Participating Stores Participating Myer stores in Victoria, New South Wales, Australian Capital Territory, South Australia, Western Australia, Tasmania and Queensland including the official online store for Myer which is located at www.myer.com.au (Online Store) Entry Method During the Competition Period, entrants must: (a)purchase any Polo Red Intense or Polo Red original fragrance (minimum 125ml) (Eligible Purchase) from any participating Store to receive an entry form (subject to entry form stocks remaining at the relevant Store); OR (b)make an Eligible Purchase from the Online Store and follow the links on the Online Store to download an electronic version of the entry form; and (c)fully complete the entry form and send it to the Promoter either by: 1)emailing a soft copy of the entry form to ralphlaurenfragrance@ au.loreal.com; OR 2)sending a copy of the entry form by post to the Promoter’s address at: Attn: Designer Brand Marketing team, L’Oréal Australia Pty Ltd, 564 St Kilda Road, Melbourne VIC 3004. Winner Determination The first valid entry randomly drawn from all valid entries received during the Competition Period will win the prize. Prize Details There is one (1) prize to be won. The prize consists of the following: • a Renault Clio R.S Sport 200 (Diamond Black) 1.6 petrol turbo car (automatic) valued at $30,040 (inc GST) and on-road costs and costs for delivery to the winner’s nearest dealership valued at $3,852 (inc GST); and • a trip to Melbourne to attend the 2016 Australian Grand Prix for the winner and one companion (who must be aged 18 or over) valued at up to $8,291 (inc GST) depending on the winner’s point of departure. The Melbourne trip must be taken on dates to be specified in March 2016 to coincide with the 2016 Australian Grand Prix. If the winner is unable to take the Australian Grand Prix element of the prize on the dates specified, this element of the prize will be forfeited. Refer to paragraphs 6 to 9 for full prize details and conditions. Prize Pool The total prize pool is valued at up $42,183 (inc GST) depending on the winner’s point of departure. Entry Limits Entrants may enter as many times as they wish, provided that each entry is based on a separate Eligible Purchase and separate entry form. Retain Receipt Requirements Entrants must retain a copy of their itemised Eligible Purchase receipt/s (or the online tax invoice if the Eligible Purchase was made via the Online Store) to verify each entry. Winner Notification and Publication The winner will be notified in writing by email within two days of the draw and their name and state/ territory of residence will be published in The Australian on 16/04/15. Prize Claim Date and Time Prizes must be claimed by 5pm (AEST) on 13/07/15. Unclaimed Prize Draw Details 3pm (AEST) on 14/07/15 at the same location as the original draw. Unclaimed Prize Draw Winner Notification and Publication Any winner in the Unclaimed Prize Draw will be notified in writing (by email) within two days of the Unclaimed Prize Draw and their name and state/territory of residence will be published in The Australian on 17/07/15. Entries must be received by the Promoter by 4pm (AEST) on 10/04/15. Entries that are submitted by email are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Any entry that is based on a returned Eligible Purchase (except where due to defect of the product) will be deemed invalid. Failure of an entrant to provide a copy of their original itemised receipt/s (as per the Retain Receipt Requirements) (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid). Entries must be on the original entry form. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise. 5. The draw will be conducted at the time, on the date and at the location as stated in the Draw Details. 6. The prize is as stated in the Prize Details. The trip to Melbourne element of the prize includes the following: • return economy airfares (including airfare taxes) for the winner and their companion from the winner’s nearest Australian capit al city to Melbourne (flights not included for Victorian residents); • 4 nights accommodation (twin share) at the Mantra hotel for the winner and their companion; • and a 3 day Sky Deck pass to the 2016 Australian Grand Prix for the winner and their companion. 7. Flights and accommodation are subject to booking and availability. The Melbourne trip element of the prize must be taken on dates to be confirmed by the Promoter in March 2016 to coincide with the 2016 Australian Grand Prix. All other costs associated with the prize, including but not limited to any transfer costs, meals, additional taxes, insurance and other ancillary costs are the responsibility of the winner and his/her companion as incurred. The winner and their companion must depart and return at the same time. The prize is subject to any additional terms and conditions specified by the prize supplier/s including any conditions of entry into the 2016 Melbourne Grand Prix. The winner and their companion are responsible for ensuring that they have all necessary documents to travel to Melbourne. The prize does not include travel insurance. The name on the airfare bookings must appear exactly as written in the winner’s personal identification and that of the winner’s companion. The Promoter is not responsible for denied boarding or any re-issue costs charged by the airline due to an incorrect name supplied. 