community joined with HIA-LI Board
members and staff at a gala networking, trade
show and luncheon celebration held at the
Crest Hollow Country Club on September
16th to recognize this year’s winners of HIALI’s Annual Business Achievement Awards.
Now in its 20th year, the awards, presented
in four categories, showcase premiere
Long Island organizations that exemplify
operational excellence, outstanding vision and
preeminent leadership.
In July, eighteen finalist organizations were
chosen from a sizable candidate pool on the
basis of their industry leadership, creativity,
successful business operations, vision and
other key aspects needed to grow a successful
business. HIA-LI Selection Committee
members met with these organizations
this past summer to learn more about their
operations and painstakingly choose one
winner in each category -- Large Business,
Small Business, Rookie-of-the-Year and Notfor-Profit Organization.
Family-owned
military
and
outdoor
merchandise wholesaler, ROTHCO, was
named winner in the Large Business category.
Nationally-recognized accounting and tax
service leader Gettry Marcus won the Small
Business Achievement award.
Compass
Workforce Solutions, a recent startup in the
HR consulting space, earned Rookie-ofthe-Year. The Long Island Chapter of the
American Red Cross secured the award in the
Not-for-Profit category.
In her opening remarks, HIA-LI President
Terri Alessi–Miceli highlighted the factors
that earned these companies their status as
winners. Applauding their achievements
she said, “The progress, effective economic
operations, corporate vision, sound leadership
and other crucial characteristics that this
year’s winning organizations have displayed
will serve to inspire other businesses and
organizations across Long Island.”
Keynote speaker Steve Bellone, Suffolk
County
Executive,
commended
the
Association for its role as a business
development accelerator, praised the winners
and discussed the critical variables that lead to
organizational success. The County Executive
pledged he would continue to ensure an
environment ripe for sustainable economic

One by one, the winners in each category
were called to the stage by last year’s category
winners and presented their commemorative
plaques. Video clips on each organization
were shown to introduce the companies and
highlight their offerings.
As Howard Somberg, President of ROTHCO
guided wheelchair-seated Milton Somberg,
Company Chairman to the stage, the two
garnered a hardy standing ovation. Side by
side, each attributed the company’s success
to their employees, customers and business
partners. President Somberg said, “You’re an
amazing guy, dad,” disclosing that at 90 years
of age his father still continues to make it into
the office on Thursdays.
Steven Marcus, Manager Partner at Gettry
Marcus, CPA, P.C., accepted the award in
the Small Businesses category and described
the process of preparing his company for a
successful attempt at getting the award. “We
were told last year that we not only needed
to talk the talk but walk the walk. We recrafted ourselves around our brand, mission,
vision and goals. I want to thank our staff for
adapting to all the changes they had to make
as part of this process.”
Compass Workforce Solutions’ Founder
Christine Ippolito graciously accepted
the Rookie-of-the-Year award to roaring,
congratulatory applause. “This is a tremendous
milestone for us in the business. I never
envisioned I would have so many people
rooting for me.” Ippolito thanked her clients,
her mom who traveled from Minnesota to
attend the festivities and her staff stating, “I
have a tremendous team and I know I push
you really hard.”
In accepting the award for Not-For-Profit
Organization, American Red Cross on Long
Island, CEO John Miller spoke of the more
than 2.8 million people throughout Nassau
and Suffolk the organization serves, citing
the millions of meals it distributed in the
aftermath of the 2011 and 2012 hurricanes and
the financial support it was able to distribute
to local organizations that assisted storm
victims. “It’s my pleasure to accept this award
on behalf of our donors, volunteers and board
members. I have never been so impressed.”

by the United States Congress for October to raise awareness of the employment needs

