While hybrids and similar vehicles make up a very small part of vehicle sales today, we’re beginning to see more of them enter the used car market. And they pose serious problems for dealers who aren’t familiar with the refurbishing costs associated with them. Problems that are unlike anything dealers have seen before. Appraising Hybrid Vehicles It’s 2013, and you are dealing with a customer wanting to trade in their 2008 first generation hybrid vehicle, it has 168,000 kms on it and they need $8,000 to make the deal. Your current appraisal process includes all the required questions (MVDA) and on the face of it the vehicle looks good and you are about to make a deal. But hold on, this is a hybrid ... is your current process detailed enough for the high tech, hybrid, dual fuel or alternate fuel vehicle that’s being traded in? Are the people appraising the vehicle aware of the pitfalls of not doing a good enough job and finding out “too late” that the cost of repairs could exceed the value of the vehicle. A Couple Of Examples 2005 Ford Escape: A U.S vehicle, just out of warranty with a brake warning light illuminated on the dash. A Ford Tech Bulletin suggested that the master cylinder required changing. Parts and labour approximately $1,500, but the problem was not fixed. It actually needed the hydraulic control unit that is an intricate part of the electro-hydraulic brake system that provides the regenerative braking and ABS functions. Total cost $5,082.76 plus labour ... just to make the lights go off. 2002 Toyota Prius Hybrid: This vehicle was taken in trade by an Ontario dealer from the original owner. The vehicle was well taken care of and ran well. The deal was made and the vehicle reconditioned and put on display for a period of time. It was eventually sold, but broke down shortly after the sale. The service manager was asked for an estimate for repairs and after a day or two came back to the sales manager and said I’m at $7,000 when do you want me to stop”. Closer Mechanical Inspection Needed These vehicles are going to need a better appraisal, a more thorough inspection, done by trained people. Otherwise the customer’s expensive repair problem, that they are trying to avoid, is going to be your problem. New UCDA Appraisal Form As a start, the UCDA has added an important new section to the Trade Appraisal Form. With the manufacturer increasing the warranty coverage for these parts, you need to know details about coverages, maintenance records, and previous repairs. In addition, a better inspection of the warning lights and messages needs to be completed and documented before you make a deal and again at time of delivery, to make sure all is still okay. Garage Insurance Rebates … $250K Daily Rentals ... Dealer Charged The UCDA garage insurance program has been available to members for more than 15 years and UCDA members have proven to be a very good insurance risk. Dealers that sell daily rentals without proper disclosure continue to get hammered at Discipline Committee. This year, UCDA members will receive $250,000 in rebates from Sovereign General Insurance for being claims free. Members have developed good loss control habits, have chosen realistic deductibles and as a result have enjoyed very stable rates in the past few years. Along with the claims free rebates, members qualify for a 7 1/2% discount off the filed premium rates, making the program consistently a very successful member service. Motor Vehicle Impoundment Governments have rightly provided for severe penalties in the case of drunk driving. Dealers need to be mindful that they don’t suffer from the consequences of one of these measures. Impoundment Individuals caught driving a vehicle, while their licence is suspended for a Criminal Code violation like drunk driving, will have the vehicle impounded ... this can apply to vehicles driven by employees of the vehicle owner, leased vehicles, daily rentals, dealer loaners, even test drives. The impoundment period can range from 45 days to 180 days. The owner has the right to appeal, but there are only four grounds: i) the vehicle was stolen; ii) the driver did not have a Criminal Code suspended licence at the time; iii) the owner of the vehicle used “due diligence”; and iv) the loss of the vehicle would cause “exceptional hardship”. Needless to say such appeals are rarely successful! Check the status of a driver’s licence before your vehicle gets impounded! Last week, the latest dealer to be charged agreed to pay a fine of $8,000, write to any customer whose bill of sale didn’t state “daily rental” and “compensate” the customer if they say they didn’t know. The dealer also agreed to pay the cost for any of his salespeople who take the OMVIC Certification Course. Sometimes the lack of a written disclosure is due to poor paperwork. Sometimes it isn’t. Either way, when a regular OMVIC inspection brings this issue to light … the dealer gets charged. Out Of Province Buyers Buyers