HouseRules EffectiveJanuary1st2016 Preface: 1. AnyviolationtotheHouseRulesissubjecttoamonetaryfine,whichwillbeaddedasanadditional maintenancechargetothemonthlymaintenancebill.Finescheduleisasfollow:firstoffense-$50,second violationofthesamerule-$100.Anyuncorrected,ongoingHouseRuleviolationswillsubjecttheoffending shareholdertoadditionalmonetaryfinesonamonthlybasis,untilallviolationsareremedied. 2. AnyconsentorapprovalgivenundertheseHouseRulesbytheCo-opBoardofDirectorsshallberevocableat anytimebytheCo-opBoardofDirectors. 3. TheseHouseRulesmaybeaddedtoorrepealedatanytimebyresolutionoftheCo-opBoardofDirectors,and theserulessupersedeanyandallpriorhouserules. 1 NOISEAND/ORDISTURBANCES a) NooneshallmakeorpermitanydisturbingnoisesinanapartmentorontheCo-op.groundsordoorpermit anythingtobedone,whichwillinterferewiththerights,comfortorconvenienceofotheroccupants. b) Noconstructionorrepairworkorinstallationworkinvolvingnoiseshallbeconductedinanyapartmentexcepton weekdaysbetween8:00AMand6:00PM,orbetween9:00AMand5:00PMonweekendsandlegalholidays. 2 ANNUALSHAREHOLDERUPDATEFORM a) AllShareholdersarerequiredtocompletetheirshareholderupdateformonayearlybasis.Formswillbe distributedbyJanuary1standmustbereturnedwithinonemonthonorbeforeFebruary1st.Thisisnotoptional, thefailuretoreturnformbyFebruary1stwillresultinafinetobebilleddirectlytoyourmaintenanceaccount. b) Allvehiclesbelongingtoanyshareholdermustbedeclaredontheupdateform. c) Allpetsmustberegisteredwiththecooperativeandlisted. d) Inanefforttostreamlinecommunications,reducepaperandultimatelycutcosts,allshareholdersareurgedto provideanemailaddressforcommunityrelatednotificationsandpublications. e) ShareholdersarerequiredtomaintainaPersonalCooperative(Renters)insurancepolicy.Acopyoftheir Declarationpagecommonlyreferred,asthe“Decpage”mustbesubmittedwithupdatedshareholderform. f) ShouldanyinformationchangeafterFebruary1st,allshareholderswillbegiven30daystoupdatetheoffice accordingly.(i.e.Newcarpurchase,additionaloccupants/petsorthechangeofinsurancecompanies) 3 Cooperative/RentersInsurance a) AllshareholdersmustmaintainattheirexpenseapersonalCooperative(Renters)insurancepolicy. b) Thispolicywillbemaintainedwithoutlapse. c) Acopyofthepolicy’sDeclarationpageclearlystatingcoveragedatesmustbesubmittedwiththeshareholders updatefrombyFebruary1st. d) Shouldashareholderspolicyexpiremid-year,shareholderswillbegivenagraceperiodof30daystoprovidea copyofanupdateddeclarationpageshowingproperpolicyrenewal. 4 MAINTENANCE a) Complaintsregardingmaintenanceservicefortheapartmentsshallpreferablybemadebysubmittingan electronicrequestatwww.birchwoodglen.com.Shouldashareholdernothaveacomputer,alettermaybe submittedtotheCo-opBoardofDirectors. b) Nothingshallbehung,placedorprotrudefromwindows,windowsills,terrace/balconiesorexteriorbuilding wallswithoutexpressBoardapproval. c) Noobjectsshallbenailed,screwedorotherwisepermanentlyaffixedtothemainfrontdoorofanyapartment. d) Nowindowairconditioningunitsaretobeused.Allairconditioningunitsmustbeinstalledinthewallsleeves andmustbecoveredwiththepropersolidorventilatedpanels.Atnotimeisanyairconditionerpermittedto projectbeyondtheexteriorofthebuildingfaçade. e) Nosign,notice,advertisementorcommercialilluminationshallbedisplayedatanywindowormountedonany partoftheexteriorofthebuildingorcommongrounds. f) Garbage,petwaste,andotherrefusefromtheapartmentsshallbedisposedofproperlyonlyindesignated receptacles.Largeitemsaretobeplacedneatlynexttothedumpsters.