Please describe every grant the agency is, or is considering, applying for this fiscal year. None. 2. Please provide the name of each employee on administrative leave in FY 2010, and thus far for FY 2011. In addition, for each employee identified, please provide: (1) their position; (2) a brief description of the reason they were placed on leave; (3) the dates they were on administrative leave; (4) whether the leave is paid or unpaid; and (5) their current status. Please see attached chart. By way of background, the OAH Act requires that Administrative Law Judges (ALJs) participate in continuing legal education opportunities for their professional development which, in turn, helps them better serve the District. See generally D.C. Official Code§§ 2-1831.03(a)(4) and 2-1831.09(a)(1). It is OAH policy to allow ALJs and other staff administrative leave for approved travel and training related to their professional development. In recognition of Administrative Professional’s Day in April, 2010, all support staff were given four hours of administrative leave. In addition, through its “Shining Star” award program, OAH has granted one day of administrative leave to selected staff once a quarter for exemplary service, and all staff received an administrative leave day on November 12, 2010 for their efforts as part of the office-wide Operation Clean Slate backlog reduction initiative. 3. How many grievances have been filed by labor unions against agency management? Please list each of them by year FY 2009 – FY 2011 (to date), and by union, if more than one union. If a backlog exists, please identify what OAH is doing to address any problems in this area. Despite historical shortages in support staff and significant increases in case filings, OAH has aggressively reduced its backlog in FY10. In 2QFY10, OAH launched Operation Clean Slate. The goal of Operation Clean Slate was to eliminate by the end of FY10 all backlogged cases filed though March 2010 that were ripe for decision. The Operation Clean Slate initiative was a great success. From June 2010 through December 2010, OAH reduced its open and pending cases by approximately 14,600 cases, or 80%. Of the remaining 3,577 cases, OAH expects to resolve about 50% in large groupings through consolidated hearings and mediation. The following chart reflects the jurisdiction breakdown of these cases as available. What is the status of efforts to mediate District Department of Transportation cases previously identified in OAH’s backlog? DDOT/WASA Mediation There are currently approximately 886 pending cases filed by DDOT against WASA at OAH. In November 2010, DDOT and WASA, through their attorneys, agreed to mediate the cases through OAH’s mediation program. An Administrative Law Judge, who is also a certified mediator, was assigned as the mediator. The first in a series of mediations was held on November 30, 2010. Since then, two other mediation sessions have been held on December 21, 2010 and February 7, 2011. Upon the granting of a continuance at the request of the parties, the next mediation session is scheduled for April 8, 2011. As a result of these efforts thus far, 95 cases have been dismissed and 30 cases settled, for a total of 125 resolved cases. DDOT/Washington Gas Light Mediation There are currently approximately 1,834 pending Notices of Violation issued by DDOT against Washington Gas Light (“WGL”). During 2008 and 2009, DDOT and WGL participated in numerous mediation sessions that were ultimately unsuccessful. On May 25, 2010, the parties appeared for a status conference before an ALJ, after which they were to report to this administrative court on their willingness to return to mediation. On June 2, 2010, DDOT sent a Notice of Status of Discussions Regarding Mediation (the “Notice”) to update the court. In the Notice, DDOT indicated that the agency required additional time to consult with the DDOT Director before making a decision as to mediation. Committee on Public Safety and the Judiciary March 14, 2011 Page 7 of 20 During a status conference on June 15, 2010, WGL stated that it was willing to continue mediation discussions. However, DDOT was not interested in pursuing mediation at that time. Since DDOT would not agree to mediate, OAH began to adjudicate the cases on the merits on a weekly basis. In light of renewed concerns by the parties over the time and expense associated with litigating these cases, on March 8, 2011, OAH convened a status conference to ascertain if the parties were willing to return to mediation. The parties, through their legal counsel, informed OAH that they would like to continue the status conference for 30 days to give them an opportunity to negotiate a settlement of all the Notices of Violation that were issued to WGL from 2007 to 2009, and possibly 2010. The request was granted, and the parties are required to provide OAH with a status report on the negotiations by March 25, 2011, followed by a status conference on April 2, 2011. 