A. A public hearing to consider an application from Loren Bradley, Managing Partner, TwoLB, LLC,
for change in zoning for property at 507 Division St. (Lots 13 through 17, Block 4, North Atchison
Addition), the former Martin East Elementary School. The applicant is requesting to rezone the
property from R-1 Single Family Residential District to R-3 Multiple Family Residential District.
Action: Consider a recommendation to the City Commission on the rezoning application for
507 Division St.
B. A public hearing to consider application from Benedictine College for a change in zoning and a
conditional use permit to allow a college use in the PD Planned District zone for the following
property: An approximately eight acre parcel north of the football stadium from A-1 General
Agriculture to PD Planned District; an unaddressed parcel on N. 4th Street (Lots 18-20, Block 27,
North Atchison) from R-1 Single Family Residential to PD; 1101, 1105, 1201, 1225, & 1301 N. 2nd
Street, 1218 and 1237 N. 3rd Street, an unaddressed parcel on N. 3rd Street (Lots 16-20, Block
26, North Atchison), and 215 M Street from R-3 Multiple Family Residential to PD.
Action: Consider a recommendation to the City Commission on rezoning applications from
Benedictine College.
Action: Consider granting a conditional use permit to Benedictine College contingent upon
rezoning the properties listed to PD Planned Development.

Commissioner Brungardt moved to approve the Consent Agenda as presented, seconded by Commissioner
Surritt. The motion carried 7-0.

PUBLIC HEARING ITEMS.
A. CONTINUE A PUBLIC HEARING TO CONSIDER AN APPLICATION FROM BETTY PAULIN
CARTER FOR A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION (AUCTION AUTO
RESTORATION) AT 705 PARK STREET (W49’ OF S15’ LOT 4 & W49’ LOTS 5-7, BLOCK 48, OLD
ATCHISON. THE APPLICANT WISHES TO USE THE GARAGE TO RESTORE VEHICLES:
The public hearing opened at 4:31 p.m. There was no comment on the application and the applicant was not
present. The hearing was closed.
Commissioner Robinson moved to approve the conditional use permit to Betty Paulin Carter, seconded by
Commissioner Brungardt.
Chairman Franklin said the application does not meet home occupation requirements. The properties (home
and garage) are not adjoining [being separated by an alley]. He was concerned the owner could sell off the
parcel with the garage. The owner is using the street and driveway for his personal vehicles to make room for
the restoration vehicles in the garage. He felt the application is not in the spirit of the home occupation
regulations.
Ms. Leif noted that the regulations do not specify the same parcel. She noted a conditional use permit goes to
the property owner and does not run with the land. She added that she received a call from a neighbor that
afternoon that the owner was detailing six cars outside.
Commissioner Bruce noted there are more vehicles behind the garage on Mr. Carter’s mother-in-law’s
property.
The motion failed by a 0-7 vote.

A. Bob Staley appeared before the Planning Commission in regard to a letter sent to Sacred Heart Thrift Store
[411 Commercial St.] to remove a portable sign that had been placed behind the building. Ms. Leif explained
that the building sits at the property line, so there is no room to meet the five-foot setback requirement. The
regulations allow downtown businesses to place smaller sandwich signs with approval of the City Manager.
Chairman Franklin suggested Mr. Staley request permission from the City Manager to place the portable sign
as a temporary use.
B. STAFF UPDATE ON THE UPCOMING COMPREHENSIVE PLAN REVISIONS:
Ms. Leif said the Kansas State University College of Architecture and Design is interested in assisting the City
with updating the Comprehensive Plan. Several graduate classes will be devoted to compiling and analyzing
data, with the estimated completion in the spring of 2014.
Chairman Franklin said he felt a professional planning firm needs to oversee the work. He suggested sending
out a Request For Proposals (RFP). Ms. Leif estimated that a professional will cost $50,000 to $100,000. She
added that the KSU classes working on the project will be older graduate students with experience in planning
work.
Mr. Farris suggested that KSU could gather the data, which could then be compiled by a professional firm.
The Planning Commission agreed by consensus to explore options with the City Manager and City
Commission.

