March 2008 NEWSLETTER Networking • Education • Integrity CFRI Celebrates 20 Years As we celebrate CFRI’s 20th Anniversary, it is a proud moment to recognize that we have become one of the largest REIAs in the United States with nearly 1,500 Members. In 2007, CFRI was awarded the National Real Estate Investing Association “Award of Excellence”, the top honor bestowed on any REIA. The CFRI legacy started with a handful of determined volunteers who worked tirelessly to lay the foundation of our Association. This is the story of our founders and the hundreds of volunteers and Leaders who have contributed thousands of hours over the years to make CFRI what it is today. During the 1980s, the real estate market was in the midst of many dynamic changes. Interest rates had peaked in the high teens, the savings and loan industry had gone bust and the Federal Government was implementing a take-over and bail out of the S&L debacle. Investors were taking advantage of the many properties being liquidated by the government-run Resolution Trust Corporation. There were a few recognized real estate gurus at that time who were traveling around the country giving seminars and selling courses to teach people how to make money in real estate. Two of these gurus were Robert Allen and Albert Lowry. Both of these gentlemen would inspire local groups to carry on and foster education and networking. Allen’s Orlando based group was called Realty Investor Association (R.I.A.) and Lowry’s group was called Central Florida Investment Society (C.F.I.S.). Although, the two groups had somewhat different investing philosophies, it occurred to some members who belonged to both groups that there were synergies that could make it advantageous to merge the groups. In January 1988, representatives of both groups met in an Orlando area public library for the first formal merger discussion. They bought some duplexes which they rented out to provide for wealth accumulation and cash flow in anticipation of leaving their jobs someday. After joining CFRI in 2001 they started attending the courses and subgroups and discovered that they could leave their jobs sooner than expected by using the acquisition techniques they learned such as subject-to, owner financing, and lease options. Must arrive on time.) CFRI Celebrates 20 Years (continued from Page 1) The merger meetings were held once a month throughout 1988. Rick recalls how Marianne “cracked the whip” and kept the difficult negotiations on track. Finally, in late 1988, a consensus was reached on how to merge the assets and interests of both clubs into one. Central Florida Real Estate Investors, Inc. was born. Rick Kanaga was elected as the first President and served in 1989. The initial membership was around 80. Ken Galliher served as President in 1990. Ken and Steve Flewelling ran the day-to-day operations of CFRI with no office staff. The newsletter was improved from a mimeographed sheet to a more professional format. The national economy slipped into a recession. Florida was one of the last regions that was impacted. Unlike previous recessions, middle income professionals were hit hard. Unemployment skyrocketed and the housing market suffered. Even during these difficult times, CFRI continued to grow. Sam Gilionna was the man in charge from 1991 to 1992. The severe recession worsened when our country went to war with Iraq in 1991. For many months, the economy was paralyzed. Sam was the leader for the time. He is remembered as being inspirational and an active investor with a creative mind. “ Chuck Bert was appointed President in 1998, 1999 and part of 2000. Membership hit 450 by the end of 2000. The General Meetings were held at the Winter Park Civic Center. 1999 was the beginning of the real estate boom. The bubble burst in the stock market after an incredible run up led by tech stocks. Millions of investors abandoned the stock market and started buying real estate. Florida was one of the primary beneficiaries of this shift in investment capital. Rudy Dubovec took over the reins and finished 2000. In August, 2000, the initial name of Central Florida Real Estate Investors, Inc. was changed to Central Florida Realty Investors Association, Inc. The continuing transformation took a giant leap in 2000 from a somewhat informal club to the professional association that we have today. The entire CFRI Board attended the National Real Estate Investors Association Meeting in Atlanta and learned how to refine the association’s legal and financial structure. Rick Kanaga, Rudy Dubovec and Steve Flewelling worked together to implement new ByLaws, revise the Code of Ethics and explored changing the Association to a 501(c) not-for-profit organization. The first CFRI County Groups were started. CFRI was the winner of the National REIA Award of Excellence in 2007 in recognition of the outstanding quality of services and benefits offered . . . In 1993, the country had come out of recession. Joan