Protecting the stay-at-home spouse

When married couples have young children, often one spouse stays home while
the other works outside the home. While most parents understand the necessity of
purchasing a life insurance policy on the income earner, few realize the importance of
also insuring the stay-at-home spouse.
Being prepared for the unexpected.
What if the stay-at-home spouse suddenly died? The family would be devastated. While
friends and family members would initially pitch in to help, eventually they would
return to their regular lives. Before the surviving spouse returned to work, a caretaker
for the children and home would need to be hired, presenting a potential financial
hardship. Had life insurance been purchased on the stay-at-home parent, however, the
family’s needs would have been protected.
Measuring the value of the stay-at-home spouse.
Despite the importance of the stay-at-home parent, there’s little research to quantify its
value. In its 13th annual “Mom Salary Survey,” Salary.com reports the most popular
functions performed by mothers equate to $113,586 per year1 in salary. Also, it states
the stay-at-home spouse works a 94-hour week, performing, among other roles, the
duties of housekeeper, cook, day care teacher, driver, and psychologist.

provides affordable coverage for several years. In contrast, permanent life insurance
offers protection for your entire life (provided premiums are paid) and accumulates

your changing needs.

What should you look for when evaluating a disability
income (DI) insurance policy?
Quick -- what’s your most valuable asset? Many people
will say their home, investment portfolio or a priceless
antique, but, generally speaking, the asset that makes
all of your other possessions possible is your ability
to work and earn an income. People often insure their
“golden eggs” but not the “goose” that produced them.
Disability income insurance can help protect you from
financial loss should an accident or illness leave you
unable to work. DI insurance can help provide you with
peace of mind and financial protection at a time when it
is most needed.
If you don’t have disability income insurance, consider
it. If you do have coverage, review your policy. The
disability income insurance marketplace has changed so
much over the past several years that existing policies
may need an update. What should you look for when
evaluating a disability income policy? Here are ten
tips.
1. Stability. Check to see that the company providing
coverage has acceptable ratings from a variety of
independent financial rating agencies like A.M. Best,
Moody’s or Standard & Poor’s.
2. Renewability. Make sure the policy is non-cancelable
and guaranteed renewable. This means the policy can’t
be canceled (except for non-payment of premiums) and
the premiums can’t increase regardless of your income,
occupation or health.

usually modest in cost and offers you the opportunity
to increase your benefits with no medical underwriting.
3. Own Occupation Protection. Under this valuable
provision, you will be eligible for benefits as long as you
cannot perform the substantial duties of your specialized

9. Recurring Disabilities. This feature can mean the
difference between resuming benefits or sending you
back to square one. For example, suppose you are
unable to work due to an illness, then recover and return
to your job. Suppose later you are disabled again due to
the same cause. With some contracts, you are allowed
up to 12 months to return to work; and if you are disabled
again due to the same cause, the elimination period (or
waiting period) has already been satisfied by the prior
disability and benefits are paid immediately. Some
contracts, however, have only a six-month successive
disabilities clause. This could mean a big difference in
your protection.
4. Partial Disability Benefits. Medical technology
and rehabilitation services are always improving. With
many accidental injuries and illnesses, people are back
to work on a limited schedule before returning full-time.
Partial disability can provide you with benefits if you
are working on a limited basis with reduced earnings.
5. Residual Income Loss Benefits. This benefit
helps the professional who is back to work full-time,
yet still has reduced income. It is designed to provide
benefits after a disability as you build your business or
professional practice back to pre-disability levels. With
a residual income loss provision, ongoing medical care
is generally not required.
6. Rehabilitation. If you have to enter a new specialty
or occupation, the carrier may provide a benefit to assist
you in the retraining process. This benefit should be in
addition to the other benefits being received.
7. Cost of Living Benefits. These important features
adjust the benefits to some measure of inflation, often
the Consumer Price Index. A wide variety of cost-ofliving options are offered and can be incorporated in
your policy.
8. Additional Purchase Options. You can help protect
your insurability today by adding an option to purchase

W
hen I say, “leader” what comes
to mind first? Politics? Work?
Generally speaking leadership is
more than a job or role. Think of it more as
a way of thinking.
Let’s face it! Most Managers (and
Politicians) see themselves as great leaders.
Unfortunately, most fall short in that
department. What makes a Leader weak?
Most of the time they tell you what you
“should” do, but rarely follow through
themselves. Typically, they have high egos
and don’t listen to their constituents. The
worst part is they believe the reason their
team fails is because they are incompetent
or not able to perform. Sound familiar?
I rarely meet a manager who admits they
suck or have weakness. But if you want
to be a great leader in business, you must
first become a great leader in your life. The
ability to transfer your beliefs in others is
the secret to becoming an effective leader
in both business and life. Here are a couple
of things you can do in order to start your
journey.

