FUEL STATION IMPROVEMENTS
STATE OF WYOMING
NOTICE IS HEREBY GIVEN that on the 21st
day of May 2014, final settlement will be made
by Weston County School District Number 1 of
$43,725.20 for and on account of the contract
of Leighton Construction and Services LLC for
the Fuel Station Improvements project and that
any person, co-partnership, association or corporation who has an unpaid claim against said
Leighton Construction and Services LLC for or
on account of the furnishing of labor, materials,
team hire, sustenance, provision, provender
or other suppliers used or consumed by such
Contractor or any of the subcontractors in or
about the performance of said work, may at any
time upon to and including said time of such final
settlement on May 20, 2014, file a verified statement of the amount due and unpaid on account
of such claim with the:

Failure on the part of a claimant to file such

ADVERTISEMENT AND INVITATION FOR BIDS
Completed sealed bids for the Kitty Moats
Complex Project (re-bid) will be received from
General Contractors no later than 3:00 p.m. on
Tuesday, May 27, 2014 at the project site, 551
Metz Street, Osage, WY at which time the bids
will be opened and read aloud.
Copies of the Bid Documents may be
obtained at the Architect’s office upon deposit
of $50.00 (check or money order) and may be
examined at the builder’s exchanges as noted
below, or the office of Schutz Foss Architects.
A Pre-Bid meeting will be held at the project
site, 551 Metz Street, Osage, WY on Thursday,
May 15, 2014 at 9:00 a.m. The Conference
is mandatory for General Contractors and
Mechanical Subcontractors.
All bids submitted shall be complete and contain all required items as per the Project Manual
and shall include a Bid Bond in the amount of not
less than 10 percent of the bid.
The Osage Improvement and Service District
reserves the right to accept or reject any or all
bids, and to waive any irregularities therein.
Preference shall be given to Wyoming contractors, subcontractors, laborers and materials as
required by all current Wyoming Preference Acts
and Wyoming Statutes Annotated (W.S.-16-6-101,
et seq.).

EXTENDED INVITATION TO BID
WESTON COUNTY LIGHT EFFICIENCY
IMPROVEMENT PROJECT
Sealed bids will be received by Weston
County, Wyoming until 4:30 p.m. on May 19,
2014, at the Weston County Clerk’s Office,
Weston County Courthouse, 1 West Main,
Newcastle, Wyoming 82701, for the Weston
County Light Efficiency Improvement Project.
The Weston County Light Efficiency Improvement
Project consists of one Bid Schedule. Bid must
be submitted in a sealed envelope with statement thereon, “BID ENCLOSED, Weston County
Light Efficiency Improvement Project” and submitted to the Weston County Clerk’s Office at or
before the above stated time. Said bids will be
publicly opened and read aloud at 1:30 p.m. on
May 20, 2014 at the Weston County Courthouse/
Commissioners Room, 1 West Main, Newcastle,
WY 82701. No bid may be withdrawn for a
period of thirty (30) days after the date set for
opening thereof. The Weston County reserves
the right to reject any and all bids and to waive
any informalities or technicalities in the bidding;
provided, however, that any bid received after
the time specified or without accompanying Bid
Guarantee, as stated below, will not be considered.
Bidding documents, including technical specifications, may be obtained from the Office of the
County Clerk, Weston County Courthouse, 1
West Main, Newcastle, Wyoming 82701.
A bid guarantee in the form of a properly
executed Bid Bond payable to Weston County,
WY in the amount of not less than 10% of the
total base bid amount shall be submitted with
each bid. A Certified Check or Cashier’s Check
made payable to Weston County for an amount
not less than 5% of the total based bid amount,
drawn upon a Bank certified to do business
in Wyoming, may be used for the Bid Bond.
The successful Bidder for each bid schedule
will be required to execute an Agreement with
the County, in the form supplied in the Bidding
Documents, within thirty (30) days after Notice
of Award is issued. The Notice of Award shall
serve as notice that the Agreement is ready
for execution. The Bid Guarantee shall be forfeited as liquidated damages if the Bidder fails
to execute the Agreement within thirty (30) days
after the Notice of Award is issued, or fails to
provide proper Bond or other form of Guarantee,
as approved.

