CONDITIONS OF ENTRY
1. The undersigned do hereby agree to the terms and conditions set forth below, and do further swear that all the information furnished
regarding this entry is true and correct to the best of my knowledge. I do further agree and specifically warrant unto any subsequent
owners that I do have absolute and complete title to the entry listed on the reverse side hereof. I do covenant and agree that I will
and shall forever defend said title against all and every person whomsoever claiming a title or interest therein, and further covenant and
specifically warrant this entry is free from any and all encumbrances whatsoever and that at no time subsequent will I create any
encumbrances, and that should any arise I shall at once discharge, satisfy, and completely absolve them.
2. Consignor agrees to consign only good quality, sound healthy horses to this sale. Entry fees on any entry withdrawn for any reason
will be forfeited.
3. Permission is hereby given for any prospective buyer at his own expense to have an accredited veterinarian perform an inspection on
this entry including pregnancy examination.
4. a. I fully understand that I must furnish the auctioneer with this entry and/or verbal information at the sale of any irregularity or
unsoundness of any kind regarding my entry (i.e., horses being denerved, foundered, or have navicular disease or etc.). All bad habits
such as cribbing, stall weaving, bucking, etc., must be stated. The auctioneer is hereby authorized to announce any such findings before
the horse is sold. Violation of this clause gives the buyer the right to return the horse to the consignor who must pay the sale commission
and accept the horse as unsold.
b. Horses purchased at the sale will be required to have a negative Coggins test.
5. Horses will be cataloged by the sale manger and sold in cataloged order unless otherwise announced by the auctioneer.
6. All registration certificates, brand inspection papers, transfer report, stallion service certificate, entry fees must accompany this entry
blank and all must be signed by the owner or legal agent thereof. The sale management will withhold payment to the consignor until the
consignor furnishes to the management all necessary documents for the transfer of the horse to the new owner.
7. It is further agreed that if this horse is sold within 48 hours prior to/or after the sale, or as a direct result of the sale, I agree to pay Ken
Beck and Associates the 8% (eight percent) of the sale price.
8. I agree to wait two weeks (14 days) before receiving payment on my horses when the purchaser makes payment via a personal check.
If the horse is paid for with cash, Ken Beck and Associates will tender payment to me in full for my consignment having made the
deductions listed in the next paragraph at the conclusion of the sale.
9. I do hereby agree that I will be charged a selling fee of 8 percent on the final bid received on the entry and that the sale manager is
authorized to deduct that selling fee from the proceeds when making payment to me. I also agree to pay the following per entry (per
head) fees regardless if my horse sells through the sale: entry/cataloging fee ($100.00), brand inspection ($2.00), veterinary inspection
($6.00), and other fees as customary and appropriate (i.e., bedding, etc.). A $3.00 Colorado Horse Development Board fee (refundable)
will be collected on each horse consigned to the sale from Colorado.
10. I reserve the right to pass this horse from the sale ring as unsold providing notification of this intent is made to the auctioneer prior to
the time the horse leaves the sale ring.
11. I hereby agree to have this horse present at the Sky Ute Downs in Ignacio, Colorado no later than 9 A.M. May 30, 2015.
12. I hereby agree and understand that all footnotes that appear in the catalog will be furnished by me, and that the sale manager is not
responsible for the writing of the footnotes but permission is hereby granted to sale manager to edit, correct, or add to the footnotes that
have been furnished regarding this entry.
13. The terms and conditions of sale as listed in the catalog are hereby incorporated into this agreement.
14. I agree to furnish the buyer of my entry a halter and lead rope. In the event I fail to do so, the sale management will furnish one
and charge it against my account, and deduct it from my proceeds.
15. I understand and agree that Ken Beck and Associates and all representatives and employees of sale managers do not assume and will
not accept any liability for injury or unforeseen illness or accident to any horse listed and consigned to it to sell. In the event a veterinarian
is called to care for or treat any of the animals, I agree to pay for said care, and for any unusual and unforeseen expenses in connection
with said care and treatment. I further agree to indemnity and hold harmless Ken Beck and Associates.
16. I will not alley trade. If my entry sales outside the sale ring on the day of the sale, I agree to pay full commission and fees