(TheaforementionedshallNOTbeleftin anycommonareaorterrace/balcony). g) Toiletsandsinksintheapartmentsshallnotbeusedforanypurposeotherthanthoseforwhichtheywere intended.Nosweepings,rubbish,sanitarynapkins,diapers,Kittylitter,papertowels,dentalflossorother foreignarticlesmaybediscardedintotoilets.Thecostofrepairingdamagefromanymisuseofanytoiletsor otherplumbingshallbechargedtotheshareholderinwhoseapartmenttheproblememanated. h) Noresidentshallbepermittedtostoreoruse,awaterbed,oraninterior/exteriorhottubinsaidapartment. i) Nowashingmachinesordryerswhatsoeverarepermittedinanyunits,excepttownhouses.Portable dishwashersareprohibitedinallapartments. j) Inanemergencysituation,managementhastherightofentrytoanyandallapartments.Akeymustbe providedtotheMaintenanceOffice.Ifyoudonotsubmitakeyandentryisrequired,anycontractual workmanshipwillbechargedtoyou. k) Noobject,whichinterfereswiththemowingofthelawnsmaybeleftontheCo-opcommonareas. 5 REPAIRSANDRENOVATIONS a) Allelectricalandplumbingrepairs,renovationsorinstallationsmayonlybeaccomplishedbyaproperlylicensed andinsuredcontractor,onlyafterobtainingwrittenpermissionfromtheBoardofDirectors. b) Anyproposedmodification/renovationstounits(interioraswellasexterior)musthaveplanssubmitted indicatingthescopeofworktothePropertyManager.Workmaynotcommenceuntilwrittenapprovalhasbeen receivedfromthePropertyManagerand/ortheBoardofDirectors. c) Beforeimprovementsbegin,proofofthecontractor’slicenseandinsurancemustbesubmittedtotheProperty Manager.BirchwoodGlenOwnersCorp.mustbenamedasanadditionalinsuredonthecontractor’spolicy. d) BirchwoodGlenMaintenanceDepartmentmustbenotifiedatleastthree(3)workingdayspriortothescheduled commencementofwork.Thisissignificantlyimportantifworkinvolvesdisruptionofutilities(gas,waterandor electric)theneighboringunits. e) BirchwoodGlenMaintenanceDepartmentmustassistallcontractorsinclosingofthewatermains. f) Thecontractormustremovealldebrisfromthepropertyororderaseparaterolloffreceptacle,paidbythe shareholder.ThePropertyManagermustapproveplacementofsaidreceptacle. g) Noconstructionorrepairworkorinstallationworkinvolvingnoiseshallbeconductedinanyapartmentexcepton weekdaysbetween8:00AMand6:00PM,orbetween9:00AMand5:00PMonweekendsandlegalholidays. 6 AUTOSANDOTHERVEHICLES a) Onlyone(1)automobilepereachpermanentauthorizedlicensedresidentdriver,maybeparkedontheCo-op. premises. b) Intheeventofavehicle(evenifregistered)foundtobeparkedillegally,thatvehiclewillbesubjecttotow.In theeventofavehiclebeingtowedtheownerofthatvehicleisresponsibleforalltowingandstoragecharges. c) Toensureampleparkingforourshareholdersanyshareholderwhoexceedsthepermittednumberofregistered andinsuredpassengervehicleswillbesubjecttoanannualfeeof$100dueonMarch1st.TheBoardofDirectors d) e) f) g) h) i) j) k) 7 Vehiclesmayonlybeparkedindesignatedmarkedparkingstallsandinthedirectionoftraffic,whenparkedon GlenHollowDr. Allvehiclesmustbeparkedfront-endfacingthegrass,butnottoextendoverthecurborwalkways.Vehicles mayonlybebackedintoparkingspacesthatdonotfacebuildingsorifaproperlyplacardedhandicappedvehicle isattemptingtoutilizeanaccessaisle. TheCo-op.willfinetheownerandpossiblytowanyunregisteredvehicles,trailers,boats,etc.parkedonthe BirchwoodGlenpremises. AllvehiclesmustdisplayanumberedBirchwoodGlenparkingpermitstickeronthedriver’ssiderearpassenger window. Allvehiclesmustobeylocaltrafficregulations.Propertyspeedlimitis15mph. Allvehiclesmustbeoperatedinasafeandquietmanner.Vehiclesmaynotobstructorimpedethefreeflowof traffic. NomajorvehiclerepairswillbepermittedonCo-op.property. Undernocircumstancesshallanymotorizedvehiclebepermittedtobedrivenanywhereotherthanthestreets orparkinglotsoftheCo-op.,norshallanymotorizedvehiclebeparkedinareasotherthanthosedesignated. COMMERCIAL&OVERSIZEDVEHICLEPOLICY a) Tomaintaintheparklikebeautyofthecommunitythefollowingvehiclesareprohibitedfrombeingparkedby