Multiple financial bid for multiple projects: Although UPNEDA has allowed to go for two locations in case the proposed capacity is more than 20 MW, we request UPNEDA to allow the bidder to submit multiple financial bids for multiple projects proposed at same locations/different locations. Under this mechanism, the projects will be separated by different switching stations & boundaries so that each project will be treated as individual project for the offered capacity and accordingly, separate PPA for effecting separate Tariff would be signed for each project for the development of project. Hence, multiple projects in same locations have been allowed to construct pooling substation for power evacuation under Central Government JNNSM Scheme for allocation of solar projects. Further, various other State Governments such as Gujarat, Madhya Pradesh, Bihar etc. have also allowed multiple projects with different Tariff at same location under such arrangement. Clarification/Amendment In this regard, we would request UPNEDA to provide the minimum Tariff which shall at least be applicable for further 13 years based on current APPC price and UPNEDA projection. This will hedge the risk of the solar power Conditions as per Clause 2.5 and 2.6 of RFP shall prevail. 4 2 S. As per the Solar Policy of Uttar Pradesh 2013, we appreciate that the expenditure on the construction of transmission line and substation at the Transco / Discom end will be borne by Government of Uttar Pradesh. However as per clause 2.7.6 of RFP, it would be difficult for the solar power developer for taking the responsibility for Construction and operation/maintenance of evacuation system associated with plants. As the very nature of the developer business is to develop, construct, operation & maintenance of the power plant for which they have got the expertise. Hence, we would request you to amend the clause by transferring the responsibility of Construction and operation/maintenance of evacuation system from generating company to State transmission utility which is set up for that purpose only Query Raised by Clarification/Amendment 1. STU / DISCOM responsible for development of transmission line should also submit Bank Guarantee equivalent to the cost of the transmission line. 3. If it is a dedicated transmission line of our project, then can we (SPD) construct and do the O&M of the transmission line? Does this include the 1. RFP Cl. 2.10.3.1 Land requirement for project development @1.5 Hectares/MW should be modified to as per the requirement of the project on per MW basis. Due to usage of new and advanced technology the requirement of land has been changed for different technologies. Requirement of per MW land has been reduced in comparison to old technology. Therefore we suggest UPNEDA to keep the per MW land requirement as per the requirement of the developers. Because it’ll help the developers from purchasing excess land to fulfill the compliance of UPNEDA. Submission of land document should be aligned with the Financial Closure documentation timeline i.e. 210 days from signing of PPA instead of 150 days. The timeline of 15 days for signing of PPA & submission of PBG is too onerous for the SPD. Arranging PBG within 15 days from issuance of LOI will be very difficult. Besides formation of SPV is not possible within this timeframe. As a general practice in solar bid One (1) month timeline is given to SPD for submission of PBG and signing of PPA. Therefore request you to consider the validity of the CPG upto 3 months from Scheduled Delivery Date. And after the commissioning of the project CPG should be released within 1 month from commissioning. RFP Cl. 2.20 In case bidder selected as successful developer for the Solar Project the Bid Bond submitted as EMD can be converted into CPG with the approval of UPNEDA and extending its validity. Because the BID Bond amount already submitted to UPNEDA will be locked until the CPG amount is being submitted to them. Request UPNEDA to consider our suggestion. 1. RFP – Cl. 2.4 & PPA – Article 4.2.1 Solar Power generation depends on solar radiation which is a natural phenomenon. A Solar plant can’t generate same unit during summer, winter, rainy & any other seasons? Therefore it can’t be assured that a plant will generate the minimum CUF of 15% throughout the year. Besides limiting the minimum CUF limit of SPD at 15% in any given contract year is too onerous to maintain whereas maximum radiation of UP is around 5 kWh. Therefore the minimum CUF limit should be in line with the NSM bid i.e.12%. In case the SPD fails to maintain 12% CUF then the SPD may be penalized. There should not be any restriction on purchase of excess energy beyond a particular CUF. 100% generated energy should be procured by the procurer. Query Raised by Clarification/Amendment 1. Clause 2.7.2 and Clause 2.7.3: Please clarify whether the transmission losses of the lines developed by the State in the areas mentioned in clause 2.7.3 will be borne by the State itself, as they have developed the lines. Will UPPCL bear the entire cost of transmission line and evacuation for the projects located in Bundelkhand Please confirm. Does this also include projects developed in regions mentioned in clause 2.7.5. Who will maintain and operate the transmission lines available in the areas mentioned in clause 2.7.5?
