Greetings From the Desk of Your Executive Director
Dan Holmes
T
he enthusiasm and
talent within this
industry never ceases to
amaze me. 150 people
joined the learning
experience at Turning Stone Resort
and Casino on March 10th and 11th
to further their careers in the Free
Paper business. The Super
Conference provided training to
sales reps through the AFCP
Learning Institute. Thanks to Dave
Tomasini, Charlie Delatorre and
Tom Cuskey for sharing their
knowledge and insights. Classified managers and representatives
were the recipients of IFPA’s generosity. IFPA paid for Janet
DeGeorge from Classified Executive Training who shared her
expertise in classified revenue growth. The classified attendees
also had the opportunity to refresh their customer service skills
with Tim Smith.
Our Graphics participants were reacquainted with Kevin Slimp
who shared tips and techniques regarding color correction and
Adobe Photoshop and our publishers had their horizons expanded
regarding the importance of keeping up with the fast-paced
changes in the electronic publishing world. Everyone in
attendance had the additional opportunity to interact with the
11 industry vendors in attendance for the two-day conference.
Congratulations to all of the winners in the Graphic Awards
competition. Nearly 900 entries were received for this year’s
contest, a record amount. Judges had a tough time analyzing
all of the professional entries. Our graphics professionals have
come a long way in this ever-changing facet of our business.
distribution of “junk” mail can be detrimental without
a specific definition of what constitutes “junk.” We had
productive conversations and walked away with the
agreement that our community publications need to be
written out of the pending legislation. Just the opportunity
to raise awareness of the importance of our publications to
our communities was priceless and every assemblyman and
Senator we spoke with was able to relate our message to their
own local community publication. We are safe for now but
we will have to remain vigilant in our effort to protect our
interests from a legislative perspective.

Hi, Neighbor
Cazenovia, NY
Publisher: Brent Selleck
Special congratulations to Jean Clarke who was presented the
2008 FCPNY Salesperson of the Year award. Jean was nominated
by her publisher at Scotsman Community Publications, Tom
Cuskey. She was then screened and judged by four board
members of the Sales Management Division of FCPNY. It
was an extremely tight competition and Jean edged out a
dozen other nominees, all of whom are clearly the cream
of our sales representative crop.
The next opportunity for professional training is the Sales
Manager’s meeting to be held at the Esperanza Mansion on Keuka
Lake June 8th, 9th and 10th. There are only 25 rooms available
for this annual event and you don’t want to miss this chance to
learn and network. Additional information is available in this
newsletter.
Your FCPNY staff is also busy on other fronts. In March we
chose Hinman Straub Associates as our Government Relations
representative. They have hit the ground running and on March
27th Dan Alexander and myself visited the State capital to visit
with the sponsors of a bill that could impact our right to distribute
our products to our readers. You will be hearing a lot locally and
nationally about Do Not Deliver or Do Not Mail initiatives that
mimic the Do Not Call registry. These attempts to limit the

