September 18, 2012 at 6:30 p.m. in the Lackey Municipal Building Council Chamber.

Michael Platero. Mayor Kemp then administered the Oath and a family member pinned his
insignia.
Recognize HPD Captain Michael Seis – Chief Howie introduced Michael Seis and recognized
Captain Seis for graduating from the Northwestern University School of Police Staff and
Command.
PUBLIC COMMENTS:
Mark Stevens, James Bruce Convention Center Executive Director and Pennyrile Area
Hospitality Association representative, spoke in favor of the original smoking ordinance.
William Joe Everett, 529 Southwind Drive, spoke in support of a smoking ban in all
public places.
Josh Arnall, 909 Gary Lane, requested Council vote on the smoking issue when all
members were present. He also request Council not limit personal freedoms unjustly.
Russell Fleming, 3977 Tanglewood Drive, supported people’s choice to smoke.
Buddy Oglesby, 605 Las Vegas Drive, requested City Council take action to provide
PEG channels to AT&T U-verse customers.
Kevin Meacham, 113 Academy Drive, thanked the City for supporting Trot for Troops
and Salute Ft. Campbell week.

ORDINANCE 08-2012 REGULATE SMOKING IN ENCLOSED PUBLIC PLACES AND WORK
PLACES (FIRST READING – SUMMARY):
Prior to reading of the ordinance, Councilman Henson moved to postpone the item to the
next meeting; seconded by Councilman Grimes. Following discussion, the motion passed by
roll call vote with all Councilmen present voting aye except Councilmen Ahart, Brooks,
Henderson, Everett, and McCarley who voted nay.

ORDINANCE 08-2012
AN ORDINANCE REGULATING SMOKING IN ENCLOSED PUBLIC PLACES
AND WORK PLACES, ESTABLISHING CIVIL FINES
FOR VIOLATION AND ESTABLISHING ENFORCEMENT PROCEDURES
SUMMARY
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HOPKINSVILLE, KENTUCKY, AS FOLLOWS:
By Summary, Ordinance 08-2012 provides as follows:
SECTION ONE
A. DECLARATION OF PUBLIC POLICY
In order to eliminate exposure of the public and workers in work places to secondhand
smoke and to reduce the harmful health effects of such exposure to secondhand smoke, the
regulation of smoking in public places and work places is required in the interests of public
health, safety and welfare of the citizens and workers of the City.
B.
DEFINITIONS
This section sets forth definitions of certain words used in the ordinance.
C.
PUBLIC PROHIBITIONS AND EXCEPTIONS
This section prohibits smoking within any building or enclosed area that is open to the
public, or any work place, that has been designated by the owner or operator as a smoke-free
establishment, including public transportation vehicles, or any City owned and/or insured
vehicle.
The prohibition does not apply to the following locations, provided smoke does not
infiltrate into areas where smoking is prohibited: (a) any dwelling, unless the dwelling is also
used as a childcare facility, adult day care center or health care facility. This exception does
not extend to the lobby, common restrooms, common hallway, common elevator, or other
common areas; (b) any room used for psychological treatment of nicotine addiction by a
licensed healthcare professional; (c) a retail tobacco store; (d) indoor smoking areas provided in
county, state, or federal governmental office buildings of workplaces; (e) tobacco warehouses;
(f) a rental room or hall being used by a person or group for a private social function that is not
open to the public; or (g) a performer as a part of a theatrical production.
This section does not prevent an owner, operator, manager, or other person having
control of an establishment from prohibiting smoking completely in such place, no person shall
fail to abide by such a private prohibition.
Nothing in this section shall authorize smoking in any place where it is otherwise
prohibited by statute, ordinance, regulation, or order of the Fire Marshal.

D.
REMOVAL OF ASHTRAYS REQUIRED; POSTING OF SIGNS
This section provides that all ashtrays shall be removed from any area where smoking is
prohibited.
The owner, lessee, principal manager or person in control of a building or
establishment subject to this ordinance shall post “No Smoking” signs, or “Smoking Allowed”
signs, depending on the designation of the owner or operator thereof.
E.
DUTY TO ENSURE COMPLIANCE
This section sets forth the policies to ensure compliance by smokers to refrain from
smoking in any no-smoking area. No owner, lessee, principal manager or person in control of a
building or establishment in a building shall fail (1) to ask smokers to refrain from smoking in any
no-smoking area, and (2) to use any other legal means which may be appropriate.
No owner, lessee, principal manager, proprietor or any other person is control of a
business shall fail to ensure compliance with this ordinance by subordinates, employees and
agents.
F.
SMOKING NEAR BUILDING ENTRANCES PROHIBITED
This section provides that smoking shall be prohibited within a reasonable distance from
the outside entrance to any “smoke-free” building or establishment.
G.
RETALIATION PROHIBITED
No person or employer shall discharge, refuse to hire or in any manner retaliate against
an employee, applicant for employment or customer because that employee, applicant or
customer exercises any rights afforded by this ordinance.
H.
ENFORCEMENT AND PENALTIES
This section provides in its entirety as follows:
1.
The provision of this ordinance may be enforced by the Code of
Ordinance Enforcement Board established in Section 33.180 et seq., or in the alternative, the
Christian County District Court, as a misdemeanor and/or violation. The decision on whether
enforcement shall take place with the Code Enforcement Board or the Christian County District
Court shall be at the City’s discretion.
2.
Any person who violates any provision of this ordinance shall be guilty of
a violation and shall be subject to a fine. A first offense under this chapter shall result in a fine
not greater than $100. A second offense shall result in a fine of not greater than $150. All other
offenses shall result in a fine of not greater than $300. Each day that a violation continues shall
constitute a separate offense.
3.
Persons who smoke in an area where smoking is prohibited and who
refuse to extinguish their smoking material when asked may be required to leave the premises
and shall be subject to prosecution for criminal trespass if they do not leave when asked.
4.
Violations of this ordinance are declared to be a public nuisance which
may be abated by the City by restraining order, preliminary and permanent injunction or other
means provided by law. The City may recover the reasonable costs of any court enforcement
action seeking abatement of this nuisance.

