This campaign challenges each local association to increase their membership by 5% each year for 5 years. The theme is “THRIVE.” A healthy and successful business cannot rely on growth alone for a sustainable future. 3-in-1 membership with the local, state and national builders association provides vital opportunities to get connected, bring significant change to our industry, and create thriving relationships. At the end of 2014, 6 outstanding locals exceeded their goals and grew their membership beyond 5%. We would like to recognize them now and say congratulations! We have made excellent progress and achieved some great milestones. During the month of May, we had the largest increase in membership that we have seen in several years. This is a great step in the right direction but there is still much work to be done. At the March Board meeting, I stated that we needed to revise our Strategic Plan. I am happy to say that the framework has been created and we are well on our way. This plan will have many goals, such as advancing advocacy or balancing finances, however, the key is still membership growth! So I need to ask, what can you do to help make our association a success? Every builder and associate knows one person that they could ask to be a member. We must be relentless in our resolve to get new members and retain our existing by proving the value of membership. For the health and future of our association, we need to attract younger members. In order to achieve this, we cannot keep doing things the same way we always have. Creativity is the process by which we solve a problem and develop new ideas. New ideas are fragile and need to be protected. We must be open and supportive of new ideas, so that our response is, “Wow!” not “How?” The greatest assets we have at our disposal is our membership and our staff. By using these assets and working together, we can produce REAL CHANGE. Please continue to fight for our advocacy efforts, stay involved with committees and events, and ask someone else to join you. Keystone Builder - July 2015 From the Publisher Recently, there has been strong emphasis in our local HBA chapters regarding membership. I would be the first to vouch for how the HBA membership has enabled me to successfully publish magazines for the building industry for over 30 years. In 1984, when I was invited to publishing Builder/ Architect Magazine in Central Pennsylvania, my knowledge of the building industry was very limited. Looking for an answer to that problem, I immediately went to Harrisburg and Lancaster and met the executive officers of the respective HBA chapters and they invited me to become a member of their associations. I joined right away and attended their meetings. This was a perfect place for me to gather knowledge about the industry and network with builders and associates that would be critical to a successful publishing business for me. Soon after, I joined the Membership Committee, where I believed I could be of service to the association. In addition to Central PA, I eventually developed my publishing network in Philadelphia and Building Baltimore. I joined the HBA of Chester Pole Components and Delaware Counties, as well as the HBA of Maryland, Mfg. & Supply and participated on the Membership Committees there. Engaging with each association helped me to achieve Spike status multiple times. After celebrating 25 years of publishing Builder/Architect Magazines in November 2009, my husband Dimitri and I started Builders & Associates Magazine. Act 162 was designed to provide for reasonable development and substantially equivalent protection of waterways that riparian forested buffers were intended to achieve. In March of 2015, Pennsylvania’s Department of Environmental Protection (DEP) issued two draft Technical Guidance Documents: Riparian Buffer or Riparian Forest Buffer Equivalency Demonstration DEP-ID 310-2135-002 and Riparian Buffer or Riparian Forest Buffer Offsetting DEP-ID 310-2135-003 to implement Act 162. DEP’s draft technical guidance documents appear to make land development in Exceptional Value and High Quality waterways more, not less, problematic. Keystone Builder - July 2015 One major concern in the draft guidance documents is DEP’s interpretation that Act 162 eliminated the existing waiver process granted to certain development projects that may have met the requirements under DEP’s current regulations. These projects will now be forced to meet significantly higher standards and may no longer be technically feasible if the technical guidance is not amended. The intent of Act 162 was to allow single and multifamily residential developers to achieve environmental compliance without the application of a “one-size-fits-all” arbitrary taking of private land. Science and engineering design have advanced significantly and many of the Best Management Practices now in use were not refined, and certainly not used, as a part of a unified engineering design over a decade ago. PBA submitted extensive comments on both technical guidance documents in May. UCC Review and Advisory Council Votes to Adopt New Code Requirements The UCC Review and Advisory Council (RAC) voted in May to adopt selected code provisions from the 2015 I-Codes. This 19-member council comprised of building industry professionals and local government representatives is charged with reviewing the latest triennial code revisions issued by the International Code Council, enforceable under the Pennsylvania Uniform Construction Code. Council members were diligent and took the responsibility to review the 2015 code revisions seriously. Underlying issues with the Uniform Construction Code statute complicated the Council’s review and many code provisions were not available for consideration. Out of concern for the usability of the final product, the RAC voted to adopt a limited number of code changes. Ultimately the RAC adopted 16 individual code provisions including 10 out of 30 PBA requested changes. The RAC notified the Secretary of Labor and Industry of the 16 code provisions that were adopted in a statutorily-required report. The new code requirements will be published by regulation and enforceable in January of 2016. PBA President Testifies on Third-Party Agency Code Enforcement with the current administration and enforcement of the Uniform Construction Code (UCC) as it relates to the use of Third-Party Agency (TPA) code inspection services. That’s why Gallagher joined his fellow members at the Installation