Loren “Skip” Bradley submitted an application to change the zoning designation of 507
Division Street, commonly known as the former Martin East Elementary School. The property
is currently zoned R-1 Single Family Residential, and the applicant is requesting a rezone to
R-3 Multiple Family Residential.
The property is approximately 2.16 acres and includes a parcel with a building, and a parcel to
the rear that was previously used as play fields.
The existing approximately 12,500 square foot building was built in 1915 and utilized as an
elementary school until approximately 1997 when the new consolidated elementary school
was built in the city. The building has primarily been vacant and underutilized for the past 15
years. The applicant proposes to renovate the building and create apartment units and
parking areas on the property.
The property is currently zoned R-1, and the proposed rezone to R-3 would allow
approximately 30 apartment units to be created on the parcel that contains the existing
building. The rear parcel (former playfields) could also accommodate new apartment units if
built on the property. Any development on the rear parcel would be subject to site plan
review, and the Planning Commission would have the opportunity to review the development
to ensure compliance with the Zoning and Subdivision Regulations. The former school would
have been a conditional use in the R-1 zone and a conditional use in R-3.

At the time of this action report, no public comments from surrounding property owners have
been received by the Community Development Department.
STANDARDS OF EVALUATION:
For the Planning Commission’s consideration, Staff has provided a review the following standards of
evaluation pertaining to change of zoning requests. Staff comments are in lighter type, and the
excerpt from the Code is in bold-faced type.
Excerpt from Section 803, Zoning Regulations of the City of Atchison, Kansas
803 AMENDMENT PROCEDURES
803.45 The following factors will be considered by the Planning Commission in determining the
reasonableness for granting rezoning requests:
803.45.1
The character of the neighborhood.
Staff Analysis: The school building has historically been a different use than surrounding uses.
The neighborhood has historically had more vehicular traffic and noise levels atypical of a single
family neighborhood. An apartment use would add weekend and evening impacts from residents
where a school may have had minimal activity during those times. However, the site has been
deteriorating in recent years and subject to vandalism, so a rehabilitation of the property would
improve upon a currently blight situation in the neighborhood.
803.45.2
The zoning and uses of properties nearby.
Staff Analysis: The site is surrounded by R-1 zoned lots and single family dwellings. However, the
subject property has historically been a school use, not a single family use. Within two blocks to
the west, several lots are zoned B-1 Neighborhood Business. Within two blocks to the north, the
Terrace Hills Apartment complex is zoned R-3.

The suitability of the subject property for the uses to which it has been restricted.
Staff Analysis: In the past 100 years, the property has not been used for single family residential.
The property was developed as a school in 1915. However, if the building was demolished, single
family homes could be developed on the land. However, due to the higher traffic volumes on
Division Street, this may not be the most suitable location to redevelop with single family
dwellings. Traffic counts taken in June 2009 on Division Street indicate that just west of the
project indicated 5,760 trips and just east of the project indicated 3,065 trips.

Staff Analysis: The building has been vacant for over 15 years. USD 409 conveyed the property to
Benedictine College in the late 1990’s, and Benedictine College later conveyed the property to
another party. To the best of Staff’s knowledge, neither party repurposed the building during this
time.

The relative gain to the public health, safety and welfare by the destruction of
the value of the property of the person making the rezoning request, as compared to the
hardship imposed upon that person.
Staff Analysis: The applicant desires to renovate the existing historic building, so a hardship could
be imposed if the applicant would be required to demolish the building and build single family
residential units. The historic use was not a permitted use in the zone, so by its nature, the site
has historically had flexible zoning.
803.45.7
The recommendations of permanent or professional staff.
Staff Analysis: The current site has been underutilized for over 15 years, so rehabilitation of the
property would create value in the community. The proposed project includes renovation of a
historic structure and repurposing it as apartment units. The project will improve a current
neighborhood blight situation.
803.45.8 The conformance of the requested change to the adopted or recognized master
plan being utilized by the City.
Staff Analysis: The City of Atchison adopted the Comprehensive Development Plan for the
Atchison Area 2004-2015 on September 7, 2004 with revisions in 2006 and 2007. This is the
recognized master plan being utilized by the City. The future land use map indicates that the
future land use of these parcels is institutional (existing building parcel) and recreational/open
space (rear, open space parcel). Page 8-13 of the Comprehensive Plan states that the City needs
additional multiple-family housing, and that this type of housing “should be developed in
residential areas around the central business district or other commercial areas.” The proposed
project is within walking distance of the central business district, on a thoroughfare that holds
higher traffic volumes. Traffic counts taken in June 2009 on Division Street indicate that just west
of the project indicated 5,760 trips and just east of the project indicated 3,065 trips.
RECOMMENDED ACTION:
Motion to recommend to the City Commission approval of the
Bradley request for a Change of Zoning.