Hello Everyone!
I
t’s April!! I hope this finds everyone well.
Spring has arrived and hopefully more
sales than this past winter will follow.
FCPNY has been quite busy since the
last newsletter. Some items of note:
Our Spring conference at the Turning Stone Casino
and Resort was well attended and the Graphic
Awards were terrific. I want to thank the eleven
vendors recognized elsewhere in this newsletter for
attending our conference and sharing their services
with our membership.
We have hired a lobbyist – Hinman Straub, located in Albany. Our contact person, Mara
Ginsberg, spent Monday evening and Tuesday morning with us at Turning Stone. This
allowed a proper introduction for Mara and a chance for her to learn more about our
industry. She is busy working with Dan Holmes to deflect “Do Not Deliver” initiatives
from affecting our community publications. They visited the Statehouse on March 27th
and sat with the sponsors of a Do Not Deliver bill, Assemblywoman Aurelia Greene and
Senator Carl Kruger. They also met with the chairs of the consumer affairs committees.
The result of the meetings is the opportunity to define our publications and protect them
as not included in the proposed legislation. Thanks to all of the members of the legislative committee who took the time and provided their expertise during the search for our
new Government Relations firm.
It is my pleasure to welcome two new publications to FCPNY; Hi, Neighbor publications
was approved at our October Board of Directors meeting. Published by Brent Selleck Hi, Neighbor adds 13,000 circulation to our membership. Napaul Publishers was
approved for membership at the January 28th Board of Director’s meeting. James Cole
is the publisher of the Rensselaer County Shopper, the Dollar Stretcher and the Wise
Shoppers with offices in Hudson Falls, NY. They bring 60,727 circulation to our
membership total of 7,381,302.
Your Board of Directors is a vibrant, committed group of leaders of the Free Paper
industry in New York State. Due to acquisitions and consolidations we have some vacancies
on our Board at this time. We would appreciate nominations of individuals that you
think would add to the growth and momentum of FCPNY. Please give me a call with
any suggestions.
To help protect the integrity of the CPAN program and the results that our advertisers
have come to expect we will be implementing an affidavit auditing process in the near
future. We are trying to keep it simple and unobtrusive to you but we need verification
that the ads that are distributed are run in all of your papers. Thank you for your
cooperation with this upcoming program. Details will be forthcoming from the
FCPNY offices.
Lastly let me be the first to invite you to the Sales Manager’s meeting to be held at the
Esperanza Mansion on Keuka Lake and the Publishers Summit to be held at the
Otesaga Resort in Cooperstown. The Sales Manager’s meeting is June 8, 9, and 10 and
the Publisher’s Summit is September 19, 20 and 21. Dan and Erika are finalizing the
speakers to assure a valuable learning experience for all who participate. Watch for
details coming your way soon, including in this newsletter. Both meetings are structured to provide networking and educational opportunities in beautiful New York
settings. Register fast because participation is limited!
Remember, the Free Community Papers of New York Board of Directors are here for
you. If you have any questions/suggestions, please give one of our board members a call
or an e-mail.

From Your
Marketing Director
Erika Perez
T
hey say time flies when you’re having fun and I must
agree - this past year my FCPNY position as Marketing
Director certainly has been fun and fast! I have learned
so much, met so many of you - our fabulous members, &
have truly experienced the “magic” of the legacy that
Mary so kindly left behind.
We just returned from our 2008 FCPNY Super Conference, which
was just that - “SUPER!” You will see the various highlights of the
conference throughout this newsletter - we received much positive
feedback from all attendees and are looking forward to exceeding
your expectations again next year!
Your association office has been hard at work updating the FCPNY
website, planning the Sales Manager’s Conference scheduled for
June 8-11th at the beautiful Esperanza Mansion on Keuka Lake
& planning the Publisher’s Conference scheduled for September
19-21st at the Otesaga Resort Hotel in Cooperstown, NY.
I encourage you to take a moment and review your publications’
information on the association website - www.fcpny.com - and let
us know if changes need to be made. It is in our best interests to
keep this website updated with contact information and links to
your websites. When a media buyer or advertiser accesses our site,
we want to make sure that we are presenting the most current
information possible. You can also access the latest and greatest
newsletter in an electronic format as well as find out what’s
happening currently within our association & download the
CPAN media kit.
Our CPAN program is pushing for a strong third quarter. Display
ad revenue is up but classified revenues are slipping slightly
compared to the strong performance we experienced in 2007.
There is still much opportunity for growth. I am ready and willing
to visit your publication and train your staff so that you are taking
advantage of all that the CPAN ad network has to offer. In this everchanging age, the CPAN program could prove to be a real source of
revenue for your publications. Call or email me today and let me
show you how!
On that note, thank you again for making my
first year memorable & don’t forget to “Make
it Great in 2008!”
‘Til next time,

