The Executive Engineer, Howrah Division, PHED invites sealed Tender in public manner for & on behalf of the
Governor of West Bengal, for following serials of Civil Engineering works from respective contractors with the eligibility as
depicted in Annexure-A for participating in this Tender process.

The rate accepted by the authority shall remain firm and valid during currency of the contract No.

Tenderers may see and understand the nature and feature of site and make them acquainted with local
conditions and constraints an quote rate accordingly. The Tender shall be presumed to have carefully
examined Drawings, General Conditions, Technical Specification, IS Specification, Clauses and SubClauses of WB Form 2911/(i)/(ii),BOQ etc and to have fully acquainted with all details of site location,
work front, communications, underground utility services, materials, labours, water supply position,
electricity and any other general information pertaining to and needed for the work to be completed in
time duly.
Acceptance of Tender shall rest upon competent Authority delegated with such power. The Authority does
not bind himself to accept the lowest rate and reserves the right to accept the most fair, reasonable and
competitive rate. However, should it is felt by the Tender Inviting Authority,rate may be lowered down by
way of inviting Bid amongst the participants being the Tenders on the day of opening this Tender for
which separate Bid Notice may not be issued. If any Tenderer/Agency intends to withdraw his Tender
before/after acceptance within a period of 90 days from the date of opening of the Tender without
assigning any satisfactory reason/explanation for such withdrawal, Tenderer/Agency in question may be
disqualified and thus debarred to participation in all consecutive Tenders/Quotations/Bids to be invited by
the undersigned for a period of 02(Two) years from the date of opening of the Tender in question. Besides
this, as the case may be, the Contract shall be subjecting to the eventualities as envisaged in Clauses and
Sub-Clauses of WB Form 2911/(i)/(ii) and general Conditions of Contract. If any participant does not
submit tender(s) in paper way and manner duly, such participants may be debarred from participating any
tender/quotation/bid invited by the undersigned for a period of 02(Two) years from the date of opening of
the tender in question.
Escalation of Cost
Security Deposit
Arbitration
There is no provision of any escalation in cost of materials or labour in the Contract whatsoever.
Successful Tenderer shall have to enter into an Agreement in WB Form 2911/(i)/(ii) in
quadruplicate/quintriplicate, as the case may be, within the period to be specified in the acceptance order.
Such Forms along with Tender Documents may be had from the office of the Executive Engineer, Howrah
Division, PHED during office hours on payment of usual charges. Security Deposit shall be realized @
7.5%/8%/10%, as the case may be, from the running accounts bills of the contractor progressively, so that,
at any stage total value of Security Deposit stands to be 10% of the value of work executed taking into
consideration of conversion of Earnest Money to Security Deposit as to be applicable for the Successful
Tenderer/Agency/Contractor in respect of concerned Serial Number of the Work as designated and as
admissible.
Clause 25 of WB Form 2911/(i)/(ii) shall be treated as deleted in terms with Government Order bearing
no. 3372-A dated 20/03/1987 and notification vide no. H/PHE-II/890/2E-177/86 dated 08/05/1987.
Moreover, following clauses are to be adhered to by the concerned during the process of Tendering

In case, office faces sudden closure owing to reasons beyond the scope and a control of the undersigned, any of the last date/dates as scheduled may be
extended up to / to next and following working day keeping attributes of time/instance identical without issuing further and separate notice, should
undersigned feels it to be so necessary and exigent.

Tender Inviting Authority reserves right to issue Tender Papers by partially relaxing credential, as sought for, in respect of Tenderers who possess
engineering acumen and excellent record in timely completion of engineering works in PHE Department.

Persons being authenticated and having registered Power of Attorney may be considered lawfully becoming to be acting on and for behalf of the
Tenderer.

Tenders are to be submitted in sealed covers super scribing with name of the work, NIT No, Serial Designated. The full name and address of the
Tenderer shall have to be written at the bottom left hand corner of the same envelope.

Tender paper comprising of Technical Specifications, General Conditions, BOQ, Drawings, WB Form 2911/(i)/(ii) etc may be had from the office of
the undersigned on payment of Cost Price as depicted in ANNEXURE-A.