BACKGROUND:

Benedictine College (BC) has applied for a change in zoning and a conditional use permit to
allow a college use in the PD Planned District zone for the following property. The numbers
correspond to the numbered parcels on the zoning map excerpt and aerial map included in this
packet:
o #1 and #2: An approximately eight (8) acre parcel north of the football stadium from A1 General Agriculture to PD Planned District – accessed from P Street. Both of these
properties will be combined prior to issuance of a building permit for new development.

R-1 Single Family Residential to PD
o #4 through #12: 1101, 1105, 1201, 1225, & 1301 N. 2nd Street, 1218 and 1237 N. 3rd

As Benedictine College has grown in recent years, it has acquired additional parcels
surrounding the main college campus. City Staff has discussed with Benedictine College that
the development plan for the campus should be amended as development occurs, and all
parcels associated with the college campus should be brought into the development plan. Thus,
the newer parcels are a variety of zoning districts, so BC is requesting that these parcels be
rezoned to PD to be consistent with the PD zoning of the main campus.
At this time, the only new development proposed for the college is the development of new
baseball and softball fields north of the football stadium. The other parcels that are part of the
rezone have existing development (please see campus map attachment for details on existing
development) or will be redeveloped in the future.
The subject property proposed for the baseball and softball fields, heretofore referred to as the
“P Street Property” labeled as parcels #1 and #2 on the maps and is currently zoned A-1 and
historically utilized as grass pastureland. The property is proposed for rezone to PD for a
college/university use.
o The former owner of the property recently conveyed the property (parcel #1) to BC.
The parcel was divided into two parcels (one parcel for existing house and a second
parcel (parcel#1) conveyed to BC) without minor subdivision approval from the City.
However, because BC owns property to the immediate south, it can combine the new
parcel (parcel #1) with the existing south parcel (parcel #2) so that there is no “new”
creation of a lot. BC staff is currently working with the Atchison County Appraiser’s
Office and City Staff on this process.
o A development plan for the ballfields has been submitted for review and approval by
the Planning Commission and City Commission. BC states that the parking for the
ballfields will be the existing parking lot by the football stadium. No new parking is
proposed.
o The development plan includes new baseball fields, new softball fields, restrooms by
the fields, and a possible future locker room building. A concession stand may also be
added in the future. The fields will either be sod or artificial turf (yet to be determined
by BC Staff). A lighting plan has not been submitted at this time.

Staff Analysis: Surrounding zoning of the P Street parcel is as follows:

North: Across P Street – R-1 Single Family and A-1 General Agriculture, single family
residences and pasture
West: R-1, single family residences
South: PD, Benedictine College
East: A-1, St. Benedict’s Abbey farmland and several residences
Surrounding zoning of the other parcels: R-1, R-3 and PD (see attached zoning map excerpt)

Staff Analysis: The P Street Property has been grass pasture. The A-1 zone allows a playfield (Use
Group No. 30) and a college/university as permitted uses. The purpose of the rezone is to
combine all BC properties into one development plan in the PD Planned District zone.
The other parcels are currently developed with college/university facilities (see campus map
attachment).

regarding the proposed baseball and softball fields and possible negative impacts of the noise,

are currently proposed on the other parcels.

Staff Analysis: Staff does not have a recommendation on this standard. The Commission should
discuss this standard of evaluation in their deliberations.

Staff Analysis: The incorporation of the BC properties into one development plan and zoning
district will ensure that the development is in compliance with the zoning code and a plan. The
Planning Commission may want to consider requesting amendments to the development plan for
the baseball and softball fields in order to mitigate the concerns of the neighbors.

