Terms of use for the card Terms of use for the card Dear guests, Welcome to the home of the Brothers Grimm. With the advantages as part of the MeineCardPlus, we would like to make your stay a special experience, together with the participating accommodation facilities, private guesthouses, service partners and the towns and regions in ‘GrimmHeimat Nordhessen’. To that end there are also clear agreements regarding shared rights and responsibilities which we would like to comply with, together with you, in the form of the following terms of use. You can find a detailed view of the terms of use online at www.MeineCardPlus.de/Nutzungsbedingungen. 1. Principle and subject of these terms of use 1.1. The issuer of the card and the partner of the card usage contract with the card holder is Regionalmanagement Nordhessen GmbH, Ständeplatz 13, 34117 Kassel, henceforth abbreviated to ‘RMN’. These terms of use govern the terms for using the card itself, as well as the contract and service relationship with the service partner, insofar as in addition to the agreements to be met by the card holder where appropriate. 2. Legal basis, information and assurances by third parties 2.1. The corresponding provisions of these terms of use and, where effectively agreed or generally applicable according to legal provisions, the terms of business and/or terms of service or carriage of the service partner, as well as the legal provisions applicable to the service relationship, shall apply for the contractual and service relationship between the card holder and the service partner. 2.2. The hosts and other outlets of the card are not authorised by RMN to meet agreements deviating from these terms of use, nor to give information or make assurances that deviate from the applicable service specification of the card, nor to contradict or go beyond the same. The same applies to service partners, unless the information, deviating agreement or assurance relates to their own service. 2.3. The issuance and use of the card incurs no contractual obligation regarding the services themselves between the card holder and the hosts or RMN and/or the outlets. The respective service partner, and not RMN or the host or outlet, is exclusively obligated to render the corresponding service for the card holder, unless the service concerned relates to their own offers. 3. The type and scope of services, restrictions of services, exclusion from use and the period of validity of the card 3.1. By issuing the card, the host or RMN enables the card holder to use the services listed in the correspondingly applicable service specification of the card. The type and scope of the services for the card holder are determined exclusively by the service specification applicable at the time the card is issued, which is provided to the card holder together with the card or otherwise generally advertised or disclosed. 3.2. The service partners are only obligated to render the service in accordance with the general terms of their business, in particular under consideration of the advertised services periods, opening times and general service requirements (e.g. requirements based on the weather conditions). 3.3. Insofar as the advantages of the MeineCardPlus are also described in other promotional material (accommodation directories, prospectuses, catalogues, websites etc.) outside of the applicable service specification for the basic version of the card, only the service description in the applicable service specification shall apply to the card holder for using these services. This particularly applies in the event the description provided in the service specification for the card deviates from other such service descriptions. 3.4. The service partners may wholly or partly, and in particular temporally, restrict the advertised services, 66 providing there are objective grounds for doing so. This includes in particular obstructions to service resulting from weather conditions, official restrictions or orders, maintenance work and repairs, traffic safety measures, excessive use or the overcrowding of facilities and other similar, objective reasons. 3.5. RMN as the issuer and the service companies may exclude card holders and other authorised users from using the card, partly or completely, temporarily or permanently, if they do not comply with particular personal requirements (e.g. health requirements or clothing/equipment requirements), or if the specific case of use is expected to cause danger to the card holder, third parties or the facilities of the service company. The same applies if the card issuer violates legal provisions, safety requirements, usage conditions or instructions by supervisors or if the card issuer otherwise behaves in a manner contrary to the agreement regarding the use of the service, such that their exclusion is objectively justified. 3.6. The advantages of the card may only be used during the card holder’s stay at a participating host in the region covered by the card. There is no entitlement to transfer the card and/or its advantages to future stays or other persons. the incident to the host or the outlet, whereby the card holder has no entitlement to the gratuitous issuance of a new card. 4.4. The card holder is liable to RMN or the host and/or other outlets and service companies for damages he, she or a third party culpably cause or help cause by misusing the card. 4.5. In the event of misuse or suspicion of misuse, the service company is permitted to withhold the basic version of the card without substitution, and in accordance with the legal provisions in the case of purchasable tickets. 4.6. The card does not include any insurance benefits. It shall be for the card holder to check and ensure his or her insurance coverage, particularly for accidents relating to use of the card advantages, for covering repatriation costs in the event of an accident or illness. 4.7. It shall be for the card holder him or herself to assess and effect his or her own suitability and qualifications, particularly regarding health and official provisions, which form a prerequisite for using the card advantages. Version: February 2015 4. Use of the card, obligations and the liability of the card holder 4.1. To utilise the services, the card holder is obligated to present the original version of the card and allow the service company to electronically or visually inspect the card before utilising the service. 4.2. The card holder is obligated to provide a valid photo ID upon request. If the card holder is not able to do so, the service company may refuse to render the service. In the case of agerelated services and advantages for the card holder or his or her authorised dependents, the service company may request a corresponding proof of age. 4.3. In the event the card is stolen, lost or becomes faulty, the card holder is obligated to promptly report 67 How to participate: Treasure hunt in the home region of the Brothers Grimm 1.