Erwin became the first women to assume the top post. Joan recalls there was some consternation among the male members that a woman could lead CFRI and be a successful investor. She not only proved to be a great President, but also a recipient of the CFRI Real Estate Investor of the Year Award. ” Duane Williams was elected President in 1994. The CFRI office was located within Rick Kanaga’s office suite and shared one office staff person. Duane recalls that the vacancy rates for rentals were running in the 3% to 5% range and rents were stable with few increases. Today, Duane is on the Board of Directors of another REIA. However he fondly calls CFRI his first “home” and attributes his substantial investing success to his involvement in CFRI. Steve Flewelling ran the show in 1995, 1996 and 1997. During Steve’s term, membership increased from approximately 125 to 350. As CFRI grew, the management style also changed. The Board meetings transitioned from informal to a more professional structure. CFRI began to gain statewide recognition. Andy Tolbert assumed the Presidency in 2001 and 2002. The General Meetings moved to the Maitland Civic Center. As we all remember, the events of September 11, 2001 severely impacted our nation and particularly the Florida tourist-rich economy. This period proved to be a temporary pull back in the booming real estate market as appreciation hit nearly 25% annually in many areas of Florida during 2002 to 2004. Another dynamic was taking place about this time and continued into 2006: Domestic and foreign investors poured billions of dollars into subprime mortgagebacked securities. This allowed thousands of people to buy homes they could not have qualified for just a few years earlier. Many of these “easy” mortgages were Adjustable Rate Mortgages (ARMs). For the first year or so, the monthly payments were affordable for these borrowers. However the ARMs began to “tick up” and the interest rates soared. The resulting monthly payments became impossible for many. In 2003, Ryan Kanaga followed in his father’s footsteps and was elected President. The Focus Groups were started during Ryan’s term. Membership climbed to approximately 700. The first full time salaried person, Cheryl Kiser, became the CFRI Association Executive and remains in that position to this day. More and more people began to flock to CFRI to help get their start in real estate. Fern C. Burr moved up to President from Program Director in 2004. Many important changes took place that year, including a major revision of our By-Laws. The General Meeting moved to its current location at the Plaza Theatre. CFRI’s administrative offices temporarily shared space with Fern’s company while plans were made to move in the spring of 2005 to the first-ever combination CFRI Office and Educational Center at the present location in Lake Mary. Two to four seminars are offered monthly in our Education Center, led by national or local real estate experts on a variety of investing-related subjects. The application to become a 501(c)(6) not-for-profit organization was submitted. The CFRI Expo was scheduled for September 2004, but several hurricanes got in the way and that very successful event took place in the Spring of 2005. About every eighteen months, CFRI hosts the Real Estate Investors Expo. Top national real estate speakers provide short seminars on various investing related subjects. By December of 2004, the combined total of General and Business Members had grown to 975. During this period, times were good in real estate if you were a seller. Many sellers did not bother listing with a Realtor and simply stuck a FOR SALE sign in their front yard. In days, they had offers and in some cases buyers were bidding the prices above the Seller’s ask price. On the other hand, investors who were attempting to buy at discounted prices were stymied by incredible competition. “ the insurance industry. Then, all property owners were hit by the changes in the Florida property tax system. Property taxes on many homes bought after the new law went into effect, nearly doubled. Our current President, Adam Sleap, was elected in 2007 and re-elected for 2008. Membership exploded to nearly 1,500 at the end of December 2007. David Coe, Communications Director and staff transformed the CFRI Newsletter into the top notch business publication that it is today. We now have 20 County and Focus Groups serving our Members throughout Central Florida. In 2007, we began participating in the NAREIA Professional Housing Provider Certification Program. Now all CFRI seminars carry credits toward completion of the PHP certification program. National REIA, with over 270 member associations, selected CFRI as the winner of their annual Award of Excellence in 2007 in recognition of the outstanding quality of services and benefits offered to our members and the public. CFRI has taken on the challenges that face our industry. Adam Sleap, on behalf of