(2) that seriow cowem be expressed at the failure to hold a second pubhc meenng within this Dtstrtct and that the Health Authority be asked to reconsider that decision. It was offered at a30,oW a pm.e stgmficantly leas than the prevtous purchase prtce of +X45,030 tu 1990 whtcb at that tnne had also reflected the price suppressing effect of the con&ton Two firm offers were remtved for S217,COOand fXO,CCKlbut finled to proceed furthet 9 23 The opmmn of a local spectahst firm of Agricultural Surveyors 1sthat the site IS “unlikely to be capable (of) sustammg a vtable agncuhural unit” and advise agamst an attempt to sell by auctton what they descnbe as a high value property 9.24 Professmnaladvice agamst auiXlom.ng has already been supported by the Planrung Inqctorate m a recent smular appeal demsion dated October 1996, that was upheld at The Fi Nursery, Barling RmJ 9.25 Furthermore that same surveying practice has formally advised t&e appltcaut that in their considered oplluon agriatltmal workers or retned workers “cannot afford to oxupy bungalows of this srze” They have also concluded by mcam of then own survey of local farmers that there IS not a sigmfiant need for workem cottages m the ares. 9.26 In ‘The Fm’ appeal the Inspector also stated that he dtd not accept the Counctl’s conchtstons for the contmumg ‘need’ in the R&ford Dtstrtct for the retention of such accommodahon, against the trend elsewhere in the County 9 27 It 1s notable that those comments made by the Inspector regarding ‘n&’ m upholdmg the dectston to ltft a restrictive comhtton, were m relstton to a hoidmg that had justified the constructton of the dwellmg in the Brst place In the case of Pondstde, its construction m 1965 was tietied on the basis of a larger farm holdmg. In support of his decision he also cited the general ttae III paa tune workers wtth a correapoudiug decline in full ttme workers wluch in lus opmton would account for a rednction in the demand for these dwelimgs He also mnchtded that “Thts mdicates to me that wuh the declmtng trend tn fullttme agriulltural employment, there 1s unlikely to be a shortfall of agncuiturai accotmnodation generaliy, and that the most pressing n&s are likely to contmue to be for accomm&tton on the employment holdmg ” 9 28 In the wider context, Members wtll be aware of other contemporaty applicatrons wnlun Rocbford Dtstrmt, for new agricubural workers dwellings on the grounds of agricuitural need, together with other proposals for the removal of agrtcultural occupancy condrtions on the grounds of msufftcmnt agrmtltural need. The Couracil’s own mveshgations togetkr arlth other information subnutted m reap& of situ&r proposals elsewhere in the diitct, have proved to be mcon&stve The Counctl’s own research m relatton to a 1995 appltcatton dtd htghbght the existence of need wtthm the Dtstrtct for agrtculhnally restricted accominodanon Also Census data supphed by MAPP mdlcated at the hme recent margmal reductions in the agrrcultural work force m the Dtstrtct, (qprox 7%) However, those local farmers who responded to the Councd’s PAGE 30 questlonnaxe did not percerve a decline m then work force and identified a contmuing demand for agricultural workers dwellings in the Dlstnct The Inspectors comments on ‘The Firs’ appeal outlti above, regardmg most presrmg need for acxxxnmodationon the employment holding 1s pertinent Also the apphcantsagent on &IS current application has provided survey mformation as at lmd 1997 regarding some 69 Agricultural Cottages owned by IMJOI landowners/farmers, which reveals the rnqority are occqxed by people not currently engaged m agriculture and therefore concludes that there is no shortage of agricultural proper&s m the area. 9 29 In summary Pcmdstdewas approved as a single dwellmg on a modest plot, and at that ume was intended to serve the close by WhXe House Farm, as evidenced by the srze of the plot orlgmally approved, a& statedon the application form that the apphcant was the farmer resl& at White House Farm , 9.30 There IS no wncluslve file evidence that it ever successfully later functioned as a smallholdmg, only of mtenhon by previous owners by virtue of the applications they subrmtted 9.31 There IS evidence that It became the focus for unauthonaed retxi sales suggestmg fauUre of the agricultural actrvxy at the%me. 9 32 The history of the site does not support the corrtenhon that the dwellmg and land mnst~tuted a viable holding axl the Local Planniug Authority contention as to need for agrlc&tual workers dwellmgs was nOt supported on a recent appeal in snnilar circumstances. 9 33 The property has been advM for sale for a considerable per10d and at a price which is considered to reflect the prexncz of the agricultural ocapancy wndtion without anyone ~~chasmiz the property 9 34 In wnclus~on, the apphcant IS considered to have eztabllsbedthat there is no longer a need at the site for an agncultural workers dwelling. 9.35 The Corporate Director (Services) recommendsthat this apphcatlon be approved PAGE 31 459 !I I , 0 lo.
