I handle multiple AT&T customer accounts, including the City of Houston's RESPONSIBILITIES AS A 17 ("Houston") accounts. My job duties include but are not limited to being the first 18 point of contact for my assigned customers' communication needs. On any given 19 day, I can place orders at a customer's request, process their change orders, and 20 answer questions they may have related to their accounts. 3 DIRECT TESTIMONY (JONES) 1 Q. HOW LONG HAVE YOU WORKED ON BUSINESS CUSTOMER ACCOUNTS? 2 A. Since approximately 1997 when I started working as a Service Representative. 3 4 Q. ARE YOU AWARE THAT THE CITY OF HOUSTON FILED A COMPLAINT AGAINST AT&T, WHICH IS THE SUBJECT OF THIS PROCEEDING? 5 A. Yes, I am familiar with the issues raised by Houston in its complaint filed in PUC 6 Docket No. 42403. 7 8 Q. AND HAVE YOU HAD A CHANCE TO REVIEW THE DIRECT TESTIMONY OF MARK WILDER? 9 A. Yes. 10 11 Q. WHAT IS YOUR UNDERSTANDING OF THE CITY OF HOUSTON'S ALLEGATIONS IN THIS PROCEEDING? 12 A. It is my understanding that Houston is alleging that AT&T: 1) failed to provide, in 13 whole or in part, discounted rates available under Section 49 of AT&T's General 14 Exchange Tariff and Contract C52034 for certain MegaLink circuits; 2) improperly 15 assessed Interoffice Channel Mileage on specified circuits; and 3) improperly 16 assessed speed calling charges on specified circuits. 17 18 Q. ARE YOU AWARE THAT SOME OF THE ISSUES RAISED BY HOUSTON'S COMPLAINT HAVE BEEN RESOLVED? 19 A. Yes. 20 Q. WHICH OF HOUSTON'S CLAIMS REMAIN IN DISPUTE? 21 A. It is my understanding that the only issue that remains in dispute is Issue 1 D. 4 DIRECT TESTIMONY (JONES) 1 2 Q. WITH RESPECT TO ISSUE 1D, WHAT IS YOUR UNDERSTANDING OF HOUSTON'S CLAIM? 3 A. It is my understanding that Houston is claiming that AT&T discounted two rate 4 elements: the Local Distribution Channel (identified by USOC 1 LDPJ) and the 5 Clear Capability Channel (identified by USOC CLR) in March 2001 on MegaLink 6 III circuit 26.DHDA.002758 but did not discount a third rate element: the 7 Interoffice Channel Mileage (identified by USOC 3LBND) and that the failure to 8 provide a discount on that third rate element resulted in overbilling. 9 Q. WHAT IS AT&T'S MEGALINK III SERVICE? 10 A. MegaLink III is simply AT&T's product name for one of our high capacity data 11 services. In general, per AT&T's Digital Link Service Tariff, the service provides 12 for the simultaneous two-way transmission of a digital signal at a terminating bit 13 rate of 1.544 megabits per second and is available in several types of point-to- 14 point configurations. I am attaching a true and correct copy of AT&T's Digital 15 Link Service Tariff, Section 4, Sheet 1 (original version and Revision 1) as 16 Exhibit 1. 17 Q. WHAT IS THE RATE CONFIGURATION FOR MEGALINK III SERVICE? 18 A. Per AT&T's Digital Link Service Tariff, the four basic rate elements that may 19 apply include local distribution channel, interoffice channel mileage, additional 20 service features, and surcharges. I am attaching a true and correct copy of 21 Section 4, Sheet 3 (Revision 2) of AT&T's Digital Link Service Tariff as Exhibit 2. 5 DIRECT TESTIMONY . (JONES) 1 2 Q. ARE ANY OF THE "ADDITIONAL SERVICE FEATURES" AT&T OFFERS RELEVANT TO THIS PROCEEDING? 3 A. Yes, AT&T offers a Clear Channel Capability feature as an optional feature to 4 MegaLink III service. Clear Channel Capability is a rate element that is 5 mentioned in Houston's complaint and was ordered by Houston for many of its 6 MegaLink III circuits. I am attaching a true and correct copy of AT&T's Digital 7 Link Service Tariff, Section 4, Sheet 4 (Revisions 1 - 2) as Exhibit 3. 8 9 Q. HAVE YOU HAD A CHANCE TO REVIEW ISSUE 1 D TO DETERMINE WHETHER AN OVERBILLING OCCURRED AS HOUSTON ALLEGES? 