties if they are unsure of their responsibilities, especially given the
economic climate.
Wrongful trading:
Directors should ensure that if a company’s financial situation
deteriorates, they have taken steps to minimise the potential loss to
the creditors of the company. If the director does not do this they could
be held financially responsible to contribute to the company’s assets if
the company goes into insolvent liquidation.
In summary, Katie stresses that awareness of possible pitfalls within
our business and legal environment and being able to react quickly and
efficiently will assist businesses in the economic climate that we find
ourselves in.

Variation Clauses in
Contracts of Employment
Frettens Solicitors specialist employment team advises local employers
that it may now be possible to unilaterally vary terms in an employment
contract, including rates of pay and hours of work.
A recent case in the Employment Appeal Tribunal (EAT), Bateman
v Asda Stores, confirmed that an employer is permitted to make
unilateral changes to contractual terms in line with the business needs,
without the express consent of employees. The changes must be
properly implemented and the employer must maintain their implied
duty to maintain trust and confidence.
In the EAT, Asda were thought to have acted properly in harmonising
the terms and conditions of employment for a small proportion of
staff that refused to agree to a new pay structure. Asda had carried
out extensive consultation and most staff had voluntarily moved on to
the new pay scheme. A provision in the staff handbook allowed Asda
to ‘review, revise, amend or replace’ the contents of the handbook,
some of which were contractual, and
introduce new policies ‘to reflect the
changing needs of the business’.
Partner and Head of the Frettens
Employment Team, Kate Fretten,
comments, ‘This is a useful
decision for employers because if a
variation clause is carried out in a
reasonable manner, ideally with as
much consultation as possible, then
the change will be lawful, even if
employees do not expressly consent
to it. It is vital to take advice from an
experienced solicitor to ensure that
Kate Fretten
the variation clause is drafted clearly
and unambiguously, so that problems can be avoided.’

Companies are being
advised to ‘spring clean’
their sickness procedures
Lesley Walford
in readiness for the arrival
of ‘fit notes’ next month. The new electronic notes
replace the traditional sick notes from doctors and
become effective from 6th April.
In the past, GP sick notes confirmed that an
employee was unfit to work. Fit notes will shift the
emphasis from sickness to fitness, allowing doctors
to indicate whether an employee is capable of doing
some work.
The hope is that more people will stay in work,
rather than drift into long-term sickness. Currently
more than 2.6 million people are on incapacity
benefit with sick leave and absence costing the
economy an estimated £100bn a year.
Lesley Walford, an Employment Solicitor with
Dorset and New Forest law firm Ellis Jones Solicitors,
said the new fit notes will allow doctors to suggest
various options.
These could include a phased return to work,
altered hours, amended duties, workplace
adaptations or another option.
‘There will be no option for a doctor to certify a
patient as fit for work. This is because doctors do not
have the necessary knowledge about an individual’s
job role to be able to assess this,’ explained Lesley.
‘The onus will be very much on the employer
to make a decision as to whether they can
accommodate any changes to facilitate a return to
work.
‘The present system is clear cut whereas the
new fit notes will enable an employer to consider
adjustments to secure the employee’s return sooner,
rather than later. This will be a “win-win” situation for
employer and employee alike.’
However, Lesley warned that employers who fail
to take action as a result of suggestions made by
an employee’s doctor could find it more difficult to
defend disability discrimination claims.
They could also face problems if ‘reasonable
adjustments’ were not adopted to enable the
employee to return to work.
Lesley said, ‘My advice to employers is to give your
sickness procedures a good spring clean to ensure
you’re ready for the arrival of fit notes.’
Her recommendations include:
b Employers should take the initiative when it
comes to managing sickness absence and ensure
good communication with sick employees.
b Have a clear sickness policy, backed up by line
manager training.
b If necessary, refer the matter to an independent
specialist, especially if dismissal is a possibility.

