It is not a comprehensive listing of all of the regulations but rather a summary guide. If you have arry questions about this guide or about any regulations governing development you should contact the Caswell County Planning Department for assistance. HYCO LAKE The area surrounding Hyco Lake is zoned. The boundary of the zoned area is as follows; Beginning at the Caswell,/Person County Line on NC 57N, thence northwest to NC 119, thence southwest to US 158, thence east to Solomon Lea Rd., thence north to Osmond Rd., thence due east to the Caswell/Person County Line, thence north along the County Line to the point of beginning (a map ofthis area is available for inspection at the Planning Departmen|. All of the lands in Caswell Coturty that are within the zoned area are zoned for single-family residential use. Manufactwed homes are not allowed in this zone except as provided for under a Special Use Permit. For detailed information regarding zoning regulations contact the Planning Department. Lot Size I acre of usable land (land within the right-of-way of the road cannot be counted towards the usable area). Setbacks Front: 50' from the edge of the rightof-way of the road or the front property line . Side: 15' from the side property line except corner lots; on corner lots the side setback on the adjoining road is 20'. Back/Lakeside: 0' to the 420' contour line. Bufler There is a 40' vegetative bufler measured from the bank of the lake. No development can take place in this buffer area. Note:Progress Energy owns all ofthe land surrounding Hyco Lake to the 420' contour. No development is permitted in this area without the written consent of the Hyco Lake Authority. The Hyco Lake Authority may be contacted by calling 336-599-4343. rL GENERAL GUIDELINES & STEPS T OF OLLOW Documents to bring with you when you apply for a permit; A copy ofthe deed for your property A copy of your most recent Tax Bill A copy of the recorded map of your property A copy of the Tax Map of your property Note:If you do not already have these documents in your possession you can obtain them at: the Caswell County Tax Department, the Register of Deeds or find them on-line at http://www.caswellcountync.gov/. or http://www.caswellrod.net/. You may also secure them at your Attorney or Surveyor's office. Grading I acre of land for any & Erosion Control a Soil first obtaining purpose other than agriculture or forestry without Permit from the North Carolina Department of Environment and Natural Resources. You may contact them at 336-771-4600 or find them on-line at www.enr.state.nc.us. It is against the law in North Carolina to grade or disturb more than Do not dig or gradebefore locating underground utilities. To locate underground utilities call 1-800-632-4949. When digging or grading be sure not to disturb your septic system area or its repair area. Contact the Environmental Health department before you dig or gtade (336-694-9731, ext.17). Farmland Preservation Districts Caswell County has enacted a Farmland Preservation Ordinance. Essentially this ordinanee provides participating members the right to farm. A map showing the locations of these protecteddistricts is available for viewing at the Caswell County Planning and Tax bepartments and the Agricultural E*ension Offrces. When obtaining your Building Permit you will be required to sign a statement indicating that you have reviewed this map and are aware of any district within Yz mlle of your property. Your signing of this statement acknowledges that you accept these participant members right to farm. Step One Planning Department - Schedule an appointment to discuss your plans to develop your property prior to beginning. A meeting with the County Planning Staffwill be beneficial to assure that your plans are within the county's regulations. Also, depending on what your pians for development are, further review may be necessary by the Planning Board or other governmental agencies. Step Two - Environmental Health After discussing your plans with the Planning Staffyour next step will be to file an application with Environmental Health to have yow site evaluated for a solid waste disposal system (septic system) and or a well. If your property already has these improvements the Staffwill come out and evaluate the existing systemto assure that it is functioning properly and that your new plans will not compromise the system. The Environmental Health Department is also responsible for monitoring several commercial enterprises such as restaurants, health care facilities, schools, day care facilities, etc. If your plans include any of these commercial activities you should schedule an appointment to discuss your plans with the Staff before beginning. Step Three - Building Inspections After discussing your plans with the Planning Staffand obtaining the necessary permits from Environmental Health then the next step is to apply for your Building Permit. Although it is possible for a homeowner to obtain his or her own Building Permit, it is advisable to have your building contractor obtain it for you. Applications for Building Permits are available at the Building Inspections Department. You should make an appointment to discuss your plans with the Building Inspections Staff. They will assist you and tell you what will be required to obtain your permit. Step Four - 911 Addresses After obtaining a Building Permit you can obtain a 911 Address by bringing a copy of your Building Permit to the 911 Dispatch Center located at the Caswell County Sheriffls Department. The 911 Staffwill go out to your site and assign your address. You may contact the 911 Staffby calling 336-694-9311. Note: The Caswell County Planning Department, Environmental Health Department and the Building Inspections Department are all located in the same building at 144 Main St., Yanceyville, NC 27379 and can be reached by phone at336-694-9731or by Fax at336-6945547. 