10 A. Yes. 11 Q. WHAT DID YOU DETERMINE? 12 A. AT&T did not overbill Houston for the Interoffice Channel Mileage component for 13 MegaLink III circuit 26.DHDA.002758. 14 Q. HOW DID YOU REACH THAT DETERMINATION? 15 A. I reached that determination by reviewing the service provided and the billing 16 method associated with the service. 17 Q. WHAT BILLING METHOD WAS APPLIED TO CIRCUIT 26.DHDA.002758? 18 A. The "26" at the beginning of the circuit number signaled to me that this is a circuit 19 that was subject to Border Interconnection Percentage (BIP) mileage or 20 otherwise referred to as meet point billing. 6 DIRECT TESTIMONY (JONES) 1 2 3 Q. OKAY, BEFORE YOU GO ON I WANT TO ASK YOU A FEW FOLLOW UP QUESTIONS ON WHAT YOU JUST STATED. WHAT IS BIP OR MEET POINT BILLING? 4 A. In general, BIP is used when there is more than one service provider operating a 5 particular facility to determine the percentage of revenues each provider is 6 entitled to for the provision of the service. More specifically, BIP is a calculation 7 used to determine the mileage owned by AT&T and another local exchange 8 carrier using V&H coordinates and provides a point to point mileage route. The 9 BIP reflects measurements, based upon airline miles, between the point where 10 AT&T's facilities meet another local exchange carrier's facilities either as the end 11 office or as a pass through. A percentage of the measured mileage is owned by 12 each local exchange carrier on the physical route of a particular circuit. 13 Q. CAN YOU GIVE ME AN EXAMPLE? 14 A. Yes. Let me give you the simplest example. If a customer has a circuit serving 15 its premises located in one of AT&T's service areas and would like to connect 16 that service to another one of their premises located outside of AT&T's service 17 area (meaning AT&T does not provide service in that area requiring AT&T to 18 engage the local exchange carrier in that service area), then that circuit would be 19 subject to meet point billing. This means that because one of the two premises is 20 located outside of AT&T's service area, AT&T would be responsible for and 21 entitled to revenue on its percentage of the mileage for the circuit from the 22 customer's premises located in AT&T's service area up through the point where 23 AT&T's service area meets (or borders) the other local exchange carrier's service 24 area. Similarly, the other local exchange carrier would be responsible for and 7 DIRECT TESTIMONY (JONES) 1 entitled to revenue (or compensation) on its percentage of mileage from that 2 meeting point through the customer's premises in its service area. 3 4 Q. DID YOU INDEPENDENTLY VERIFY THAT CIRCUIT 26.DHDA.002758 WAS SUBJECT TO MEET POINT BILLING? 5 A. Yes, I did. 6 Q. HOW DID YOU MAKE THAT DETERMINATION? 7 A. I looked up the circuit in the SBC OVALS Address Validation database, which is 8 one of the databases I access when I am trying to identify the local exchange 9 carrier for a specific address for a circuit. Based on the OVALS database, I 10 verified that the terminating address of 3915 Rustic Woods, Kingwood, Texas 11 77339, which was provided by Houston, is outside of AT&T's service area. The 12 local exchange carrier currently serving that location is Central Tel. Co. of Texas. 13 The other terminating address is 3300 Main Street, Houston, Texas 77002, which 14 is located in AT&T's service area. I am attaching a true and correct copy of the 15 screenshot of the address and local exchange carrier information provided by the 16 OVALS database as Exhibit 4. 17 Q. WHAT DOES OVALS STAND FOR? 18 A. OVALS is the acronym for One-View Address and Location System. It is an 19 internal AT&T system which verifies addresses and provides the name of the 20 local exchange carrier. 