I had a client who had an employee they were
going to terminate because of his inability to
show up on time. They gave him a verbal
warning as well has two written warnings.
They asked me if they should fire him in the
morning or at the end of the day. My answer
was neither. As a leader, you either allow
negative behaviors or teach it with actions.
In this case, I asked to have a conversation
with the employee. I shared with him it was
no surprise to him that the end was near
because of his actions (which he needed to
accept responsibility for). Then I listened to
every reason (excuse) on why he was late
over the past two months. We then spoke
around his strengths and what he loved most
about his job. Did he really want to be there
or was he going through the “motions” of
showing up, but he quit mentally already?
I then asked him to put together a written
strategy whereby he could follow in order to
make it to work on time. This may seem like
a lot of effort, but remember our first rule?
It was important to see the world has he saw
it prior to me making a decision based on
perception. This guy had great performance
while at work and the cost to replace him
would be expensive. This exercise also
made it very clear that his destiny was in his
hands at this point. Pain is a big motivator,
but didn’t want the threat to come from
leadership, rather himself.
What happened? Eight months later he’s
showing up early to work and more excited
about his job than ever. But the Leader did
her part too. Every day she acknowledged
him and encouraged him staying true to his
plan.
Being an excellent leader isn’t an easy thing
to do. It requires a lot of effort and little
recognition from others. At least in the short

• Successful leaders possess the ability to see
challenges and opportunities from different
perspectives. There’s a danger to manage
from how you see the world. Honestly, the
way you see it is not nearly as important
has the people you’re trying to lead see
their world. People are connected through
common human experiences. Think about

The FMLA – or Family and Medical Leave Act
– has far-reaching scope and implications. Some
businesses will be impacted by its latest changes;
others will not, therefore remaining a perennial
concern among employers.
The FMLA provides up to 12 weeks of unpaid
leave a year for eligible employees, with their health
benefits protected and jobs secured upon return
from their leave. Public agencies and schools must
provide FMLA coverage. Private business must only
provide FMLA coverage if they employ 50 or more
employees for at least 20 work weeks in the current
or preceding calendar year.
Ask yourself:

Are your employees eligible for FMLA
coverage?
•
Are they in a state where the DOMA ruling
increases their FMLA rights?
Many small businesses don’t think they are
required to provide coverage, especially if they
don’t have 50 full-time employees, but some of these
businesses hire temporary or seasonal workers. If
those employees work 20 work weeks in a calendar
year and their addition brings a company’s total to 50
or more employees, that business must comply with
the FMLA.
This is also true for other small businesses that
have cut their staffs to fewer than 50 employees
because of the Affordable Care Act for example. If
these businesses employed at least 50 employees
for 20 work weeks in the previous calendar year,
they also must comply with the FMLA and provide
coverage in the current year.

The FMLA continues to challenge employers.
Each FMLA request requires a case-by-case analysis
which is what makes the FMLA difficult to apply.
Additionally, intermittent leave and controlling
employee leave abuse were identified as the top 2
leave-related challenges for employers by nearly 70%
of employers surveyed in a 2013 poll sponsored by
the Disability Management Employer Coalition and
Spring Consulting Group. These employers stated
that they were concerned with employees abusing the
FMLA and similar laws.
To make matters worse, the FMLA overlaps
with many other laws and policies, such as
collective bargaining agreemen ts, short- and long
term disability policies, workers’ compensation,
absenteeism policies, and paid time off. Employers
must remember and consider all of them every time a
leave question arises.

