Oh The Things They didn't
Teach Us In Law School
The old adage, "It's not what
you know, but who you know"
does not hold true in the modern
practice of law. As classic overachievers, many of us began to
compete in elementary school,
continued to work hard to obtain
the best grades and then to
achieve the highest score on our
college SATs. Once in college, we realized that the
competition intensified, culminating in a big push on
the LSATs. Having made the grade, we looked around
on the first day of law school, and realized that being
an overachiever in a classroom of overachievers is not
enough, and made even greater strides to excel. Finally
upon graduation, we all put in a Herculean effort to sit
for the Maryland Bar examination only once.
The problem is that after being sworn in as attorneys, we all have the harsh realization that law school
really did not prepare us for the practice of law. In reality, law school can do little more than teach Socratic
reasoning and problem solving, encourage the development of research and writing skills, and provide a
rudimentary understanding of the rules of procedure.
This became apparent to me in 1977, the summer

Circuit
Renovations: The Terrace Level corridor connecting the Circuit Court to the
EOB will remain closed through
November 14, 2014. The closure is
required to construct a new entrance from
the EOB plaza into the Circuit Court.
During this time all access between the
Circuit Court and the EOB will be
through the EOB Lobby located on the
Monroe Street side of the Circuit Court.

after my first year of law school, when I
went door-to-door in Rockville looking for
a summer internship. I knocked on the
door of Barney Welsh, a senior lawyer and
a part-time law professor who had the reputation, unbeknownst to me, of being quite
a character. I had no idea what I was in for!
He asked me in a scolding tone "What do
you know and what can you possibly offer
a law firm? You will not have any idea
what this is all about until you have practiced law for ten years.” I stood my
ground, and told him I was willing to learn
and would be a hard worker. Needless to
say, I walked out mad as a hornet, and
without a job. What really angered me was
that over the next five to ten years, I realized that he was right. I needed to learn so
much more than was offered in law school.
At our March Bar luncheon, we were
pleased to have University of Maryland
Law School Dean Haddon speak to us
about the need for experienced attorneys
to serve a mentors to graduating law students. Chief Administrative Judge John
Debelius asked the question that was on

most members minds, “Why doesn't law
school curriculum include pragmatic education as to the basics, such as setting up
IOLTA accounts, and running a law
office?” Clearly, law schools recognize
the need to address these issues but with
limited time and resources the law schools
have been unable to do so.
As a bar association, we can help by
providing gap-bridging programs and
practical supplemental education for
recent graduates on these subjects as well
as the need to belong to our association
and become part of the legal community.
It was clear from the Dean's presentation
that if we don't step up and assist, this
vital need goes unanswered.
John Monahan has begun formulating
our contribution of CLE programs for this
purpose. These presentations have been
well received by recent admittees who now
desperately recognize this need. For those
of you who have the ability of paying it forward by mentoring recent graduates and
assisting in this program, you can help ease
the culture shock we all have experienced.
Merely knowing the players is a help, but
WHAT YOU KNOW by way of introduction to the real practice of law is critical.
The BAMC Mentor/Mentee program
is in full swing, so if you are interested in
becoming a Mentor or are looking for a
mentor, please contact Eby Kalantar at

who is associated with the Montgomery
County Chapter of the Sierra Club, and
our newest member. Concerning this
book, Barbara Kingsolver wrote: “Read
it, please. Straight through to the end.
Whatever else you were planning to do
next, nothing could be more important.”

1. Are you running your practice or is it running you?

(Contraband Policy)
• Ask all persons, prior to passing through the metal detector, to place in the supplied containers all loose items such as, not not limited to: cigarettes, keys, lighters,
change, knives, pagers, cellular phones, credit cards, and all other metal objects.
• Inspect all bags, briefcases, handbags, packages, etc. The baliff shall use a
ruler or paint paddle to help facilitate this inspection.
• Not allow into the courthouse, except when prior approval has been granted
by the administrative judge, administrative clerk, or supervising baliff, for evidentiary or facility maintenance purposes, the following:
• Knives of any size.
• Stun guns, slapjacks, nightsticks, brass knuckles, nunchaku, illegal knives, and
any other dangerous or deadly weapon, possession of which constitutes a violation of Maryland Law. Such items shall be confiscated as potential evidence.
• Scissors
• Metal nail files

Montgomery County Bar Association
Mentor-Mentee Program, experienced
attorney-mentors are paired with newpractitioner-mentees. The mentors share
their experiences and wisdom with their
mentees. Both mentors and mentees
build relationships with each other,
involve themselves in the Montgomery
County Bar Association, and network
with other mentors and mentees. With
their involvement, each can learn from
one another.