8. The winner and their travel companion may not accrue frequent flyer points or other credits or points associated with any travel loyalty programs. Prize cannot be used in conjunction with travel discounts or special offers. Any extension or variation of the travel dates nominated by the winner and/or their companion will be at the cost and responsibility of the winner and their companion. Any request to extend or vary travel arrangements must be made in writing and must be received by the Promoter prior to time of booking. Once booked, any changes made to the booking by the winner (and/or their companion) may incur a cancellation or amendment fee, at the cost and responsibility of the winner and/or their companion if applicable. 9. The Renault Clio R.S Sport 200 car includes all statutory and on-road costs. The car element of the prize does not include comprehensive insurance or any accessories not specified. The winner must arrange to attend the premises of the dealer nominated by the Promoter to collect the vehicle. The winner must provide all information and sign all documentation necessary to enable the Promoter to register the vehicle in the name of the winner prior to collection. To be eligible to claim the vehicle, the winner must be capable of obtaining registration of the vehicle in his or her name in accordance with the applicable legislation in the state or territory in which the vehicle is collected. If the winner is, through any legal incapacity or otherwise, unable to register the vehicle in his or her name then he or she may, notwithstanding any other paragraph of these conditions, assign the vehicle to another person with legal capacity for the purpose of registration of the vehicle. All other costs not specified as included in the prize including without limitation fuel etc are at the winner’s expense. Delivery time may vary depending on the availability in the winner’s state/territory. 10.The winner will be notified in accordance with the Winner Notification and Publication section of these conditions. By entering this competition, each entrant requests that his or her full address not be published. 11.The winner (and their companion) must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in promotional material. 12.The Promoter may require the winner to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion. 13.If a winning entry is deemed not to comply with these conditions of entry, the entry may be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 5. 14.The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation the winner or their companions) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. The winner is fully responsible for the acts and omissions of their companion and the Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, the winner and their companion if their companion breaches these conditions, whether or not legally bound by them. 15.The Promoter may in its absolute discretion cancel the prize or otherwise cease to provide any benefit of the prize to a winner (and their companion, if applicable) if the winner (or their companion, if applicable), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. 16.The Promoter’s decision is final and no correspondence will be entered into. 17.The prize is not transferable or exchangeable and cannot be redeemed for cash. If for any reason the winner or their companion does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited and cash will not be supplied instead. The Promoter accepts no responsibility for any variation in prize value. If the prize or any element of the prize is unavailable for any reason, the Promoter may substitute for that element of that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities if required. 18.Notwithstanding paragraph 17, if the 2016 Australian Grand Prix is abandoned, called off or postponed for any reason, the winner and their companion forfeit their entitlement to that component of the prize, and no cash or alternative prize will be substituted for that component of the prize. 19.If the prize has not been accepted or claimed in accordance with the Prize Claim Date and Time or if, after making all reasonable attempts, the Promoter cannot contact the drawn winner (or the drawn winner does not contact the Promoter) by the Prize Claim Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws in accordance with the Unclaimed Prize Draw Details as are necessary to distribute the prize, subject to any requirements of the relevant gaming authorities. Any winner in this draw will be notified as stated in the Unclaimed Prize Draw Winner Notification and Publication. 20.The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including, without limitation, allergies, skin conditions or other reactions), illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). 21.21Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prizes. The prizes will be delivered in Australia only. 22.The Promoter may communicate or advertise this competition using Facebook. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability. 23.As a condition of accepting or participating in any prize the winner’s companion accepts these conditions. 24.If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities if required. 25.The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. 26.All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may collect entrants’ personal information (including through its contractors or agents) or disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with, or developing its relationship with, entrants including to overseas locations such as New Zealand, the USA, Canada, Singapore and other countries in Asia and the EU. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter. The Promoter is bound by the Privacy Principles in the Privacy Act 1988.
