An analysis of the constitutional and statutory
powers of local self-government and the
preemption of taxation to the state. Included
is a discussion of governance alternatives
implementable by ordinance or interlocal
agreement. Finally, this session will outline the
constitutional status and role of the municipal
service taxing unit and the implementation and
application of a home rule tax increment to fund
a project or to finance infrastructure as the public
share in a public/private partnership.

An examination of the case law criteria for
the adoption and imposition by ordinance
of special assessments, user fees, regulatory
fees, and proprietary fees to fund services and
infrastructure; and a discussion of collection
methods for special assessments. Also included
are the general law restrictions on the imposition
of impact fees and the legal sufficiency tests for a
valid mobility fee.

The impact of the Community Planning Act on
local governments and how local governments
can respond through home rule initiatives to
the evolution or weakening of state planning

dealing with large-scale sector plans and RSLA
planning processes and the advantages of home
rule mobility plans and fees over transportation
concurrency.

Analysis of Pasco County’s mobility fee system
implemented under home rule utilizing
home rule tax increment funds to create fee
incentives for specific geographic areas and land
uses. Included is an explanation of the timing
and phasing requirements incorporated as an
alternative to transportation concurrency. Also
discussed is the pending litigation and proposed
legislation that has resulted from implementation
of this home rule solution.

and Land Use Regulations at Trial and
On Appeal

An analysis of strategies local governments may
use to prevent and defend challenges to home
rule revenue sources at trial and on appeal. A
review and update on various local government
land use issues including quasi-judicial
proceedings, “takings” jurisprudence and actions
under the Bert J. Harris Private Property Rights
Protection Act.
