Seminole, Oklahoma USPS 489-380 Tuesday District Judge Injured 50 Cents In Two-Car Accident April 24, 2007 By DONNY COFER Managing Editor Seminole County District Judge Gary Snow and his wife, Linda, were severely injured in a two-car motor vehicle accident on Sunday. Two minor occupants, Breanna Lynn Brooks and Samantha Lynn Brooks, and their mother, Angela Renee Brooks of the second vehicle were also injured in the accident, which took place just before noon at the intersection of SH 9 and US377. According to the accident report, Seminole Police Officer Brad Willis, Central Dispatch was notified of the accident at approximately 11:55 a.m. “When I arrived, Seminole Medicus and Fire were on the scene,” Willis stated in the report. “According to the investigation, Snow’s 2006 Mercury was in the southbound right lane on US377 traveling south bound with a green traffic light when it was hit by vehicle one, a 1996 Red Chevy pickup pulling a travel trailer driven by Jody Dewayne Brooks of Shawnee. According Willis’ report, Brooks’ vehicle was traveling west on SH9 in the westbound left lane and failed to stop for the red traffic light. “The vehicles came to rest about 52-feet west of the area of impact,” Willis said. “The pickup left no noticeable braking skid marks prior to the accident.” Willis said in his report that just prior to approaching the intersection, Brooks had gotten Vol. 81, No. 39 The drive of a third vehicle, Patricia Lynn White, 522, Ada was not injured. According to Trooper Troy Thompson’s report, Kessinger was westbound on SH39 and the other two were going east. “Vehicle one (Kessinger) was attempting to pass another vehicle, and apparently decided he was not going to be able to successfully complete the pass,” Thompson stated in his report. “The vehicle went into a broadside in the eastbound lanes striking Holbutta’s vehicle.” Thompson’s report then states that White’s vehicle took evasive action, striking the eastbound ditch where it was struck by Kessinger’s vehicle. According to the report, Kessinger was ejected at some unknown point and that point could not be determined because the driver had been removed by Konawa EMS prior to the trooper’s arrival. The report states that all (See Fatality on Page 10) government is seeking the forfeiture of more than $700,000 from the Hilsts, who still list their residence as 1 Ridgeline Dr., Wewoka. According to Wewoka city records, Dr. Hilst quit paying water bills for the Wewoka Regional Medical Clinic sometime last year, and the city shut off water to the clinic in February. The records show that the home’s water bill is still being paid. According to U.S. Attorney Eric Melgren, the four defendants are accused of illegally distributing prescription drugs through an internet pharmacy once located in Wichita, Kan. The defendants were set to appear in federal court tomorrow for an initial appearance. An attorney for part-time pharmacist Lovern said his client had nothing to do with the organization and operation of Red Mesa Pharmacy. Donald Ray Kessinger, 28, Konawa, was pronounced dead at the scene by the Seminole County Medical Examiner. The occupant of the second vehicle, Damian T. Pastor Gary Pollard will officiate the service. Interment will follow at Oakwood Cemetery in Wewoka. Services are under the direction of Swearingen Funeral Home, Seminole. Posey, 69, died Monday, April 23, 2007 at Seminole Regional Hospital. She was born July 12, 1937 in Kingfisher to Audrey May (Shay) Greenfield and Ray Leroy Greenfield. She graduated from Cashion Southwest Bible College and later married Donald Leroy “Don” Posey on June 18, 1955 in Kingfisher. Posey worked as a bank teller and bookkeeper for Security State Bank in Wewoka for over 18 years. The couple lived in Branson, Mo., for 13 years moving back to the Seminole area almost three years ago. Surviving is her husband, Donald Leroy “Don” Posey of the home; one son, Donald Posey Ray “Don” Posey of Konawa; one daughter, Nancy Horn of Seminole; one brother, Charles Greenfield of Yukon; one sister Esther Sproul of Edmond and three grandchildren. Casket bearers will be; Chet Horn, Don Kimery, Jeff Misenheimer, Mike Grant, Robert Ingram and Herb Williams. Kessinger, 28, died Saturday, April 21, 2007 in Konawa. He was born on Oct. 7, 1978 in Shawnee to Donald Ray Kessinger and Deborah Kay (Green) Reed. On Sept. 2, 2000 he married Keri Michele Robertson in Maud and he was a longtime Maud resident before moving to Konawa in 2006. He was employed by St. Louis Well Service and