AUCTION TERMS & CONDITIONS:
Agency: Farm & Ranch Co. and its representatives are acting as
Agents of the Seller. All Buyers are treated as customers of Farm
& Ranch Co.
Sale Method: The real estate will be offered in three tracts or as a
combination for bidding. Except for Tract 1 bidding will be on a
per acre basis, multiplied by the advertised acres. All successful
bidders will enter into a purchase agreement immediately following
the auction. The Seller reserves the right to accept or reject any or
all bids. The sale is not contingent on Buyer(s) financing. The
property will be sold in the method resulting in the highest total
sale price. Bidding increments are solely at the discretion of the
Auctioneer. No absentee or telephone bids will be accepted
without prior approval of the auction company or the Seller.
Property Location
Earnest Money Escrow: The successful bidder as determined by the auctioneer is required to make a non-refundable 10% down
payment of the final bid on the day of the auction with the balance due at closing.
Closing & Possession: The closing shall be on or before January 8, 2013. The balance of the purchase price shall be payable at closing
in guaranteed funds or by wire transfer at the discretion of the auction company. Possession is on the day of closing, subject to the 2012
lease, which expires February 28, 2013. Seller or Seller’s Agent shall order an owner’s policy of title insurance in the amount of the sale
price from a title company of their choice. The cost of title insurance and escrow closing services will be shared equally by the Seller and
Buyer(s).
Survey: Should Tract 1 and Tract 2 sell to two (2) separate Buyers, a registered survey will be provided at the Seller’s cost.
Taxes: The 2012 real estate and personal property taxes shall be paid by the Seller. The 2013 taxes and all subsequent taxes will be the
responsibility of the Buyer(s).