CFRI, continued the efforts started by Jim Alexander in 2005 to form a statewide Florida Association of Real Estate Investors (FAREI). The purpose of this organization of REIAs from throughout Florida is to monitor and provide input to our law makers regarding real estate investment legislation. Our Association has been committed to Habitat for Humanity for several years. After many fundraising events, raffles, and donations from members and friends, CFRI raised $75,000 to sponsor the construction of a new home for a deserving family. The entire Board of Directors attended the groundbreaking ceremony in December 2007. It is the unselfish contributions of our volunteers that staff that makes our Association strong . . . Jim Alexander picked up the Leadership position in 2005. In spring of that year, the booming real estate market came to an abrupt halt. Sellers were rushing to place their properties on the market to cash in on their huge equity gains. Buyers began to step back from the market, discouraged by lofty prices. Listings on the MLS began to soar as sales dropped. In 2006, Roger Reid assumed the Presidency. The fallout from the thousands of shaky subprime mortgages began to take their toll on real estate markets. Mortgage lenders and brokers began to go out of business. Easy mortgage loans began to dry up. Investors, who had bought properties at the top of the market, could not sell and in many cases could not breakeven on cash flow if they rented. To make matters worse, the hurricanes of 2004 caused many problems in The real estate market is more challenging today than any of the difficult markets in memory. The combination of the collapse of the mortgage markets, high property taxes and insurance, escalating foreclosures, low market rents and media induced fear have caused many investors to stay on the sidelines. On the other side of the coin, this is a fantastic time of opportunity. If you can buy right and hold, there will be a time in the future when supply will decrease and demand comes back. ” I have mentioned the Presidents of CFRI and some of the events that occurred during their respective terms. Some people are positioned better than others to take advantage of the opportunities. What we have here for you this month are ideas and principles that work are working for investors today. The experience level of our presenters starts with an investor’s first ever deal and then goes to a couple of active members that have been around long enough to see that the only constant in a market is change. Joyce Powell How many deals have you done? 1 “ How did you market it? Signs; ad in newspaper; Craig’s List; several open houses. I eventually did a flat fee listing with Sand Dollar Realty. How did you get it sold? Two brothers bought it whose parents live in the subdivision. The father had been watching the renovation and told his sons to go look at it and buy it. I learned that with knowledge, networking and action, I can do this. ” How did you locate it? Through Scott Baker and Lynn Thompson. We are in Augie’s coaching program together. They found the property and sent an email to the ones in our group letting us know they had a property to wholesale. How did you evaluate it? I took into consideration the loan balance, the cost of bringing the loan current, and their wholesale fee. I had Greg Clarkson with Home Fixers (also in our coaching group) do an inspection and give me an estimate to renovate the home. I then checked the comps in the area to establish an ARV. Even though it would be a complete renovation, I knew I was okay with my profit margin. I also looked at the listings to see what my competition would be once I started marketing it. How did you do the paperwork? Assignment of contract. How did you puchase the property? I paid a wholesale fee of $10,000 and I bought the property “subject to” the first mortgage of $87,500. The seller had approximately $7,500 in arrearages, which I paid. How did you get it prepared for sale? Greg Clarkson of Homefixers did the renovation. It was completely renovated: new roof, new heat and air conditioning; all new kitchen and baths; new doors, hardware, lights, baseboards, flooring; painted interior and exterior; all new sod, landscaping and sprinkler system. It was like a new home. Did you stage it? Yes, I staged the kitchen and baths and added some potted plants. The home was a modest size, so I didn’t want to fill it with furniture. How did you get it closed? Contract price of $222,500, with them purchasing it through the Nehemiah Program. (That’s basically a channel through which the seller can pay their down payment of 3% and their closing costs.) I paid a total of $14,500 in down payment assistance and closing costs. Did you get a nice big check? Yes. After my expenses of purchasing it, renovating it, holding costs, marketing fees and closing costs, my profit was approximately $41,500. Would you do it again? Absolutely. What would you