Salesperson of the Year!
Congratulations to Jean Clarke of the Scotsman
Pennysaver, Syracuse, New York for the honor &
achievement of the 2008 FCPNY Salesperson of the
Year award. As a sales representative, Jean is responsible for the sales and marketing of all Scotsman products to customers in her territory. In addition to serving the needs of and developing relationships with
existing customers, Jean is always responsible for new
business prospecting and development and for developing special promotions that
are specific and suitable for
the area. She also is charged
with maintaining collections
and good credit standings
among her clients.
Associate Publisher and Sales
Manager,
Tom
Cuskey
writes: “Jean is one of the
most determined individuals
I have ever known. She’s
been a single Mom for a long
time and battles dyslexia, a
tough obstacle to battle when
you’re working in print. But
it’s these sorts of things that
have made Jean a tough battler who never gives up, at
least on the inside. Her
warm, charming and helpful
demeanor sometimes belies
the fire that burns inside her.”
“Jean has excellent customer management skills, making sure she is ahead of their marketing curves and
always on top of their schedules. When challenges occasionally arise, she is quick to meet it head-on and
works hard to be sure the customer’s best interests are
always at the center of decisions we make.”
“Hand in hand with her customer service system and
aggressive promotional calendar goes the ability to
manage the week, the basic
building block of our time and
deadline schedule. What makes
it a little easier for Jean than
most is her consistent willingness to devote extra time to
accomplishing more and getting things done correctly. She
consistently works evenings
and Saturdays, developing
new customer spec ads and
campaign proposals to keep
the pipeline filled with new
prospects”
Jean Clarke and Tom Cuskey, Scotsman Pennysavers
“Jean challenges herself far more than we do, not only
in setting sales objectives but she also lays out heavy
promotional objectives. We call her “Jean, Jean, the
promo queen” in the office – she typically has multiple
in-paper local promos running weekly and is consistently among our top special publications performers
as well. Jean’s promotional adventures help serve as
her entrée to new businesses and existing prospects
who haven’t bought in to the main product idea yet.”
“With her extensive background, Jean brings great
knowledge of the marketplace and competitive products to the position. Thus, she designs her promotions
and campaigns to market competitively against other
media products and uses her expertise with our product capabilities to continually build market share for
us in her areas.”
“Jean is a great community
volunteer, having given time to
a large number of charity
events and fundraisers through
the years, both in her sales territory and in the greater Syracuse area. She also has served
as an officer of two area Chambers of Commerce.”
“Jean has recently been promoted to a sales team
leader position in recognition of her own sales success
but more so because of her demonstrated history of
helping her colleagues in the office. She is a valuable
trainer and has always helped introduce new staff to
her successful methods of developing new business
through promotional concepts within our pages. Her
territory is also among one of our consistent top dollar
producing areas, posting a 16% increase on sales during our most recent fiscal year. That’s a double-digit
increase performance on a mature and consistently
high performing territory.”
“Jean has been a consistent star for us for 12 years
and this is long overdue recognition that she is very
deserving of.”
Congratulations
from your fellow
FCPNY Members!

members of the

Chicago, IL for a one

session with facilitator
Andy Hoh. In January
the chairmanship of
PaperChain passed
from Loren Colburn to
Dan Holmes and when
the leadership
transition occurs we
often schedule a strategic planning session to set the
course for the next two years.
Participants at this session made a clear directive, it
is time for PaperChain to get back to the business of
marketing the Free Paper industry. This is evident in
the slight change made to the PaperChain Mission
statement. It has changed from: “PaperChain
enhances the profitability of its members by
coordinating unified education, marketing and sales
programs”, to: “PaperChain enhances the value of the
members and the free paper industry by coordinating
unified standards, education and marketing.”
This simple change turns our PRIMARY emphasis
towards the mission of education and marketing. We
will continue to provide the industry with the Link &

will also strive to renew our marketing of the
industry. Since we hit a home run associating with

