It is located on Rt. 309 West . . . it is about three miles west of Marion. Region 5: Dan Cisco tells me that Haskel combs started putting the sign up years ago. We get permission from the Clinton County Commissioners to put it up on the Courthouse lawn every May for Motorcycle Awareness Month. April 29th 2012. June 2012 OutSpokin’ 4 The State Awareness Rally 2012 was a huge success, even though I was informed Wednesday May 2nd @ 3pm, by Lt. Carl Barth of the Columbus Police Special Events Division, that in a meeting that morning with the U.S. Secret Service, they demanded full commitment of resources from The Columbus Police Department, The Franklin County Sheriff’s Office and the entire Central District of the Ohio Highway Patrol, to serve in the escort for President Barack Obama’s visit to the Schotenstein Center, May 5, 2012 on the Main Campus of The Ohio State University, Columbus Ohio, to kick-off his Reelection Campaign. I immediately called Lt. Shelly Pfan, Special Duty Coordinator for the Delaware County Sheriff’s Office and told her of our predicament, and she said she would devise a plan to escort the Parade all the way to the Statehouse and that is just what she did, only problem, when she submitted the plan to Acting Sheriff Scott Vance, he would not allow his Deputies to cross Jurisdiction Lines. Lt. Phan called me with the bad news and said she would spread the word about our predicament to her fellow Deputies and see what could be done, AND!!! If you were there you saw 5 Cruisers and 1 Motor Deputy to shut down I-71, just like the Columbus Police Motor Unit has done for us in the past and Delaware County Motor Deputy Evans, led the Parade out of the A.D. Farrow NorthStar Dealership parking lot onto I-71 South and led us all the way to the Delaware County Line at Gemini Parkway on I-71, where he peeled off and our most professional Road Captains took over. From this point all the way to the Statehouse the Parade moved smoothly and safely just as if we did have our Columbus Police Escort. I want to thank all of The Delaware County Sheriff’s Office and all who rode in the Awareness Parade and a special Heart Felt Thanks to our Great Road Captains. Legislative News is all good, Scott “Woody” Wood, has some very good news for us, and I want to congratulate him on a Job Well Done, be on the Lookout for a “Call to Action” Soon. A great day and against what seem to be a tradition, no rain. Next year our police escort will be back and that should straighten out some of the chaos on the parade. Not an election year, no surprise visits. Due to the amount of experience in this group, no major issues were reported. We not only let the people of Columbus, some of who didn’t seem very happy, and the great state of Ohio know that we are on the road and to “LOOK TWICE.” But we let the powers that be known that there is still work we expect to get done before the year is up. Our handle bar height bill has good momentum and will hopefully be out of the House and on it way to the Senate by the time you read this. Be ready to start contacting your legislators for passage of this bill. This month is going to be short and sweet. I have the usual updates to the Bylaws. I have also been working with Seneca County for Veterans on the “Traveling Wall” escort. It has been a great experience. It has been great to see the motorcyclists band together to pay tribute to America’s veterans. The ones who protected and still protect our right we hold so dear. It doesn’t matter what you ride or how you ride, only that you ride. And that’s the way it should be. The flyer on this event is in this month’s OutSpokin’. I wanted to leave room for the list of the clubs in Tiffin where you can park and take a free shuttle to the Memorial Walls. The Vietnam Wall, 9/11 Tribute, Iraqi Freedom and Enduring freedom will be on display. We are expecting over 10,000 on the escort. Come and share the honor of escorting these great tributes. I look forward to seeing everyone at the June Jam. Ed Schetter And then there’s the Bylaws. The Bylaw review committee has been busy. Both the Constitution and Bylaws have been reviewed. The Policy and Procedure manual is next. This will move faster only one reading is needed instead of three. If you have any input please send it to me. Here is the hard work of the Bylaw Review Committee for your review: Many changes in the Organizational Manual were nothing more than correcting spelling and grammatical errors. The Bylaw review committee determined that these were a matter of housekeeping and motions are only proposed for changes that alter the intent, meaning or procedures outlined in this document. OUR HANDLEBAR BILL (H.B. 