FMLA and the type of employee notice required

School Zone Speed Cameras – A Pilot Program or Here to Stay?

severity of violation, the number of notices of liability
and the amount of fines paid.
The question remains – is this the start of a slippery
slope? Red light cameras are now common place on Long
Island. If effective by a school, should not such a program
be effective near a senior citizen home? What about near
a park, gymnasium, or other area where one is sure to find
school-aged children? Perhaps the context will matter. Are
we more concerned about “catching speeding violations
and preventing the accidents that arise from speeding”
or “encourage[ing] drivers to proceed with caution
through school speed zones [and] enhancing the safety of
children[?]” Perhaps the real motivation is revenue? In any
case, speeding and other traffic violations (such as texting
while driving or driving under the influence) are becoming
increasingly more serious offenses on Long Island. To be
sure, although a Pilot Program, the message is clear: obey
traffic laws or you will suffer the consequences.

Speed cameras were installed on Long Island. If you get
‘caught’ speeding near a school, you may be subject to civil
liability. Setting up speed traps near schools has been a topic
of heated debate and [t]he new law authorizes Nassau and
Suffolk counties to establish a pilot program with speed
cameras in school speed zones - one per school district - to
record speeding violations as they occur, without requiring
a police officer to be present at the scene. This will enable
speed cameras to be placed in up to 69 school speed zones in
Suffolk County and in up to 56 school speed zones in Nassau
County. Additionally, the new law expands the number of
school speed zones in which New York City is authorized
to use speed cameras by an additional 120, for a total of 140.
It is very difficult to challenge the purpose of this
legislation: prevent speeding and protect children near
schools. Legislative findings and statistical data prove that the
consequences of speeding near schools can be devastating.
Proponents of this legislation offer common-sense data about
the dangers of speeding near a school zone:
Data has shown that if a vehicle traveling at 40 mph strikes
a child, there is a 70% chance that the child will be killed, but
if a vehicle strikes a child at 30 mph, there is an 80% chance
that the child will survive. Implementing speed cameras in
school speed zones will supplement police presence on the
streets in catching speeding violations and preventing the
accidents that arise from speeding. The presence of speed
enforcement cameras will also encourage drivers to proceed
with caution through school speed zones, thus enhancing the
safety of children, pedestrians, and drivers alike.
Although well warranted, some may find it troublesome
that a camera and radar can replace a police officer and result
in millions of dollars of speeding fines with little that can
be done to challenge alleged violations. This Pilot Program
has already resulted in some problems and public scrutiny.
Nassau County Executive Edward Mangano has dismissed
over two-million dollars worth of these tickets. “Mangano
said cameras at five locations malfunctioned, spitting out
tickets on days when school was not in session.” Mayor
DeBlasio came under questioning about this legislation after
refusing to answer questions about some of his own traffic
issues.
The “Photo Speed Violation Monitoring System” will
not be used in a school speed zone unless it is tested on
the day it is used. This system requires a vehicle sensor
producing two or more photographs or a videotape of
the images of each speeding vehicle. Not only does this
system require a daily self-test of its functions but it also
requires an annual calibration check. Operators will have
to undergo training and need to sign a daily “set-up log”
stating the “date and time when, and the location where,
the system was setup that day” and that the system
successfully underwent and passed a self-test.
"The Counties shall retain each such daily log until
the later of the date on which the photo speed violation
monitoring system to which it applies has been
permanently removed from use or the final resolution of
all cases involving notices of liability issued based on
photographs, microphotographs, video or other recorded
images produced by such system." It will be a defense if
the car is stolen and if the owner of the car is a leasing
company and/or agency. Further, the law provides the
purported violator with a defense that the Photo Speed
Violation Monitoring System was malfunctioning at the
time of the alleged violation
The adoption of this program will require that the
County conduct a study and report the results of the use
of this system to the governor. The study will include,
amongst other things, the locations and dates where
the system was used, the number of violations and the