8 DIRECT TESTIMONY (JONES) 1 2 Q. WHEN A CIRCUIT IS SUBJECT TO MEET POINT BILLING, HOW IS THE BILLING FOR THAT CIRCUIT HANDLED? 3 A. There are three billing methods. For purposes of this proceeding, only two of 4 these methods are relevant. One method is for the service provider, AT&T in this 5 instance, to send a single bill with a rate based on a single tariff to the customer 6 that includes the charge for the service, including mileage, on behalf of both local 7 exchange carriers. 8 the applicable tariff, bill the customer, collect that payment, and remit a 9 negotiated percentage of the mileage charge to the other local exchange carrier, 10 and AT&T would keep the remaining portion. The other method is the multiple 11 bill, multiple tariff method which, using the same example, simply means that the 12 customer would, instead of receiving one bill, would receive two bills-one from 13 AT&T for its portion of the mileage charge based on AT&T's tariff and one from 14 the other local exchange carrier for its portion of the mileage charge based on its 15 own tariff. For example, AT&T would calculate the mileage based on 16 Q. HOW WAS HOUSTON BILLED FOR THIS CIRCUIT? 17 A. Houston was being billed using the single bill, single tariff billing method up until 18 March 2006, when the billing method changed to multiple bill, multiple tariff 19 method effective January 1, 2006. 20 under the single bill, single tariff billing method from at least October 2000 21 through December 2005. That means AT&T was effectively billing 9 DIRECT TESTIMONY (JONES) 1 2 3 4 Q. A. OKAY, WITH THAT ADDITIONAL BACKGROUND INFORMATION, EXPLAIN HOW YOU DETERMINED THAT AT&T DID NOT OVERBILL HOUSTON FOR CIRCUIT 26.DHDA.002758? Because the single bill, single tariff billing method was used from October 2000 5 through December 2005, this circuit had some unique order issuing and billing 6 requirements. In this case, the "single tariff" used to determine the applicable 7 rate was AT&T's Digital Link Service Tariff, and the other local exchange carrier 8 would have agreed to receive compensation for its portion of the service based 9 on rates derived from that tariff for this circuit. 10 11 Q. WHY IS THE BILLING METHOD IMPORTANT TO CONSIDER IN THIS PROCEEDING? 12 A. Because if AT&T were required to provide Houston the refund it is requesting for 13 circuit 26.DHDA.002758, it would not be appropriate or just to hold AT&T 14 accountable for charges assessed by the other local exchange carrier during the 15 October 2000 through December 2005 time period at which time the single bill, 16 single tariff billing method was being used. 17 refund of the difference of the monthly rate billed between October 2000 and 18 December 2005 and the $60.00 discounted rate, the $60.00 rate would not be 19 enough to cover the other local exchange carrier's compensation and AT&T 20 would be losing money each month. If AT&T had to provide Houston a 21 22 Q. CAN YOU GIVE US AN EXAMPLE OF WHAT YOU ARE TALKING ABOUT SO THAT WE CAN BETTER UNDERSTAND? 23 A. Yes. If you look at Houston's July 5, 2005 bill for account 713 222-1952 you will 24 see that there was some rate changes occurring on this circuit. For purposes of 10 DIRECT TESTIMONY (JONES) 1 my example, I will use the lower $386.00 rate for the 24 miles on the Interoffice 2 Channel 3 February 17, 2005. 4 consistent with the 5-year term tariff rate under Section 4.5.8 of AT&T's Digital 5 Link Service Tariff, Section 4, Sheet 9 (Revisions 1 - 3). 6 calculation is as follows: $14.00 (per mile) multiplied by 24 miles plus $50.00 7 (fixed rate) equals $386.00. 