Monday, May 5, 2014
Mayor Greg James called the regular meeting of Monday May 5, 2014 to order at 7:00
p.m. In attendance were: Mayor Greg James,
Roger Hespe, Archie Callander, Linda Hunt, and
Don Steveson. Absent: Iva Carter, and Todd
Quigley. Also present Department Heads: City
Attorney Jim Peck, City Clerk/Treasurer Brunner,
Police Chief Jim Owens, and Engineer Bob
Hartley.
APPROVAL OF AGENDA: Don Steveson
moved and Roger Hespe seconded to approve
the Agenda for Monday, May 5, 2014. MOTION
CARRIED.
APPROVAL OF MINUTES: Roger Hespe
moved and Archie Callander seconded to
approve the Minutes of the Regular Meeting
of April 21, 2014 and the Executive Session
Minutes from April 21, 2014. MOTION
CARRIED. Mayor James asked for a motion to
appoint Stan Sheehan as an alternate judge for
the City of Newcastle Municipal Court. Linda
Hunt moved and Roger Hespe seconded to
appoint Stan Sheehan as an alternate judge for
the City’s court. MOTION CARRIED.
Todd Quigley joined the meeting at 7:04 p.m.

CITIZEN’S BUSINESS – IN WRITING: 1.
Mayor James read a request for Cap ‘N Bottle
to cater the Horse Sale at the Newcastle
Fairgrounds beginning at 9:00 a.m. and running
until 12:00 midnight on June 21, 2014. Linda
Hunt moved and Roger Hespe seconded to
authorize Treasurer Brunner to write a letter to
the Weston County Clerk stating that Cap ‘N
Bottle is in good standing and has permission to
grant a catering permit to Cap ‘N Bottle for the
date and event read in the request. MOTION
CARRIED. He read another letter from Cap
‘n Bottle requesting authorization to cater outside the City limits to consent for the Husman/
Lenardson wedding at Mallo Camp beginning
at 9:00 a.m. and running until midnight on June
14, 2014. Linda Hunt moved and Roger Hespe
seconded to authorize Treasurer Brunner to
write a letter to the Weston County Clerk stating
that Cap ‘N Bottle is in good standing and has
permission to grant a catering permit to Cap ‘N
Bottle for the date and event read in the request.
MOTION CARRIED. 2. Lanny Reimer, MD submitted a letter to the City for High Plains Health
requesting summer sewer averaging for the summer of 2014. Archie Callander moved and Roger
Hespe seconded to approve the request as read.
MOTION CARRIED.
CITIZEN’S BUSINESS – VERBAL –1. Don
Thorson appeared to request a reduction in
sewer charges that resulted from a water leak.
This request was for a portion the sewer charges
only, not the water. Roger Hespe moved and
Don Steveson seconded to approve the request.
MOTION CARRIED.
MAYOR/COUNCIL REPORTS: - 1. Mayor
James requested volunteers for the City’s WAM
Convention Voting Delegate. Archie Callander
volunteered. Roger Hespe moved and Linda
Hunt seconded to officially appoint Archie
Callander as the City’s official voting delegate to
the WAM Convention June 14, 2014 in Casper.
MOTION CARRIED. 2. Mayor James read
a proclamation declaring May 4-10, 2014 as
Municipal Clerks Week in the City of Newcastle,
WY.
Iva Carter joined the meeting at 7:15 p.m.
3. Mayor James reviewed a letter from
WYDOT Aeronautics Division regarding 6
months of annual contract for preventive maintenance for Mondell Field. This maintenance is
for the weather AWOS system. He requested
approval to sign the State Grant in Aid document. Archie Callander moved and Linda Hunt
seconded to authorize the mayor to sign the
WYDOT Aeronautics document. MOTION
CARRIED. 4. Linda Hunt commented that the
baseball fields, the parks and the greenways
continue to be vandalized. The City has installed
more lighting but she requested assistance from
the community to help “police” these areas. She
particularly mentioned that one of the new signs
at Railroad Park was vandalized one week after