do differently? I had a lot to learn about marketing. Next time I will have my marketing in place and hit it harder at the beginning. What did you learn? How important it is to have a network in place. That is what CFRI and Augie’s coaching program provided for me. I learned that with knowledge, networking and action, I can do this. In addition, our volunteers that help staff the General Meeting, Seminars, Expos, Committees, and a variety of other volunteer postions help make our Association strong, organized and financially sound. It is truly a spectacular achievement, and a result of freedom, democracy, and volunteerism that created and nurtured CFRI for 20 years. For many years to come, Members will continue to pursue their dreams of self fulfillment and financial security by taking advantage of the many benefits and opportunities available through our Association. Many of us who have attained success in real estate can credit our membership in CFRI as a major factor. As we face the challenges of today’s real estate market, let our resolve be strengthened through the knowledge that our Association is strong and our Leadership is solid. We are all the recipients of the incalculable contributions made by those before us. Through our Association, we will continue to benefit from invaluable networking, continuing essential education, while taking pride in the ethical standards that are the cornerstone of CFRI. How many times have we read the newspaper or seen on TV how bad things are today? My goodness, financial planning seems to be at the forefront of people’s minds these days. But, you guys and gals know better – we are professional housing providers, financial engineers, and last but not least -problem solvers. Because of this professional approach we can overcome all that hype – right? – WRONG! “ Now some of you will disagree and say that the early to mid 2000’s were the good years. Maybe you’re right, but how many discounts could you get then and how many of those properties did you buy to hold for long term wealth? Strangely enough though, the world wide web is pretty quiet on the product and its issues. Therefore, I speak mostly from personal experience. The 80’s were a great time for me. I was rockin’ with hair bands and fittin’ in Sassoon jeans like nobody’s business. Nowadays, the ol’ jeans aren’t the only thing that’s unraveling. The grey flexible ductwork that transports conditioned air from the air handler to the rest of the house is most often seen in pieces in an attic space because heat and light simply disintegrate the outer plastic which then falls off. In turn, the interior fiberglass insulation falls off and the inner plastic is left to fend for itself. Before this plastic rips open, you risk mold/ mildew growth from the clash of temperatures as well as a very inefficient system. During the summer, 55˚ F air is about normal for an air conditioner to produce. It’s also normal for an attic to reach 150˚ F. The extreme temperature difference creates condensation On the Down Low On the Down Low which can create a whole other list of bad things so it’s imperative to address the issue as quickly as possible. This stuff is not considered repairable, just replaceable. Having a professional AC contractor replace the duct work may run about $200 per drop (or vent). (Which is why all my mortgage docs state that the property is for investment ONLY.) Loans on investment properties do not require following the Truth in Lending guidelines. HOEPA! No it’s not what Greeks yell while dancing on the restaurant tables when eating. That’s Opa! HOEPA (Home Ownership and Equity Protection Act aka Section 32) was passed in 1994 as part of the Truth-inLending Act dealing with highcost mortgages. This was later enhanced by the Florida Fair Housing Act, effective in 2002. It is surprising how many mortgage brokers call me regarding a foreclosure bailout for an owner-occupied property. They don’t know the law or the consequences the lending institution may face if I have had several calls lately from homeowners and investors trying to get more caught. Many times it doesn’t occur to them that if the money out of their property for reasons ranging from borrower can’t make payments on a low interest bank wanting to buy other properties to trying to stay out of loan, how are they going to pay a high-cost hard money loan? It’s just a band-aid on an infection. It’s not a cure. foreclosure. How does this law apply? If I refinanced a loan on an investment property that was already in foreclosure, it would be knowing that I would probably anyway and I want the Loans on investment properties don’t require foreclose property (at a real safe price). With this market, a major consideration is following Truth-in-Lending Guidelines the exit strategy. “ First, you must realize that it only pertains to owner occupied properties. Secondly, it only deals with the equity in that property. The law was originally