VOUNAKI CRUISING AREA
Vounaki Marina is the ideal place to start your adventure in the Ionian. Take a day
yacht and explore the cluster of beautiful islands and sheltered bays that lie in the
waters off the eastern coast of the pretty island of Levkas. Sivota, on the
southeastern side of Levkas is in particular a very pretty and sheltered anchorage
with a good choice of tavernas lining the harbour.
Sailing further south, you’ll discover the enchanting islands of Meganissi and
Kalamos. On Meganissi you’ll find anchorages such as Abelike Bay and Port Athene
– both excellent for lunch stops, swimming and snorkelling. Kalamos is a peaceful
island where you can spend a relaxing afternoon ashore with a picnic. You’ll also
find some of the finest beaches in the entire Ionian along your route, wherever you
choose to spend the day sailing to.

GALINI CRUISING AREA
Take a day yacht out and discover the sailing area that extends from Galini down to
the north coast of Meganissi Island, a spectacular, lush spot with some beautiful
caves along the coastline for you to explore. You’ll also find an excellent choice of
secluded coves and bays, ideal for lunchtime picnic stops. Cruise into the pretty
fishing village of Vathi on Meganissi - the harbour entrance is lined by chapels to
bless boats that leave it and wish them well on their journey.
You can also cruise to Skorpios, the exclusive Onassis Island, which is owned
by the famous family. Although you can’t moor at the island, you can anchor,
plunge into the crystal clear waters that surround it and enjoy a spot of
swimming and snorkelling.

provides the chance for some longer sails. The Sporades islands – as their Greek name
suggests – are ‘scattered’ around the Aegean. Starting and finishing from our base at Milina,

The Gulf of Gulluk has a variety of bays and anchorages to explore. Sail to Torba, a
small sheltered harbour, overlooked by several restaurants. Enjoy the view from the
hillside restaurant at Maya Koy or sail further to Turk Buku.

We have our own traditional Turkish Gulet based at the Club. Enjoy a free daytime
cruise to neighbouring bays, or one of our special Sunset or Starlight Cruises (at a

OUT AND ABOUT
The nearby village of Guvercinlik is only a 10 minute taxi ride away and is worth
visiting for its variety of small taverna style waterfront restaurants serving good
Turkish food. Torba is 20 minutes away by taxi with a good selection of restaurants.

JAVELIN CRUISING AREA
The Gulf of Bodrum has plenty of pretty bays and anchorages for you to explore.
Plunge into glistening waters at the Blue Lagoon and enjoy a refreshing swim or take
a short sail around the point to explore Karaada, also known as the Black Island
even though it is green and covered in pine trees. It is the largest in a group of
uninhabited islands and with stunning steep cliffs that jut into the sea, this
spectacular island has a beautiful coastline. A cave on the island has a spring of
healing hot water and mud and is a popular stop for a day trip.
OUT AND ABOUT
For those interested in local history and culture, we organise a day trip to the ancient
ruins of Ephesus and an evening trip to the traditional village of Gümüslük. You can
visit nearby Bodrum with its excellent bazaar shopping, restaurants and nightlife by
Dolmus (minibus). Bodrum Castle with its ramparts and museum is also well worth
visiting. Our Club team will be happy to help you to organise your own trips to

Sailing west from the Club, you can visit the bustling fishing port of Datça and moor
up along the quay. Alternatively, anchor off the beach and enjoy some great
swimming and snorkelling at Kargi Koyu Bay.

There are some fascinating archaeological remains to be seen at Knidos, including a
large amphitheatre. Or perhaps, take a ferry trip to the bustling Crusader Castle town
of Bodrum, or take a trip to a local olive oil farm.
If you are looking for some local Turkish colour, you can visit the port of Datça by
Dolmus (minibus) or taxi. Datça market is a great place to buy souvenirs and drink
Turkish tea with local carpet sellers! The town’s bay hosts a marina and has many
waterfront cafés bars and restaurants. Diving sessions can also be arranged, for all
experience levels, with a local CMAS dive centre.

The transfer time to Club Perili is approximately 2 and a half hours. We understand
that this is quite a long journey but most people who come regularly to Perili
assure us that it is well worth it. It’s this distance which locates Perili in uncrowded,
unspoilt Turkey, and provides the ‘get away from it all’ atmosphere that this Club is
famous for.

Our Turkish village at Perili offers accommodation in various buildings. Bedrooms are as
unique as the buildings themselves, with no two rooms being identical.

individual furnishings, a good location, size and/or views.