316) UNANIMOUSLY PASSED THROUGH COMMITTEE ON MAY 9, 2012. The amendment changing it from the original bill which included a roadside test requiring a 45 degree turn of the handlebars to its amended form which increases the maximum handlebar height to be shoulder high. This vote passed it out of committee to the floor of the general assembly. We need everyone to contact your House of Representative delegate and let them know that you support this bill and ask them to support this bill as well. Let’s get this thing pushed through before we run out of time and have to start again next year. The House’s summer break is coming up, which means we’re running out of time before elections consume the time of our legislators. Call or email your Representative as soon as possible. Also it’s not too early to thank Rep. Cliff Rosenberger and Rep. Al Landis for sponsoring this bill. Please email me with the location of any traffic signal that does not activate with a motorcycle triggering it. According to ODOT, there were only 5 traffic signals reported last year. I am still hearing complaints that this is a major problem. I have contact info and will follow up to make sure the signals are adjusted or replaced. June 2012 OutSpokin’ 7 Hi Friends, Starting with this article and for the rest of the year, I will be giving you the statistics for fatalities year to date compared to last year. In 2012, January 1 to May 11, we have had 667 crashes, 573 injured, and 23 DEATHS, in 2011, January 1 to May 11, there were 552 crashes, 428 injured, and 20 DEATHS. This is 3 more than last year. We need to make it much lower. These statistics are for Ohio and are correct to the best of my fact finding. Starting soon I will be posting county stats on the web site. As good freedom fighters that we are, let’s inform everyone that we need to be AWARE not only as motorists but bikers as well. This is the time to let the motorists know we are everywhere, and check out your fellow biker. If you see someone not doing it safely, talk to them, maybe they don’t know they are not using their turn signal properly. To everyone that made the trip to Columbus for the Awareness Ride, I would like to thank every one of you. It was a great day - no rain and the sun did come out. Losing our Columbus police and state highway patrol escorts made the day a little trying, but with Jim Elgin’s hard work and Delaware Sheriffs great help and giving us extra help, it all worked out. And with our fellow motorcyclists riding as safely as they did, it was a great day. Now for some thank yous. I would like to thank Bob Secrest from the Motorcycle Ohio Program for coming out and saying a few words and the T-shirts that he threw out [Harley throws like a girl]. He is always there for us. I also want to thank Sam McCoy and the Brothers Forgiven for coming out and giving our prayer and blessing the bikes for our safe ride. Finally, a great big thanks to everyone that pitches in every year and makes it a great run. You know who you are, THANK YOU!!! In every article I bring up the yard signs. Every year I bring up yard signs on the State House steps. The first year about a handful of people said they have signs, the next year two handfuls, this year I was impressed, a lot of hands came up. Now let’s start on your neighbors. Push those signs. THANK YOU!!! We have a lot of volunteers going into drivers ed schools and talking about Motorcycle Awareness. That is our first line to get to kids and make them aware. But if I told you that the state wants to give drivers training on the internet, what would you think? We will lose our chance to have a face to face about Motorcycle Awareness. At this time it is in committee and it is HB487. When you talk to your state representative let them know that new drivers can get very little practical knowledge from a computer. Let us talk to them. In Northwestern Ohio we have a friend in the Charles Boyk Law Firm. They have been helping with hand-outs and advertising in spreading the word about Motorcycle Awareness and safe motorcycling. They have a Motorcycle accident handbook that can be very helpful. We will be seeing them around at our events. I had a great time at Region 9. It was a sunny day and nice number of members came out to the meeting. We talked about safety and education and covered the 3R’s program. I was going to show the power point program but it was too sunny out and no one wanted to go inside, so I will go back again. Thanks again for having me. Something that I have been over hearing when I’m not on the bike, but at work and around, is about our image out on the road. We already know that we are bunch of bad asses, so let’s not portray