designed to protect homeowners (mostly senior citizens and those facing foreclosure) against unscrupulous mortgage brokers trying to take advantage of a situation. This occurs when the broker churns the mortgage (refinancing several times to get the commission similar to stockbrokers) or just refinancing (or adding a second mortgage) at a high rate when the borrower is not capable of making the additional payment. In both cases, the homeowner’s equity is being eaten away and there is a possibility of losing their property. Can a buyer finance the purchase of a property with a high-cost mortgage? YES! Because there is no equity until after the purchase. However, if the buyer plans on living there, the financing institution must follow the ” Chances of selling quickly is doubtful. What is the ability of the prospective borrower to refinance? If he cannot refinance, will the rents cover the costs of the hard money loan? I’m not going to get into the details, but the law states when refinancing owner-occupied properties, points & fees must be under 8% of the total loan amount and the APR must be under a certain interest rate. This, along with other guidelines, does not permit the true hard money lender to loan on owner occupied properties without serious consequences. Our costs and rates are too high and our term (usually a one year balloon) is too short. Now more than ever, the hard money lender must consider the worst case scenario – foreclosure and getting rid of that property without taking a big hit. Guilty until proven innocent. As I parked my truck and got out to look around it was as if I was on the set of the movie “Field of Dreams.” But instead of players coming out of the cornfield to play ball, people came in from all directions, out of the fog, to help build this home. By the end of the day the sun was out and it was amazing to see how the house had taken shape. Once everyone was there, any of us ever involved coordinating the common efforts of a group thought, “This is going to be a nightmare!” Over 60 people came to this Habitat wall raising and 29 of them were CFRI members. Contrary to my original thoughts, I was amazed to find that the coordination of the team leaders was flawless. Everyone was involved, productive, and operations were like a well-oiled machine. Kudos to the Habitat professionals. We all had a really great time. We laughed and joked and still got the home “square” and “level.” And when the trusses went up and the hurricane “H” clips were installed, you would have thought we were building the Sears Tower; the banging and the noise of workers was deafening. In the morning coffee and doughnuts was supplied by CFRI. Rain Forest Café had a choice of box lunches for everyone’s enjoyment. And when we were done for the day, we left in a bright sunny blue sky afternoon with our bodies nourished and our hearts filled with the pleasure of knowing that we all did something good. What a day! They both left their jobs more than 2 years ago and have been able to focus full-time on real estate investing. Robin is currently the leader of the Advanced Investors Focus Group. Charles Fischer Charles is a full-time Real Estate Investor and small business owner from Merritt Island, where he lives with his wife Monica and their three children. He has been an investor for 10 years, and fired his boss three years ago this May. He has experience in Short Sales, Foreclosures, Property Wholesaling, Retailing, and Landlording. Recently, he has expanded his portfolio to include Commercial Real Estate. He is a principal in the ‘investor friendly’ Real Estate Company called “The Housing Market Real Estate Services”, an Independent Marketing Director for Team National and recently started a community based newspaper called “Local MugSHOTS”. He currently leads the CFRI Brevard County Subgroup. Phil Georges In 1984 Phil Georges, President of Equity Source Consultants, Inc. and HelloSold.com started his real estate investment career In New York City by watching a late night infomercial. By 1986 he quit his day job, went full time during a big down market similar to the one we are in right now. In 1988 went back to work, while still buying single family properties at a discount, fixed them up on the weekends and rented them out. In 1995 he started buying commercial property. In early 2003 he retired the day job, moved from New York to Windermere, Florida, and continued to invest in both single family and commercial property. Since 2005 Phil has been focusing mostly on apartment buildings in New York for long term cash flow. Pat Kiehl Pat started investing in 1985, when you could buy 3/2 HUD’s in decent neighborhoods for $45,000 and sell them for $85,000+ (this was back when HUD was more investor friendly). He started out buying 3-4 houses at a time on credit cards (because he had no money.) His average credit card balance was $45,000+. In 1996 he bought the mortgage company he used to borrow