Maulana Azad National Academy for Skills, (MANAS) New Delhi Guidelines for Project Implementing Agencies (PIAs) for Operation, Control & Management of their Training Centres being used for MANAS Programme During the implementation of Entrepreneurship & Skill Development Programmes (E&SDPs) by MANAS, it is observed that PIAs are adopting various models in the field, wherein trainings are organized through the following four models:i. Type – I - Through centres owned and run by the PIAs, ii. Type – II - Through centres in rented premises, but run by the PIA, iii. Type – III - Through entering into franchisee arrangements with local centres, where local centres are affiliated/recognized as PIA, as its training centre with a revenue sharing model. iv. Type – IV - Through fully outsourced arrangement with local centres – where PIA has no training facility of its own. 2. It is a well-established fact that to ensure quality training programme best suited models are models I & II through the centres run directly by the PIA itself. The model-III where the centre is based on franchising of the training centre could also be considered in the eventuality where it is not feasible for the PIAs to operate centres by themselves directly. However, under the MANAS programme the model type–IV, “through the fully outsourced arrangement with local centres” is highly discouraged. 3. It is therefore expected that the PIAs would furnish the proposals of organizing such E&SDP exclusively through the centres (Model – I / II) run by them directly to impart the E&SDP in the most efficient manner, to ensure quality skills training. The outsourcing model (Model – IV) could be considered only as an exception, with the prior written approval of MANAS, in specific cases, duly justifying the reasons, such as better chance of success of the training programme, support from local community to minimize dropouts, effective mobilization, prohibitive investment in terms of setting up new centre etc. 4. Thus, in order to define the nature of arrangement by the PIAs with the filed centres for implementation of the MANAS programme, the basic conditions / documentation required to be fulfilled by the PIA have been prescribed. The general terms & conditions for the respective models are as given below. i. Organizing E&SDP through own Centre of PIA – Model - I a. The PIA should furnish the self-certified copy of the documents establishing ownership of the premises and ownership of training equipments / office infrastructure etc. of the training centre where the E&SDP is proposed to be organized. b. The details of infrastructure available for the training and the reference norms to which it is in conformity. No. players and it is in compliance with the guidelines of the respective body, then a selfattested copy of the affiliation certificate should be enclosed. c. Self-attested copies of electricity, water or Internet & telephone bills in the name of the PIA. d. The details of the staff and faculty should be furnished as per the proforma. 1. e. Self-attested copies of the offer letters issued to the staff members and resume to be made available. f. Self-attested copies of the bank statement of the faculty members showing transfer of salary by the PIA. g. Self-attested copy of the balance sheet for the preceding financial year with specific mention of the centre. ii. Organizing E&SDP through hired training Centre of PIA – (Model-II) Centre In case the PIA hires premises and sets up training institute for organizing the E&SDP training directly by itself, the following information should be furnished by the PIA – Salary Bank Account Details & other employment details of the staff Employment Status (Regular / Contractual / Part Time) Employment Date with Current Employer Previous Employer Industry Experience Technical Qualification Academic Qualification Contact No. Designation Name of Trainer/ Demonstrator/ Operations/ Supporting staff S. No. a. Attach a self-attested copy of the rent agreement between the PIA and the owner of the premises of the training institute, valid for the duration of the E&SDP entrusted by MANAS. The terms & conditions for the payment of rental amount for the hired premises should be given. Further, name of the landlord, Aadhar card or other photo ID proof, Bank account number in which the rent is being transferred. Self-certified copy of revenue documents establishing ownership proof of building/premises should also be submitted for the record and reference. b. List of existing infrastructure / equipment available, if any in the premises and the payment terms for use of the same on rental basis / lease agreement should be submitted. A selfattested copy of the Rental Agreement along with the self-attested copies of documents showing the ownership of the person receiving the rent. c. The details of the staff and faculty should be furnished as per the proforma. 1. d. Type – II centre should be got inspected by the concerned authority for affiliation / certification. In case the Training Centre is affiliated with SSC / NCVT / NSQF or leading Page 2 of 5 industry players, then details of infrastructure available for the training and the reference norms to which it is in conformity should be furnished. A copy of the affiliation certificate should be enclosed. e. Self-certified copies of electricity, water or telephone bills/ internet static IP Address in the name of the PIA or the owner of the premises. f. PIA is required to furnish the details related to operational/training staff of the centre, further, this could be divided into three category – a. If the centre staff is on the role of PIA, the PIA would require to provide all the details related to proof of appointment, salary details, bank account statement, copy of resume, etc. b. If the centre staff is on the role of any third party recruitment agency, PIA is required to provide the detailed agreement between PIA and the Recruiting Agency, in addition to the information at (a) above. c. If the centre staff is associated with centre owner and have been deputed for the project, PIA is required to provide the detailed agreement with centre owner, in addition to the information at (a) above. g. Copy of the balance sheet for the preceding financial year with specific mention of the centre. iii. Franchisee Arrangement – (Model – III) If the PIA has entered in to an arrangement with local skills training centre under franchisee model, the core activities of selection of trainees, provision of approved course curriculum, instruction material, qualification and experience of the faculty, assessment and certification and placement (self & Wage employment) & post placement tracking of the trainees cannot be delegated to the franchisee. The following information should be furnished by the PIA – 1. Operational manual of the PIA, envisaging the procedure for identifying, shortlisting & finalizing the franchisee centres along with franchisee fees and other legal bindings. The operations manual should also include full terms of implementation of the programme till its successful completion. 