it was installed.
DEPARTMENT HEAD REPORTS:
City Attorney Jim Peck - 1. stated that
regarding the vandalisms the sheriff and police
departments have been investigating these situations. He made another plea for the public to
come to the aid of law enforcement to assist in
catching these vandals. 2. the deeds on the
property in Gray Addn and the resolutions were
filed. The City’s responsibilities in that project
are complete at this time. 3. City Court has 11
cases for court this week.
City Engineer Bob Hartley 1. the City
crews are working on pot holes; 2. the refinery
project pipeline is done. 3. there is some money
left over in the equipment portion of the Parks
Budget. He requested permission to advertise
for bids for a building at the ball fields (built in the
open area between the two little league fields).
Council consensus was to proceed.
Police Chief Jim Owens - 1. the uniform patrol
section is back up to full strength so he is trying
to get some officers out for training. Officers
Tacy and Herrberg completed the Interview and
Interrogation Course last week. Hillhouse will
go to a 2-day Drug Identification Course put on
by DCI; Officer Miles will be doing her TASER
Recertification Course in Colorado next week.
Detective Williams had shoulder surgery on April
29, 2014; hope to have him back on limited duty
in May and hopefully full duty by August. 2. He
attended the Police Chief Admin Conference in
Casper; A few items of city concern came out of
the conference: In June there will be an Interim
Legislative Committee meeting in Sheridan
where they will discuss two topics: 1) there
is currently no E911 tax base on pre-paid cell
phones; discussion on whether the State should
take over all E911 funds; Negative side – state
would control funds for local system; Positive
side – a state pool of funds would be distributed on an “as need” basis and would help the
smaller communities who have too little funds
while the larger communities have more than
they need; 2) Also the Next Gen 911 services
are a long way from being implemented due to
the fact that software is still 4 years from being
completed and also there is a need for filters on
viable information that would come into dispatch
centers.
City Clerk/Treasurer Charita Brunner – 1.
requested to have Mayor James sign a Business
Associate Agreement with Willis (the City’s
health care insurance agent) as a “business
partner” to allow Willis to have access to the
City’s health plan individually identifiable health
information. This requirement satisfies the City’s
responsibilities according to the Health Insurance
Portability and Accountability Act of 1996
(HIPAA). Iva Carter moved and Linda Hunt seconded to authorize the mayor to sign the Willis
document as requested. MOTION CARRIED.
2. Treasurer Brunner reviewed the WAM
Resolutions that she had previously e-mailed to
Council. Council consensus was to support the
resolutions, particularly Resolution 14-05 regarding a 1% Optional Sales Tax submission for vote
by municipalities AND Resolution #14-07 regarding “revision to Wyoming Unemployment Rules
regarding the right to protest benefit charges for
reimbursable based employers”. 3. She related
that Deputy Vodopich received an e-mail from
the Wyoming Liquor Division regarding Fresh
Start. The e-mail did not verify that Fresh Start
had corrected their dispensing room errors, but
just that they had contacted the Liquor Division
regarding the issue. 4. She reminded the
Council of the Preliminary Budget work session
to be held Tuesday, May 6, 2014 at 5:00 p.m.

go into an Executive Session to discuss personnel. Roger Hespe moved and Linda Hunt seconded to go into executive session at 8:00 p.m.