residentsonBirchwoodGlenpremisesatanytime,exceptwiththeexpresswrittenapprovaloftheBoardof Directors,anduponpaymentoftherequisiteannualmonetarysurcharge. -Anyvehiclewithlettering,writingoradvertisingonanypartofthevehicle. -Anyvehiclewithexposedtools,laddersorequipment. -SchoolBuses,tractor-trailersandorcabsforpullingtrailers. -Anyvehicleforpassengerhire;vans,taxisorlimousines. -Allboats,trailersandrecreationalvehicles. -Anyvehicleofanynatureinexcessoftwenty(20)feetinlength. b)UponapprovalfromtheBoardofDirectorsandoncepaymentofrequisiteannualfeeisreceivedeachvehiclewill beassignedanoversizedvehicleparkingspot. c) Fourteenextra-wideoversizedvehicleparkingstallsdesignatedwithredcoloredlineshavebeencreatedinthe rearofbothDcourtandFcourtparkinglots. d)AssignedparkingstallshavebeenmarkedOV1–OV7andthevehiclemustbeparkedinitsassignedstall. e) Anewstickerwillbeissuedannuallyandmustbeconspicuouslyplacedonthevehicleonthedriver’ssiderear window,oronthedriver’ssidebythehitchassemblyontrailers,whicheverapplies. f) ShouldashareholderchoosenottomaintainthevehicleatBirchwoodGlenfrotheentireyear,noprorated refundswillbeconsidered. g) Intheeventofacommercialvehicle(evenifregistered)thatisfoundtobeparkedinanon-assignedparkingstall, thatvehiclewillbesubjecttotow.Intheeventofavehiclebeingtowedtheownerofthatvehicleisresponsible foralltowingandstoragecharges. 8 PETS a) AllpetsmustbeBoardapprovedandregisteredwiththeCo-op.Failuretoregisterpetsandorfailuretocomply withprovisionsofthesearticlesmayresultinproceedingstocompelremovalofyourpetaswellasamonetary fineandpaymentoflegalfees. b) Residentshareholdersarepermittedatotaloftwo(2)pets.Onlyonepetmaybeadoganditsfull-grownadult weightmustbebelowsixty(60)pounds.Asecondnon-caninepetispermittedexcludingreptiles.Allresidents livingwithinthecooperativeonorbefore12/31/2015arepermittedtoretainanydogstheycurrentlyhave, howeverintheeventofanexistingpetsdeath,theymustconformtothispolicy. c) Reptiles(Snakes,Lizards,ect)arestrictlyprohibited. d) Petsshallnotbepermittedanywhereoutsideoftheapartmentunlesscarriedoronaleash. e) Nopetshallbeleftoutdoors,unattended.Thisistoincludebutnotlimitedto:balconies/terraces. f) PetsmustbecurbedandwalkedonGlenHollowDrive,parkinglotsoroutsideonBuckleyRd.Atnotimearepets tobeallowedtodefecate/urinateinthecourtyards. g) Anypetwastemustbeimmediatelypickedupanddisposedofinatrashreceptacle. h) Noferalanimalsshallbefedorshelteredinanyareaswithinthecooperativegrounds. i) Subtenantsarenotpermittedtokeeppets. j) PetsareprohibitedfromtheParkarea. 9 SUBLETRULES a) Priortosublettingyourunit,shareholdermustoccupytheirunitforaminimumofoneyear. b) TheCo-op.BoardofDirectorsmustapprove,inwriting,anysublettenancybeforeoccupancycommences.No subletapplicationwillbeaccepted,andinterviewsofprospectivetenantswillnotbeconducted,untila BirchwoodGlenSubletapplicationhasbeenfullycompletedinaccordancewithBirchwoodGlensublet applicationpacketdirections.Inaddition,saidapplicationwillnotbeformallyacceptedbytheBoardofDirectors, andwillnotbedeemedcomplete,untiltheshareholder/tenantsuccessfullyobtainsandsubmits,totheBoardof Directors,acopyofavalidTownofBrookhaven(NewYork)“RentalRegistrationPermit”. c) UpontheexpirationofpreviouslyvalidTownOfBrookhaven(NewYork)“RentalRegistrationPermit”,the subleasewillbeterminatedbytheBirchwoodGlenOwnersCorporationandtheoccupyingsub-tenantsmust vacatetheleasedpremises.Itistheresponsibilityoftheshareholder/tenanttoprovideacopyofavalidrenewal, extension,orsuccessor“RentalRegistrationPermit”totheBoardofDirectorsbeforetheexpirationdateofa previouslysubmitted“RentalRegistrationPermit”toavoidleaseterminationbytheBirchwoodGlenOwners Corporation. d) Asubletleasecannotbeformorethanone(1)yearatatime. e) Asubletapplicationwillnotbeapprovedifoverduemaintenancechargesand/orfinesexist. f) Theprospectivetenantsmaybeinterviewedbeforeapprovalandre-evaluated,aswellasre-interviewedeach yearpriortorenewalofthelease.Allsubtenantsincludingthosethatareparent/childorchild/parent arrangementsaresubjecttoannualreviewpriortoleaserenewal.