Our Focus.
The success of acquisitions or joint venture transactions is
often dependant on them complying with competition law. It is
often necessary to obtain merger control approval in numerous
countries. Market dominant companies are increasingly
accused of market abuse based on their pricing, licensing and
delivery practices. Activities which are often carried out by
individual employees, but which violate the ban on cartels, can
cost companies hundreds of millions in fines. Damages claims
are increasingly filed by customers and competitors. All this is
occurring at a time when competition law is becoming more
and more complex and the cartel authorities in Europe and
worldwide are working even closer together.
We offer advice and support in overcoming competition law
obstacles. Our team of six partners, one (Of) counsel and
25 lawyers in our offices in Düsseldorf, Berlin, Brussels
and London can advise you on all aspects of German and
European competition law. We are part of Linklaters’ Global
Competition/Antitrust practice group, which comprises 28
partners and a total of 120 lawyers in Europe.

European Commission relating to the restructuring of IKB
- assisting Saint-Gobain in a complex merger control remedy
case (HeidelbergCement) before the European Commission
- representing Lesaffre with several acquisitions in the EC and
national competition authorities, including the acquisition of
parts of GB Ingredient’s business
- representing VION before the European Commission on its
acquisition of Grampian, the UK’s largest meat manufacturer
- obtaining European merger control clearance for Nutreco’s
acquisition of BASF’s animal feed ingredients business
- advising Husqvarna on the acquisition of JennFeng and
Stihl/Zama
- representing Cargotec in an appeal against the German
Federal Cartel Office’s decision to prohibit the acquistion
of CVS Ferrari
- representing Basell before the CFI in damage claim
proceedings for access to file
- representing ArcelorMittal before the EC Court of Justice and
the Court of First Instance against the European Council and
Parliament in an action for (partial) nullity and damages in
relation to the emission allowance trading Directive
- a dvising SES ASTRA on the planned formation of a digital
platform for satellite television in Germany and also in
cartel/abuse of dominance proceedings before the Federal
Cartel Office
- representing Royal Bank of Scotland against Lufthansa in a
landmark dominance case before the Düsseldorf Court
of Appeal
- representing Omya in appeal proceedings before the
European Court of Justice against two European Commission
decisions
- a dvising in cartel proceedings (and also with regards
to claims for damages) in numerous sectors, for food &
beverages, construction/materials, energy, chemicals,
cosmetics, computer and banking
- d
evelopment and implementation of a multi-national
compliance programme, especially the development of
compliance guidelines, implementation of compliance
audits, competition law training sessions and training
sessions explaining best practice by unexpected dawn raids
as well as interactive eLearning modules