8 carrier was entitled to at least $154.00, which I calculated by multiplying $14.00 9 (per mile) by 11 miles (representing the other local exchange carrier's mileage), 10 plus a percentage of the $50.00 fixed rate that was also billed. As you can see, if 11 AT&T was required to provide Houston the refund it is requesting and the $60.00 12 discounted rate was retroactively applied, the $60.00 discounted rate would not 13 even be enough to cover the $154.00 that, at a minimum, was previously paid to 14 the other local exchange carrier. That would mean AT&T would be losing money 15 and effectively paying the other local exchange carrier for the provision of service 16 on Houston's circuit. I am attaching a true and correct copy of the July 5, 2005 17 bill and those tariff sheets, hereto as Exhibit 5 and Exhibit 6, respectively. HOW DO YOU RESPOND TO MARK WILDER'S TESTIMONY THAT SECTION 49 OF AT&T'S GENERAL EXCHANGE TARIFF DOES NOT EXCLUDE CIRCUITS SUBJECT TO MEET POINT BILLING? 21 A. Section 49 of AT&T's General Exchange Tariff does not address exceptions or 22 exclusions; it only addresses services and the applicable pricing. In this case, 23 although circuit 26.DHDA.002758 is a MegaLink III circuit, because the 24 termination of the circuit was outside of AT&T's service area, AT&T was required 11 DIRECT TESTIMONY (JONES) 1 to negotiate the mileage charges with the other local exchange carrier. 2 point billing is not included in Section 49 of AT&T's General Exchange Tariff 3 because it has unique order issuing and billing requirements. A true and correct 4 copy of AT&T's General Exchange Tariff is attached hereto as Exhibit 7. Meet 5 6 7 8 Q. HOW DO YOU RESPOND TO MARK WILDER'S TESTIMONY THAT THE LOCAL DISTRIBUTION CHANNEL AND THE CLEAR CHANNEL CAPABILITY COMPONENTS WERE DISCOUNTED UNDER SECTION 49 OF AT&T'S GENERAL EXCHANGE TARIFF? 9 A. Based on my review of the April 5, 2001 bill for account 713 222-1952, I 10 confirmed that AT&T applied the rates available under Section 49 of AT&T's 11 General Exchange Tariff for the Local Distribution Channel (at $145.00 per 12 component) and the Clear Capability Channel (at $5.00 per component) 13 components for circuit 26.DHDA.002758 effective October 17, 2000. 14 because circuit 26.DHDA.002758 was subject to meet point billing and not 15 included in Contract C52034, the discounted rates to those service components 16 did not apply and were provided in error. But 17 18 Q. WHEN WAS THE DISCOUNTED RATE FOR THE LOCAL DISTRIBUTION CHANNEL COMPONENT CHANGED OR REMOVED? 19 A. The discount was removed within 3 months after the re-rating was initiated for 20 that circuit. The S02 Reports provided by Houston show that the $145.00 rate for 21 each of the two Local Distribution Channel components was changed to a 22 $110.00 rate, which is not consistent with the rate for that component under 23 Section 49 of AT&T's General Exchange Tariff. The $110.00 rate was consistent 24 with the 5-year term tariff rate under Section 4.5.7 of AT&T's Digital Link Service 12 DIRECT TESTIMONY (JONES) 1 Tariff, Section 4, Sheet 9 (Revisions 1 - 3). 2 sometime in June or July 2001. I am attaching a true and correct copy of S02 3 Reports bates labeled H42403 NC RFP 1-22-13586 - H42403 NC RFP 1-22- 4 13587 and H42403 NC RFP 1-22-14753 - H42403 NC RFP 1-22-14754 hereto 5 as Exhibit 8, which shows the rate change. See also Exhibit 6. This rate change took place 6 7 Q. WHEN WAS THE DISCOUNTED RATE FOR THE CLEAR CHANNEL CAPABILITY COMPONENT CHANGED OR REMOVED? 8 A. The S02 Reports provided by Houston show that the $20.00 charge and the 9 $15.00 credit, resulting in the $5.00 rate for each of the two Clear Channel 10 Capability components, were removed within 7 months after the re-rating was 11 initiated for that circuit. I am attaching a true and correct copy of S02 Reports 12 bates labeled H42403 NC RFP 1-22-18283 - H42403 NC RFP 1-22-18284 and 13 H42403 NC RFP 1-22-19471 - H42403 NC RFP 1-22-19472 hereto as Exhibit 9, 14 which shows that the charges/credits no longer appear on Houston's S02 Report 15 for the bill period November 5, 2001. 