It is the first day of Spring as I write my article, however, it is 30-some degrees outside with a chance of snow! You will find a great deal of information in this edition of our newsletter – the upcoming Employability Expo that we participate in each year, key legislation that may affect your business, looking for volunteers to speak to the students at Strayer, participation in the Diversity survey, etc. Because of all the things I just mentioned, SEPA SHRM has been awarded the 2015 Gold EXCEL Award in recognition of our SHAPE (SHRM Affiliate Program for Excellence) submission. The award recognizes the achievements of our chapter operations and the commitment to providing meaningful programs and services to our members. This award also distinguishes our chapter as an outstanding organization dedicated to serving the needs of our members and to the advancement of the HR profession. We are always looking for chapter members to get involved in the chapter and one way is through the committees we have. We also have a few Board positions that are open. Contact Lisa Fugelo for details. 2 P a g e Legislative Affairs Report By Roz Schaffer, SHRM-SCP, SPHR V.P./Director Legislative Affairs March 2016 Legislative Update Pennsylvania Legislation The General Assembly has been quiet, with only three employment related bills introduced as of the date writing. HB 1857 would amend the Unemployment Insurance law by extending temporary benefits to those who are out of work due to a lockout, and 1141 amends the Workers’ Compensation Act providing a schedule of compensation and amending definitions. The third, HB 1881, requires employers in the construction industry to verify the Social Security numbers of employees. Department of Labor FLSA Section 541 Exemptions On March 14, 2016, the Wage and Hour Division of the Department of Labor (DOL) sent the final regulations to the Office of Management and Budget (OMB) for fiscal review. This is the last step before publishing them in the Federal Register. Once published, it is expected that they will take effect in 60 days. Ironically, on March 14, I attended a session presented by Tammy McCutchen at the SHRM Employment Law and Legislative Conference. Ms. McCutchen is Principle at Littler in Washington, DC and is the former Administrator of the Wage and Hour Division who was responsible for the current regulations issued in 2004. Key provisions of the proposed regulations that were released for public comment on June 30, 2015 include: Salary Threshold Increase—The DOL proposed increasing the salary threshold for overtime pay from $23,660 per year to $50,440, a 113% increase and pegs the salary level to the 40th percentile of earnings for all full-time salaried workers. Traditionally the threshold was pegged at the 10-20 percentile of earnings. Annual Automatic Updates—The DOL proposed increasing the minimum salary threshold on an annual basis by pegging it to changes in the 40th percentile or by indexing it to inflation using the Consumer Price Index. This threshold is nearly $10,000 higher than that of California and nearly $15,000 higher than that of New York which are two of the country’s most expensive states and does not consider regional differences in salaries. Bonuses—The DOL sought public comment on whether to include discretionary bonuses paid monthly or more frequently in up to 10% of the salary basis. However, most bonuses paid to exempt employees are paid on a quarterly or annual basis. Duties Test—The DOL did not propose specific changes to the duties test but indicated that it was considering changes and requested input. In response to those who said that the DOL is required to issue specific changes so that the public could react, the DOL responded in an email that the proposed rules detailed the issues and invited discussion. Furthermore, the DOL cited the Administrative Procedures Act that does not require agencies to include proposed regulatory text and permits a discussion of issues instead. The current definition of “primary duty” is the principle, major, main or most important duty that the employee performs. The DOL asked for consideration of requiring employees to spend a percentage of their time performing work that is their primary duty. They also asked for comments regarding whether adoption of the California rule that requires 50% of time spent exclusively on work that is the employee’s primary duty. 3 Concurrent Duties—The current regulations state that non-exempt work “does not disqualify” an employee from the executive exemption when the employee decides when to perform such nonexempt work and remains responsible for success/failure of the business. The proposed regulations suggested whether to eliminate the permissibility of concurrent duties entirely, modify the rule to “avoid sweeping non-exempt employees into the exemption”, or to limit the amount of non-exempt work that an exempt employee can perform. Return to the Short and Long Duties Tests—The current regulations eliminated the dual test structure and adopted a single test. The DOL suggested a return to the long duties test with additional duties required for a lower salary level. The DOL received more than 293,000 comments in response to the proposed regulations. On March 16, hundreds of conference attendees met with their elected officials on Capitol Hill to discuss the impact of the regulations and urge them to support legislation introduced, the Protecting Workplace Advancement and Opportunity Act (S. 2707 and H.R. 4773). The legislation would nullify the regulation, prohibit automatic annual increases to the salary threshold, require the DOL to conduct a comprehensive economic analysis on the impact of to small businesses, non-profit organizations and public employers and require that any proposed changes to the duties test be subject to public comment. SHRM urges members to contact their elected officials and has through the Policy Action Center. __________________________________________________ SHRM’s Employment Law and Legislative Conference (March 13-16, 2016) Once again, I had the opportunity to attend this excellent conference. Mike Aitken, VP, Government Affairs at SHRM kicked off the conference by discussing the Washington Outlook for HR Public Policy. He reviewed the legislation outlined in SHRM’s 2016 Guide to Public Policy Issues. Please note that Mike will be the Keynote speaker at the HR and Legal Summit on September 11. Other Keynote speakers included Charlie Cook, Editor, Publisher and Columnist who gave an entertaining and well