Financial market turbulence renders the formulation of
a lucrative, low-risk retirement investment strategy a
daunting task.
Conventional wisdom dictates that the retirement
contributions of individuals in their 20s be very heavily
invested in stocks relative to bonds. As subsequent
contributions are made as one ages, the stock-bond mix
should be increasingly weighted toward bonds so that upon
retirement, the risk level associated with one’s retirement
accumulation is age-appropriate. This genre of strategy is
implemented by managers of life-cycle retirement funds.
There is a superior strategy—Zig-Zag retirement investing.
Consider an individual beginning her career and saving for
retirement at the age of 25 and retiring at the age of 70.
From ages 25 through 50, the Zig-Zag strategy calls for
all retirement contributions to be invested in shares of an
enhanced stock index fund, with all dividends and capital
gains reinvested.
From age 50 through the retirement age of 70, all new
retirement contributions are invested in shares of an
enhanced bond index fund, with all interest and capital
gains reinvested. The arbitrarily chosen age of 50 is the
“Zig-Zag age” since that is when her retirement investment
strategy goes in a completely different direction. It can be
altered to conform to her risk tolerance.
Upon retirement, the risk level associated with her
retirement accumulation will be lower and its returns
will be higher relative to the outcomes that would have
emanated from a life-cycle retirement fund strategy.
An important feature of the Zig-Zag strategy is that none of
her new retirement contributions will be purchasing shares
of an enhanced stock index fund during the final 20 years of
her working life. By age 70, the value of the shares she had
already purchased combined with all of its reinvestments
will have had a solid chance of realizing the stock market’s
expected stable long-run average annual rate of return.
A phenomenon driving this result is the secular increase
experienced by stock market indices over especially long
periods of time, ever greater portions of which will achieve
greater degrees of permanency as time passes, barring
cataclysmic events such as the 1929 crash.
Had new retirement contributions purchased shares of
an enhanced stock index fund beyond age 50, their value
combined with all its reinvestments will most likely not
appreciate to the same extent, and be more adversely
impacted during subsequent bear markets, compared with
those emanating from shares purchased prior to the age of
50.
These contrasts will be continuously starker when
one makes the same comparisons with those of shares
purchased ever closer to the age of 70 to those purchased
ever closer to the age of 25.
During their respective bear markets, the bond market is far
less adversely impacted than the stock market.
Since individuals aging beyond 50 are ever less able to
recover from significant valuation declines, the bond
market is an increasingly attractive haven for them, making
the Zig-Zag strategy’s timing of enhanced bond index fund
share purchases and reinvestments especially ideal. This
strategy makes no attempt to realize the bond market’s
expected stable long-run average annual rate of return since
it will likely continue to be below that of the stock market.
Relative to the life-cycle retirement fund approach, the
Zig-Zag strategy results in a higher risk level associated
with one’s retirement accumulation the younger one is, and
a lower risk level at the time retirement begins—when it
matters the most.
Let us empirically illustrate the superiority of the Zig-Zag
strategy with a simple, scaled-down scenario. Consider
Thomas and Jane who began saving for retirement on
March 1, 1990, and stopped 24 years later. They each made
$250.00 retirement contributions once every 2 weeks,
and restricted their investments to the College Retirement
Equities Fund’s (CREF’s) Stock and Bond Market variable
annuity accounts, which automatically reinvest their
earnings in their respective accounts.
Thomas employed a life-cycle retirement fund strategy,
and began by investing 80 percent of his contributions
in the Stock account and 20 percent in the Bond Market
account. Each year, the percentage he invested in the Stock
account dropped by 2.6 percentage points, while that of the
Bond Market account rose by this same amount. During
the final year, Thomas’ contribution split was 20 percent
Stock account and 80 percent Bond Market account.
Jane utilized the Zig-Zag retirement investment strategy
and invested all of her contributions in the Stock account
until March 1, 2002, at which point all new contributions
up through February 27, 2014 were invested in the Bond
Market account.
In the end, Thomas’ retirement accumulation was
$405,197.00 while Jane’s was $419,484.00. Not only did
Jane realize greater returns, but given the timing of her
investments in the Stock and Bond Market accounts along
with their respective reinvestments, the risk level associated
with her retirement accumulation is lower as well.
These risk and return disparities will be ever starker the
greater are the retirement contributions, and the longer the
time periods over which they take place, both above and
below the Zig-Zag age.
Despite the promise of the Zig-Zag retirement investment
strategy, it is crucial to consult your licensed financial
adviser to assess its appropriateness within the context of
your personal financial situation.
Perhaps, you just might conclude that the life-cycle
retirement fund strategy should be dethroned.

