Issue Date: 07/21/2014 Effective Date: 07/21/2014 No. 2014-07-08 Summary: Fees Worksheet Examples Notifications: FEE WORKSHEET DATA ENTRY FOR PROPER DISCLOSURE OF FEES CHARGED ON A LOAN To elaborate further on a statement from the Processing Manual (available on the retail website), the information below details how to allocate “BORROWER” fees when paid by seller. Processor Manual-1004.001 (page 30) Allocating Buyer and Seller paid fees correctly for Doc Magic disclosures According to RESPA, certain fees must remain “borrower” responsibility, whether paid by the borrower or the seller. In order to accurately disclose fees, including those that are APR related as well as “borrower” responsibility, but “seller” paid, you must follow the process noted below. If you do not follow these instructions, the fees will not be properly allocated and the APR could be impacted creating a compliance issue and possible lender (branch) cure to resolve. Seller paying ½ of Closing/Escrow Fee Issue Date: 07/21/2014 Effective Date: 07/21/2014 No. 2014-07-08 Click on Borrower button to open adjustment box in Calyx/Point Fees Worksheet screen. Responsible Party remains “Borrower”. Complete % fields and click OK. If the amounts are split by $, select the $ button and complete accordingly. Click OK when done. Any fee that can be split between the buyer and seller or paid by seller but is considered “borrower” responsibility should be entered into Calyx/Point this way for the data to transmit correctly from Point to Doc Magic. Incorrect disclosure (which will result in a lender/branch cure at closing) Note that when the Borrower button is accessed, the responsible party was erroneously changed to reflect Seller. The responsible party should NOT be changed! Issue Date: 07/21/2014 Effective Date: 07/21/2014 No. 2014-07-08 Correct Disclosure Please note-How the information prints out from Calyx/Point does not matter as we do not initially disclose from Calyx/Point (in most cases) and more importantly, our closing packages are always from Doc Magic and our data entry must be done to accurately integrate loan information from Calyx/Point to Doc Magic. A reminder-Prior to releasing the loan disclosures to the borrower(s), please review for accuracy. You can always correct information BEFORE the disclosures are released to the borrower. Once the borrower has seen the disclosures, the fees and how they were disclosed cannot be corrected (unless a valid change of circumstance).