8. Please provide the following with regard to transcripts: a. A status update on the issue of transcripts. If there is a backlog, identify the reasons for this and explain what OAH is doing to resolve it. OAH is required by rules of the District of Columbia Court of Appeals to file the “record” in any OAH case appealed to the Court of Appeals. The record consists of all the papers filed in the case and a transcript of any hearings in which evidence has been taken. OAH generally has 60 days in which to prepare and file the record after an appeal has been filed with the Court of Appeals. OAH has made a significant push through its Office of the General Counsel to timely file the record in cases appealed to the Court of Appeals. Since the beginning of FY11, we have filed the record in approximately 74 cases. There are 25 cases in which a transcript is due. There are two ongoing resource challenges which affect OAH’s ability to promptly file the record with the Court of Appeals. The first is a shortage of staff members to gather the files, copy the audio recordings of hearings onto CDs, prepare the cover papers, and copy and file the record with the Court of Appeals. OAH has solicited and obtained a volunteer from a local law school to assist in the preparation of records and hopes to recruit additional volunteer law students this summer to assist with this ongoing effort. b. In table format, please break out all OAH’s costs to process transcripts in fiscal years 2009, 2010, and 2011 to date. Please provide the following with regard to OAH’s adjudication of unemployment insurance cases: a. The agency’s level of compliance with current federal guidelines for unemployment cases, by month, for fiscal years 2010 and 2011 to date. The United States Department of Labor (DOL) has standards for the number of cases that should be decided within certain timeframes. DOL’s regulations provide that 60 percent of all cases should be decided within 30 days of filing; 80 percent of all cases should be decided within 45 days of filing; and 95 percent of cases should be decided within 90 days of filing. Please see attached chart. b. What steps is OAH taking, or has taken, to meet these guidelines, if any. OAH has taken a number of steps to meet DOL standards. In February 2009, because of an increase in filings, OAH increased the number of hearings scheduled. In June 2009, OAH revised its methods of processing these cases and assigned legal assistants and ALJs to work in teams. Since that change was implemented, and with some additional ALJs assigned to work part-time in the area, OAH has met the standards more consistently. As can be seen from the attached charts, OAH met or substantially exceeded the most stringent 30-day/60% standard in 8 of the 12 months of FY10, with a fiscal year average of 64%, well above the DOL standard. c. In table format, please list the amount of intra-District funding dedicated to employment insurance cases in OAH’s budget for each fiscal year in which the agency has had jurisdiction of these cases. Also identify the amount of funding that has actually been transferred to the agency in each fiscal year. OAH has adopted a performance accountability target of 85 percent of case dispositions within 120 days of filing (non-UI cases). In table format, provide by case jurisdiction for fiscal years 2010 and 2011 to date: (1) the total number of cases within the jurisdiction; (2) the number of cases that have met this target; and (3) the percentage of cases that have met the target. As part of its FY10 Performance Plan, OAH adopted two standards relating to case processing: (1) 95% of Unemployment Insurance cases resolved in 90 days from the filing date; and (2) 75%-85% (depending on the fiscal year in question) of non-UI cases resolved within 120 days of the filing date. In FY10, OAH substantially met the UI standard at 93%. The chart that follows reflects all non-UI cases that were entered into the new case management system which was phased in during 1QFY10. Please provide a list of all committees in the agency, and the membership of the committees. b. Provide a description of each committee’s purpose, deliverable goals, and action plan, if available. c. Provide the planned or anticipated meeting schedule. d. If the committee has deliverable goal(s), what is the timeframe for the deliverable(s)? In FY10, internal committees provided support to many OAH functions. Most committees are chaired by ALJs and have ALJs as members, with support staff participation where appropriate. Summaries of the activities of OAH’s major operations committees follow. Rules Committee Chair: Judge John Dean Members: Judges Erika Pierson, Elizabeth Figueroa, Nicholas Cobbs, Jesse Goode, Ann Yahner, Jennifer Long; Attorney-Advisor Meredith