was a member of Hart Street Full Gospel Church, Shawnee. Surviving is his wife of the home; father, Donald Ray Kessinger of West Virginia; mother, Deborah Kay Reed of Kessinger Asher; one son, Jason Boggs of the home; three daughters, Myah Robertson Kessinger, Tyler Kessinger and Jessie Kessinger, all of the home; one brother, David Kessinger of Maud and one sister, Nikki Wright of Shawnee. Butner also stated that Snow was scheduled for his third surgery on Tuesday morning. “Linda is doing better, but she still in a lot of pain and her mobility is hampered,” Butner said. According to the indictment, doctors outside of Kansas authorized the order of the drugs for people who filled out an online medical questionnaire set up by Integra Rx and Safe Trust Processing. Customers reportedly paid Integra Rx and Safe Trust Processing through the website, and these companies then forwarded money on to Hilst and Red Mesa. According to federal prosecutors, Hilst and Red Mesa distributed 9,256 orders in less than four months, from December 2005, to March 2006 (at the same Hilst was supposedly operating the clinic in Wewoka). The indictment cited two specific drugs: Ambien (for insomnia) and phentermine (a stimulant sometimes used for weight loss). The American Medical Association requires that a doctor have personal contact with a patient before issuing a prescription. The federal indictment isn’t the first trouble Hilst has found himself in, according to a variety of government sources. As early as 1991, Hilst was sued by Safeway U.S. Holdings for more than $10,000, in Tulsa County District Court. Court records show that the case was settled out of state, in Kansas. In 1999, Hilst found himself in legal trouble in Oklahoma County, when he was issued a traffic ticket for failure to wear a seatbelt. Court records show that the doctor failed to appear on two separate occasions, and so a bench warrant was issued for his arrest. According to court records, the warrant still stands. Then, in 2001, Hilst was charged in Texas County (Oklahoma) with a felony bogus check charge. After failing to appear, a warrant was issued, which also apparently is still in effect. March 2003 was another bad month for Hilst, as two separate suits were filed. In Oklahoma County, he was sued by the State of Oklahoma’s Medical Licensure board for civil relief (though the cause of the case wasn’t immediately available). The fees are associated to work provided by the company to ensure that all safety and maintenance is sufficient according to state guidelines. Commissioners agreed they would like time to clarify the documentation. The fees include all of Seminole County bridges. An approval was made by the commissioners as to the appointment of Donald Meaders, Michael Roberts, Mark Spargo, Josh Ramsey and Nora Nadeau to the Sheriff’s Department. Currently, the County Jail is overflowing at a 90 capacity, far exceeding the normal required capacity. According to County Sheriff Joe Craig, this is still an issue that is being dealt with as best as possible. “We realize we are over populated, but we really have no choice,” Craig stated. “We are currently working on an alternative solution and just trying to figure out what we can do to get it corrected,” he added. Items approved by members of the commission included the acceptance of a $14,500 bid for sewer and plumbing supplies for the Senior Citizens Building at the New Fairground location. The bid came for Contractor Supply of Oklahoma City and it was the only bid received by commissioners. The bid will include a length of six-inch water line and eight inch sewer line for the facility. In regards to the Senior Citizen Building, commissioners additionally agreed to solicit for bids on heat and air condi- $6,298.02 over the course of the next year as a result of the case’s settlement. Also in March 2003, Hilst was sued in Seminole County. PHI Financial Services filed a claim against the doctor. He made an appearance in April, court documents show, and then in May the case was dismissed with no further action. (PHI is Pioneer Hi-Bred International, a subsidiary of DuPont, which develops and supplies genetically-engineered crops to farmers around the world. Hilst’s connection to PHI was unclear.) Then Hilst brought his troubles to Wewoka, when he used part of the defunct Wewoka Hospital to open his “Wewoka Regional Medical Center” on the southeast side of the city. At the time, Hilst refused interview requests by The Producer, and not long after became the subject of a