Conditions of Entry
1. Information on prizes and how to enter form part of these Conditions of Entry.
Participation in this promotion is deemed acceptance of these Conditions of
Entry.
2. The Promoter is Australian Postal Corporation (ABN 28 864 970 579) trading as
“Australia Post” at 111 Bourke St, Melbourne VIC 3000, 13 76 78 (the “Promoter”).
Entry
3. The promotion commences at 12am AEST on Monday 21 April 2015 and ends at
11:59pm AEST on Tuesday 30 June 2015 (the “Promotional Period”). No
responsibility accepted for lost, late, illegible or misdirected entries.
4. Entry is only open to residents of Australia aged 18 years or over who fulfil the
entry requirements. Employees, directors, management, licensees and
contractors of the Promoter, its related companies and agencies associated with
the promotion, the immediate families of the above listed persons, and the
retailers of and suppliers to the Promoter are ineligible to enter.
5. To enter the major and minor promotions, entrants must complete the following
steps during the Promotional Period:
a. Spend $5 or more in any single transaction at a participating Post Office
(“Qualifying Transaction”) and request a digital receipt; and
b. Access the digital receipt through MyPost Digital Mailbox by either:
i. Logging-in to the entrant’s MyPost Digital Mailbox account, if the
entrant already has an existing account; or
ii. Registering for a MyPost Digital Mailbox account, if the entrant does
not have an existing account. The entrant must register via the
activation email sent to the entrant’s email address following the
request for a digital receipt; and
c. Present the digital receipt for the Qualifying Transaction (either printed
copy or mobile screen) for scanning at any participating Post Office.
6. Multiple entries are permitted subject to the following:
a. Only one (1) entry permitted per Qualifying Transaction; and
b. Each entry must be submitted separately and in accordance with entry
requirements.
7. The Qualifying Transaction is only eligible if the purchase is not subsequently
refunded.
8. Entrants must retain their digital receipt(s) for all entries as proof of the
Qualifying Transaction. Failure to produce the digital receipt(s) for all entries
when requested may, in the absolute discretion of the Promoter, result in
invalidation of all of an entrant’s entries and forfeiture of any right to a prize.
Digital receipt(s) must clearly specify the store of purchase as Australia Post,
that a spend of $5 or more in any single transaction at a participating Post
Office occurred, and that the purchase was made during the Promotional Period
but prior to entry.
9. To be eligible for the major or minor promotions, entrants must ensure that their
MyPost Digital Mailbox account is opened with the same email address provided
in-store,
10. The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age and place of residence) and
reserves the right, in its sole discretion, to disqualify any individual who the
Promoter has reason to believe has breached any of these Conditions of Entry,
tampered with the entry process or engaged in any unlawful or other improper
misconduct calculated to jeopardise fair and proper conduct of the promotion.
Errors and omissions may be accepted at the Promoter's discretion. Failure by
the Promoter to enforce any of its rights at any stage does not constitute a
waiver of those rights. The Promoter's legal rights to recover damages or other
compensation from such an entrant are reserved.
Major promotion prize and draw details
11. The major promotion draw will take place on Tuesday 7 July 2015 at 11am AEST
at Anisimoff Legal, Level 5, 492 St Kilda Rd, Melbourne, VIC 3004. The Promoter
may draw additional reserve entries and record them in order in case an invalid
entry or ineligible entrant is drawn.
12. The winner of the major promotion will be notified by telephone and email within
two (2) business days of the draw, and their name will be published in The
Australian on Thursday 9 July 2015.
13. The first valid entry randomly drawn for the major promotion will win a holiday
package to their preferred destination(s) within Australia, up to the value of
$20,000. The winner will be able to determine the holiday destination(s) within
Australia, the number of travellers on the holiday, the travel dates and the length
of the holiday, and the contents of the holiday package, subject to reasonable
notice, availability and the budget of up to $20,000. The holiday package must
be organised in conjunction with the Promoter’s travel agent Garwood & Turner
Travel Associates, and can include any of the following items, up to a maximum
value of $20,000 in total: flights (any class), accommodation (any star-rating),
transfers, tours, travel insurance and spending money (up to a maximum of
$3,000, awarded in the form of an electronic funds transfer). The holiday
package must be booked and taken as a single trip, but can include multiple
destinations in Australia. In the event the holiday package planned by the winner
in conjunction with Garwood & Turner Travel Associates is less than $20,000, any
remaining value will be forfeited by the winner and will not be redeemable for
cash. In the event the holiday package planned by the winner in conjunction with
Garwood &Turner Travel Associates exceeds $20,000, the winner will be
responsible for paying the difference.
14. The prize must be claimed within three months of the major promotion draw, and
the trip taken within 12 months of the prize being claimed.
15. The winner and his/her nominated party must depart from and return to the
same departure point and travel together. Frequent flyer points will not form
part of the prize. Prize is subject to the standard terms and conditions of
individual prize and service providers. The winner may be required to present
their credit card at time of accommodation check in.
16. Travel insurance is the responsibility of the winner and his/her nominated party.
The winner and their nominated party should consider obtaining travel insurance
before taking up the prize.
17. All travel arrangements must be organised through Garwood & Turner Travel
Associates. Any alterations (e.g. upgrades, extensions, hotel changes etc.) to the
trip itinerary once the trip has been booked are at the winner’s expense. All
additional costs outside the prize inclusions outlined in clause 13 are at the
winner’s expense (i.e. additional spending money, additional nights’
accommodation, meals other than those included as part of a tour or
accommodation package, taxes (excluding airline and airport taxes), additional
insurance, passports, visas, vaccinations, transport to and from departure point,
items of a personal nature, in-room charges and all other ancillary costs. By
accepting this prize the winner and their nominated party accept that these
costs are their responsibility.