ADDITIONAL STANDARDS OF EVALUATION FOR THE “P STREET PROPERTY” (PROPOSED BASEBALL AND
SOFTBALL FIELDS):
Excerpt from Section 606, Zoning Regulations of the City of Atchison, Kansas
606.2.2
The Commission may recommend the development as submitted or may modify,
alter, adjust or amend the plan before recommendation, or deny the plan and shall
make a report to the governing bodies setting forth its reasons for approval or
denial of the application and if approved, specific evidence and facts showing that
the proposed development plan meets the following conditions.
606.2.2.1
That the value of the buildings and the character of the property adjoining the area
included in such plan will not be adversely affected.
606.2.2.2
That such plan is consistent with the intent and purpose of these regulations to
promote public health, safety, morals and general welfare.
606.2.2.3
That the street and highway access is of sufficient capacity for uses dependent on
automobile transportation.
606.2.2.4
That the design and landscaping is in harmony with adjacent areas.
606.2.2.5
That the yard requirements and open spaces are adequate to serve the needs of the
people as projected by the plan.
Staff Analysis of 606.2.2.1 through 606.2.2.5): The Commission may want to discuss how the
development plan for the P Street Property could be amended to mitigate concerns of the
surrounding property owners.
RECOMMENDED ACTION:
Motion to recommend to the City Commission approval of the
Benedictine College request for a Change of Zoning and motion to
grant a Conditional Use Permit for a college campus in the PD zone
subject to the following conditions:
1. No building permits shall be issued for the “P Street Property”
until the two BC-owned lots north of the football stadium are
combined into one lot.
2. A lighting and parking (if applicable) plan for the P Street Property
shall be submitted to the City prior to issuance of a building
permit.

Notice is hereby given that the Atchison Planning Commission will hold a public hearing
to consider application from Benedictine College for a change in zoning and a
conditional use permit to allow a college use in the PD Planned District zone for the
following property: An approximately eight acre parcel north of the football stadium
from A-1 General Agriculture to PD Planned District; an unaddressed parcel on N. 4th
Street (Lots 18-20, Block 27, North Atchison) from R-1 Single Family Residential to PD;
1101, 1105, 1201, 1225, & 1301 N. 2nd Street, 1218 and 1237 N. 3rd Street, an
unaddressed parcel on N. 3rd Street (Lots 16-20, Block 26, North Atchison), and 215 M
Street from R-3 Multiple Family Residential to PD. See map on reverse side. Legal
descriptions of subject property are on file with the Community Development
Department. The Planning Commission will make a recommendation to the City
Commission on this matter.
Pursuant to §803.2 of the Zoning and Subdivision Regulations for the City of Atchison,
written notice of the public hearing shall be mailed to all owners of property within two
hundred feet (200’) of the property being petitioned for rezoning for areas within the City
boundaries.
Therefore, you are advised that this public hearing will be held on Wednesday, May 1,
2013 at 4:30 p.m. in the Commission Room, second floor of City Hall at 515 Kansas
Avenue, Atchison, Kansas. Interested persons may attend the public hearings or submit
written comments to the Community Development Office at City Hall, 515 Kansas

Re: Benedictine College Change in Zoning
City of Atchison,
This is to comment on the proposed change in zoning for Benedictine College.
You state that the request is to change zoning for several parcels to Planned District.
Your letter does not state what the uses will be. Will the new uses be the same as the
current uses? It hardly seems fair to place a high density use in a single family
residential area. Will citizens be given due process every time a new use is planned?
I am commenting in regard to our property at 1420 N. 2 nd St. I am aware that there are
plans to build a baseball field in the farm field immediately east. I have the following
comments about a baseball field in a single family residential neighborhood.
Lighting: Will sports field lights be allowed? There are ways to install sports field
lights that will not be intrusive to the surrounding residences. For example shades
on the luminaires that prevent direct light from leaving the property. The light at the
property line should be no brighter than the light from a full moon.
Noise: I believe the city has a noise ordinance. Will it be required that the
loudspeakers not exceed the limit. I think the loudspeakers at the football stadium
must exceed the limit. I can’t carry on a conversation four blocks away, let alone
200 feet, when the loud speakers are in use.
Parking: Will sufficient off street parking be required on site? Where will the parking
lot be? What will be the access route? Will it be through the monastery grounds or P
Street? P Street is unpaved and not safe for a high volume of traffic. The parking
and foot traffic for the football stadium spills over onto public streets and private
property.
I request that you notify the taxpayers what the planned uses will be, and allow them to
comment, before voting on a mass zoning change to residential neighborhoods.
