DEPARTMENT OF THE TREASURY WASHINGTON, DC 20220 March 26, 2015 Re: 2014-11-010A Mr. Jason Torchinsky Holtzman Vogel Josefiak PLLC 45 North Hill Drive, Suite 100 Warrenton, VA 20186 Dear Mr. Torchinsky: This concerns your Freedom of Information Act (FOIA) appeal dated January 30, 2015, and received in this office on February 5, 2015, on behalf of your client Mr. Craig Robinson of The Patriots Foundation. The basis of your appeal is that you dispute the estimated search time and duplication volume as provided in the January 28, 2015, fee estimate letter sent to your client with regards to FOIA request #2014-11-010. In your appeal, you also requested a waiver of fees. I denied your fee waiver in my letter to you dated March 16, 2015. After carefully considering your appeal, I am affirming the initial fee estimate that was provided to Mr. Robinson in a letter dated January 28, 2015. The estimated fee of $24,508.24 is based upon the 1,067 applications and supporting materials submitted by Sungevity, Inc for Section 1603 awards. The January 28, 2015 letter (enclosed) provides an accurate and detailed breakdown of the estimated search time and duplication costs associated with your request. Please submit your advance payment in the amount of $24,508.24 within 20 working days from the date of this letter. Please make your check or money order payable to the “Treasury of the United States” and send it to the following address: FOIA and Transparency Department of the Treasury Washington, D.C. 20220 Once your payment is received, Treasury will begin to process your request. If we do not receive your payment of $24,508.24 within 20 working days from the date of this letter, we will assume that you are no longer interested in your request and will consider your request withdrawn. If you are dissatisfied with my action on your appeal, you may file a lawsuit in the United States District Court for the judicial district in which you reside or have your principal place of business, the judicial district in which the requested records are located, or the District of Columbia, in accordance with 5 U.S.C. § 552(a)(4)(B). Alternatively, you may contact the Office of Government Information Services (OGIS), which offers mediation services to resolve disputes between FOIA requesters and federal agencies.