informed presentation about the current political and legislative environment and election forecasting in a balanced, non-partisan way. On Tuesday, March 15 we began with a conversation with The Honorable Eric Holder, Jr., 82nd Attorney General of the United States and Partner at Covington & Burling, LLP. During this session he shared an insider’s perspective on the stories that made headlines and addressed real-world consequences that followed high-level decision making. Later that day, we heard from Jim Clifton, CEO of Gallup. Mr. Clifton discussed how Gallup has used the same techniques it uses to understand employee engagement to gain insight into how the will of the world has changed and implications for changes needed in the workplace. We also heard from the Chair of the EEOC, Jenny Yang who discussed the priorities of the EEOC for 2016 and beyond. Later that day, Doris Kearns Goodwin closed out the conference with a riveting discussion of how the nature of the campaign process has changed, sharing rich stories to illustrate her points. There were a wide variety of informative sessions. I attended a lively session on Scandals & Screw-ups: Learning HR Best Practices from Today’s Headlines presented by Gregory Hare, an employment attorney with Ogletree Deakins. He covered the role of HR in training managers to model the mission, handling a crisis and develop a plan forward by owning up to actions citing real life examples from the headlines. I also attended a timely session on Social Media: Protecting Vital Employer Information vs. Protecting Employee Privacy that was presented by Douglas Towns, partner at Sherman & Howard. He provided an analysis of key legal, IT and HR issues related to workers’ privacy and oganizations’ information security. We covered issues such as restricting, monitoring and scrutinizing employees, applicants and litigants outside and inside the workplace, byod, social media practices, state limitations as well as overall best practices. John Doran, attorney with Sherman and Howard presented Barbarians at the Gate: Why You Need to Plan an Organizing Campaign and How to Build Your Battle Plan. In this session, he stressed the impact of the “quickie election” rules and the importance of having a plan in place and managers trained before there is a campaign. Joe Beachboard, shareholder at Ogletree Deakins closed out my concurrent sessions with a review of the high court in The Supreme Court Speaks…Are You Listening? He presented an analysis of various decisions in light of the death of Justice Scalia and discussed the impact of recent decisions and practical applications for the workplace. WORKFORCE READINESS By Denise Lantz, SHRM-SCP, SPHR, CHC VP/Director Workforce Readiness SEPA SHRM In Action: Career Guidance for Disabled Students Because a shocking 70% of people living with disability who want to work can't find it, SEPA SHRM has long been committed to supporting efforts that support Workforce Readiness for the disabled in our community. One key initiative for our Chapter in this area has been the annual EmployAbility Expo at the Bucks County Intermediate Unit #22 in Doylestown. On Wednesday, May 4th, SEPA SHRM will once again to provide volunteers to conduct mock interviews at the EmployAbility Expo. This event draws approximately 100 disabled high school students throughout the Bucks County School District and prepares them for entry into the workforce. The mini-interview process is the highlight of the event, and often the first opportunity the students have to apply what they’ve learned to a real-world setting. The school district relies heavily on our Chapter to provide a meaningful experience for their students by providing access to experienced HR professionals in various industries of interest to the students. VOLUNTEERS NEEDED! Make an important impact in the life of a child by providing students with a 15-minute mock interview, and feedback on how to present themselves for job opportunities in the community when they graduate. There is NO commitment or expectation to hire a student. Your only commitment is of your time on the morning of the Expo from 8:30 am - 11:30 am. An orientation session is provided. The Diversity Task force has worked on a variety of edits to our group’s mission as well as asked for your feedback on our current Diversity survey which is was sent out in March. Tabulated results of what the members would like to see in the future will be shared as appropriate to our membership. We are supporting Linda Horton, one of our task force members, who is leading the event Youth and Young Adult Job Fair on April 6, 2016 which will be hosted at Bucks County Community College form 10 am to 2 pm. Where HR departments are asked to do more with less, consider a few of the technology trends within the recruiting process, as featured in an April 2015 SHRM.org article. Employers are using video vignettes to introduce candidates to their employment brand with internal top talent confirming what they love about their job, the company and the overall employee experience. Next on the talent acquisition must have list: an integrated candidate experience. Job seekers are increasingly using mobile devices, in addition to computers, to access & complete the application process. At the interview stage, to speed up scheduling and reduce travel expenses, employers are implementing (mobile or computer based) video interviewing. The ability to connect a candidate to a one-stop career experience, from application to onboarding, offers a great first impression. Having recently completed a job transition, my direct experience included use of several devices (email, phone/ smartphone, laptop) to complete my application, background check and onboarding paperwork. While my employer chose to interview the old fashioned way (on-site face to face interviews) the rest of my recruitment experience was online & streamlined. In December, SHRM’s Vice President, Brian Dickson presented “The Future of HR is Here”, an exciting update to some of our area Chapter Leaders and Villanova University Faculty. One important take-back about which we’ve been waiting to hear is that the national pass rates are within industry norms: 69% for the SHRM-CP and 53% for the SHRM-SCP. (Looks like the Villanova University – and SEPA SHRM’s pass rates - will be even better, just as they have been in the past). Brian Dickson also reported that there has been steady progress in the number of HR job postings that cite SHRM-CP and/or SHRM-SCP as a preferred or required qualification.