The
Business owners could land themselves in hot water by putting
employees on garden leave. Garden leave is routinely used by
companies as a way of keeping staff who are leaving a job – through
choice or otherwise – away from work during their notice period.
This paid absence is used to ensure staff are not aware of
commercially sensitive information which could be shared with a
potential new employer. But practices could face action for sending
employees on garden leave if their employment contracts do not
include guidance on this.
Mark Briegal, head of Ralli Partnership Law, said this breach of
contract could have disastrous results.
He added, ‘It is commonplace in businesses for departing staff to be
put on garden leave but often employers act in haste, without checking
out the employment law issues they could be facing.
‘Garden leave provisions must be written into partnership or LLP
agreements to ensure businesses are protected from future actions.
Putting a partner or member on garden leave without precautions in
place is unlawful exclusion and can result in anything from a damages
claim to a winding-up order.’
Briegal said extreme conclusions can be avoided if employers check
their contracts from the outset.
He added, ‘Garden leave is only an option if the employment contract
makes reference to it. We have already worked on cases where a
departing member has contested garden leave because it was not
referred to in his contract.
‘Employers need to ensure they have relevant and accurately drafted
clauses to cover all eventualities. In times of economic uncertainty,
making sure your partnership agreements are watertight can save a lot
of legal and financial heartache in the long term.’

Global Refurbishes Expanding Studio
Designed for Politics
Bournemouth-based creative marketing agency, CuCo, has been
awarded a prestigious political contract to develop, design and market
a web-based information tool that aims to encourage debate on the
political and economical issues relating to a hung parliament. In
addition, CuCo is also carrying out all marketing tactics, both on and
offline, to promote Charter 2010 resulting in articles being featured in
national press such as The Daily Mail, radio interviews on BBC Radio 4
and television appearances on ITV South. CuCo has developed
www.charter2010.co.uk so that the easy to use website facilitates online
discussion enabled by blogs, forums, as well as Facebook and Twitter
pages. This has encouraged parliamentary candidates to answer some
tough questions concerning their opinion on a hung parliament.

this can have a detrimental effect. We have also found National

The Dorchester land-based college is celebrating after its staff
placed it in the UK’s top 75 public sector organisations to work for.
The prestigious national survey measures how workers feel about
their job and their role within a company, and also describes the
college as ‘one to watch.’
This is the first time Kingston Maurward has been involved in the
annual study, with the 48% of staff taking part also praising how
well they work together and support each other. A total of 1,086
organisations from the private and public sectors applied for Best
Companies recognition this year, with 410 firms being accredited
and another 363 organisations achieving ‘One to Watch’ status.
This is also the first year the Sunday Times has recognised public
sector organisations and published a special supplement listing
them, on 14th March.

aste Management Facilities (WMF) is one of the fastest
growing waste management companies in the country.
Its success has been down to the hard work and determination
of Managing Director Gary Fendley and his team. They have

registration for the CRC scheme
starts in April 2010 and it is
estimated that up to 20,000 UK
businesses could be affected, with
5,000 having to be registered
for the scheme. It is also widely
regarded that awareness of the
scheme is low, with a recent
survey from SAP revealing that
a fifth of companies have not
even started planning or have
no idea what measures they
need to take. Considering the
increasing scrutiny being placed

Finding the Key
to a Low Carbon Future
Harnessing the UK’s abundant
wind, tidal and wave resources
could hold the key to tackling
the UK’s energy crisis, as well as
make a massive contribution to
the economy with the creation
of over 40,000 jobs, experts said
recently in a report published by
the Institution of Civil Engineers
(ICE).
The UK energy sector is facing
a security of supply crisis. One
third of our power plants are due
to close by 2025, which equates
to a loss of 30GW of energy. At
the same time, we urgently need
to decarbonise our energy supply
to meet pressing environmental
targets.
ICE’s report Offshore
Renewables: Unlocking the
Potential says the rapid upscaling of offshore renewable
resources, on a similar scale to
that experienced by the North
Sea oil and gas sector in the
60’s and 70’s, could provide
the solution. The UK possesses
some of the richest wave, tidal
and wind resources in the world,
with the potential to provide
up to half of the UK’s current
energy demands as well as create
a major new industrial sector,
with significant export potential.
In January this year the third
round of tenders for offshore
wind sites was announced,
representing over £100bn of
private investment and 32 GW
of projects. If achieved, these
projects, combined with advances
in wave and tidal energy
generation, could contribute
significantly to plugging the
energy gap faced by the UK.
However, ICE warns that
to deliver on such a massive
scale industry requires a secure
commercial environment within
which companies can invest with
confidence.