and Awards Banquet at the Mohegan Sun at Pocono Downs Hotel & Convention Center in Wilkes-Barre to honor five major annual award recipients earlier this year. “This is the true value of membership – when you are dedicated to your industry and your association, people recognize that. The recipients go above and beyond for our association, and this is how we can thank them,” says Gallagher. Each of these awards represents the pinnacle efforts of our association in different forms. The Associate of the Year award proves the same of an associate member; those who invest their time, energy, and talents to serve the federation at all levels and the industry as a whole. Richard Jackson of the ELA Group, Inc. was named the 2014 Associate of the Year and is currently serving as the President of the BIA of Lancaster County. But his involvement doesn’t stop there. Jackson has also served PBA as a Regional Legislative Officer and sits on the Government Affairs Committee, Hammers & Gavels club, and the Board of Directors. He is most passionate about storm water management and permit extensions, and has been very helpful in PBA’s legislative successes. Member Awards The Builder of the Year award exemplifies a builder member that demonstrates professionalism in their work, along with outstanding service to a local association, as well as to state and national. The 2014 Builder of the Year award was presented to Mark McNaughton of McNaughton Homes. As an active member of the HBA of Metro Harrisburg for over 20 years, McNaughton is heavily involved in the Government Affairs side of PBA. It’s always hard to pick just one project that is deserving of PBA’s Community Service Project award, as there are many locals with outstanding ideas. This year’s Best Community Service Project award was presented to the BIA of Lancaster County, for their project BIA Community Collaborative. The BIA partnered with numerous organizations in the Lancaster area to complete a home renovation for the Strawberry Street Neighborhood in Lancaster City. The mission of this initiative was to provide a well-built house priced far below market value in order to make it accessible for a lower income family in need. The BIA campaigned to obtain materials, skilled labor, and monetary donations through mailings, emails, and personal contacts. The best part? By Melanie Wise, Director of Communications & Member Services The Home Improvement Consumer Protection Act (HICPA) has been in effect since July 1, 2009. It requires all home improvement contractors who work in our state to be registered with the Pennsylvania Attorney General’s Office. PBA wants to ensure that all of our members have access to the resources they need to comply with this law. As a home improvement contractor, you are expected to register every 2 years and the cost is $50. Here are answers to frequently asked questions from the Attorney General: in a calendar year), and large retailers (net worth of more than $50 million). All contractors, including self-employed contractors and sole proprietorships, subcontractors and independent contractors, and corporations, partnerships and all other types of business entities must be registered, unless they fall into the two exemptions above. Who must register? • Anyone who owns or operates a home improvement business or who offers, performs, or agrees to perform home improvements in Pennsylvania must register with the Office of Attorney General, unless they fall into two exceptions: Small contractors (less than $5,000 of work RESIDENTIAL WARRANTY COMPANY, LLC • Contractors are defined as: Any person who owns and operates a home improvement business or who undertakes, offers to undertake, or agrees to perform any home improvement. The term includes a subcontractor or independent contractor who has contracted with a home improvement retailer, regardless of the retailer’s net worth, to provide home improvement services to the retailer’s customers. Contractors who exclusively build new homes, commercial builders, and builders who only work on local, state and federal government construction projects are excluded from the law. What information is required to register? The law requires contractors to submit a completed application, which includes the following information: • Contact and identifying information for the applicant (including information on any prior home improvement businesses operated by the applicant) • For corporations and business entities – information on partners, officers, managers and other parties with an interest in the business • Information on other contractor licenses and registrations held by the applicant 18 Keystone Builder - July 2015 • A description of the applicant’s business What needs to be in contracts for home improvements? • Background disclosures, including information on prior bankruptcies and criminal pleas or convictions • Insurance policy information showing at least $50,000 of personal injury liability coverage and $50,000 of property damage coverage • A signed and dated certification by the applicant • A non-refundable application fee of $50, payable to Commonwealth of Pennsylvania. Do contractors need to display their registration # on their vehicles? Your registration number must be included in any advertisements, contracts, estimates and proposals that you use in Pennsylvania. If your vehicle includes an advertisement for your business, then it must display your HIC Registration number. Your number display must include the abbreviation “PA” and the number assigned to you (example: PA123456). Though the law does not dictate where your number must appear in contracts or advertisements, it must be clearly displayed so the consumer can easily read it. Every contract for home improvements needs to be written, legible and signed by the consumer and the contractor (or their representatives). Contracts must also contain important provisions, including the total price of the project; estimated start and completion dates; and a description of the work. In October 2014, HICPA was amended to allow “time and materials” contract usage by contractors, provided the contractor: (1) informs the consumer in writing that the time and materials contract will not exceed 10% above an initial cost estimate agreed by the homeowner; and (2) informs the consumer in writing that any cost beyond the contract price (initial cost plus estimated 10%) must be agreed to by the homeowner in a written change order. As you get more positive reviews, you will see rankings for your website increase in Google search results, as well as the rank of other sites with reviews about you. • I f you do not bolster your online reputation with honest, positive reviews, a few bad reviews may tank your reputation. The following tips will help you get more reviews and take control of your online reputation. 