scandal in Wetumka, where he’d reportedly purchased hospital equipment. In January 2005, Hilst got a good buy on an X-ray machine and an ECG monitor, along with 25 other items to help expand his new practice in Wewoka. But city councilors in Wetumka followed the action with requests for the resignations of all their hospital trustee members. Wetumka City Manager Joey Beth Smith confirmed that the reason for the resignation requests was Hilst’s purchase. Councilor Marc Kagan, a physician assistant at a Wetumka clinic, brought the matter to the council, saying the Wetumka General Hospital failed to go out for public bid before selling the items to Hilst. Smith said at the time that she wasn’t exactly sure how the hospital’s trustees came into contact with Hilst, but that he was there to look at some medical supplies, including syringes and other items used routinely in medical clinics. “When he was walking through the hospital, he saw this other equipment,” Smith said, “and offered to buy it.” Apparently, Kagan first learned of Hilst’s purchase when he saw a truck loading the equipment and supplies. He said the Wetumka Family Clinic, where he works, was not aware of the possibility of buying unused hospital equip- tioning for the facility. Commissioners also agreed to accept bids on a new backhoe for District 3 and a new track hoe for District 2. In other business, the Commissioners accepted the resignation of Seminole County OSU Extension Office Director, Kevin Nickell. Nickell was not in attendance at the meeting but did provide a letter to the commissioners thanking them for the opportunity to serve the county. “Kevin has done a good job and we at the courthouse will miss him,” Eberle stated. “He will not be easily replaced and I appreciate his efforts, I propose we accept this resignation and we wish Kevin the best of luck in his future adventures.” According to Nickell, he has taken a job in Oklahoma City but intends to remain living in Seminole County with his family. Commissioners discussed and agreed to the juvenile attendant care and home detention contracts provided by Megan Gay and Kim Le. A discussion was held by the Commissioners, but lead to no action, on the item of the –2007 CDBG Grant. Smith noted that the Wetumka hospital has been closed for about a year and a half, and that the local clinic has had that time to look over the equipment and make an offer. Smith said that once she learned of the coming sale, she had gone to the trustees on three different occasions, asking them to wait, and put the items up for public auction, since it is public property. But she noted that they did have the authority to sell the items. Hilst’s purchase totaled around $8,000. Before opening his clinic in Wewoka, Hilst reportedly conducted major repairs on part of the old building, fixing leaks, replacing windows, installing a new floor, and painting. But this also brought trouble. In October 2005, Hilst was the target of a small claims filing, when T.H. Rogers Lumber Company sued him for unpaid bills of about $500. The small claims case was first postponed when Hilst claimed he had a medical convention to attend, and then was dismissed in November 2005, according to local court records. Then, in December 2005, Hilst was brought before the Kansas “Board of Healing Arts,” and voluntarily surrendered his medical license in that state. “(Hilst’s) offer to surrender his license and his lack of appearance indicate that the facts in this matter are not in dispute,” court documents state. Further documents show that Hilst’s Kansas medical license had been revoked earlier, in 1990. “The board concluded that petitioner (Hilst) was unable to practice medicine and surgery with reasonable skill and safety to patients because of alcoholism,” the court record shows. He got his license back, but it was revoked again in 1997. Special Events ** Ed. Surviving Donna is her mother, Nona Dearing of Wewoka; her husband, Kraig Rogers of Oklahoma City; son, Ryan Hutchison and wife, Linda, of McAlester; Rogers daughter, Teresa Rowlan and husband, Terry, of Mustang; grandsons, Nathan and Kamden Hutchison, and Chase Rowlan; granddaughter, Alyssa Rowlan; stepchildren, April Rogers, Joel Rogers and wife Monica and Jacinta Rogers; step-grandson, Austin Rogers; brothers, David and wife, Carolyn, of Wewoka and Dan Dearing and wife, Linda, of Seminole; and numerous other relatives and friends of the Wewoka area. In lieu of flowers the family suggests that donations be sent to Hillcrest Living Center in Moore.