TIME DIFFERENCES
Greece and Turkey are two hours ahead of the UK. Antigua is 4 or 5 hours
behind the UK, according to winter or summer GMT.
WHAT TO PACK?
Dress code at the Clubs is very relaxed and informal and we recommend
travelling light with swimwear, shorts and t-shirts for the daytime and casual,
comfortable clothing for the bar and restaurant areas. To protect yourself
from the sun, we recommend you wear a hat, sunglasses and high
protection water resistant sun cream (factor 20+). For early and late season
you will also need some warmer clothing and you may like to bring a
wetsuit, although these can be hired at the Club.
All of the main equipment you need for your Club holiday is provided free
of charge. However, you might like to bring your own sailing gloves and
watersports accessories. For on shore activities, don’t forget to pack your
sportswear and appropriate footwear. Although towels are provided at our
Clubs, beach towels are not, so please bring your own.
CLUB SHOPS
All of our beach clubs have shops where you can buy many holiday items
from beach towels and swimwear to clothing and sunglasses. You can also
purchase professional sailing gloves and sailing shoes as well as wet suits.
We also offer basic medical supplies and a wide choice of toiletries,
including baby products such as food and formula milk, wipes, shampoo,
nappies and swim nappies. Clubs offering Club Flotilla also have
provisioning facilities for everything you require on board.
MONEY MATTERS
At the beginning of your holiday you will be given a swipe card which can
be used to purchase items at the bar, shop and reception. All items are
charged to your room bill, ready to settle weekly or at the end of your
holiday. You can view your bill at reception at any time. Outside the Club
you will need Euros for Greece; Turkish Yeni Lira for Turkey and US dollars or
Eastern Caribbean dollars for Antigua.
ROOM CLEANING AND SERVICE
Your room will be cleaned daily. Bed linen and towels are changed twice
a week. A laundry service is available at all Clubs.
FIRST AID/MEDICAL ASSISTANCE
All Clubs have staff who are trained to RYA basic First Aid standard and local
doctors are available for further medical assistance.
BEACH OPENING TIMES:
Mediterranean: 9.30am – 1pm and 2pm – 5.30pm every day
Caribbean: 8.45am – 4.45pm every day
SCUBA DIVING
Those who have pre-booked diving for their holiday will receive an
information sheet. If you have any health issues which may come under
question before diving, it is advisable to bring a medical certificate from your
GP stating that you are fit to dive. You must also check your insurance cover
includes this activity.
EARLY/LATE SEASON HOLIDAYS
Please appreciate that if you choose to holiday ‘out of season’, some shops
and local facilities may be closed as they only operate during high season.
On a Club Flotilla holiday, this may mean more cooking on board if
restaurants are closed.
DISABLED PEOPLE OR THOSE WITH REDUCED MOBILITY
People with disabilities or reduced mobility should please contact our
reservations team to discuss the best locations for a Club holiday.

1. Please take care not to drop litter, which not only is unsightly but is harmful
to animals. If you can leave places ‘better than you found it’ you will help us
to make a real difference.
2. Take the minimum of packaging with you. Soap boxes, wrappers and so
on place additional strain on waste disposal systems that may already be
unable to cope.
3. Try to use water sparingly. Take showers instead of baths.
4. Use detergents that are eco friendly for cleaning and shampooing, this will
prevent pollution to water supplies, the sea and rivers.
5. Turn down/off air conditioning when not required. Switch off lights when
leaving a room.
THE ECONOMY
1. Respect the local culture and traditions. Ensure that your dress and
behaviour is appropriate for the places you visit.
2. Support local craftsmanship and remember bargaining for the sake of it is
accepted, but can be overdone.
3. By enjoying the local cuisine, using local suppliers and local guides you will
enrich your holiday experience and help support the local economy.
4. Please don’t pick flowers and plants or collect pebbles and seashells. Leave
them for others to enjoy.

At the time of booking, we require your credit/debit card details for insurance
premiums (if required) and the deposit(s) or the full balance if booking within
10 weeks of the start of your holiday. We will then give you a reference
number and send you a booking confirmation.
SPECIAL REQUESTS
We are happy to take any special requests you may have, i.e. a specific room.
However, whilst we will do our utmost to meet your request, unless there is a
charge or we confirm in writing, special requests are not guaranteed.
PAYMENT
Deposit payments are £150 per person excluding infants under 2 years on the
date of their return flight for whom no deposit is payable. Final payment of the
balance of your holiday is due 10 weeks before the date of departure. Please
bear in mind that we require 5 working days for cheques to clear. Cheques
that will not clear at least 10 weeks before departure are not acceptable. If you
wish the final balance to be automatically debited from your credit/debit card
when the final balance is due, please indicate this by marking the appropriate
area of your booking confirmation when signing. Failure to pay by the due date
will result in your holiday being cancelled and you will lose your deposit.
YOUR CONTRACT
Our contract with you is made when we accept your completed booking
confirmation with the accommodation and pricing you have requested.
Please check this information carefully and complete any other outstanding
detail, i.e., party members, sailing experience etc. Please sign and return to
Sunsail within 7 days.
The person who signs the booking confirmation is called the Lead Name.
When the Lead Name signs the form, this confirms that the people named on
it accept the booking conditions as shown on pages 97 – 98 of this brochure.
Upon receipt of this confirmation form Sunsail will send you a holiday
confirmation invoice. If you book within 7 days of your departure or if there is
not enough time to send you written confirmation, a contract between us will
exist when we confirm your booking. We reserve the right to refuse your
booking. If this should be the case we will refund any money already paid to
us. If you cancel or alter your booking later you may be subject to
cancellation/administration charges. The Lead Name is responsible for the full
cost of the holiday, including insurance premiums and cancellation or
amendment charges.
AMENDMENTS/CANCELLATIONS
Changes or cancellations to your booking must be made by telephone and
confirmed in writing to our After Sales Team on 023 9222 2333 who will
endeavour to assist you where possible. There is a charge of £20 per person
for each change made unless the change is made within 10 weeks of
departure in which case it will be treated as a cancellation and cancellation
charges will apply. Please refer to points 3 and 4 of our Booking Conditions
on pages 97 and 98 of this brochure for further details.
TRAVEL DETAILS AND TICKETS
We will send all documents and other information to the Lead Name, who
must inform other members of the party. Airline tickets will be sent to the
Lead Name approximately two weeks prior to departure. Tickets will not be
issued until we have received your holiday confirmation and full payment.
YOUR SECURITY
When you book your holiday, it is essential to know that your holiday
payments are secure. The air holidays and flights in this brochure are ATOL
protected by the Civil Aviation Authority. Our ATOL number is ATOL 987. To
obtain this we are required to lodge a substantial bond to protect your holiday.
This means in the unlikely event of our insolvency before or during your
holiday you will be repatriated, if already abroad, or if your holiday has not yet
started, the money which you have paid us will be returned to you in full.