ourselves as such when we are around non-bikers. In town let’s think before we act regarding noise, speed and behavior. Have fun but think about our image. At the BOD meeting, the subject of pictures came up. It got me to thinking. So I went to the ABATE web site and took a look at the pics posted on there. TJ has done a great job. Send him more and thank him for the great job the next time you see him. For some reason I just never looked our pics. I even found myself in there. They recently named the Conferees that will negotiate the differences between the House and the Senate. This is a crucial juncture for the legislation that would end the motorcycle-only roadside checkpoints. The language is in the HR 7, (the House bill) but not in the US House passed bill, HR 4348 and not in the Senate bill, S 1813. Its our goal to have the conference adopt the language into the final report. The conference is sure to be lengthy as the two bills are wildly different. The House bill, H.R. 4348, is a short-term extension of federal highway funds that includes a requirement to approve the Keystone oil pipeline. The Senate bill, S. 1813, is a two-year, $109 billion extension. Here is where you come in. Below is the list of every member of the Highway bill conference committee. If one or more of them are your elected officials. call them ask them to support the inclusion of the language that would prohibit federal funding of motorcycleonly roadside checkpoints. Call immediately. This will also be the key issue we lobby for next week at Bikers Inside the Beltway. This year's event drew hundreds of motorcyclists from 17 States and met with almost 250 elected officials. One of the top issues the attendees were lobbying for was asking their members of Congress to work the HR 904 language into the now conferenced highway legislations. HR 904 is the bill to prohibit federal funding of motorcycle-only roadside checkpoints. During the Congressional Panel portion of the day, the group of riders gathered in a Ways and Means Committee room to hear from a select group of Members of Congress. Addressing the group was Congressmen Burgess, the Motorcycle Safety Caucus co-chair, along with his colleagues in the House of Representatives: Alan West-FL, Scott Rigell-VA, Jon Runyan-NJ, Bob DoldIL, Todd Young-IN, Richard Hanna-NY, Erik Paulsen-MN, and Adam Kinsinger-IL. The MRF thanks all of the Members of Congress who attended the event. Coinciding with Bikers Inside the Beltway week, Congressman Jim Sensenbrenner ran an op-ed in the daily paper, "Roll Call" urging conferees on the highway bill to include language from HR 904. Sensenbrenner said "May is Motorcycle Safety Awareness Month and we welcome motorcyclists from across the country to Washington for 'Bikers Inside the Beltway' week. During this week, Congress should be reminded that effective motorcycle safety can help keep all of us safer on the road, but efforts to expand a government program that arbitrarily roadblocks law-abiding motorcyclists are a misguided, ineffective use of taxpayer funds." This bill creates a motorcycle road guard certificate under which a person can stop and hold traffic during a motorcycle group ride. 1) Obedience to traffic-control signal or flagger; presumptions. Permits holders of a motorcycle road guard certificate who are acting as a flagger for a motorcycle ride to stop and hold traffic, and override traffic control devices to direct motorcycle operators or other vehicles. Requires drivers to remain stopped until directed to proceed. 2) [171.60] Motorcycle road guard certificate. Establishes a motorcycle road guard certificate program. Subd. 1. Certificate required. Restricts performing traffic control by a motorcycle road guard unless the person holds a valid motorcycle road guard certificate. Subd. 2. Certification qualifications and standards. Directs the Minnesota Motorcycle Safety Center in the Department of Public Safety to: set qualifications to obtain a certificate; create and provide a certification course; and establish vehicle and equipment standards. Sets minimum requirements, including completion of a certification course and use of a safety vest. Subd. 3. Fee. Directs the department to set a fee for the certificate based on agency costs in implementing the program. Subd. 4. Penalty. Makes viola- June 2012 certificate program effective one year following publication of associated administrative rules. Helmet Law Introduced in MN Legislature A motorcycle helmet law proposal has been introduced in the Minnesota House and Senate. Here is the short description: Motorcycle owners required to bear the economic costs of their injuries not caused by