1. Meet and exceed your customers’ expectations, and provide them with a positive buying experience. The buying experience will give them something to talk about. Make sure they have plenty of great things to say about the process, and are not leaving the situation with a bad taste in their mouth. 2. If you want reviews, you have to ask for them. Remember to follow the terms and conditions of all the websites for which you solicit reviews. You can ask for reviews on most sites, except Yelp, and in no circumstance can you offer compensation for reviews. However, it’s always best to check the guidelines of a review site first. 3. Determine strategic points in the buying process to ask for reviews. These opportunities will usually come at the peak of buyer excitement. These are some of the best times to ask for reviews. 4. Decide the best ways to ask for reviews. For example, you can mention the review verbally in person, and also include a reminder in your next email with a link to the page where you’re hoping to get a review. Ad 5. Include links to your preferred review sites — like your Google Plus, Yelp and Facebook page — in your email signature. For every email you send, this will subtly remind the client that they have multiple opportunities to review you. • • • 6. Be specific on what you would like the client to review (Sales process, Warranties, etc.), and make it easy on the client by sending them a link to the specific review site in question. To build a strong reputation across multiple review sites, ask different buyers to write reviews on separate sites. Cell 7. Ask open-ended, yet specific questions that are likely to lead to longer, more detailed reviews that will help your rankings. If a customer gives you praise via email, with the client’s permission, use that as a testimonial on your website or sales collateral. 10. Send a follow up survey to your customers. Make sure there is a place for them to leave comments along with an opt-in agreement that authorizes you to use the comments in promotional materials. You can then post these comments to the reviews section of you website. 11. Don’t be afraid of reviews that are not 100 percent perfect. The home building process is a long, complicated and human business. Honest reviews that reveal minor flaws will feel more authentic to the future buyer. While all these tactics are great ways to garner reviews, implementing all of them may leave your customers feeling bombarded by sales people asking for reviews. Wentling, AIA Since we are in the middle of the summer season it might be a good time to discuss how exterior features can help market your new home offerings. This discussion can start with the street view of the home but then extend to other outdoor areas of the lot or yard. to the front door of the house with balusters or pillars on either side of a walkway to the front door. For entry-level housing, a picket fence will meet this need at an affordable cost, but for more upscale models a low stone wall with landscaping might be more appropriate. Looking at a typical single-family house on a rectangular lot, the front yard is generally seen as the “public” side of the house and the rear yard as the “private” side. These correspond to the interior spaces in front being more “formal” and in back more “informal”. Designs should make the front more about welcoming guests while the back is for the enjoyment of the owners. The Entry Porch The next element of the outdoors to enhance is the entry porch or stoop at the front door. This feature is repeatedly identified in consumer surveys to be very important -- so I recommend putting some thought into making this element an appealing part of the front elevation. Street or Sidewalk Line We can start the discussion with the forward limit of the lot at the sidewalk or street. Historically this line may have included a fence or low wall to clearly identify ownership, and may have included a gate at the entry walk. Low fencing is still incorporated into the front yard in many communities, In some cases a useable porch may be most appropriate for the house style and local market, which typically means 8 feet of depth. This will allow enough room for comfortable chairs and a table. In other designs a small canopy over the entry door with detailed moldings or other features will suffice. With any type of covered porch, column and railing designs are an great opportunity to dress up the entry with human scale details. particularly to distinguish common open space from private yards and to enhance the street view of the house. Historically these were found in southern mansions and vernacular Charleston houses, however today the trend to locate the garage in the back of the house often makes the front elevation a more appealing location for a second outdoor porch. Sk Back Yard Spaces Moving to the private rear yard, here the outdoor spaces are more about enjoyment for the owners. Typical outdoor spaces found the rear yard are patios, decks, covered porches and sometimes range from freestanding structures such as gazebos to trellises to fully equipped outdoor kitchens. The addition of an open fire pit or full scale fireplace has become a popular amenity to option here as well. Patios and Decks As expected these areas are sized based on the price point of the house, with entry level product often including a 10 x 10 concrete patio slab while larger homes may have generous decks or covered porches. A covered porch may also include an adjacent uncovered outdoor area for the grille or just some additional exterior spaces that may feature a garden or trellised patio. Practical Outdoor Spaces - Let’s talk trash.. Seriously..do your new home designs address a reasonable location for trash containers, recycle bins, perhaps a compost station that is shielded from the rest of the yard? This has become such an issue that some municipalities require a specific cubic area in the garage for trash containers as to not have them in public view. I recommend a fenced area or covered enclosure just off the garage for this accessed from the garage and ideally, the house as well.