Tenderer shall have to quote rate on percentage below, at par or above the estimated cost as per BOQ in English in link in both words and figure
legibly. In case of any discrepancy in the rate and amount, rate shall govern. Erases, changes and corrections of whatever type and nature shall have to
be attested and authenticated by the Tenderer.

The participants while submitting Tender shall make no conditions/propositions/deletions/alterations/modifications in the various Tender Forms and
Pares. Also, any Tender that is not accompanied by all/requisite data/information in respect of rate to be quoted by way of process of Tendering and or
whichever is not initialed or signed by the Tenderer wherever required, shall be deemed to be considered incomplete and may be liable for rejection at
the discretion undersigned.

The rate of the Tenderer shall remain valid for a period of 90 days from the date of opening of this Tender or during the contractual period whichever is
later.

Contractual Time may be extended depending upon value of work remaining as residual in regard to the accepted/estimated valued of work after
successful an satisfactory execution of work depending upon site conditions arising out of disputes and deficiency in getting clear work front, and/or, as
the case may be, consequent upon rendering consent by the Agency on and after expiry of the contract, necessary continuation order may be issued
further on satisfactory execution and completions of contract, should it is considered by the EIC and the accepting authority in exigency to providing
potable drinking water in quality affected area in the District.

Undersigned reserves right to reject all Tender/s under compelling situation, if secrecy of Tender is hindered and or any unlawful situation takes place.

All Tenderers are requested to be present during opening of this Tender. Bid may be conducted subsequently on the date of opening of this Tender
without issuing further notice, should such is felt to be so necessary by the undersigned.

It is customary to submit/exhibit the labour License Certificate registered under provision of Contract Labour (Regulation & Abolition) Act, 1970 by
the Agency, as applicable.

Sufficient care has been taken to avoid variance in between the contents of the listed documents in Tender papers. However, if there exists any variance
between the contents of different documents, the provision in documents coming later shall prevail over the same provided in the contents appearing
earlier, as the contents in the documents are at variance. Besides this, the documents issued time to time during the contractual period shall be treated as
part of agreement/ contract document. Any arithmetical/typing mistake/mistake in spelling or common attributes in nomenclature, and, or, mistake in
unite rate of items in the BOQ shall be corrected in respect of Schedule of Rates of PWD/PHED and treated as a part of Tender Document, even after
issuance of Acceptance/Formal Work Order(s) upto the period of finalization of Tender including usual security/defect liability period of contract.
Imposition of any duty/tax/rule etc owing to change/application in legislations/enactment shall be considered as a part of the Contract and to be adhered
to by the Tender/Contractor strictly.


Canvassing in connection with Tender is strictly prohibited and Tenders submitted by the Tenderers who resort to canvassing shall be subjecting to
rejection.

Acceptance/Work Order may be issued against issuance of allotment order of the scheme, should situation demands likewise under normal situation.

Nothing in this NIT shall be fostered or constructed to limit or abridge the power of the Hon’ble Governor to dispense with or relax the requirement of
the Rules & Regulations to such an extent and content and subject to such conditions as He may consider necessary in the interest of the public Utility
Service.

N.S.C. will not be accepted as Earnest Money.

Enlistment confirmation from ARCS and authentication certificate as Engineers Co-operative must be produced by applicants of exempted category.

The applicant should submit deed for registration of the company under the prescribed letter head with name and style of business to establish the
authenticity of the authorized signatory.

The undersigned reserves the right to accept or reject any application (seeking permission for issuance of tender paper) without assigning any reason to
the applicant.

Current performance certificate regarding works from competent authority enclosed herewith the application.

Authorised signatory of the Company should invariably be present during tender opening to establish his/her personal identity before the undersigned.

The undersigned reserves the right to accept/reject any or all tenders without assigning any reason.

Decision of accepting authority (Executive Engineer, Howrah Division, Public Health Engineering Directorate) is final and binding in all respect.

Receipt copy of labour payment of engaged labour wages must be produce through competent authority at the time of permission for working
Contractor of the scheme.

Declaration in prescribed format of enclosed herewith to be submitted by the tenderer at the time of dropping of tender papers.

Bank Draft to be purchased in favour of the Executive Engineer, Howrah Division, Public Health Engineering Directorate from any nationalized Bank.