others, motorcycle owners required to comply with the motor vehicle insurance requirements that apply to other motor vehicles, and motorcycle riders required to wear helmets subject to an exception. HF2755 SF2381 The following are some of the highlights of the bill: (c) A person over the age of 18 years may operate or ride a motorcycle without 3.21wearing the protective headgear required under paragraph (a) if the owner of the 3.22motorcycle has a plan of reparation security, as defined in section 65B.43, subdivision 3.2315, on the motorcycle that provides medical expense benefits of at least $250,000 and at 3.24least that amount for the total of income loss, replacement services loss, funeral expense 3.25loss, survivor's economic loss, and survivor's replacement services loss, all as described 3.26in section 65B.44. A person exercising the option provided under this paragraph must 3.27display, in the appropriate place on the motorcycle, the special license plate required under 3.28section 168.013, subdivision 1b. 3.29 EFFECTIVE DATE.This section is effective January 1, 2013. We all need to contact our State Representatives and Senators and ask them to support our rights as adults to make adult choices. We need to ask them to help us focus on public awareness, rider education, and crash prevention. OutSpokin’ 12 2012-05-16 - Attention Ohio Motorcyclists! Motorcycle Handlebar Height Bill on the Move! Contact U.S. House Speaker John Boehner and your representative today! House Bill 316, sponsored by Rep. Cliff Rosenberger (RClarksville) and Rep. Al Landis (R-Dover), seeks to relax the current motorcycle handlebar height standard of no higher than 15 inches above the seat or saddle to a more reasonable limit. The bill has eight co-sponsors. At a February 15 hearing on HB-316 before the House Transportation, Public Safety and Homeland Security Committee, it became clear there was opposition to the introduced version of HB316. Representatives Rosenberger and Landis developed an amendment to the bill, addressing concerns raised at the hearing about measurement and enforcement issues. The amendment proposed a new handlebar height standard of no higher than shoulder height of the operator while the operator is seated in the operator’s seat or saddle. On May 9, the committee held a 3rd hearing on HB-316. Following public testimony in favor of amending the bill, Chairman Rex Damschroder (R-Fremont) called the amendment up for consideration. Committee members voted to amend the bill and then voted the amended version out of committee; both votes were unanimous. The next stop for HB-316 is the full House of Representatives. Nineteen other states permit motorcycle handlebars to be higher than Ohio’s current maximum of 15 inches above the seat or saddle, while sixteen states have no restriction whatsoever. According to a 2006 Connecticut Office of Legislative Research Report, “We were unable to find any unequivocal information or scientific studies that establish a context for either Connecticut’s handlebar height standard [15 inches above the uppermost portion of the seat when it is depressed by the weight of the operator] or for the relationship between handlebar height and accident experience.” Take a few minutes TODAY to make contact with your representative and those responsible for introducing and moving HB-316 through the legislative process. On April 19, the American Motorcyclist Association (AMA) sent a letter to U.S. House Speaker John Boehner urging the House to consider H.R. 3199 that would require the U.S. Environmental Protection Agency (EPA) to seek independent scientific analysis on the effects of E15 gasoline as soon as possible. This bill needs the support of the House so the American people will know exactly how the use of 15 percent ethanol blend (E15) gasoline will affect the operation of their vehicles. The House Committee on Science, Space and Technology reported H.R. 3199 favorably, as amended, with a vote of 19-7 on Feb. 7. The bill was introduced by U.S. Rep. Jim Sensenbrenner (R-Wis.). "The EPA's decision to allow E15 into the marketplace will impact every American who owns a car, lawnmower or boat," Sensenbrenner said. “Automakers insist that using E15 will void warranties, lower fuel efficiency and cause premature engine failure. In off-road engines, the effects can even be dangerous for users. "There are serious concerns that the EPA used only one Department of Energy test and rushed E15s introduction into the marketplace," Sensenbrenner said. "This test was limited in scope and ignored a plethora of evidence -- albeit inconvenient evidence for the EPA -- that shows E15 gasoline has a negative effect on engines." The