Saladyga The purpose of the Rules Committee was to undertake a comprehensive review and overhaul of the OAH procedural rules. Proposed rules were issued in September and November, 2010. The proposed rules were a result of a cooperative effort between OAH and stakeholder groups, with the Committee producing an initial draft of the rules and sharing the draft with more than 40 private and governmental stakeholders, comprising a cross-section of individuals and groups who regularly appear before OAH. The Committee held a series of meetings with the Committee on Public Safety and the Judiciary March 14, 2011 Page 12 of 20 stakeholders and revised the proposed rules in light of suggestions and comments received at those meetings and through comments submitted from the public and OAH ALJs and AttorneyAdvisors. After considering comments received, OAH published final revised procedural rules in December 2010, which became effective January 1, 2011. The Committee also developed and administered several internal and external training sessions on the new rules. During the preparation of the revised rules, the Committee met weekly, sometimes twice-weekly to meet the timetable requested by the Council for the promulgation of new rules. The Committee now meets as needed to address any procedural rule matters. Mediation Committee Chair: Judge Beverly Nash Members: Judges Elizabeth Figueroa, Caryn Hines, E. Savannah Little, Margaret Mangan and Wanda Tucker The purpose of the Mediation Committee is to expand the use of alternative dispute resolution at OAH, thereby increasing the efficiency in which matters are resolved, as well as litigant satisfaction associated with that resolution. Towards that end, the Committee coordinated the opening of the newly-acquired OAH Mediation Center located on the seventh floor of OJS, which includes conference and break-out rooms. The OAH Mediation Center opened in August 2010, and resolution of cases through mediation has increased significantly with this new resource. The Committee analyzed OAH’s current mediation program and has gathered data relating to the types of cases mediated and outcomes. The Committee also reviewed and proposed revisions to the OAH draft rules on mediation and collected information about other mediation programs and policies to develop the OAH program. The Committee is updating forms to be used in the Mediation Center and plans to complete revisions by June 2011. Recruitment Committee Chair: Judge Louis Burnett (three-year term ended February 2011); succeeded by Judge Caryn Hines Members: Judges Joan Davenport, Audrey Jenkins, Margaret Mangan, Samuel McClendon, and Arabella Teal; Attorney-Advisors Meredith Saladyga and Janell Smith The Recruitment Committee’s purpose is to recruit legal interns to support the judges and the Office of the General Counsel by conducting legal research, drafting and editing memoranda and opinions, observing hearings and mediations conducted by Administrative Law Judges. The Committee also coordinates a Summer Intern Program which includes having interns attend Council hearings, proceedings in Superior Court and oral arguments at the Court of Appeals. The Committee coordinates mentor assignments and conducts training seminars for the interns on topics such as deference to agency decisions, evidence, mediation, and how a bill becomes a law. During the fall semester 2010, two volunteer law clerks were placed. Goals include the following placements: spring semester 2011, 5-7 part-time interns; summer 2011, 15 full-time interns; fall 2011, 5-6 participants from local university externship programs. Committee members attend recruitment and career fairs at local universities, partner with professors at Catholic University, Howard University School of Law and University of the District of Columbia School of Law, and cultivate relationships with university career services directors outside of the region such as McGeorge University, University of Miami, and Vermont School of Law. The Committee also partners with the judicial council of a local bar association Committee on Public Safety and the Judiciary March 14, 2011 Page 13 of 20 which sponsors a legal internship program at the Superior Court of the District of Columbia. The Committee is planning monthly meetings. Training Committee Chair: Judge Paul Handy Members: Judges Nicholas Cobbs, Arabella Teal, Elizabeth Figueroa and William England; Legal Assistant Starr Gantt The Training Committee provides professional development opportunities for ALJs and staff members. During FY10, the Committee met quarterly and accomplished the following: (1) partnership with the Office of the Attorney General (OAG) for ALJs and attorneys to attend OAG’s Inns of Court programs; (2) development of a full-day in-house training program for legal assistants; (3) cross-training of all judges in DPW cases; (4) coordination