2. Copy of the agreement/MoU between the PIA and franchisee defining the deliverables and the complete agreement between them. 3. Certified copy of payment terms & conditions – break-up of the cost / expenditure estimates against the training fee approved by MANAS in between the PIA and it’s franchise centre. 4. The PIA should provide the bank account number of the franchisee where the funds for the programme would be transferred by the PIA. 5. The PIA would be responsible for compliance of all guidelines of MANAS issued from time to time and MANAS will have no dealing with franchise centre of PIA, except for supervision, monitoring, inspection and control of training process. iv. Outsourcing Arrangement – (Model – IV) Under the MANAS programme (Model-IV) “through the fully outsourced arrangement with local centres” is highly discouraged. However, in exceptional circumstances the arrangement could be considered with prior written approval of MANAS, with proper justification. No. a. Certified copy of the agreement between the local outsourcing institute and PIA clearly defining the roles and responsibilities of both the partners. It should clearly define the amount per candidate payable to the centre by PIA alongwith the list of deliverables by the outsourced centre. b. The following core activities cannot be delegated by PIA to anyone under any circumstances – a. Mobilisation & enrolment of the trainees – providing admission data to MANAS. b. Development of course content, session plan, course curriculum etc. c. Assessment & Certification of the trainees d. Placement (self & Wage employment) & post placement tracking of the trainees e. Providing all documents/information to MANAS. c. Self-certified copy of the ownership document of the outsourcing partner - In case of rental premises copy of the agreement between actual owner of the premises of the training institute, valid for the duration of the E&SDP entrusted by MANAS. The terms & conditions for the payment of rental amount for the hired premises, should be clearly defined along with the name, address, bio-metric identify proof, Bank account number of the owner of the premises/training/office equipment. d. List of infrastructure / equipment available in the premises and the payment terms between the PIA and local outsourcing agency for use of the same should duly become part of the agreement along with the name, address, bio-metric identify proof, Bank account number of the owner of the premises/training/office equipment. e. The details of the staff and faculty should be furnished as per the proforma. Copies of the offer letters issued to the staff members and resume to be made available. 1. f. In case the local outsourcing partner is affiliated with SSC / NCVT / NSQF or leading industry players, in compliance with the guidelines of the respective body. A copy of the affiliation certificate should be enclosed. In case it is not having any recognition, affiliation/certification by the above mentioned bodies, PIA will get it inspected and provide copy of the affiliation/recognition etc. by the competent agency, before it can start training at such Model-IV centres. g. Self-certified copies of electricity, water or telephone bills in the name of the local outsourcing agency. h. Self-certified copy of an affidavit to the effect that the local outsourcing partner has not been blacklisted by any of the government / statutory agency. i. Copies of the bank statement of the local outsourcing institute as well as some of the faculty members showing transfer of salary by the institute. j. Copy of the balance sheet of the local outsourcing partner for the preceding financial year with specific mention of organizing skills training programme. Page 4 of 5 General Conditions a. From the point of view of MANAS only is responsible for proper transaction of the programme. If any of the entities commits default and is unable to fulfil the obligations as defined in agreement / MoU & MANAS guidelines, the PIA should inform MANAS within 3 days of default. MANAS will deal only with PIAs. b. Once the franchisee, outsourcing /rental arrangement is opted by the PIA, it will not be permitted to change the partner under any circumstances. The PIA would have to conduct the training in the field directly if the arrangement fails. c. In any circumstance franchisee, outsourcing partner cannot further franchise, outsource or sublet the project to any other individual / organization /institutions etc. d. The following activities cannot be the part of franchisee, outsourcing / rental arrangement under any circumstances – i) Mobilisation and enrolment of trainees. ii) Development of course content, session plan, course curriculum etc. iii) Assessment & Certification of the trainees. iv) Placement (self & Wage employment) & post placement tracking of the trainees. v) Providing all documents/information to MANAS related to the entire training programme, from pre-training to post-placement stage. vi) Violation of any of the conditions, stipulated for all kinds of training centres, by PIAs will lead to penal action, including cancellation of the allotment of work, forfeiture of Bank Guarantee, blacklist not only for future work for MANAS but also circulate the information to all other stakeholders, in Government of India/State Government. ***** Page 5 of 5