new E15 gasoline formulation may soon appear at a fueling station near you, and you need to be careful how you use this new fuel blend. That is because the EPA, in October 2010, approved E15 for use in model year 2007 and newer light duty vehicles (cars, light-duty trucks, and medium-duty passenger vehicles). In January 2011, it added model year 2001-2006 light duty vehicles to the approved list. Riders should pay attention to this list because no motorcycles or ATVs are currently listed. The AMA is concerned about E15 because it burns hotter than gasoline that contains a lesser amount of ethanol. In engines not designed to dissipate that extra heat, damage in the form of premature wear can result. Although this is a concern in all motorcycles, it's particularly problematic for air-cooled engines found in many bikes. Moreover, use of E15 may even void the manufacturer warranty. Since the approved list includes many light-duty vehicles in use today, refineries, distributors, and fueling stations may choose to offer primarily E15 gasoline because of this action by the EPA. This should concern all motorcyclists and off-highway enthusiasts since this may affect the availability of gasoline with less or no ethanol (E10 or E0). This legal document works if done correctly, but it has to be done correctly, as the law strictly construes such waivers of rights. This is the way it should be. When we host an event, we ask that all attendees sign away their rights to sue us, make claims against us and indemnify us for any expense we incur to resist such claims when a waiver has been signed. Behold: The Ten Commandments of waivers, releases and hold harmless agreements 1. Be familiar with every point in the waiver. 2. Appoint a waiver overseer to direct the process of signing and processing the waivers. 3. Examine photo identification and compare signatures (this may be discretionary in some instances). 4. Then Waiver Overseer shall initial properly executed waivers at the time of execution (this is so you are able to obtain an affidavit verifying the authenticity of the signature should that become necessary after an incident). 5. Secure waivers after confirmation (should be kept a minimum of two years). 6. Transfer the signed waivers to event person assigned to hold waivers from the event. 7. And they work well as long as ya don’t hold up their customers. The same is true with the covered entrances to some of the fancier hotels, motels and restaurants. Even the meanest cop wouldn’t hassle ya for stopping there if it’s really raining (and if you’re not blocking anything). You are, in fact, riding responsibly BY stopping. But one of the weirdest for me was that time last autumn when I had to use the large, wide portico that was covering the side entrance to a funeral home. It was raining so hard that I didn’t even realize anything was going on there when I rode in, shut ‘er down, and climbed off. But the funeral director soon pulled his shiny, black Chrysler limo up next to the bike, got out and stuck a little magnetic flag on its front fender. Remember, it is the state’s job to do that with trained instructors. There is a rule of law that places liability on your shoulders if you ASSUME a duty, a duty you may not have had under the law, and then fail to perform that ASSUMED duty properly. So, if you assume a duty of providing additional rules and riding instructions for the ride, you may have just set yourself up for a lawsuit, if they can claim your instructions were inadequate or just plain wrong. Remember, all you need to get sued is a lawyer with very little to do with a client that has a filing fee. Here are the three commandments for ride leaders that will best keep you out of the courthouse and away from the process server jockey. 1. Rely on and assume that the riders are trained and skilled. After all, the state has sprinkled holy water on them and provided them a license/endorsement to ride a motorcycle. 2. Reaffirm the obvious -- all riders are to follow the rules of the road and to obey all laws. Don’t make up any new ones. Common sense is your key to safety. The riders on the ride are the ones that have to use it. 3. Make sure all riders know the road that is being taken to the destination. Map quest takes it off you -- use it. If the ride is escorted by the law, put it in their hands and off your shoulders. P.S.: Check your homeowners insurance policy. You may have coverage under that policy as a volunteer for a not-for-profit organization like a veterans group. That may be nice to know, so call your agent. Sometimes it just takes getting out there and running a whole tank out and refueling just to clear the ole head.