18. As a condition of accepting the major prize, the winner (and his/her party) must
sign any legal documentation as and in the form required by the Promoter
and/or prize suppliers in their absolute discretion, including but not limited to a
legal release and indemnity form. In the event the winner’s nominated party is
under the age of 18, a nominated parent/legal guardian of such person will be
required to sign the legal documentation required under this clause on their
behalf.
Minor promotion prize and draw details
19. Eligible entrants will be automatically entered into the minor promotion where
they can win one of 51 $500 Load&Go Visa Prepaid Gift Cards valued at $505.95
each (including the $5.95 card fee), given away each business day Monday to
Friday during the Promotional Period.
a. The minor promotion winners will be drawn randomly at 4.00pm (AEST) on
each business day Monday to Friday during the Promotional Period at 111
Bourke Street Melbourne VIC 3000. Winners will be notified by telephone
and email within two (2) business days of the relevant draw.
b. Limit of one (1) $500 Load&Go Visa Prepaid Gift Card to be awarded per
customer.
c. Load&Go Visa Prepaid Gift Cards can be used wherever Visa is accepted.
Excludes ATMs, over the counter at financial institutions and merchants
who elect not to accept Visa Prepaid Cards. Merchants or other providers
may impose limits on use of the Card. Conditions, limits and fees apply.

General
20. The maximum total value of all prizes in the major and minor promotions is
$45803.45.
21. The major and minor promotion prizes, or any unused portion of the prizes, are
not transferable or exchangeable and are not redeemable for cash.
22. If for any reason the winner does not take the major or minor promotion prize (or
an element of the prize) by the time stipulated by the Promoter, then the prize (or
that element of the prize) will be forfeited.
23. If the major or minor promotion prize (or part of the prize) is unavailable, the
Promoter, in its discretion, reserves the right to substitute the prize (or that part
of the prize) with a prize to the equal value and/or specification, subject to any
written directions from a regulatory authority.
24. The Promoter may conduct a further draw as necessary, if the major or minor
promotion prize(s) remain unclaimed three months after the draw. If necessary,
an unclaimed prize draw will be conducted on Friday 9 October at 11am AEST at
the same time and place as the original draw, subject to any directions from a
regulatory authority. The winner(s), if any, will be notified by email and telephone
within two (2) business days of the draw, and their name(s) will be published in
The Australian on Monday 12 October 2015.
25. The Promoter's decision is final and no correspondence will be entered into.
26. Tax implications may arise from the receipt or use of a prize. Independent
financial advice should be sought.
27. Nothing in these Conditions of Entry limits, excludes or modifies or purports to
limit, exclude or modify the statutory consumer guarantees as provided under
the Competition and Consumer Act, as well as any other implied warranties
under the ASIC Act or similar consumer protection laws in the States and
Territories of Australia (“Non-Excludable Guarantees”). Except for any liability
that cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoter (including its respective officers, employees, contractors and agents)
excludes all liability (including negligence), for any personal injury; or any loss or
damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of the promotion.
28. Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter (including its respective officers,
employees, contractors and agents) is not responsible for and excludes all
liability (including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of: (a) any technical difficulties or equipment malfunction
(whether or not under the Promoter’s control); (b) any theft, unauthorised access
or third party interference; (c) any entry or prize claim that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the Promoter) due
to any reason beyond the reasonable control of the Promoter; (d) any variation
in prize value to that stated in these Conditions of Entry; (e) any tax liability
incurred by a winner or entrant; or (f) taking/use of and/or participation in the
prize.
29. The Promoter assumes no responsibility for any error, omission, interruption,
deletion, defect, delay in operation or transmission, communications line failure,
theft or destruction or unauthorised access to, or alteration of, the promotion.
The Promoter is not responsible for any problems or technical malfunction of any
telephone, network or lines, computer on-line systems, servers or providers,
computer equipment, software, technical problems or traffic congestion on the
Internet or at any web site, or any combination thereof, including any injury or
damage to entrant’s or referral’s or any other person’s computer related to or
resulting from participation in or down-loading any material in this promotion.
30. If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the reasonable
control of the Promoter, including but not limited to technical difficulties,
unauthorised intervention or fraud, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify,
suspend, terminate or cancel the promotion, or any prize, as appropriate.
31. The use of any automated entry software or any other mechanical or electronic
means that allows an entrant to automatically enter repeatedly is prohibited
and will render all entries submitted by that entrant invalid.
32. Entry into the promotion shall be deemed acceptance of these Conditions of
Entry. The Promoter may at its discretion refuse to award any prize to any
entrant who fails to comply with these Conditions of Entry.
Use of personal information
33. Entrants consent to the Promoter using their name, likeness, image and/or voice
in the event they are a winner (including photograph, film and/or recording of the
same) in any media for an unlimited period without remuneration for the purpose
of promoting this promotion (including any outcome).
34. The Promoter collects entrants’ personal information so that they can enter and
the Promoter can administer this promotion. Without this information, the
Promoter is unable to process an entrant’s entry. The Promoter may disclose
entrants’ personal information to third parties in order to administer this
promotion, including but not limited to agents, contractors, service providers,
prize suppliers and, as required, to Australian regulatory authorities.
35. Entrants’ personal information will not be used for any secondary purposes,
unless the entrant expressly consents to receive information about Australia
Post news, special offers and current and future products and services.
36. Entrants’ personal information is handled in accordance with Australia Post’s
Privacy Policy which outlines how entrants can access and/or correct their
personal information or make a privacy related complaint. Entrants may