Climate Change Comes
to Bournemouth & Poole
Tourism businesses in Poole and
Bournemouth are preparing for
the future following a special
conference on climate change.
Poole and Bournemouth
Tourism in partnership with
South West Tourism, held
the free workshop at the
Bournemouth International
Centre to help local tourism
businesses find out more about
how to prepare for a changing
climate.
With the effects of flooding
and rising sea levels
becoming more
evident in the UK,
being prepared and
resilient can mean the
difference between
business success or
failure. And in an area
famous for its unique
natural environment,
created over centuries
by the elements,
the benefits to local
tourism businesses of looking
ahead and adapting early are
crucial.
Tourism businesses explored
local transport options that
encouraged visitors to give the
car a holiday, how to save energy
and waste to increase profitability
and using local foods to help the
local economy and reduce food
miles. The workshop also looked
at future plans for the shoreline
of the area and best practice from
across the south west region.
A
new government
initiative looks set to
boost job opportunities
in the region and help
households save money
and reduce their carbon
emissions.
Warm Homes, Greener
Homes, the government’s
household energy management
strategy, was launched recently
by Ed Miliband, Secretary of
State for Energy and Climate
Change with the aim of meeting
the target of a reduction of 29%
in carbon emissions from the
household sector.
Regen SW Chief Executive
Merlin Hyman said, ‘This
strategy is a significant step
forward in helping south
west households save money
by reducing energy use. It
will also create significant
job opportunities in making
and installing energy-efficient
Merlin Hyman
technologies – an excellent
opportunity for the many south
west businesses in this sector.’
The strategy proposes that by
2020 up to seven million homes
in Britain will have received
eco-upgrades, including
improvements such as solid
wall insulation or renewable
energy generating technologies.
It paves the way for ‘pay as you

London Plays Host to Carrington City Launch
One of the south of England’s largest and
most vibrant business networking clubs
is to launch its first meeting in the City of
London. The Chairman of The Carrington
Club, Jonathan Rose, is to host a cocktail
party for invited new businesses from the
London city business community, as well
as existing members from the south of
England. The event takes place on 15th
April at 6.00pm at 60 Cannon Street,
London.
Jonathan Rose
Chairman, Jonathan Rose, says, ‘With
the launch of Carrington City, I am delighted to bring the spirit and
ethos of Carrington Business Network to London.
‘One of the most important things to recognise about business
networking is that it is a two-way street. The Carrington Club is a
group of businesses who have a goal in mind and that is to improve
the size of their business and their contacts, not only in the south of
England but nationally and internationally.

and successes that SMEs in and
around Bournemouth experience in accessing business advice and
support.
A discussion white paper ‘Access All Areas?’ was published by The
Chartered Institute of Marketing at the end of last year to promote
discussion on how the role of government might best evolve to suit
the disparate requirements of SMEs and makes the case for effective
marketing support being central to SME business development. Mark
Stuart, head of research at the Institute will present the key themes at
the discussion evening.
Mark will be joined by Julie Leigh, an adviser at White Egret Ltd, who
has 30 years experience working with SMEs in the banking sector and
more than five years experience working within Business Link before
becoming an independent business consultant.
The Chartered Institute of Marketing is stimulating this debate
because many business development issues are at their core
marketing issues and these impact on a businesses’ growth prospects
and ultimately the growth of the future economy.
Mark and Julie will be joined by two local business people; Declan

providing advice for his Forerunner Personal Catering business, and
Justine Wyness will talk about how she has addressed some of the
marketing challenges of BeCheeky.com, her online consumer business.
The event will be chaired by Henry Howarth, SME champion for The
Chartered Institute of Marketing’s Dorset branch, and will finish with a