You may not travel with us unless you have holiday insurance either with
Sunsail’s provider or by arranging a policy yourself with comparable or greater
cover under all sections. Sunsail offers travel insurance arranged through
Towergate Chase Parkinson Ltd. Elvia Travel Insurance International N.V.
underwrites the scheme. They are the largest insurer of travel insurance policies
within Europe and part of the Alliance Insurance Group.
HEALTH INSURANCE WARRANTY
This policy is conditional upon each insured person being in good health at the
time of booking. If you are aware of any medical conditions or material facts that
may prevent acceptance of your cover it is vital that you inform Towergate Chase

SUNSAIL FLIGHTS AND TRANSFERS
Air travel is on licensed charter flights recognised by the Civil Aviation
Authority (CAA). For 2006, our charter flights will be from London Gatwick,
Manchester and Luton with First Choice Airways. Please refer to the individual
Club pages for flight options and times. If you are on a Sunsail flight, your
holiday price includes your transfers to/from the Club/Flotilla base in your
chosen destination. You will be greeted at your arrival airport by a member of
the Sunsail team who will direct you to your transport and supply you with a
bottle of water for the journey. Transfers may include a stop en-route in
addition to the journey times given in this brochure.
REGIONAL FLIGHTS
Please check availability for regional flights at the time of making your
reservation. We may be able to arrange other regional flights for travel to your

Foreign nationals seeking to take out our insurance should be aware that their
own countries might have restrictive rules preventing them from taking our
insurance. Please check this with a local travel agency in your own country.
If you plan to participate in any activities other than those offered directly
through Sunsail (i.e. kite surfing), please contact your insurer to ensure you are
fully covered for personal accident and personal liability.

Alternative travel/departure days can be arranged to Club Colonna, Antigua
with Virgin Atlantic Airways. We have negotiated exclusive rates for travel in
their Economy, Premium Economy and Upper Class services. Please call

For all scheduled carrier itineraries, we request payment at the time of
booking, in order to secure the seats and prices.
BAGGAGE ALLOWANCE
For passengers travelling on First Choice Airways charter flights, the baggage
allowance is 20 kilos for economy and 30 kilos for Star Class Premier.
Cabin baggage is limited to 5 kilos per passenger. Should you book an
alternative scheduled flight through Sunsail, your baggage allowance will
be communicated to you at the time of booking.
Bags weighing over 32 kilos will not be accepted and will need to be
re-packed into two bags.
FLIGHT TIMINGS
Airline schedules may alter occasionally causing a change to the brochured
flight timings. This is outside of Sunsail’s control. Details of your flight
numbers, carrier and timings will be provisionally confirmed to you when
you make your booking. In the event of any major changes we will advise
you as soon as we have details. Final details will also be shown on your
travel documents.
CONNECTING FLIGHTS
If you require connecting flights to meet our charter flight, Sunsail can arrange
flexible flight tickets for you. Please call 023 9222 2222 for availability and
prices. We will only book flexible tickets in order that these may be altered in
the event of schedule changes/delays to your charter flight.
If you choose to arrange your own non-flexible tickets, that this is at your own
risk and we cannot accept responsibility for any extra costs incurred due to
changes in our flight timings or delays.