The regular meeting of the Weston County
Commissioners convened at 9:00 a.m. with
Chairman Seeley presiding. Present for the meeting were Commissioners: Lenard D. Seeley, Jerry
Shepperson, Randy Rossman, Tracy Hunt, Marty
Ertman and County Clerk, Mamie C. Krank.
Invocation and Pledge of Allegiance
Chairman Seeley gave the Invocation and
Commissioner Rossman led the delegation in the
Pledge of Allegiance.
Approve Minutes
A motion was made by Commissioner Hunt,
seconded by Commissioner Shepperson, to
approve the minutes of the regular meeting held
April 15, 2014, as published. Carried.
Accept Collections
A motion was made by Commissioner
Shepperson, seconded by Commissioner
Rossman, to accept the collections of the County
Clerk in the amount of $12,533.75. Carried.
A motion was made by Commissioner
Shepperson, seconded by Commissioner
Rossman, to accept the collections of the District
Court Clerk in the amount of $1,179.60. Carried.
The meeting recessed at 9:50 a.m. and reconvened at 9:57 a.m. with all present.
Public Transportation
Scottie Murray, Safe Ride, met with the
Commissioners and discussed Fiscal Year 2015
grant funding for public transportation in Weston
County. Mr. Murray stated that the grant funding will be used to purchase an ADA compliant
van and requested $5,383.40 from both Weston
County and the City of Newcastle to be used for
the required twenty percent matching funds. The
public transport service would go to Upton, Osage
and Newcastle weekly. No action was taken.
Bureau of Land Management
Rick Miller and Tracy Pinter, BLM, met with the
Board and discussed the Northern Long Ear Bat
(NLEB) and white nose syndrome, a fungus that
decimates bat populations. NLE Bats have been
caught in northern Campbell and Crook Counties,
although their existence in Weston County is
undetermined. Ms. Pinter related that the US Fish
& Wildlife is concerned about the forested areas
around caves and mines which are hibernation
areas for the NLE Bat. The final ruling to determine if the bat should be listed as endangered is
expected from the US Fish & Wildlife Service in
October of 2014. Mr. Miller distributed literature
on the NLE Bat along with a map showing possible habitat in Campbell, Crook and Weston
Counties. No action was taken.

reconvened at 11:00 a.m. with all present.
Heath Anderson Single Land Division
Heath Anderson met with the Board to discuss
a possible single land division. Chairman Seeley
questioned if the Planning & Zoning Board had
approved the division. Mamie C. Krank, County
Clerk, stated that the single land division had
been approved by the Planning & Zoning Board
and all paperwork was in order. A motion was
made by Commissioner Shepperson, seconded
by Commissioner Rossman, to approve the Heath
Anderson Single Land Division as presented.
Carried.
The meeting recessed at 11:04 a.m. and
reconvened at 11:12 a.m. with all present.
County Road Fund
A motion was made by Commissioner
Rossman, seconded by Commissioner
Shepperson, to approve and sign a County Road
Fund Eligibility Form for the local match to the
Buffalo Creek Road Project in the amount of
$5,000.00. Discussion ensued, carried.
Buffalo Creek Traffic Study Budget
Amendment Hearing
A motion was made by Commissioner Hunt,
seconded by Commissioner Shepperson, to set
a Budget Amendment Hearing for May 20, 2014,
at 9:45 a.m., to consider the transfer of $5,000.00
from the County Road Fund into the General
Fund to be used as the local match portion of the
Buffalo Creek Traffic Study grant. Carried.
Road Crossing Permits
A motion was made by Commissioner
Rossman, seconded by Commissioner
Shepperson, to consent to assign road crossing permits between Weston County and MGCT
Inc. MGCT Inc. would like to assign the permits
to Cheyenne Light, Fuel and Power Company
(CLFP), a subsidiary of Black Hills Corporation.
The permits are on record in the County Clerk’s
Office on the following books and pages: 116535, 116-538, 351-312, 351-315 and 351-318.
Discussion ensued, carried. The recorded votes
were as follows: Yea: Commissioner Rossman,
Shepperson and Hunt; Nay: Commissioner
Ertman.
Easement Application – Breakneck Road
A motion was made by Commissioner
Shepperson, seconded by Commissioner
Rossman, to approve and allow Chairman
Seeley’s signature on an application for easement
to the State of Wyoming to maintain access to
Breakneck Road (County Road #65). The motion
further approved the payment of $44.00 for the
easement and application fees. Carried.
WYDOT
A motion was made by Commissioner
Rossman, seconded by Commissioner
Shepperson, to sign a letter to the WYDOT and
appropriate $5,000.00 to be placed in a WYDOT
account for the purchase of reject materials for
use on Weston County roads. Carried.
Weston County Event Center
A motion was made by Commissioner
Shepperson, seconded by Commissioner Hunt,
to approve and sign Amendment #2 between
Weston County and the Wyoming Business
Council for a service agreement extension
through June 30, 2017, for the Weston County
Event Center. Discussion ensued, carried.
Weston County Event Center
A motion was made by Commissioner
Shepperson, seconded by Commissioner
Rossman, to approve an agreement between
Weston County and Wiss, Janney, Elstner
Associates (WJE) as architect for remediation of
the Weston County Event Center. Carried.
The meeting recessed at 11:51 a.m. and
reconvened at 1:32 p.m. with all present except
Commissioner Hunt.
BFY2015 Consensus Projects
The Commissioners discussed various projects for the 2015 Biennium Funded Consensus
Grant.
Commissioner Hunt rejoined the meeting at
1:37 p.m.
The Board prioritized the Consensus
Projects chosen as follows: 1. Courthouse
Improvements $150,000.00; 2. Youth Exhibit
Hall Improvements $100,000.00; 3. Solid Waste
Projects $300,000.00; 4. Mallo Water Tank
Project, Phase II $60,000.00 5. Upton Fairview
Road, Phase I $400,000.00. Secondary Projects
were as follows: Law Enforcement EOC Phase
III, County Shop Fence, Upton Fairview Rd Phase
II, Mallo Camp Cabin and Various County Roads.
The Consensus Meeting will be held May 12,
2014 at 5:30p.m. at the Newcastle City Council
Chambers.