Back According to Barometer
The Manufacturing Advisory Service in the South West (MAS-SW)
has revealed survey findings which show that manufacturing in the
region is being boosted with new orders and that an increase in jobs is
anticipated by the sector in 2010.
The wave of positivity surrounding the manufacturing sector in the
region is reflected by outcomes of the South West Manufacturing
Barometer, compiled by MAS-SW, which reveals that more than half
those manufacturers surveyed either saw no change or an increase in
their turnover in the past six months, with 81% expecting to see this
figure continue to rise in the next six months. Order books also look
healthy with 67 % seeing either no change or an increase since June
2009, and enquiry levels are also up by more than a third.
Designed to collate information on the economic climate and
emerging trends from manufacturers in the region, the latest South
West Manufacturing Barometer revealed:
b 62% of businesses say that jobs are safe while one in 4% predict
an increase in staff numbers
b 32% have seen increased sales over the past six months with 31%
expecting their order books to remain healthy
b 35% will invest in new machinery and or new premises while 33%
will invest in new technology
b 77% believe that the emerging low carbon market will have no

European Security and Defence Assembly. The visit was organised as
part of the industry wide Defence Matters campaign which aims to

Bob Walter was given an insight into the ETL operation by Ken Crook
ETL’s Managing Director, and received a presentation by ETL’s Ministry
of Defence Project Manager, Philip Scantlebury, describing some of the
work that ETL has been involved in recently on behalf of their clients
in the UK, US and Europe, and how as project manager, he interacts
across the supply chain. Philip also took the opportunity to highlight
the high financial investment the company is forced to make in order
to meet the critical timescales set by Urgent Operational Requirements
(UORs). To provide a rapid solution and meet the tight deadlines
necessary, ETL often has to commission and buy-in components early
before an official order is received, only by doing this can they be sure
to deliver vital equipment on time, and in some cases, before time!

Election Fears
Stifle Property Market
The upturn in the UK’s property market slowed in
February as buyers and vendors adopted a ‘wait and
see’ approach in the run up to the general election.
14% fewer estate agents reported a rise in property
prices to the Royal Institute of Chartered Surveyors
during February than in January.
‘The possibility of budget cuts and tax rises
are causing many prospective vendors to await
the outcome of the election,’ said David Plaister
Managing Director of LetAssured UK.
‘However, landlords should be aware that the
current level of house prices when allied to the
recent improvements in buy-to-let finance probably
creates an excellent environment in which to extend
property portfolios,’ he said. ‘It is highly likely that
house prices will resume their upward trend after an
election regardless of which party wins.’

Warning
Check Your Lease
Business owners could be liable for payment of rent
long after they have vacated a property. That’s the
warning from Adams & Remers solicitors, following a
recent court ruling.
The case of Newham v Van Staden has caused
concern in legal circles because leases thought to