This brochure is issued at the sole responsibility of Sunsail. It is not issued on
behalf of the airline and does not commit any airline whose services are used
in the course of the holiday.
FLIGHT DELAYS
It is regrettable, but flight delays may occur. Where the delay is caused by the
airline, accommodation, food and refreshments may be provided by the
airline. In addition, if you have taken out Sunsail Insurance, you will be entitled
to £20 compensation after the first 12 hours delay and a further £10 for each
subsequent 12 hour delay up to a maximum of £100 per person in total. You
also have the option, after a 12 hour delay of your outward journey from the
United Kingdom, of cancelling your holiday and receiving a refund, unless
covered by insurance, of the amount you have paid for your holiday, subject to
a maximum of £1500 per person. If you are booking transport of any
description to connect with any of our charter flights, please check with our
office first and obtain up to date flight schedule arrangements.
MINIMUM AGE
Unaccompanied passengers under the age of 18 will need a letter of consent
from a parent or guardian. The minimum age of travel is 17 years on the day
of departure.
HEALTH
At the time of publishing no vaccinations were required for British citizens
visiting any of the destinations featured in this brochure. For further
information you can obtain a copy of The Department of Health booklet T6,
Health Advice for Travellers from Post Offices or by calling 0800 555 777 or a
specialist travel clinic MASTA (Medical Advisory Services for Travellers Abroad)
on 0208 994 9874. If you are a UK resident you are entitled to any medical
treatment which becomes necessary, free or at a reduced cost, when
temporarily visiting a European Union (EU) country. We recommend that you
obtain an E111 form, free of charge from your nearest Post Office or download
the form from www.dh.gov.uk/travellers before travel. You may also obtain a
European Health Insurance Card (EHIC).
DEEP VEIN THROMBOSIS
Prolonged immobility can result in deep vein thrombosis (DVT). This occurs
when a blood clot forms, usually in the lower leg. This is a serious medical
condition that requires treatment with blood thinning drugs or anticoagulants
to prevent clots breaking off and travelling to the lungs causing significant
illness and, on rare occasions, death.
The risk of DVT occurring while travelling by air is extremely low. However,
there are a number of precautions you can take to further reduce the risk.
Periodic exercising of the feet and legs, or walking around where feasible, is
advised to reduce the risk. Elastic stockings or flight socks may be helpful.
Drink plenty of non-alcoholic liquids to prevent dehydration. Those who are
believed to be particularly prone are advised to obtain expert medical advice
for the journey.
EXPECTANT MOTHERS
Expectant mothers will be accepted for carriage, up to the end of the 34th
week of pregnancy on their return flight. After 28 weeks, prior notification of
travel must be given to First Choice Airways Customer Support on 0870 757
2757. All expectant mothers should carry a medical certificate confirming the
stage of pregnancy for the homeward flight and confirming fitness to fly.
Please check your insurance policy for any restrictions.
PASSPORTS AND VISA REQUIREMENTS
The information and advice given in this section is valid for British Citizens
only. If you are not a British Citizen, you should consult your Embassy for
information and advice on the visa requirements of the countries you propose
to visit.
■ It is the Lead Name’s responsibility to ensure that all members of the party
are in possession of all necessary documentation in respect of passports
and visas required for your holiday.
■ PLEASE CHECK THAT YOUR PASSPORT IS VALID - a full machine readable
British passport is required, valid for at least 6 months after your return to
the UK.
■ All children who are not already included on a parent’s
existing valid 10 year passport now require their own passports. This
includes newborn babies and children up to the age of 16 and over.
■ It is vitally important that the initials and names on your flight tickets match
those on your Passport exactly. Please check these are correct when you
receive your travel documents. You may be liable to a fine for holding
incorrect documents.
■ For holders of full British passports, visas are not required for visiting any of
the countries featured in this brochure other than Turkey. Turkish visas must be
purchased on arrival at Dalaman or Bodrum airport. In 2005 these cost £10
per person. These visas are required for every member of the travelling party,
including infants. Payment will only be accepted in English Sterling notes.
■ If you are 16 or over and haven’t yet got a passport, our recommendation is
that you should apply for one at least six weeks before your holiday. The UK
Passport Service has to confirm your identity before issuing your first passport
and from October 2006 will ask you to attend an interview in order to do this.
The above information is correct at the time of going to press. This information

and cannot be held responsible if you are prevented from travelling or reentering the UK due to lack of valid passports or relevant visas.