3 S UB DIVIS ION REGULATION S SuMivision regulations apply to all lots in Caswell County created after June 30,1979. There are three types of subdivisions; a Minor SuMivisioru a Major SuMivision and Exempt Subdivisions. Lands being subdivided that are located in Watershed Protected Area are subject to the Caswell County Watershed Ordinance regulations, which take precedence over Subdivision regulations (see Watershed Regulations). If you are unsure of how these regulations pertain to your property or you are considering a subdivision of your property contact the Planning Department for assistance. Minor Subdivisions: lands being subdivided into 6 or fewer lots. Each lot must have a minimum of 50' of road frontage on an existing State Maintained Road or an approved Public or Private Road, except lots fronting on a cul-de-sac which are only required to have 35' ofroad frontage. All Major Subdivisions: lands being subdivided tnto 7 or more lots. Each lot must have a minimum of 50' of road frontage on an existing State Maintained Road or an approved Public or Private Road, except lots fronting on a cul-de-sac which are only required to have 35' of road frontage. All Exemptions: Recombination: Whenever previously recorded lots of record or portions thereof are combined together and the total number of lots is not increased and the newly formed lots meet the ordinances minimum standards. Sometimes called an "Add ON". Greaterthan 10 Acres: Whenever newly formed lots are greater than 10 acres (10.01 ac. or larger) and no new right-olway is dedicated or no existing right-of-way is extended. Estates: Whenever a property is divided amongst the heirs for the sole purpose of settling the Estate. Any future subdivisions of any portion ofthe Estate are subject to the Subdivision Regulations. Two Lots Out: Any property owner may subdivide up to 2lots every 12-months and serve those lots with as little as a20 ft. wide easement provided that the easement serves no more than 2 lots total and that it provides access to a state maintained road. Other: There are 4 other exemptions that are seldom used. For more information on these contact the Planning Department. Minimum Lot Size: The minimum lot size is I Ac. ofusable land. Land within the right-of-way ofthe road cannot be counted towards usable acreage. Minimum lot size differs in the Country Line Creek Watershed Protected Area; In the Water Critical Area minimum lot size is 3 Ac., in the Balance of the Watershed the minimum lot size is 2 Ac. (See Watershed Regulation Summary) Setbacks From Property Lines and Road Right-of Ways: Front: 50 ft. from the edge of the right-of-way of the road and or the front property line. Side: ft. from the side property line except on corner lots that have adjoining roads, then the side setback on the adjoining street side is 20 ft- Rear: 25 ft. from the rear property line. 15 Minimum Lot Width at the Building Line: Al1 lots must have a minimum width of 125' at the building line (the point in the lot where the structure will be placed) Buflers Setback from Streams, Ponds and Lakes: A 50 ft. vegetative buffer must be maintained on each side of all streams, ponds and lakes. Watershed Protected Areas are divided into two categories; Water Critical Areas (CA) and Balance of the Watershed (BW) Regulations are different within these two categories and they may also differ from one Watershed Protected Area to another. If you are uncertain as to how these regulations pertain to your property contact the Planning Department for assistance. Minimum Lot Size. Fullers Creek is the only Watershed Protected Area that is located in both Yanceyville's jurisdictions and Caswell County's jurisdiction. The other 3 Watershed protected Areas are all in Caswell County's jurisdictions. Fullers Creek Water Critical Area, located in the Town of Yanceyville's Jurisdiction The Water Critical Area of Fullers Creek Watershed lies entirely within the Jurisdiction the Town of Yanceyville. Fullers Creek Balance ofthe Watershed: Yanceyville' s Jurisdiction: A portion of the Balance of the Watershed Area is in the Jurisdiction of the Town of Yanceyville. Contact Steve Smitta Town Manager, at336-694-5431for more information. Caswell County' s Jurisdiction: A portion of the Balance of the Watershed Protected Area is in the County's jurisdiction. The minimum lot size is 1 acre and up to l2Yo of the total acreage can be built upon (only 12% ofthe total area can be covered with impervious surfaces such as roofs, asphalt, concrete, gravel, etc.). Country Line Creek Water Critical Area: The minimum lot size is 3 acres with up to 6Yo of the total acreage built upon (only 6Yo the tgtal area can be