Business owners have a hard time trying to decide
among the many options available to them when it
comes to retirement plans. There are a multitude of
choices, and nothing seems clear. Which plan type
offers the best benefits for you and your employees?
Does one have greater tax benefits than another?
To add to this financial confusion, a new plan has
emerged, the Cash Balance plan. Even with all the
choices business owners have, Cash Balance plans are
gaining quickly in popularity.
The pension arena is typically split into two
categories: defined contribution plans and defined
benefit plans.
Defined contribution plans do
exactly what the name says; they explicitly define
the contributions to be made each year the plan is
operating. The actual amount of an employee’s
retirement benefits depends on the specified amount
of the contributions as well as the investment gains
or losses of the account. Defined benefit plans, on the
other hand, are designed to provide a specific benefit
amount at retirement. This is a fairly traditional
pension plan where the employer bears the risk of
providing the promised level of retirement benefits to
employees.
One of the reasons for the Cash Balance plan’s
growing popularity is its unique blend of the best parts
of these two plan types. It is designed like a defined
benefit plan for the employer, but has the ease of use
of a defined contribution plan for its participants. The
employer defines and guarantees the interest credits
in the plan, just like a in a regular defined benefit
plan. However, it acts like a defined contribution
plan because the plan participants receive account
statements with “pay” credits and “interest” credits.
Balances are theoretical, so they do not need to equal
the plan assets. When employees retire, they may take
their benefits as a lump sum, or as annual distributions
While the Cash Balance Plan’s distinct design
makes this plan attractive to employers, perhaps the
most appealing aspect of this plan is its flexibility.
These plans have a contribution limit almost four
times as high as a traditional 401(K) plan. These
high contribution limits allow plan sponsors to play
catch-up, especially if they started saving later in
life. Contributing high amounts to these plans can
also come with many added tax benefits. If you’re a
business owner looking to save more than $52,000 a
year for retirement, adding a cash balance plan to your
retirement program could significantly increase your
tax deferred benefits and possibly take an immediate
tax deduction as well.
As we approach the end of the plan year for most
plans, now is a good time for business owners and
plan sponsors to give their plans a quick once over
to see if everything is properly in place. It’s a good
practice to review your plan every year to make sure
it’s compliant. Now is the time to review your plan
and make any necessary changes for January 1.
Owning a business is tough for many reasons, but
having difficulty saving for your and your employees’
retirement shouldn’t be one of them. Considering a
cash balance plan addition to your current plan can
allow you save comfortably and easily for the future.

Yaphank
Historical Society
celebrated
their
40 th
anniversary
last
Saturday,
August 23, 2014,
by
opening
the
SwezeyAvey House in
Yaphank’s Historic
District. Legislator John M. Kennedy
attended this celebration to present
a proclamation to honor the group
on this occasion. As part of this
celebration, the Swezey-Avey House,
which was the original meeting place
of the Yaphank Historical Society 40
years ago, was opened to the public
and would now serve as the Yaphank
Historical Society’s new headquarters.

guests of Welcome INN.
On September 7, 2014, the Nesconset
Chamber of Commerce hosted their
Annual Nesconset Day Street Fair,
which featured Legislator John M.
Kennedy’s 2014 “Out for Blood”
Blood Drive Tour, making its annual
stop from 11:00am to 5:00pm on
Smithtown Boulevard. To date,
Legislator Kennedy has taken his
annual blood drive tour to Smithtown,
Centereach, Commack, Hauppauge,
Lake Grove, Ronkonkoma and now
Nesconset, with blood drives yet to
be held at the Smithtown Historical
Society, Saint James Day Festival, and
the last one at our office.