of general training with the Workforce Development Administration; (5) facilitation of brown-bag lunch discussions on legal issues for judges; (6) arrangement of bi-weekly legal assistant training sessions led by ALJs. Performance Measures Committee Chair: Deputy Chief ALJ Mark D. Poindexter Members: Judges E. Savannah Little and Robert Sharkey In FY10, the Performance Measures Committee reviewed OAH’s existing performance measures, researched and reviewed the performance standards adopted by other court systems, and issued an extensive report providing recommendations to the Chief ALJ for enhanced FY 2011 agency performance measures to be tracked. During the preparation of its report, the Committee scheduled bi-weekly meetings. The Committee will be expanding its ranks with new volunteers and, working with the Case Management Committee, will be focusing on the development of more individualized performance measures. The Committee expects to meet monthly with additional recommendations issued by OAH’s consolidation in July 2011. Ethics Committee Chair: Judge John Dean Members: Judges Joan Davenport, Robert Sharkey, James Harmon, Jesse Goode, and Sam McClendon In FY10, the Ethics Committee members responded informally to various requests for advice from ALJs concerning the application of the OAH Code of Ethics for Administrative Law Judges. The Committee’s work is on-going, and it meets as needed in response to ethics inquiries. Revenue Committee Chair: Judge Wanda Tucker Members: Judges Jesse Goode, Sharon Goodie, E. Savannah Little, Erika Pierson, Arabella Teal and Steven Wellner; Attorney-Advisor Meredith Saladyga The purpose of the Revenue Committee is to pursue revenue growth opportunities. OAH identified the need for 11 additional Legal Assistant positions to operate efficiently. OAH first requested funding for these positions its FY08 budget submission. The positions were not funded and the Revenue Committee was charged with identifying funding sources. Committee on Public Safety and the Judiciary March 14, 2011 Page 14 of 20 The OAH Establishment Act permits agencies, boards, and commissions to refer cases to OAH for adjudication with the approval of the OAH Chief Administrative Law Judge. D.C. Official Code § 2-1831.03(c)(1). Prior to the establishment of the Committee, there were standing Memoranda of Understanding (MOUs) between OAH and other agencies that referred cases under this authority. To ensure that local funds allocated for adjudication in the agencies’ budgets followed the function, the MOUs required agencies to transfer local funding to OAH using the intra-district transfer process. The Committee was charged with negotiating the continuation of those MOUs in FY10. This responsibility was transferred to the Office of the General Counsel for FY11. The Committee’s primary focus is the development of a reimbursement rate and billing convention that would allow OAH to claim federal funds for public benefit cases typically referred to as “fair hearings” under federal law. While federal funds are available to cover a substantial share of the salaries and administrative costs attendant to adjudicating these cases, the District government did not claim these funds after the OAH Establishment Act transferred responsibility for adjudicating these cases from the District government’s human services and health care finance agencies to OAH. For FY10, the Committee shepherded the development of a contract with Innovation Cost Solutions (ICS) for the development of a time reporting tool and reimbursement rate that would withstand federal audit. The intent is to have OAH invoice the District’s health care finance and human services agencies, who would claim the federal costs of providing the adjudication services from the federal government and then transfer the federal funds obtained to OAH. The Committee meets twice per month. Website Committee Chair: Attorney-Advisor Holly Kirk Members: Judges Sharon Goodie, Nicholas Cobbs and John Rooney; Attorney-Advisors Janell Smith and Meredith Saladyga; and IT Manager Phillip Fauci The purpose of this Committee is to review the current website, update it and add new material. Recently, the Office of the Chief Technology Officer (OCTO) has scheduled OAH for website migration to a new Content Management System. OAH is using this opportunity to review, rewrite, and reorganize all of the content on the website to make it more user-friendly to parties. The Committee ordinarily meets monthly. However with the current website migration project, the Committee recently has been meeting weekly to meet an aggressive migration schedule. OCTO had set a launch date for the new website of March 17, 2011. In early February, OCTO informed OAH that the launch of the new website must be postponed while OCTO reviews the stability of the servers hosting the new websites. OAH has not