16 17 Q. WHAT OTHER RATE CHANGES, IF ANY, WERE APPLIED TO CIRCUIT 26.DHDA.002758? 18 A. The next change that I found occurred in early 2005. Based on a review of the 19 March 5, 2005 bill for account 713 222-1952, an order was issued to correct the 20 mileage from 22 miles to 24 miles for the Interoffice Channel Mileage for circuit 21 26.DHDA.002758. Specifically, the bill shows that AT&T removed the $710.00 22 monthly rate for 22 miles on the Interoffice Channel Mileage component for 23 circuit 26.DHDA.002758 on February 15, 2005. At the same time, the bill shows 13 DIRECT TESTIMONY (JONES) 1 that AT&T added an $872.00 monthly rate for 24 miles on the Interoffice Channel 2 Mileage component for circuit 26.DHDA.002758 on February 15, 2005. I am 3 attaching a true and correct copy of the March 5, 2005 bill hereto as Exhibit 10. 4 5 Q. WHAT OTHER OBSERVATIONS, IF ANY, DID YOU MAKE FROM THE MARCH 5, 2005 BILL? 6 A. On February 23, 2005, AT&T applied an adjustment in the amount of $15,271.20 7 to Houston's account 713 222-1952 (on consolidated billing account 713 A13- 8 2501) for the difference between the applied rate of $710.00 and a $386.00 9 monthly rate for the Interoffice Channel Mileage component for circuit 10 26.DHDA.002758. I am attaching a true and correct copy of the BOSS notes 11 showing the $15,271.20 adjustment hereto as CONFIDENTIAL Exhibit 11. 12 Q. WHAT IS THE BASIS FOR THE $710.00 RATE? 13 A. Based on my calculations, that rate was consistent with the month-to-month rate 14 under Section 4.2 of AT&T's Digital Link Service Tariff, Section 4, Sheet 6 15 (Revision 3). 16 multiplied by 22 miles plus $160.00 (fixed rate) equals $710.00. I am attaching a 17 true and correct copy of that tariff sheet hereto as Exhibit 12. Specifically, the calculation is as follows: $25.00 (per mile) 18 Q. WHAT IS THE BASIS FOR THE $386.00 RATE? 19 A. As stated previously in my testimony, based on my calculations, that rate was 20 consistent with the 5-year term tariff rate under Section 4.5.8 of AT&T's Digital 21 Link Service Tariff, Section 4, Sheet 9 (Revisions 1 - 3). Specifically, the 14 DIRECT TESTIMONY (JONES) 1 calculation is as follows: $14.00 (per mile) multiplied by 24 miles plus $50.00 2 (fixed rate) equals $386.00. See Exhibit 6. 3 4 Q. WHAT CONCLUSIONS HAVE YOU DRAWN, IF ANY, BASED ON THE $15,271.20 ADJUSTMENT? 5 A. Based on the BOSS notes ( CONFIDENTIAL Exhibit 11), AT&T was providing an 6 adjustment for the difference between the month-to-month tariff rate and the 5- 7 year tariff term rate. 8 9 10 11 Q. YOU JUST TESTIFIED THAT AT&T CORRECTED THE INTEROFFICE CHANNEL MILEAGE FROM $710.00 TO $872.00 BUT NOW I HEAR YOU SAYING THAT AT&T WAS PROVIDING AN ADJUSTMENT BASED ON A $386.00 RATE. WHY DIDN'T AT&T CORRECT THE RATE TO $386.00? 12 A. It was corrected effective February 17, 2005. That change appears on Houston's 13 July 5, 2005 bill for account 713 222-1952. See Exhibit 5. 14 15 Q. WHAT OTHER ADJUSTMENTS WERE APPLIED, IF ANY, DURING THAT TIME PERIOD? 16 A. AT&T provided an adjustment to satisfy in the amount of $5,588.01 to account 17 713 222-1952 ( on consolidated billing account 713 A13-2501) on June 2, 2005 18 for the billing on the Interoffice Channel Mileage component for circuit 19 26.DHDA.002758. I am attaching a true and correct copy of the BOSS notes for 20 the $5,588.01 adjustment and the June 5, 2005 bill for account 713 222-1952, 21 which includes the $5,588.01 adjustment as part of a larger adjustment in the 22 amount of $5,591.79, hereto as CONFIDENTIAL Exhibit 13 and Exhibit 14, 23 respectively. 15 DIRECT TESTIMONY (JONES) 1 Q. BOSS NOTES (CONFIDENTIAL EXHIBIT 13)? 