marketing. The success we have enjoyed from our
relationship with SRDS and the advertising some of
our members have received as a direct result of that
relationship verifies the importance of a marketing
strategy. During our attempt to create a working
database for use in national advertising sales efforts
we backed away from the marketing function that
has been the foundation of PaperChain’s existence.
This was a strategic decision to avoid any overlap
and lack of consistency with the efforts contracted
with Gemstone Media. Our success with Gemstone
and the data collection process has been limited due
to a variety of reasons and due to short-comings on
both sides of the relationship. We have decided to
wait no longer in our effort to educate the advertising
buyers of the importance of the Free Publication
piece of the overall Media package.
www.fcpny.com
Our data collection will continue in concert with
Circulation Verification Council (CVC). Tim
Bingaman at CVC has expanded his data collection
process to include the compilation of rate
information. All audited publications provide
demographic and circulation information to CVC on a
quarterly schedule and Tim will secure rate
information on this same schedule, information that
he will share securely with PaperChain and our
internal database. Based on the success of this
process we will continue to pursue direct sales in
addition to our emphasis on marketing our industry
and our products. We hope you will provide your rate
information based on the faith and comfort you have
with CVC, a long-time provider of audit services for
our industry.
We have much to do and through the Strategic
Planning process conducted in Chicago we have
created a structure to accomplish our goals. Three
primary initiatives were created at the meeting and
leaders have been chosen for each initiative. In the
next month our action steps will be developed and
PaperChain will announce our specific direction at
the AFCP meeting on April 24th in Palm Springs. If
you are attending the AFCP annual conference join
us at 3:45 on Thursday as we spell out our plans. The
national, regional and state associations will provide
updates at your upcoming conferences as well. In the
meantime we are interested in your thoughts and
your participation. If you have an interest in working
on any of our acting committees please let me know
and we will gladly put your enthusiasm and talents
to work for the benefit of the industry. I can be
reached at 877-275-2726 or at dholmes@fcpny.com.

By Jean Barraclough
S
taffing can be a
nightmare for almost
any business, and it’s
especially true in the
free paper industry,
where many publications are
familyowned, “mom and pop”
operations. So, what do you do
when you need to fill that leftover
half page, or you want to give
your readers some good,
informational news but can’t
afford an editorial department?
You turn to North American
Precis Syndicate; just the way
newspapers -- small and large -have been doing since 1958.
With about 120 employees and
offices in New York, Chicago,
Washington, San Francisco,
Los Angeles, Florida and
Michigan, NAPS provides content
for print and online publications,
in the form of features like health
and fitness, home improvement,
car care, food, vacation and
travel, religion, senior citizens,
and holidays to fill those holes or
to help you build a special section.
Best of all, they do it for free
through a service called
Featurettes. You can choose
content in print or on CD or
just go to their web site
(www.napsnet.com) and download
what you need... including highresolution graphics! How easy is
that? And in case you’re thinking
of expanding into broadcast, they
also offer content for TV and radio.
www.fcpny.com
NAPS provides features and
graphics from more than 750
companies, associations, PR firms
and government information
offices. This includes most
Fortune 500 companies, and more
than 100 PR firms, including the
20 largest in the country.
Gary said, as free papers continue
to strengthen their ties to their
communities through online
editions!
NAPS is still the number one
provider of free quality features
for publications and onlines
(special sections and inserts),
according to Gary Lipton, NAPS
vice president, Media Department.
“The subject range of the material,
the relevance to families and
communities, and the excellence
of our writing and research makes
Featurettes unbeatable!”
Gary said.
Like so many of us in the
publishing business, NAPS has
had to grow and change with the
demands of the marketplace.
“The biggest change (and the
latest) is the expansion of
publications from print to online
editions,” Gary said.

NAPS has joined FCPNY because
the association offers the
company an excellent opportunity
to spread the good word about
Featurettes/NAPS throughout
New York State’s free paper
community.