(Seesection#14oftheProprietaryLease). g) Subletapplicationandrenewalfeecategoriesareasfollows: -Reviewandprocessingofapplicationdocuments. -Credit/backgroundchecksperapplicant. -Commonareasecuritydeposit.(SEENOTE) -Policereport,perapplicant.(3-5businessdaysforreturn). (Inquiriesregardingthepricingoftheabovecategories,pleasecalltheBoardOfficeat(631)475-3720) Note:ThisdepositwillbeheldassecurityforpotentialdamagetocommonareasorfinesleviedbytheCo-op.This depositwillbereturnedtotheshareholderprovidedtherearenooutstandingdamagesandorchargesatthe terminationofthelease. h) Theannualsubleasechargestotheshareholderareasfollows: ApartmentType YearlySubletFee Junior1-bedroom $1125.00 Deluxe1-bedroom $1275.00 two(2)Bedroom $1575.00 Townhouse $2025.00 Thesubleasefeeistobepaidinfullwiththeoriginalapplicationandeachyearthereafterthatthe subleaseisrenewed.Thissubleasefeeisineffectforallrentingarrangements,exceptincaseswherethe shareholderisaparentrentingtoachildandorvice/versa.Thissubleaseandorrenewalsarestillsubjectto boardwrittenapproval. i) Shareholderswillbeheldresponsiblefortheirguest’sbehaviorandobservanceoftheHouseRules. j) AnyandallactsofvandalismcausedonthecommongroundsofBirchwoodGlenshallbethefinancial responsibilityoftheindividualcausingthedamage.Ifaguestorchildoftheshareholder/tenantcausesdamage, theshareholder/tenantwillbefinanciallyresponsibleforthedamage.Failuretomakerestitutionfordamages causedbytheabove,stipulatedindividualswouldresultinfurtherfinestotheshareholdersmaintenance account. 10 RESALE a) SalesaresubjecttotheapprovaloftheCo-opBoardofDirectors. b) Salesapplicationsareobtainedfromthemanagingagent.Nosalesapplicationwillbeacceptednorwill interviewsbeconducteduntiltheapplicationiscompletelyfilledoutasperpackagedirections. c) Salesapplicationcategoriesareasfollows: -Reviewandprocessingofapplicationdocuments. -Credit/backgroundchecks.(Perperson). -Policereport.(Perperson). -Moveinmoveoutfee.(SEENOTE) (Inquiriesregardingpricingfortheabovecategories,pleasecalltheBoardoffice(631)475-3720) d) Afliptaxof$5.00pershareisimposedonallre-sales. e) Alloverduechargesthatexistmustbepaidinfullatclosingwhenunitissold. NOTE:ThisdepositwillbeheldassecurityforpotentialdamagetocommonareasorfinesleviedbytheCo-op.This depositwillbereturnedprovidedtherearenooutstandingdamagesorchargesatthetimeofclosing 11 BBQ’s&Grills a) Therearetobenoliquefiedpropanebarbeques,petroleumgasbarbeques,anyothertypeofgasbarbeques,or containersortankscontaininganytypeofgasorliquefiedpropaneplacedanywhereontheBirchwoodGlen premises. b) BytheorderoftheTownOfBrookhavenFireMarshall,CharcoalBarbequesareNOTtobeusedonorunderany balcony,terraceorstructureattachedtoabuilding.Inaddition,theymustNOTbeusedinanyBirchwoodGlen parkinglotorrecreationalarea. c) BytheorderoftheTownOfBrookhavenFireMarshall,charcoalbarbequesareonlypermittedwhenusedata distanceoften(10)feetormorefromBirchwoodGlensbuildings,trees,bushes,oranyotherstructureand flammablematerial. d) Nobarbequegrill,ofanytype,istobeleftunattendedwhileinuse.Aftereachuse,thecoalsfromacharcoalgrill mustbeextinguishedandremovedfromthecommonarea. e) ElectricpoweredbarbequesaretheonlytypesofbarbequespermittedonBirchwoodGlenbalconiesorterraces. f) Aresponsibleadultmustalwaysbeinattendancewhenabarbequeisinuse. 