Richmond decision update: The Court
of Appeals ordered the implementation of
the Richmond Decision effective July 1,
2014. (Rule 4-213, et seq). In furtherance
of the implementation, the Court of
Appeals has created a District Court of
Maryland Appointed Attorneys Program
for the purpose of providing attorney representation to indigent criminal defendants
during initial appearances. The program
provides compensation to attorneys who
contribute their time and legal expertise.

E-filing Update: The Maryland
Electronic Courts Program is starting
training for Anne Arundel County Bar
Association Members in August. The
training will be open to other attorneys
shortly and there will also be webinars

in the fall in Anne Arundel County.

Because these new citations charge a
civil offense, the burden of proof will be
preponderance of the evidence, but
District Court will schedule the cases on
criminal dockets in the same manner as
drug cases are now.
The State’s Attorney’s Office is
already modifying its approach on first
offense possession of less than ten grams
cases under current law. Assistant State’s
Attorneys can now resolve such cases by
authorizing defendants to make a voluntary contribution of $100.00 at the time of
trial. A court appearance is still mandatory
on existing marijuana charges of any kind.

the supervising bailiff to determine if

special considerations in valuing professional practices, such as Law Offices and

Evidence and trial practice for the fam-

will review the proper methods of introducing evidence relevant to a family law
case. Focus will be on methods and
objections to authenticating evidence,
including lay testimony, expert testimony,
expert reports, social media, and prior
statements of children. This practical
seminar will also review effective cross
examination techniques and arguments
before the court. Tips on presenting your
case and “views from the bench” will be
provided along with helpful written material.

functions to avoid improper communication with personnel.
One caveat seen throughout both
Phase One and Phase Two of AJAC is
that a “new issue” or alternative legal
argument raised by a taxpayer is not the
same as new information or facts.
Nonetheless, the Phase Two guidance
instructs Appeals to provide the originating unit of the IRS with an opportunity to
examine any new issues. Appeals may
generally not raise new issues on its own
or re-open issues already agreed upon at
the Examination level. Although perhaps
the most ambiguous aspect of AJAC,
Appeals’ consideration of new issues and
alternative theories is constrained by the
express prohibition under the Phase One
guidance that Appeals may not develop
new facts to support any novel theory.
Thus, the potential for abuse by either
taxpayers or the IRS appears limited.

Montgomery County Bar Foundation Pro
Bono Program seeks volunteers –
whether experienced or newly barred
attorneys – to join our panel. There are
many county residents that are in great
need of pro bono services. Your call to
volunteer will make a difference to those
without resources.
The Pro Bono Program provides two
ways for county residents to receive
FREE LEGAL SERVICES in civil
cases – at a legal advice clinic or through
the client intake line for referral to an
attorney volunteer for direct representation. The legal advice clinics operate in
four locations across the county (SEE
BOX BELOW) and provide residents the
opportunity to walk-in and meet with an
attorney volunteer without scheduling an
appointment. Eligible clients present
their legal problems to an attorney and
receive free immediate legal advice
and/or referral to a non-profit or government social service agency that may be
helpful. The client intake line operates
out of the main office where the staff
screens calls from potential clients. The
Pro Bono Program staff conducts all
screenings over the phone only. Cases
referred to attorney volunteers include
family law, debt collection, bankruptcy,
limited employment, limited immigration, wills and power of attorney.
The Pro Bono Program currently is
participating in three projects. First, we
participate in the Judicare Project.
Contested custody and complex family
law cases are referred at a reduced fee to
experienced family law attorneys.
PRO BONO UPdATE
Attorneys can seek reimbursement of $80
per hour with a cap of 20 hours per case.
The Pro Bono Program requires that the
attorney must accept a pro bono case for
each case accepted under the Judicare
Project. Second, we have a working
agreement with the Collaboration
Project of Maryland for family law case
referrals that include modifications.
Third, we refer eligible clients with debt
buyer cases to attorney volunteers for
direct
representation
under
the
Consumer Protection Project.
The Pro Bono Program provides
FREE LEGAL TRAINING to attorney
volunteers. The Rita Rosenkrantz
Family Law Training is available via
webcast to attorneys for free in
exchange for agreeing to accept a family law case. You can sign-up to begin
the training at your convenience over
the next 30 days. The most recent training was taped during the recent live
class presentation held the 1st week of
May 2014. Maryland barred attorneys
in good standing can watch a preview of
the training and then determine if they
would like to proceed with the entire

almost always have clients
waiting during lunch hours,
and could use your assistance.
2. Scheduled Volunteering: If you have more
time to spare or prefer a more
structured
arrangement,