from out of province will often want to drive their vehicle back to their home province. The best way to handle such a sale is to: 1. Register the vehicle to the buyer’s name, 2. Obtain a “Special Permit” which goes in the windshield, and 3. Confirm the customer’s insurance to cover the vehicle for their drive home. The vehicle does not need a “safety”, can be driven for 10 days this way and the vehicle is not in your name when it leaves. Translation? You can sleep at night! An Ontario Registration Permit, in the name of the Buyer, can be obtained at the licence office using the Buyer’s home (out of province) address. The MTO advises that: “A vehicle transfer to the out of province registrant can be performed without an Ontario address, the vehicle is not eligible to be plated in that scenario however a special permit may still be issued. The out of province address is used in this scenario.” For registration and for the “Special Permit”, the Buyer will need to provide proof of legal name, birthdate and signature ID, most commonly in the form of: Passport OR Out of Province Driver’s Licence and Birth Certificate Ignoring Complaints None of us like confrontation and unpleasantness. The natural reaction, when someone calls to complain about a problem with a car they just bought, might be to hope it just goes away. Fight that impulse! Don’t ignore complaints. Remember, most people (not all, but most) don’t like to complain. If matters get to the point where the customer feels obliged to talk to you about it ... it likely warrants a look see. Ask them to bring the vehicle in so you can discuss the issue. Even if it turns out to be nothing, the customer will be reassured that they made the right decision buying from you … because you showed you cared and provided after sale support. On the other hand, ignored complaints can be like a small cut. Minor at first, if left to fester, it can become more serious. And we all know customers have many routes available to them to complain if they don’t feel they are being treated fairly. Turn a negative into a positive at every opportunity. Selling Extended Warranties So you have followed the UCDA’s advice and made sure the third party warranty you’re selling is on our list of Ontario insured warranty products. Now what? One source of consumer complaints we have dealt with at the UCDA is from consumers who complain they did not fully understand the coverage. This shouldn’t happen and can cause you grief. Too often consumers are claiming they didn’t understand what terms like “powertrain” mean, or that they were not given the secondary documentation, like the third party warranty application forms and brochures, that they need to fully understand the product. Just like you don’t want consumer’s coming back to complain about a car they bought, you don’t want them complaining about the aftermarket products you sell them. Don’t have a customer surprised when they go to make their first warranty claim only to find it’s not covered or there is not as much money as they expected to cover it. Most warranty companies provide paperwork which, if properly completed, contains the customer’s signature and initials on the coverages and exclusions. Make sure you have that signature in your file. If you don’t, it’s a weak argument to say “I told them about the details”. Arm the customer with all the information they need and protect your dealership in the process. Extended Warranty Payments Section 47 (7) of the MVDA regulations requires dealers to remit payments for the sale of third party warranties to the warranty company within 7 days of the sale of the warranty. The concern is that the longer the period of time between the warranty being sold and the warranty company being paid, the higher the chance that a consumer may have a problem, for which the warranty provider may deny coverage, due to non-payment. If this happens, the dealer, and potentially the Compensation Fund, could be on the hook for the cost of the warranty or the cost of repairs. Members are urged to make sure that warranty payments are submitted to the warranty company within the 7 days required by the regulation. 25 Year Members This year, 103 members have joined the ranks of the UCDA’s 25 Year group which now has a total of 381 longtime members. We’ve published their names on the back page of this issue of Front Line, The commitment of so many members, who continually support the UCDA, allows the association to offer the types of services and benefits that dealers most appreciate. The UCDA is nothing without its members and, while we’re pleased with the continuing growth of our membership, we look to our long term members as the foundation that’s made the UCDA possible. Without the continuous support of these members, along with those who’ve joined since and annually renewed their membership, the UCDA could never have sustained the type of growth that has brought the association to where it is today.