2 3 WHAT OTHER OBSERVATIONS DID YOU MAKE AFTER REVIEWING THE A. It is apparent that, since at least June 2005, AT&T's position has been that circuit 4 26.DHDA.002758 was not included in Contract C52034. This has been AT&T's 5 position for at least 10 years. 6 under Contract C52034 because it was subject to meet point billing. 7 that AT&T provided Houston with an adjustment to satisfy in June 2005 is not an 8 indication that a discount was due on this circuit. WHAT OBSERVATIONS DID YOU MAKE FROM HOUSTON'S JULY 5, 2005 BILL FOR ACCOUNT 713 222-1952? 14 A. Based on a review of that bill, AT&T changed the rate for the Interoffice Channel 15 Mileage to $386.00. Specifically, the bill shows that AT&T removed the $872.00 16 monthly rate effective February 17, 2005, and at the same time, AT&T added a 17 $386.00 monthly rate for 24 miles on the Interoffice Channel Mileage component 18 for circuit 26.DHDA.002758 effective February 17, 2005. See Exhibit 5. 19 20 Q. AND IS IT YOUR TESTIMONY THAT THE $386.00 WAS THE 5-YEAR TERM RATE UNDER AT&T'S DIGITAL LINK SERVICE TARRIF? 21 A. Yes. 16 DIRECT TESTIMONY (JONES) 1 Q. Based on that fact, applying Section 4.5.8 of AT&T's Digital 19 Link Service Tariff, Section 4, Sheet 9 ( Revisions 1 - 3), I calculated the 20 Interoffice Channel Mileage component for a circuit with 24 miles under a 5-year 21 term tariff rate and came up with a $386.00 rate. Therefore, I am no longer of the 22 opinion that the $386.00 monthly rate included a monthly charge of $60.00 for 23 the Interoffice Channel Mileage owned by AT&T and that the other $326.00 17 DIRECT TESTIMONY (JONES) 1 monthly charge was owned by the other local exchange carrier as I stated in my 2 affidavit. 3 4 Q. DID THE BILLING METHOD FOR CIRCUIT 26.DHDA.002758 CHANGE IN 2006? 5 A. Yes. 6 0. PLEASE EXPLAIN. 7 A. In November 2005, AT&T sent a notice dated November 18, 2005, titled 8 "IMPORTANT NOTICE" to certain customers, which would have included 9 Houston, regarding a billing change for IntraLATA private line service that was 10 jointly provided between AT&T and either United Telephone Company of Texas, 11 Inc. d/b/a Sprint or Central Telephone Company of Texas, Inc. d/b/a Sprint. In 12 general, the notice informed those customers that the method of billing would 13 change from the single bill method to the multiple bill method. 14 specified, among other things, that for customers not currently under a contract, 15 the change would be effective January 1, 2006. I am attaching a true and correct 16 copy of the "IMPORTANT NOTICE" hereto as Exhibit 15. The notice 17 Q. WAS THIS CIRCUIT UNDER CONTRACT ON NOVEMBER 18, 2005? 18 A. No. 19 0. PLEASE EXPLAIN. 20 A. HOW DID THE CHANGE IN THE BILLING METHOD AFFECT THE RATES AT&T CHARGED FOR THE CIRCUIT IF AT ALL? 7 A. Because Houston's 5-year term agreement expired in November 2005, the rate 8 for each component of service reverted to month-to-month tariff rates effective 9 January 2, 2006. The rate changes are shown on the April 5, 2006 bill for 10 account 713 222-1952. AT&T's billing for its portion of the service included a 11 charge of $529.00 for 13 miles and another charge for one Local Distribution 12 Channel. It also appears that Houston again added the Clear Channel Capability 13 as an optional feature; therefore, AT&T charged Houston for one of those, as 14 well. And based on my calculations, the $529.00 rate for the Interoffice Channel 15 Mileage component was consistent with the month-to-month rates under 16 Section 4.2 of AT&T's Digital Link Service Tariff, Section 4, Sheet 6 (Revision 4). 17 Speciftally, the calculation is as follows: $28.00 (per mile) multiplied-by 13 miles 18 plus $165.00 (fixed rate) equals $529.00. However, I did not find a purchase order number from 6 Houston making a request that the term agreement be renewed. Therefore, 7 those month-to-month rates are appropriate and correct.