SECTION TWO
If any section, subsection, sentence, clause, or phrase of this ordinance is held
unconstitutional or otherwise invalid, such infirmity shall be affect the validity of the remaining
portions of this ordinance.
SECTION THREE
Any and all existing ordinances inconsistent with this ordinance are hereby repealed.
SECTION FOUR
This ordinance shall take effect after January 1, 2013 after its passage and publication
according to law.

AMENDING THE CITY OF HOPKINSVILLE, KENTUCKY, ANNUAL CAPITAL EQUIPMENT
AND PROPERTY REPLACEMENT BUDGET FOR FISCAL YEAR JULY 1, 2012 THROUGH
JUNE 30, 2013 BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING

WHEREAS, on September 20, 2012, the Committee of the Whole forwarded a capital
budget amendment to City Council to provide funding in an amount not to exceed $26,900 for

ORDINANCE 16-2012
AN ORDINANCE PROHIBITING USE OR OPERATION OF ANY ENGINE BRAKE,
COMPRESSION BRAKE OR MECHANICAL EXHAUST DEVICE
WHEREAS, on September 20, 2012 the Committee of the Whole forwarded an
ordinance to City Council to address complaints received from citizens regarding loud braking.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HOPKINSVILLE, KENTUCKY AS FOLLOWS:
SECTION ONE
(A) It shall be unlawful for the driver of any vehicle to use or operate or cause to be used
or operated any engine brake, unmuffled compression brake or mechanical exhaust
device designed to aid in the braking or deceleration of any vehicle which results in a
noise disturbance, except on limited-access highways. This prohibition shall not
apply to personnel of the City who are driving vehicles related to providing
emergency services or any driver of a vehicle who is responding to an emergency
event.
(B) A noise disturbance means any sound which:
1. Endangers or injures the safety or health of humans or animals;
2. Annoys or disturbs a reasonable person of normal sensitivities; or
3. Endangers or injures personal or real property.
(C) Any person who violates any provision of this section shall be subject to a fine of not
less than fifty dollars ($50.00) nor more than five hundred ($500.00) for each offense.
SECTION TWO
If any section, subsection, sentence, clause, or phrase of this ordinance is held
unconstitutional or otherwise invalid, such infirmities shall not affect the validity of the remaining
portions of this ordinance.
SECTION THREE
All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.
SECTION FOUR
This ordinance shall take effect after its passage and publication according to law.

Military Leave Policy
The City of Hopkinsville supports employees serving in the Armed Forces of the United States.
This service may be Active Duty, Guard, Reserves, or the Commissioned Corps of the Public
Health Service and may be voluntary or involuntary.
The City shall provide a maximum of 1521 paid calendar days per federal fiscal year to any
employee serving in an authorized component of the above mentioned services as outlined in
KRS 36.140, and KRS 61.394, and KRS 61.396 (a fiscal year is October 1 of one year to
September 30 of the following year). The City shall pay the equivalent of two consecutive
normal workweeks of pay. Any unused military leave in a federal fiscal year shall be carried
over to the next year. Any unused military leave shall expire 2 years after it has accrued. The
City follows the specific guidelines of the Uniformed Services Employment and Reemployment
Rights Act (USERRA).
Any employee in a qualifying service commitment shall be given all rights as outlined by
federal and state law. Any employee called to serve shall be required to continue to pay any
healthcare premiums they are currently required to pay. The employee shall not be required
to use vacation leave. The employee is responsible for paying the premiums on any voluntary
benefit programs such as short or long-term disability,or cancer insurance, etc. in which they
participate.
An employee called to active duty shall not continue to accrue holiday, vacation, or sick leave.
However, any time the employee has accrued shall not be lost due to the absence of the
employee. The employee shall have all available leave balances placed in abeyance until the
employee returns from active duty. The employee shall then be given ample time to use any
leave available to ensure they are “made whole” per USERRA.

NOW, THEREFORE BE IT ORDERED, Hopkinsville City Council hereby declares the
items listed on Exhibit A surplus property and authorizes the Mayor to dispose of said
items by methods available in KRS 82.083.