covered with impervious surfaees such as roofs, asphalt, concrete, gravgf, uc.). of + Country Line Creek Balance of the Watershed: The minimum lot size is 2 acres with up to 12o/o ofthe total acreage built upon (only 12% ofthe total area can be covered with impervious surfaces such as roofs, asphalt, concrete, gravel, etc.). Stoney Creek Water Critical Area: There is no Water Critical Area in Caswell County's jurisdiction. Stoney Creek Balance ofthe Watershed: The minimum lot size is 1 acre with up to l2Yo of the total acreage built upon (only l2o/o the total area can be covered with impervious surfaces such as roofs, asphalt, conctete, gravel, etc.). of South Hyco Creek Water Critical Area: There is no Water Critical Area in Caswell County's jurisdiction. South Hyco Creek Balance of the Watershed: The minimum lot size is I acre with up to 12Yo ofthe total acreage built upon (only l2Yo the total area can be covered with impervious surfaces such as roofs, asphalt, concrete, gravel, etc.). of Buffers ponds and lakes have an 80 ft. vegetative bufler measured from the edge of the stream (both sides), pond or lake. The first 30 ft. ofthis buffer must remain undisturbed (no development, no cutting oftrees, no cultivating, no fertrlizer or grading of soils). The next 50 ft. of buffer area must be maintained in vegetative cover but trees may be replaced with grass. No construction is allowed in the buffer area. A11 streams, Types of development allowed in Watershed Protected Areas: Water Critical Areas is allowed. Agriculture and Forestry operations must follow BMPs @est Management Practices - see USDA and Forest Service guidelines). Some All residential development forms of commercial development are restricted; contact the Planning Department for more information. 9 Balance of Watershed All residential development is allowed. Types of development prohibited: Water Critical Areas: The storage oftoxic and hazardous materials is prohibited unless a spill containment plan is approved by the NC Department of Environment and Natural Resources and implemented. All landfills and the application of sludge/residuals or petroleumcontaminated soils are prohibited. Balance of Watershed prohibited. The storage of toxic andhazardous materials is prohibited unless a spill containment plan is approved by the NC Department of Environment and Natural Resources and implemented. All discharging landfills are Exemptions Contact the Planning Department for more information concerning exemptions. Notes Persons owning property on Farmers Lake or Roxboro Lake are reminded that their property does not go to the waters edge. Caswell County owns all ofthe land surrounding Farmers Lake to the 500.5 ft. contour line. The City of Roxboro owlls all ofthe land strrounding Roxboro Lake to the 489.5 ft. contour. Absolutely no development is allowed in these areas without a permit from the county or town. MANUFACTURED HOME REGULATIONS Regulations regarding manufactured homes can be separated into categories; manufactured home parks and manufactured homes placed on individual lots. The regulations concerning manufactured home parks are very detailed and cannot be addressed in a sunmary guide. Anyone wishing to learn more about regulations concerning manufactured home parks is asked to contact the Planning Department. The following summary of regulations pertains to manufactured homes being placed on private lots. If you do not understand how these regulations effect the development of your property contact the Planning Department for assistance. Age of Manufactured Homes placed in Caswell County Any manufactured home regardless of its age that is set up and is currently occupied and or connected to a well, septic system and power may remain atthat site indefinitely. Any manufactured home that is currently set up on a lot in Caswell County's jurisdiction may move to another lot in Caswell County's jurisdiction provided that it is no older than 20 years old. Any manufactured home that is currently located outside of Caswell County's jurisdiction nray move into Caswell County's jurisdiction provided that it is no older than 10 years old. Underpinningff oundations homes placed on individual lots since April3,2000 must be underpinned permanent masonry curtain wall foundation as described in the North Carolina with a Building Code. All manufactured Number of Units 3 or more manufactured homes placed on a property or adjoining properties owned or controlled by the same persorL fum, partnership, corporation or family constitutes a manufactured home park. Contact the Planning Department for regulations regarding manufactured home parks. 2 manufactured homes may be placed on a property for rental purposes. 3 manufactured homes may be placed on a property and not be considered a manufactured home park ifthey are occupied by family members or bona fida farm labor. An afhdavit must be signed attesting to this condition. Each unit placed on a parcel of land must have the minimum lot area for each unit as required by the SuMivision and/or Watershed Ordinances. Building Permit A building permit is required for all manufactured homes prior to setting them on a lot and or making any repairs, alterations and or additions to them. Manufactured homes may not be used for storage buildings.