These Booking Conditions apply to any booking that you make with us and should therefore be read carefully.
They contain some exclusions and limitations of liability.
a) a change of your UK departure airport
If any part of these Booking Conditions is found to be invalid or unenforceable, then the remainder of these
Booking Conditions will not be affected and will remain valid and enforceable.
c) a change of accommodation to a significantly lower standard
1. YOUR CONTRACT
Your contract is with Sunsail Ltd, The Port House, Port Solent, Portsmouth PO6 4TH. When making your booking
you guarantee that you have the authority to do so and accept on behalf of your party the terms of these booking
conditions. A contract exists as soon as we accept your Booking Confirmation Form. You should check the details
of your confirmation carefully to ensure that it accurately reflects the booking you have requested and immediately
inform us of any discrepancies. If the departure date of the holiday is less than 14 days from the date of issue of
the Booking Confirmation Form this should be done within 24 hrs of that date. Otherwise we would expect a
response within 7 working days.
e) a change from a day to a night flight where the departure time changes by more than 4 hours
You should also send us the requested outstanding information, either by returning the completed Form or online
as described on the Form. This information forms part of the contract between us.
If you accept a Major Change, or if we have to cancel your holiday then in addition to any refund, we will pay you
as a minimum compensation in accordance with the amounts noted below. For children in respect of whom
reduced rates have been charged, credit/compensation will be paid on a pro-rata basis of the adult rate. Children
under two are not entitled to any compensation.
This contract will be governed by English law and dealt with by English courts. If however, if you booked your
holiday in Scotland or Northern Ireland any disputes may be dealt with in the local courts in Scotland or Northern
Ireland and will be subject to the law of those countries.
By accepting this Contract you, the lead name, are confirming that you and/or members of your crew are capable
and competent to sail the yacht in the conditions and cruising area of charter.
2. YOUR HOLIDAY PRICE
The prices in this brochure are in pounds sterling. Prices are accurate at the date of publication, but could have
since changed. Prices in this brochure supersede all other prices in other material printed at an earlier stage. Once
you have made your booking and paid a deposit of £150 per person, the cost of your holiday will not normally be
subject to any change. This does not apply to invoice errors or ommissions. Once a booking has been made,
offers and discounts cannot be applied retrospectively.
The balance of the price of your holiday must be paid at least 10 weeks before your departure date. If the balance
is not paid in time, we may cancel your travel arrangements and retain your deposit. If you book through a travel
agent, all contact with you will be via them.
3. IF YOU CHANGE YOUR BOOKING
If, after our confirmation invoice has been issued, you wish to change your travel arrangements in any way, for
example your chosen departure date or accommodation, we will do our utmost to make these changes, but it
may not always be possible. If you or any member of your party are unable to proceed with the holiday, you can
transfer the booking to a substitute person, providing they satisfy all the conditions applicable to the original
booking and your request is received by us at least 14 days prior to departure. Any request for changes to be
made must be in writing signed by the Lead Name or your travel agent. You will be asked to pay an administration
charge of £20 per person and any further cost we incur in making this alteration. Please check whether your
holiday insurance will cover any changes or increased costs resulting from a change. Should you request a major
alteration within 10 weeks of departure date (such as a change of date or area) then this will be treated as a
cancellation and re-booking. Clients wishing to add to a party after the initial booking will only be able to do so if
sufficient flight seats are available. This should not be automatically assumed to be possible and you should ring
the office to check first. The price of your holiday may increase or decrease to reflect the changes requested by
you. For example, increasing the length of your holiday may mean that aircraft seats go empty and we may have
to buy extra seats. We are not able to reserve flight seats without payment of deposit.
NB: Certain travel arrangements (e.g. Apex tickets) cannot be changed after a reservation has been made and any
alteration will incur a 100% cancellation charge. Changes from a brochured holiday booking to late availability or
other special offer holidays will not be permitted. Requests for changes to your booking should be sent to your
travel agent, or if you booked directly with us, to our After Sales Department.
4. IF YOU CANCEL YOUR HOLIDAY
You or any member of your party may cancel your travel arrangements at any time. Written notification from the
Lead Name or your travel agent on your behalf must be received by our After Sales Team. Cancellation will be
effective on the date which it is received by Sunsail together with any travel documents already issued to you.
Note: If the reasons for your cancellation are covered under the terms of your insurance policy, you may be able
to reclaim these charges.

PART PARTY CANCELLATIONS
If you cancel 43 days or more before departure then the remaining two or more members of your party are reinvoiced at the per person rate appropriate to their new party size and the cancelling members are charged the
appropriate cancellation fee according to our scale of charges below. If you cancel less than 43 days before
departure then charges for those cancelling are based on the percentages in the table below and are levied on
the holiday price and any extras cancelled. The per person rate is not adjusted for the remaining party members.
5. IF WE CHANGE OR CANCEL YOUR HOLIDAY
The arrangements for holidays in this brochure are made many months in advance and it is sometimes inevitable
that changes or cancellations may need to be made. We reserve the right to make such changes should they
become necessary.

If we are unable to provide the booked travel arrangements and have had to cancel them before the holiday is
due to start, you can either:
(a) Accept our offer of a replacement holiday of equivalent or higher quality (subject to availability)
(b) Accept our offer of a replacement holiday of lower quality (subject to availability) and we will refund the
difference in cost
(c) Accept a full refund of the money you have paid