the Landlord & Tenant Act 1954 might not in law be
excluded afterall.
The new ruling means that anyone who was a
former tenant of a lease could remain liable for a
‘holding over’ period long after the original tenancy
has been assigned to a third party. Therefore the
former tenant may think his responsibility has ended
at the end of the original lease so what they believe
to be excluded leases should be checked.
‘This has widespread ramifications for any
business owner that has owned a lease on their
own or other properties,’ says Robin Illingworth,
Managing Partner at Adams & Remers. ‘Basically,
they could now find themselves liable to rent
payments many months or years after they have
vacated a property.’
The Van Staden ruling also means that businesses
who have not spelled out this potential liability
in their records could find themselves liable for
misleading accounts.
Robin Illingworth comments, ‘Our advice, following
this case, is that businesses should seek legal
guidance as soon as possible to confirm whether
the Van Staden decision applies to any leases which
they have formerly owned and “were excluded”.
Otherwise, they may have a nasty shock when they
get a big demand for back payment of rent for a
property they no longer have anything to do with.’
Building
Insurance
Valuation
It is important to ensure your
buildings insurance is up to date
and accurate especially in a
fluctuating property market.
If you are over insuring your
property this will be money
wasted since the insurers will
only pay up to the current market
value of the property using the
‘average’ clause in the policy.
If you are under insured then
your insurers will only pay up
to the value of the sum insured
which may be far lower than the
current value of the property,
potentially, leaving you with a
large shortfall in the event of a
total loss.
Property values vary over time
and can go down as well as up,
and since the cost of building
work also varies, especially
in recessionary periods, it is
possible, for example, that
building reinstatement costs
could be quite low for a property
which has maintained or even
increased its value; the insurance
premiums need to reflect this.
Building Insurance
Valuation calculations are not
straightforward. This is why it
is important to maintain up to
date and accurate valuations by
qualified professionals to ensure
piece of mind in the event of a
claim.
Goadsby surveyors recently
carried out a valuation on a
property in Boscombe to ensure
the building owner is not paying
an excessive premium but
maintaining the correct sum
insured.
Goadsby has a team of
Building Surveyors who can
produce Insurance Valuations for
any property, and offer related
advice. Contact the Building
Consultancy Department on

Excelsior Coaches
implements Safe and Fuel
Efficient Driving (SAFED) into
its driver training programme
for 2010.
Excelsior Coaches driver
development programme is a
feature of its commitment to
achieve reductions in its fuel
spend, carbon emissions and
accident rates.
SAFED is a driver
development course
that aims to help businesses and organisations reduce fuel and
maintenance costs, reduce CO2 emissions and improve safety through
the enhancement of driving techniques.
SAFED is a one-day, off-the-job driver training programme that aims
to improve safe and fuel efficient driving techniques of commercial
vehicle drivers. It involves a mix of classroom and on the road
tuition and each driver is assessed on their driving techniques and
knowledge. The course includes a ‘before and after’ comparison of
driver performance and indicates the MPG improvement achieved by
each driver. By undertaking the training, drivers can also help reduce
their risk of accidents and gain a better understanding of the thought
processes involved in reading the traffic and road conditions ahead
while driving smoothly, safely and economically.
SAFED training was originally created for drivers of lorries and was
launched in the bus and coach industry in 2009. By the end of March,
Excelsior will see 20 of its drivers complete the training.

Rally Call to Business
Bandits and border guards are
the least of his worries as Ashley
Platen-Mills prepares for a gruelling
6,000 mile rally across the roof of
the world to central Asia.
The Dorset businessman says
the epic journey will raise £20,000
for two UK charities helping sick
and dying children here and at his
destination in Tajikistan. He now
hopes firms will ‘rally behind’ him,
sponsoring squares along his route
map via a special website designed
to boost business networking and
internet presence.

Motor into Spring
with a Stylish Coupe
If you have read any paper in the last 18 months you could be forgiven
for thinking that the car industry is on its last legs. The current climate
at Horizon Honda is, however, not as you would think with a vast
refurbishment and investment at the Ringwood Road dealership having
just been completed. The building like Honda itself is now in perfect
condition to showcase the latest offerings from the forward thinking
manufacturer.
This spring will see the latest launch of the third hybrid in the CRZ,
a highly stylish coupe. The CRZ offers three different driving modes.
In fact the driving experience was the core of the design brief with a
wide track and short wheelbase which offers responsive steering and
short sharp gear changes, and because it’s a hybrid, low CO2 emissions
(below 120GSM’s) and high MPG for a performance car. In fact the car
VED (Car Tax) is £0 per year.
The three modes include Sport, Normal and Econ so there is a mode
to suit your journey and your style of driving. You will be able to view
the CRZ from June onwards but you can view the new impressive
showroom and the highly desirable range now.
The corporate department can also offer the latest advice and
information on contract hire and your responsibilities under the