from and it later became Investors Mortgage, which is a CFRI business member. His goal in this market is to stay in business, while many of his competitors have dropped out, and take advantage of the good times to come. Lee Spaziano Lee became a real estate investor in 2003. He decided to become a full-time investor in October of 2004 and hasn’t looked back. If there is money to be made in it, Lee has invested in it - including commercial, industrial, and residential properties. Lee has invested in quick-turn properties as well as buy-and-hold properties. He has also diversified his income stream by starting up several real estate related companies including Platypus Homes, Ibuyland.com, Bike Realty, and Reinvestorwarehouse.com, which is a CFRI business member. It is in his blood and he always has an eye out for a deal. In this case Foster was driving away from a Kiwanis Charity event one day and he noticed a house in a neighborhood that seemed to fit his criteria. Foster’s next step was, through the Orange County Property Appraiser web site, to find the owner of record and send them a letter. He did and they quickly responded. In this case the owner was deceased and the heirs were interested in selling. Foster performed a CMA (Comparative Market Analysis) and in using his property checklist he was able to establish the value. After having the numbers of the deal documented he met the seller and got a contract signed. Next he set-up a trust with Joe Sealge, a fellow CFRI member who is an attorney, and used Joe as the trustee. Since the property was now under contract it was time to get the exit strategy system working. Foster has a buyers list that he has developed and maintained over time. He e-mailed everyone on the list and had a buyer for the property within 24 hours. What he sold was an interest in the trust allowing this new buyer to close and take possession of the property. Interestingly enough the buyer is also a CFRI member. At the closing he collected an $11,000 assignment fee. Not a bad return on the investment of time. Augie Byllott Homeowner Resource, LLC is no stranger to our stage. Augie is an accomplished investor and understands the value of sharing his talents and knowledge. So many of us are in a rush to make the deal and chase the cash of the deal. Sure that will make you money, but that is only cash flow. Augie takes a very marginal deal (on the surface) and makes monster returns. Read on and get educated . . . this will make you wealthy! How did you get it prepared for sale? Power washed exterior, repaired HVAC system, painted interior and landscaped. Did you stage it? Staged kitchen and baths. How did you market it? Cleaned it up within 7 days of closing and put it on USLeaseOption.com as a buy now or rent to own opportunity. We were looking for $5K down and $800 per month at $99,900. How did you get it sold? We accepted a candidate able to pay $745 per month and able to move in immediately. He only had $1,500 to put down so instead of a Lease Option we did a Contract for Option which gave us more protection because of the small amount of consideration. But this gave us $1,500 cash and a tenant in the property before out first payment was due, along with almost $200 a month positive cash flow and a purchase price of $99,900. Closed Sept 19, occupied October 1. In January we get a call that the tenant is being transferred and needs to move closer to their new assignment. As part of the early termination agreement they must keep the property in showable condition and also allow us to market and show the property. So again we put the property on USLeaseOption.com only this time we got a buyer with $10K to put down. We now have a $5,700 non-refundable deposit and the buyer has been approved for seller financing with buyer to pay all closing costs. We’ll wrap our equity (less the $10K) with a 40 year amortization and likely pay off the underlying first in 17 years. Our profit will be $28,000 of which we already have $10,000. The spread on the deal will be $240 per month for as long as she owns it. If she carries the property 5 years we’ll pick up an additional $14,400 in interest. Let’s take this a step further and see the power of compounding. When you structure the deal so that you offer owner financing, take a look a this chart and see how a $95+/manufactured home can generate over a quarter of a million dollars. Can you say WOW! They just wanted moving money so they could lower their monthly expenses and prepare for an out of state move before their credit got any worse. How did you evaluate it? This was a manufactured home with a good size lot they just couldn’t afford it. How did you do the paperwork? My assistant put the property under contract and we purchased the contract for a $1,000 assignment fee. How did you get it purchased? Checked the title with PCS and closed within 10 days. We also allowed the seller a postoccupancy agreement holding $2K in escrow.