No compensation or refunds will be paid where the change or cancellation is due to Force Majeure, or because
the number of persons who have booked is less than that required for the package.
Force Majeure means unforeseeable and unusual circumstances beyond our control, the consequences of which
could not have been avoided even if all due care had been exercised. Such circumstances or events include (but are
not limited to) war or threat of war, riot, civil strife, industrial dispute, unavoidable technical problems with transport,
closure or congestion of airports, terrorist activity, natural or nuclear disaster, fire and adverse weather conditions.
Carriers such as airlines used in this brochure may be subject to change. Such a change is deemed to be a minor
change. Other examples of minor changes include: alteration of your outbound/inbound flights by less than 12 hours,
changes to aircraft type, change of yacht to one of a similar size (within 2ft) and number of cabins, change of route
within a cruising area.
If after you have travelled we have to make changes to your holiday and such changes prove to be significant, we
will make suitable alternative arrangements and compensate you if appropriate. If it is impossible to make suitable
alternative arrangements or these are not accepted by you for good reason we will return you to your point of
departure and if appropriate compensate you.
6. HOLIDAY TERMINATION AND INDEMNITY
You must accept responsibility for the proper conduct of yourself and any members of your party. Sunsail cannot
be held responsible for under age consumption of alcohol. We reserve the right in our absolute discretion to
terminate without further notice the holiday arrangements of any client who refuses to comply with the reasonable
instructions or orders of the company staff, agent or other responsible person whose behaviour in their opinion is
likely to cause distress, damage, danger or annoyance to other customers, staff, any third party or to property.
Upon such termination our responsibility for your holiday ceases and we shall not be liable for any extra costs
incurred by you.
Disruptive passengers: The captain has authority over the aircraft and passengers at all times when they are
boarding or on board. He/she may prevent you from travelling if you are considered to be unfit to do so, or if you
pose a danger to the aircraft or passengers. The captain will exercise this right if, for example, you are found to be
drunk before or after boarding, if you smoke on board or use threatening, abusive or insulting words or behaviour.
In those circumstances, we or the airline may, at our reasonable discretion, terminate your holiday, and we will not
be responsible for completing your holiday arrangements. Nor will Sunsail or the airline be liable for any refund,
compensations or any other costs you have to pay.
7. IF YOU HAVE A COMPLAINT
If you have a problem during your holiday, please inform a relevant member of Sunsail staff immediately, who
will endeavour to put things right. If your complaint is not resolved locally, please follow this up within 35 days
of your return home by writing to our Customer Relations Department, giving your booking reference. It is
strongly suggested that you communicate any problem to our Club, base or flotilla staff without delay and
complete a report whilst in the resort. If you fail to follow this simple procedure we will have been deprived of
the opportunity to investigate and rectify your complaint whilst you were on holiday and this will reduce your
rights to compensation.
It is unlikely that you will have a complaint that cannot be settled amicably between us. However disputes to do with
this contract which cannot be settled amicably, may (if you wish) be referred to Arbitration under a special scheme
which is arranged by the Association of British Travel Agents. This scheme provides for a simple and inexpensive
method of Arbitration on documents alone with restricted liability on you in respect of costs. The scheme does not
apply to claims for any amount greater than £5,000 per person or £25,000 per booking form. Where a claim
includes, in part, a claim for personal injury or illness, a limit of £1,000 per person applies to that part of the claim.
If you choose to proceed to Arbitration under this scheme, you must send a written notice of your decision to ABTA
within 9 months after your scheduled date of return. Full details of the scheme are available from:The Association of British Travel Agents at 68-71 Newman Street, London W1P 4AH
Most of these changes will be minor and we will advise you or your travel agent of them at the earliest possible
date. We also reserve the right in any circumstances to cancel your travel arrangements. For example, for some
holidays in this brochure a minimum number of people need to book to enable the holiday to take place. We
shall assess whether the minimum number has been achieved and inform you as soon as possible. Occasionally
we may need to make a major change which includes, but is not limited to the following:

8. OUR LIABILITY TO YOU
Subject to the limitation of liability set out in the following paragraph, our liability to you for any loss or damage
which you may suffer (other than personal injury resulting from the non-performance or improper performance of
the services involved in the holiday) is limited to three times the price of your holiday. Carriers (the providers of
transport) have their own conditions of carriage which form part of your contract with us and these conditions of
carriage, together with the provisions of certain international conventions, generally limit the liability of carriers.
Copies of the conditions of carriage and the international conventions referred to are available on request from
Sunsail or your travel agent.
We accept responsibility for any death, bodily injury or illness caused to you as a result of the proven negligent
acts and/or omissions of our employees, agents, suppliers and sub-contractors and their servants and/or agents
while acting within the scope of, or in the course of, their employment.
We also accept responsibility for any damage caused to you as a result of any failure to perform, or improper
performance of the services we have agreed to provide to you, except where such failure or improper
performance is not our fault or that of our suppliers because:
(a) such failure is attributable to you or a member of your party.
(b) such failure is attributable to a third party unconnected with the provision of the services to be provided to
you and is unforeseeable or unavoidable.
(c) such failure is due to Force Majeure. (See the Definitions section in paragraph 5).
(d) or an event which could not be foreseen or prevented even with all due care.
In respect of transport by aircraft, ship, train or coach or as a result of the use or operation of any pleasure craft, the
amount of compensation we will pay is limited in line with the Warsaw convention (transport by air), the Athens
Convention (transport by ship), the Berne convention (transport by rail), the Geneva convention (transport by
road), the London convention (applies to the use or operation of pleasure craft) and any other Conventions that
might be applicable from time to time.
Sunsail accepts no responsibility for the acts or omissions of its clients whether negligent or otherwise and shall
not be held liable for any claims made against them (or as a result of their actions) either by other clients of
Sunsail or third parties. Sunsail does not accept liability for losses that were actually unforeseeable to those
involved at the time of booking, losses that were not caused by any breach on the part of Sunsail or its supplier
and any business losses or similar to the client as a result of unforeseeable circumstances.
9. PERSONAL INJURY UNCONNECTED WITH YOUR BOOKED TRAVEL ARRANGEMENTS
If you, or any member of your party, suffer death, illness or injury whilst overseas arising out of an activity which
does not form part of your package travel arrangements or an excursion arranged through us, we shall at our
discretion, offer advice, guidance and assistance. Where legal action is contemplated and you want our assistance,
you must obtain our written consent prior to commencement of proceedings. Our consent will be given subject to
you undertaking to assign any costs and benefits received under any relevant insurance policy to ourselves. We
limit the cost of our assistance to you or any member of your party to £5,000.
If your claim is successful then you must repay the amount of any financial assistance we have given you as soon
as you recover it.
10. EQUIPMENT AND YACHT INSURANCE COVER
Our equipment and yachts are comprehensively insured. Our policy provides full cover for the equipment and
yachts and no less than £3m third party cover (except for Colonna watersports dinghies and equipment which is
US$1.5m) for your skipper and crew. Sunsail cannot be held responsible for any loss which you may suffer as a
result of the insurers failing to indemnify any risk through you providing incorrect information of previous sailing
experience when requested .
A deductible/refundable security deposit payable at the Sunsail base by credit or debit card will be required for
dinghies, outboards, windsurfers, ocean kayaks, cruising chutes and GPSs, which will be forfeited in the case of
loss of, or damage to, this equipment. However, should damage or loss to yachts and equipment be caused as a
result of wilful damage or gross negligence by a client, a client under the influence of alcohol or drugs or as a
result of not obeying the company staff’s instructions, then he or she will be liable for the full amount of repair
or replacement and any resulting costs. Adults will at all times be responsible for minors in their charge.
11. SAFETY
As with other activity based holidays, watersports activities contain an element of risk. It should be understood
that participation in these activities is your decision and at your risk. The skipper of a yacht has primary
responsibility for the safety of the crew and craft at all times. Neither night sailing outside the designated cruising
area nor partaking in any third party race is permitted without written approval from Sunsail.
In the interests of safety, Sunsail’s staff may order a change to your itinerary, decide whether or not conditions are
safe to use a craft or make a passage and whether this should be under power or sail.
Club Flotilla, Bareboat and Day Yacht clients – by accepting this contract you, the lead name is confirming that
you and/or members of your crew are capable and competent to sail the yacht in the conditions and cruising
area of charter.
The Skipper is responsible for assuring that he/she and the crew are competent to undertake the planned
itinerary. The Skipper must take note of safety information contained in any written material or delivered to the
yacht and in chart briefings and is responsible for briefing the crew on this, the yacht and it’s systems. The skipper
is responsible for checking the inventory and yacht systems before the yacht makes passage. Yachts may not be
sailed single handed and the second crew member should be fit and have at least a basic knowledge of yachts.
12. WHAT IF MY ROOM OR YACHT IS NOT AVAILABLE?
Should your room or yacht not be available when you arrive through no fault of Sunsail (e.g. having been
damaged by a previous client) Sunsail may substitute another room or yacht if necessary of a different type and in
a different hotel or area but of similar or larger dimensions and facilities. If a yacht is not available then
accommodation will be provided for you free of charge in a hotel of Sunsail’s choice while repairs are carried out
or an alternative yacht is provided. Should this happen you will be compensated under the Sunsail Guarantee.
13. CHILDREN
Children will only be accepted into children’s clubs or flotilla activities if they are healthy. We reserve the right to
exclude a child if he or she is unwell. Children with special needs must be notified to our Reservations
Department at the time of booking. Failure to do so may result in the child being unable to take part or be
accommodated in the children’s club. At Kids Free Clubs, Club owners’ children may occasionally be on site.
Children not booked in to Sunsail Kids’ Clubs when operating or left in their rooms during the evening without