12 PoolRules a) Allshareholdersmusthaveapoolpassforentranceintothepoolarea. b) Ifyouhaveachild/childrenundertheageof16,parents/guardianswillhaveanewpoolpassmadewith children’snamesonthebacksoftheircards. c) Allchildrenovertheageof16shouldhavetheirownpoolpass. d) Uponenteringthepoolarea,lifeguardswillcollectthepoolpass,thenreturnpassuponexitingthepoolarea. e) Eachadultresident(overageof18)withavalidpoolpassisallowed2guestsforfree.Eachadditionalguestis $2.00.(Maximumof2paidguestsperresident) f) Aparent/guardianwhoisresponsibleforthechildrenandtheirbehaviormustaccompanychildrenunderthe ageof16. g) Childrenshouldalwaysbesupervisedbyanadultwhileinthepoolarea. h) Nodiving,running,horseplay,roughhousing,andballplayingallowedinthepoolarea. i) Swimmersmustwearswimsuits.Shirtsandshortsareprohibited. j) Suitablepooldevices,i.e.,waterwings,approved“swimmies”andlifejacketsareallowed. k) Useofsoftplasticballs,waterguns,noodles,kickboardsoranyotherwatertoysareatthediscretionofthe lifeguards. l) Soundreproductiondevices(i.e.radios,boomboxes)arenotpermittedwithoutthedirectapprovaloftheBoard ofDirectors.Musicfromportablepersonaldevices(iPods,MP3players)ispermittedsolongasvolumeiskept lowanddoesnotdisturbothers. m) Noglasscontainersorbottlesarepermittedinthepoolarea. n) Smoking(cigarettes,cigars&E-cigarettes)isNOTpermittedinanyareaofthepooldeck.Toaccommodatepool guestswhosmoke,allsmokingmustbedoneinadjacentBocce&Horseshoecourtarea. o) Theratioofchildrentoparent/guardianwillnotbegreaterthan5to1. p) Infantsandchildrenunderthree(3)yearsofage,orwhoarenototherwisepottytrained,mustwearwaterproof swimdiapers,andplasticpantsundertightfittingsuit. q) Nopetsareallowedinthepoolarea. r) Poolmayonlybeusedduringpostedhoursofoperation.Duetounforeseencircumstancesaresubjecttochange. s) Urinating,dischargeoffecalmatter,expectorating,orblowingofnoseinanyswimmingpoolisprohibited. t) Lifeguardshavefullauthoritytoexpelanyviolatorsofpoolregulationsoranypersonwhosebehavioris objectionable. u) ItisunderstoodthattheBoardofDirectorsmaybeatthesolediscretiontorevokeyourpoolprivilegesand/or subjecttoamonetaryfineasaresultofapoolinfraction. 13 MISCELLANEOUS a) NosolicitingispermittedinthecomplexwithoutapprovaloftheCo-opBoardofDirectors. b) Nopersonalarticles(Toysincluded)shallbeleftunattendedoutsideofunits.Theonlyexceptionshallbe outdoorstoragecabinets.Thesecabinetsarenottoexceedthedimensionsof76-inchesinheight,34-inchesin widthby30-inchedindepthforaverticalcabinet,or36-inchesinheight,55-inchesinwidthby30-inchesin depthforhorizontalstylecabinet.Beforepurchasinganyoftheseitems,writtenapprovalmustbeobtained fromtheBoardofDirectors.Pleaseprovidewrittennotificationwiththesizeandproposedlocationforthe storagecabinetaswellascolor.Thestorageunitsaretobeneutralincolor,locateddiscretelyeitheronthe terrace/balconyoragainstbuildingwalls.Managementreservestherightto:Changelocationofthecabinet, denypermissionbasedoninappropriatelocation,sizeandorcolorandorderremovalofanycabinetthat exceedstheguidelinesorwhichisinstalledwithoutwrittenpermission.Residentsarelimitedtoone(1)cabinet perapartmentunit. c) AlllandscapingplansneedtobeapprovedbythemanagingagentandortheBoardofDirectorspriorto commencement.Allshrubberyremoved,mustbereplacedwithevergreenshrubs. d) Nogrouptourorexhibitionofanykindforanapartmentoritscontentsshallbeconducted,norshallanyauction salesbeheldinanyapartmentwithouttheconsentoftheCo-opBoardofDirectorsoritsmanagingagent. e) A10%latefeeisimposedonallmaintenancecharges,(includedonmaintenanceaccount),whennotreceivedby the10thofthemonthinwhichtheyaredue. _____________________________________________________________________________________
