BADASS DASH™ RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT WARNING BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL
RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY.
This is a binding legal agreement. In CONSIDERATION of the acceptance of my registration to participate in the BADASS Dash™ event, the undersigned acknowledges and
agrees to the following terms:
1. Description of Risks:
In consideration of my registration and participation in the BADASS Dash™ events, I hereby acknowledge that I am aware of the risks and hazards associated with or related
to any such adventure, obstacles, and multisport events. The risks and hazards include, but are not limited to, injuries from:

Running, Climbing, Crawling, and Swimming;
Executing strenuous and demanding physical techniques;
Vigorous physical exertion, strenuous cardiovascular workouts, rapid movements, quick turns and stops;
Exerting and stretching various muscle groups;
Entering the water by diving, jumping, or falling;
Extended time in mud, ice, water, and underwater;
Extreme weather and temperature conditions, which may result in dehydration, heatstroke, sunstroke, or hypothermia;
Climbing, mounting, dismounting, crawling, or falling of course obstacles;
Falling or colliding with the ground, walls, trees, stands, containers, course obstacles, equipment, or with other participants;
Falling due to slippery surfaces, or uneven or irregular terrain;
Failure to properly use any piece of equipment, obstacle, or from mechanical failure of any obstacle or equipment;
Contact or being struck by other participants, spectators, event staff, obstacles, equipment or vehicles;
Spinal cord injuries, which may render me permanently, paralyzed.
Travel to and from the events, which are an integral part of BADASS Dash™ races, activities and events;

That I may experience anxiety while challenging myself during the BADASS Dash™ events.
That I may come into close contact with other participants.
That my risk of injury is reduced if I follow all rules established for participation and competition; and
That my risk of injury increases as I become fatigued.
3. Release Of Liability and Disclaimer
In consideration of Bad Ass Dash LLC / Fun Guys LLC / Bad Ass Dash Canada / It’s Affiliated Companies, Venues, Sponsors, Suppliers, allowing me to participate, I agree:

That my physical condition has been verified by a medical doctor within the past twelve months and I am medically cleared to participate;
To assume all risks arising out of, associated with or related to my participation and am fully aware of the nature of these risks including personal injury, death,
property damage expense, and related loss, including loss of income;
To be solely responsible for any injury, death, loss, including loss of income or damage that I may sustain while participating;
To provide Bad Ass Dash LLC / Bad Ass Dash Canada, and it’s Affiliated Companies, and Sponsors, a worldwide license to use all rights of publicity, including but
not limited to my name, image, and likeness, for purposes of promoting events, in advertising (Promotional Rights) in perpetuity (and such release shall apply to
any images or video taken by Bad Ass Dash LLC or on Bad Ass Dash’s behalf at the events.
To RELEASE, DISCHARGE, SAVE HARMLESS AND INDEMNIFY Fun Guys LLC / Bad Ass Dash LLC / Bad Ass Dash Canada / It’s Affiliated Companies, Venues,
Sponsors, Suppliers, and their respective directors, officers, committee members, members, employees, volunteers, officials, judges, contractors, sponsors,
participants, facilities where the activity occurs, agents and representatives from any and all liability, for any and all claims, demands, actions, judgments,
executions and costs that might arise out of my participating, even though any such risks, injuries, loss, damage, claims, demands, actions or costs may have
been caused by any manner whatsoever , including but not limited to, the negligence, breach of contract or breach of any statutory duty of care of Bad Ass Dash
LLC / Fun Guys LLC / Bad Ass Dash Canada, It’s Affiliated Companies, Venues, Sponsors, Suppliers.
4. Acknowledgement
I acknowledge that I have read and understand this agreement, that I have executed this agreement voluntarily, and that this agreement is to be binding upon my heirs, my
executors, administrators, representatives and myself.

FULL AND UNCONDITIONAL RELEASE
FOR PARTICIPATION
(“SOUTH POINT PARTICIPATION RELEASE”)
1.
RELEASED PARTIES DEFINED
The “Released Parties,” for the following event: "102.7 The Coyote Las Vegas BadAss Dash " , are Gaughan South LLC, Gaughan Straight Holdings Inc., 102.7 The Coyote Las Vegas
BadAss Dash (Event Promoter) any sponsor company of the Event, and any of the above listed companies officers, directors, employees, shareholders, contractors, affiliates, agents
and representatives, (individually and collectively referred to as “Released Parties”). This entire Agreement is referred to as the “South Point Participation Release.”
2.EXPRESS ACKNOWLEDGMENT, ACCEPTANCE AND ASSUMPTION OF RISKS
The undersigned participant is fully aware, completely understands, and accepts that participation in the Event, whether as a contestant, employee, volunteer, exhibitor, sponsor or
spectator, is dangerous and that the events and activities associated with, relating to, arising out of, and concerning this participation present substantial, serious, and real risks of
personal injury or death to the undersigned participant, and the loss of, damage to, or destruction of the undersigned participant’s personal property.
The undersigned participant, by his/her signature below, fully and completely accepts and assumes these substantial, serious, and real risks whether or not apparent, known, unknown,
foreseen, unforeseen, present, or contingent, and whether or not caused by any negligence of the Released Parties, or the negligence of any contestant, volunteer or spectator
including but not limited to, any negligence associated with the design or designing, staging, supervising, maintaining or in any way presenting, conducting or sponsoring the Event.
3.FULL AND UNCONDITIONAL WAIVER AND RELEASE
Regarding Section 1 and 2 above, which are incorporated into this Section 3, the undersigned participant expressly and completely waives, releases, discharges, holds harmless and
otherwise agrees not to sue any of the Released Parties in any manner for any claim, loss or damage, or through any forum, at common law or under any statute, rule, regulation, order
or law.
The undersigned participant also completely waives, releases, discharges, and otherwise holds harmless any and all Released Parties from any charges, demands, damages,
attorney’s fees, costs, or losses or expenses of any kind whether in law or in equity, which he/she could assert for all damages or destruction associated with, relating to, concerning, or
arising out of the substantial, serious, and real risks acknowledged, understood, assumed, and expressly accepted in this South Point Participation Release.
4.ASSURANCES
The undersigned participant has read this South Point Participation Release, has had an adequate and sufficient opportunity to consider it and have it explained to him or her. The
undersigned participant fully understands and agrees that this South Point Participation Release is to be interpreted and applied in the broadest and most comprehensive manner in
favor of the Released Parties.
The undersigned participant has full power authority, capacity and right without limitation to sign, deliver and perform this South Point Participation Release. The undersigned
participant further understands, acknowledges, and agrees that he/she is knowingly and voluntarily signing this South Point Participation Release with full knowledge and understanding
of its contents and meaning and with an intent to be bound thereby.
5.BINDING EFFECT This South Point Participation Release shall be and is binding upon the undersigned participant and his/her spouse, legal representatives, heirs, successors and
assigns. The undersigned agrees that this South Point Participation Release is governed by the laws of the State of Nevada.
6. By Signing this release, I have read, understand and intend to abide by the South Point Arena & Equestrian Center Barn Rules & Regulations.South Point Arena & Equestrian
Center's Barn Rules and Regulations are available at Southpointcasino.com or inside the Barn Show office.