Solid Waste Facility
Joe Wood Jr., concerned citizen, met with
the Commissioners and discussed the Central
Weston County Solid Waste District (CWCSWD).
Mr. Wood discussed the possibility of Weston
County and the municipalities imposing a tax
for solid waste disposal. The expansion of
CWCSWD boundaries and user fees were also
discussed. The Commissioners encouraged
CWCSWD to charge higher fees to cover the
costs of operation. No action was taken.
Mondell Airport
Byrand Streeter, Mondell Airport Manager;
Dan Moudree and John Patik, Mondell Airport
Board Members, met with the Commissioners and
discussed the Mondell Airport Runway overlay
project. Morrison Maierle Inc. bid the project and
came in approximately $50,000.00 under the next
highest bid. Mr. Streeter requested the Board
sign a task order which for Morrison Maierle Inc.
services as engineer for the project. Mr. Streeter
explained that task Order #4 is contingent on
receipt of the Federal Aviation Administration
(FAA) Grant for the project. A motion was
made by Commissioner Rossman, seconded
by Commissioner Hunt, to authorize Chairman
Seeley’s signature on Task Order #4 for the
Mondell Airport Runway Rehabilitation Project,
Phase II. Carried.
AWOS
Byrand Streeter, Mondell Airport Manager, distributed a Certificate of State Grant-in Aid for the
Automated Weather Observation System (AWOS)
and explained that if signed it would allow for
the State to reimburse approximately $3,298.00
in fees back to Weston County. A motion was
made by Commissioner Hunt, seconded by
Commissioner Shepperson, to sign the Grant-inAid form for reimbursement of AWOS funds to the
County. Discussion ensued, carried.
Road & Bridge Department
Rick Williams, Road & Bridge Foreman, met
with the Commissioners and discussed roads
including the Mallo Camp Road, which needs
gravel and dust suppression. Mr. Williams updated the Board on the progress of the Old Shop
Roof Project, stating materials would be delivered
by May 20, 2014 when the work will begin. Mr.
Williams discussed the purchase of a beaver tail
trailer to haul motor graders which would save
wear and tear on the tires and machinery. The
Commissioners requested Mr. Williams form a list
of road projects to be used as a secondary project for the BFY2015 Consensus Funding.
American Lands Council
A motion was made by Commissioner
Shepperson, seconded by Commissioner
Rossman, to contribute to the American Lands
Council at the bronze level of $1,000.00.

committeewomen must file a statement of receipts by August 12, 2014.

committeewomen, whether successful or not, must file a statement of receipts and expenditures by
August 29, 2014. Candidates for county and municipal offices file with the County Clerk; State or legislative candidates file with the Secretary of State.
The Polls will be open from 7:00 a.m. through 7:00 p.m. on the day of the election. Absentee ballots will be available up to Election Day. Polling places are: Upton Community Center, Osage Kitty
Moats Complex and Newcastle State Forestry Building. Registration is permissible on Election Day.