“No Good Deed – The Dangers Presented by
Employee Assistance and Wellness Programs”
By: Joseph J. Steflik, Jr., Esq. • Coughlin & Gerhart, LLP
Many
employers
have, over the
last several
years,
instituted both
Employee
Assistance
Programs
(“EAP”) and
wellness
programs to aid employees with
emotional, physical, addictive, and social
problems and reduce medical insurance
costs. Unfortunately, both have become
the subject of lawsuits and federal
regulation.
EAP
EAPs are employer, union, or joint
counseling services designated to aid
employees in the identification and
resolution of personal and/or work-related
problems. These problems may require
the intervention of medical or counseling
personnel. Such intervention may involve
extremely personal and private matters –
drug and alcohol abuse, family disputes,
domestic violence, financial problems,
gender identity issues, health, etc.
Almost all programs promise privacy.
Recent developments in the law
necessitate an evaluation of the programs
with regard to employer liability which
may result from their use by employees.
Both the Americans with Disabilities Act
(ADA) and the New York Human Rights
Law (HRL) prohibit discrimination
against an employee with a disability or
who is perceived to have a disability.
Holihan v. Lucky Stores, Inc. (CA 9 1996),
a federal case involving an EAP and
perceived disability under the ADA,
reflects the dangers to employers. There
the employee had been the subject of fiftyone (51) abusive behavior complaints by
co-employees. He was given the choice of
suspension or leave pursuant to the
company EAP. The court held:
18
“Lucky called Holihan into two separate
meetings to discuss his aberrational
behavior. At one of these meetings,
Lucky District Manager Church asked
Holihan if he was having any “problems”;
at the other, Church strongly encouraged
Holihan to seek counseling through
Lucky’s EAP. Lucky also received several
doctors’ reports diagnosing Holihan
with depression, anxiety and stress, ….
From these facts, a reasonable jury could
infer that Lucky regarded Holihan as
suffering from a disabling mental
condition that substantially limited his
ability to work.”
An EAP was also the focus of litigation in
a recent New York federal case, Jackson
v. University of Rochester (NDNY 2006),
where an employee allegedly told an EAP
counselor that he would go home, get his
gun if someone in the department ever
made him angry, and he previously
brought a gun to work with the intent to
use it but no one upset him that day. The
counselor notified the university and the
employee was terminated. The court
dismissed the case.
However, both cases are instructive as to
the conundrums faced by employers –
recommendation to employees to seek
assistance pursuant to an EAP may be an
acknowledgement of a perceived
disability; failure to direct such assistance
may put co-employees at risk, and privacy
concerns may involve both issues.
Employers should carefully review their
EAP and how they intend to utilize it.
WELLNESS PROGRAMS
Wellness programs may contain a variety
of items – health club memberships, nonsmoker discounts, waiver of co-payments,
health education, etc. The United States
Department of Labor has recently issued
guidelines to determine if a wellness
program complies with the nondiscrimination provisions of the Health
Insurance Portability and Accountability
Act (HIPAA). The first issue is whether
the wellness program is part of a group
health plan (subject to HIPAA rules) or
merely an employment policy (not subject
to HIPAA rules). A wellness program
subject to HIPAA must follow the
following rules:
1. The amount of the reward must not
exceed 20 percent of coverage. When
calculating the 20 percent, the plan
sponsor must include all of the plan’s
wellness programs that require
individuals to meet health-related
standard.
2. The program must be reasonably
designed to promote health or
prevent disease.
3. Individuals must have a chance to
qualify for the reward at least once
a year.
4. The program must have a reasonable
alternative standard for obtaining the
reward for individuals for whom it is
unreasonably difficult due to a medical
condition to satisfy the standard or it
is medically inadvisable to attempt to
satisfy the standard.
5. All plan materials that describe the
program must disclose the availability
of a reasonable alternative.
Thus, if a wellness program varies
benefits based on meeting a healthrelated measurement, it must satisfy
the five-factor test.
Employees who fail to meet the
requirements will be directed to correct
their health plan and make participants
whole for any violation.
SUMMARY
EAP and wellness programs serve a
beneficial service for both employers
and employees. However, be careful to
craft the programs to accomplish your
purpose and not expose your company
to increased liability.