of cars, trucks, vans and motorhomes, but provides services for 35
corporate transport operators from the surrounding counties.
Secondwind for Loders
Throughout the 25 years Airport Cars has been delivering a range
of top quality transfer services for private and corporate use.
Company Director, Ken Hodgetts said, ‘Like most businesses
we have been victims of the recent recession. Since late 2008
the decline in corporate and holiday travel has had a dramatic
impact on our trade. However, as we continue through 2010 and
our 25th year of business I believe this year will see the start
of recovery. Compared to the first quarter of 2009 bookings for
our Service so far this year have increased. Although it will take
time to get back on track, I am optimistic bookings will continue
to increase at a steady pace as confidence grows.

vehicle will become popular with our corporate clients along with
the holiday traveller that requires comfort on a different level.’

Drive Time Team
Get into the Driving Seat
New Driver instructor, Adam Parker, challenged the Drive Time team on
Wave 105, to a mock driving test following on-air banter about driving
tests.
Presenter, Rick Jackson, had wished a listener luck for their driving
test, then asked colleagues Kate Weston and Shaun Aquilina, ‘If we
were to take our driving tests again would we pass?’
Listener and new driver
instructor, Adam Parker,
immediately picked up on
the point and rang in with the
challenge. Over the next few
days, the trio had time to brush
up on their driving skills and
revisit the Highway Code, all
the time talking about it on
air with all the tension of a
real driving test. When the day
of the mock test arrived, the stakes were even higher, with the worst
driver of the three losing the use of their car to get into work for a day.
Wave 105 presenter, Rick Jackson, said, ‘Fortunately we all passed
our tests, but it was pretty close as you are allowed a maximum of 15
minors before it becomes an instant fail. Kate and I got 13 minors each
and Shaun got 15, so Shaun will have to get the train to work for a day!
While we all had a bit of fun with this challenge it certainly highlighted
that we’ve all picked up some bad driving habits. Hopefully this
exercise will help us to address these issues and will make us more
mindful with our driving, as I think we all tend to forget how dangerous
driving can be at times.’

estover Nissan is offering cost-conscious Dorset drivers
the deal of 2010 on its compact city car, the Pixo. For
a deposit of just £1 local
motorists can take to the
town in a brand new 10 plate
car – and make the most of
Westover’s ‘three year, nocost’ offer at the same time.
The five door Pixo 1.0 n-tec
comes complete with a three
year warranty, three years road
fund licence and three years
free servicing, as well as three
years complimentary roadside
assistance. Customers can elect
to pay a £1 deposit and make monthly payments of £195 a month (or
increase the deposit and make lower monthly payments). The ‘3, 3, 3,
3’ offer is also available to people choosing other payment methods,
including those opting for cash back on the part-exchange value of
their old vehicle. With blockbusting fuel economy figures of up to 73
miles per gallon, insurance at the lowest rate and complimentary road
tax for three years, the Pixo is one of the most economical cars on the
road.
‘This is a great offer which makes budgeting for motoring costs a
no-brainer. It also proves that strong deals are still around for anyone
who missed out on the government’s scrappage scheme,’ says
Paul Hughes, Westover Nissan General Sales Manager. ‘Petrol and
insurance are the only additional costs that Pixo customers need to
consider and even that’s unlikely to leave a dent in the cash flow – the
car’s fuel efficiency means that it only costs around £8 to travel 100
miles.’
Front, side and curtain air bags are
standard on Nissan’s 1.0 n-tec Pixo, as
are ABS brakes, a radio with CD player,
remote central door locking, Isofix child
seat anchorage points, front electric
windows, air conditioning and power
assisted steering. Westover customers
opting for a finance deal can have a
free sat nav system installed at no
extra cost, which also provides MP3
compatibility and Bluetooth connectivity.
Anyone wishing to arrange a test drive
(including a trial from home) can do so
online, by telephone or in person.