supervision are left so entirely at the total responsibility of their parents/guardians.
14. CONDITIONS OF CARRIAGE
The contractual terms of the companies that provide the transportation for your travel arrangements will apply to
the contract. These may contain terms which affect your rights to compensation.
You must comply with the conditions of carriage applied by land, sea and air carriers. The provisions of the
Warsaw Convention 1929 (as amended) concerning the carriage of passengers and their luggage by air, and the
airlines' conditions of carriage, may apply to you and your party during your flight, and during boarding and
disembarkation. These provisions and conditions may limit or exclude liability for death or personal injury, or loss
of or damage to luggage, and may make special provisions for valuables. We will supply a copy of the conditions
of carriage applicable to your holiday, and of the Warsaw Convention, if you request them. The Athens Convention,
and the carriers' conditions of carriage, may limit or exclude liability for death or personal injury, or loss of or
damage to luggage, and make special provisions for valuables. A copy of the conditions of carriage applicable to
your holiday, and the Athens Convention referred to above, can be supplied on request.
Air carrier liability for passengers and their baggage This information notice summarises the liability rules applied by
Community air carriers as required by Community legislation and the Montreal Convention.
Compensation in the case of death of injury There are no financial limits to the liability for passenger injury or death.
For damages up to 100000 SDRs (approximately £80,000) the air carrier cannot contest claims for compensation.
Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at
fault. Advance payments If a passenger is killed or injured, the air carrier must make an advance payment, to cover
immediate economic needs, within 15 days from the identification of the person entitled to compensation. In the
event of death, this advance payment shall not be less than 16000 SDRs (approximately £13,000). Passenger delays
In case of passenger delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the
damage or it was impossible to take such measures. The liability for passenger delay is limited to 4150 SDRs
(approximately £3,300). Baggage delays In case of baggage delay, the air carrier is liable for damage unless it took all
reasonable measures to avoid the damage or it was impossible to take such measures. The liability for baggage delay
is limited to 1000 SDRs (approximately £800). Destruction, loss or damage to baggage The air carrier is liable for
destruction, loss or damage to baggage up to 1000 SDRs (approximately £800). In the case of checked baggage, it is
liable even if not at fault, unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only
if at fault. Higher limits for baggage A passenger can benefit from a higher liability limit by making a special declaration
at the latest at check-in and by paying a supplementary fee. Complaints on baggage If the baggage is damaged,
delayed, lost or destroyed, the passenger must write and complain to the air carrier as soon as possible. In the case of
damage to checked baggage, the passenger must write and complain within seven days, and in the case of delay
within 21 days, in both cases from the date on which the baggage was placed at the passenger’s disposal. Liability of
contracting and actual carriers If the air carrier actually performing the flight is not the same as the contracting air carrier,
the passenger has the right to address a complaint or to make a claim for damages against either. If the name or code
of an air carrier is indicated on the ticket, that air carrier is the contracting air carrier. Time limit for action Any action in
court to claim damages must be brought within two years from the date of arrival of the aircraft, or from the date on
which the aircraft ought to have arrived. Basis for the information The basis for the rules described above is the
Montreal Convention of 28 May 1999, which is implemented in the Community by Regualtion (EC) No 2027/97
(as amended by Regulation (EC) No 889/2002) and national legislation of the Member States.
15. PHOTOGRAPHY
An essential part of the success of our brochures is using photography that gives clients a true idea of the product,
rather than using models. For Club holidays, during the course of the season we occasionally have photographers
on site at our Clubs, in which case you will be advised on your arrival at the Club. If you have any concerns, please
notify your Club Manager on your arrival at the Club. For Charter holidays, photographers are occasionally in our
cruising areas. If you have any strong objections to close up photography of yourself and your party, please indicate
your feelings to the photographer at the time.
16. BROCHURE ACCURACY
The brochure is prepared from information gathered prior to publication. Every care is taken to ensure that this
information is still correct at the time of going to press (August 2005 ) but it has to be remembered that facilities
may be withdrawn from Sunsail and holiday particulars altered as a result. These circumstances are regrettably
beyond our control and we are unable to accept liability.
Our sales staff are instructed to advise enquirers of amendments which the company regard as significant. Sunsail
shall be entitled to make any modifications it feels appropriate to the routes, yachts and the equipment provided
at any time, without prior notice.
Our sales staff are often asked for information not contained in the brochure. However, whilst every effort is made
to ensure that all information given is correct, Sunsail cannot however be held responsible if this should prove
inaccurate, unless requested and answered in writing.
Building Work: From time to time, expansion, redevelopment, building work and associated noise is unavoidable
at our Clubs and bases. Wherever possible we will notify you in advance and if we consider the work will have a
significant effect on the enjoyment of your holiday, you will be entitled to exercise the options outlined in the
section headed ‘’If we Change or Cancel your Holiday’’.
17. DATA PROTECTION
To ensure that your holiday runs smoothly, we need to use information such as your name and address, special
needs, dietary requirements, etc. We will apply appropriate security measures to protect this data. However, we
must pass it to suppliers of your travel arrangements, including airlines, hotels and transport companies. We may
also supply it to security or credit checking companies, and to public authorities such as customs and immigration.
If your holiday is outside the European Economic Area (EEA), controls on data protection in your destination may
not be as strict as in the UK. We will only pass data, including sensitive information regarding disabilities or dietary
and religious requirements, to people responsible for your holiday arrangements. If we cannot pass this information
to the relevant suppliers, in the EEA or elsewhere, we cannot provide your booking. When you make this booking,
you consent to this information being passed to the relevant people. We can supply a copy of your information
held by us; there is a small charge for providing this.