Publisher Named for Wayne
County Publications
Tracey Curry
Editor, Palmyra Courier-Journal
Longtime Palmyra resident Tom Klemann has been
promoted to the top spot at Messenger Post Media’s
expanded Wayne County operations.
that already exist, while providing fresh marketing
and promotional opportunities for existing customers and making sure readers are satisfied as well.
‘We’re truly fortunate to have someone living and
working right here who can step up to this kind
of lead role,’ said Kelly Luvison, GateHouse Media
Executive Vice President.
‘Our customers can expect to deal with the same
talented Ad Group staff as always,’ he said. ‘Yet,
at the same time, we will have the benefit of
improved resources and advertising opportunities
that are shared with our neighboring Messenger
Post Media and the hundreds of newspapers within
the GateHouse family.’
‘This kind of local connection is key
to our expansion in Wayne
County, not to mention a great
opportunity for a proven manager
from within our own ranks.’
GateHouse Media Inc., parent
company of Messenger Post
Media and AdNet Direct Printing, annou-nced the acquisition
of Ad Group WC Inc., from
John Van Dusen of Newark
two weeks ago.
Ad Group includes the weekly
Courier-Gazette newspaper, the
Newark Pennysaver, SodusWilliamson Pennysaver and
Lyons-Clyde Savannah Shopping
Guide. GateHouse also operates
The Timesaver and the Courier-Journal in Palmyra,
in addition to the 21 Messenger Post Media
publications in Monroe and Ontario counties.
In all, the company publishes more than 50 titles
from multiple production facilities across central
and western New York.
Klemann said, ‘I’m excited to have the opportunity
to work more closely with the people of Ad Group.
I already know many of the employees. As being
publishing neighbors, we have worked together and
cooperatively for many years. It is a solid company
with some very good and dedicated people.’
His role of publisher, he said, will include building
on the strengths and qualities of the publications
Klemann has been in advertising
for over 30 years, rising through
the ranks as a sales rep, sales
manager, and then division
manager, for what was first
Timesaver Advertising, then
Adnet Community News and
now as Messenger Post Media.
‘Tom’s appointment as publisher
really puts the icing on our Ad
Groupacquisition,’ Luvison said.
‘The combination of his industry
experience, reputation and local
market know-ledge makes this a
perfect fit.’
Klemann, too, sees the expansion as a win-win
situation for everyone.
‘It gives us the opportunity to expand our circulation in the Wayne County and Rochester area
markets with quality and respected publications
and it gives Ad Group the advantage of many more
resources through GateHouse Media,’ he said.
Klemann, born and raised in Clifton Springs,
graduated from Alfred State College. He has been
involved with Canaltown Days in Palmyra for over
30 years, 15 of which he has served as its general
chairman. He and his wife Deb are the parents of
the late David Klemann, and their daughter, Jill,
27, who lives in San Diego, California.

“I would like to thank you for the informative and
entertaining conference at the turning stone. I learned
new techniques for selling and prospecting, which
were most helpful. I was also pleased to meet others
in my specific field and realized that we all faced the
same problems and symptoms!!! It’s always helpful to
brainstorm with peers!!! Thank you, again ~
I enjoyed the day very much.”

A Few Kind
Words from
our Associate
Members...
“Just wanted you to let you know that the NY
show was excellent for my company Kaesu/
coolerads.com. I had a great turnout and I
kept busy almost all the time. You ran a great
conference and it was well organized. I look
forward to returning next year.”
Joe Nicastro,
Co-Founder
Kaesu / coolerads.com
“What I liked most about the 2008 FCPNY
event was that it was a relatively small,
intimate conference, but with big-conference
ideas, presentations, and discussions. All the
attendees seemed eager to face the future of the
industry, and openly shared a lot of ideas and
experience. Anyone who missed this, missed the
best FCPNY gathering I’ve ever attended.”
Justin Gerena,
JB Multimedia, Inc.
“From a vendor’s point of view your winter
conference was terrific. Your hospitality and
attention to detail made it a wonderful experience
and a very conducive atmosphere to conduct
business and discuss the state of our industry.
Continue the good work and keep me posted of
upcoming events.”

IMPORTANT!!
Below is a directive that has been distributed to all
Wal-Mart store managers. Since it affects anyone who
distributes publications in Wal-Mart’s store vestibules we
thought it important to share this information.
“As we strive to save our customers money so they can live
better, it is important that we redefine our brand image
to reflect our brand promise, and the customers’ needs in
their communities. We’ve conducted research to find out
what our customers want, and it is clear they expect a new
shopping experience at Wal-Mart. Some changes will take
place in store vestibules.”