been informed of a new launch schedule. Case Management Committee Chair: Judge Steven Wellner Members: Judges Nicholas Cobbs, Elizabeth Figueroa, Jesse Goode, Audrey Jenkins, Margaret Mangan, Beverly Nash, John Rooney, Ann Yahner; Attorney-Advisor Janell Smith; and IT Manager Phillip Fauci The Case Management Committee works to refine the court’s electronic case management system that was implemented in 1Q 2010. The Committee’s objective is to help OAH meet case processing goals based on legal standards for promptness and fairness and reasonable expectations of government officials and the public. The Committee has made significant progress in streamlining case processing through the development of electronic templates for Committee on Public Safety and the Judiciary March 14, 2011 Page 15 of 20 orders and notices. The Committee has also greatly improved case tracking and reporting functions. Committee members participate in weekly conference calls with the case management system vendor about specific modifications to the case management and document management systems, and the full Committee meets monthly. Pro Bono Committee Chair: Judge Sharon Goodie Members: Judges Claudia Crichlow and Beverly Nash; Attorney Karim Marshall (Capital City Fellow) The Pro Bono Committee is responsible for the expansion of OAH’s Language Access program. Before FY11, the agency relied on Language Line, a service that provides interpreters by telephone. Beginning in 1Q FY11, interpreters are onsite two days per week to provide interpretation in Spanish, Portuguese and Italian. The Committee also worked to help put in place a contract for onsite interpreters for other languages. OAH has recently started translating critical documents and forms into Spanish and Braille, and the Committee is in the process of developing a protocol to prioritize the order in which to translate key documents. Recommendations will be completed by summer 2011. The Committee also manages the Pro Bono Panel which provides student lawyers from four area law school clinics (American, Catholic, Georgetown and George Washington) to represent parties at OAH. The Panel is already operating in the Unemployment Insurance jurisdiction, and will be expanded to include public benefit matters from the Department of Human Services by summer 2011. The Committee will also explore including law firm associates and government attorneys on the Pro Bono Panel. The Committee has also collaborated with Professor Faith Mullin of Catholic University’s School of Law to design and implement the OAH Resource Center. Specific tasks on this project include: (a) working with the D.C. Access to Justice Commission and the D.C. Bar to recruit volunteer attorneys to work in the Resource Center assisting litigants in preparing for their hearings; (b) designing and drafting fact sheets and information booklets for various jurisdictions as well as for specific procedures, such as requesting a hearing; and (c) working with the Office of Cable Television to produce two instructional videos directed at selfrepresented litigants that will be accessible on the OAH website as well as in the Resource Center. 13. The Committee had previously requested that OAH “commence bi-monthly stakeholder meetings regarding access to justice.” OAH stated to the Committee a year ago that it had started meeting with the Access to Justice Commission. a. Do these bi-monthly meetings continue to take place? b. Please provide the dates on which OAH met with stakeholders during the previous 12 months. c. Committee on Public Safety and the Judiciary March 14, 2011 Page 16 of 20 OAH has had regular meetings with Access to Justice Commission members, including meetings in February 2010, April 2010, and October 2010. Most recently, on February 15, 2011, OAH met with Commission members including DC Court of Appeals Judges Inez Smith Reid and Anna Blackburne-Rigsby to discuss Access to Justice initiatives, particularly as they relate to the development and staffing of the OAH Resource Center. This meeting included a tour of Phase 1 of OAH’s new hearing facility. These meetings have been invaluable in gaining insight into the needs of self-represented litigants, particularly as OAH develops and staffs its Resource Center. Through these meetings, OAH has also developed various contacts for the various Pro Bono Committee projects outlined above. In addition, through regular meetings of OAH’s various operations task force meetings, we receive regular feedback from public and private stakeholders on all operations issues, including Access to Justice issues. 14. What is the status of Prof. Faith Mullen’s 2-year fellowship (Bellow Fellowship) aimed at assisting OAH in becoming more accessible to unrepresented litigants? Are there specific deliverables for this project? Please explain. The two-year Bellow Fellowship for Professor Faith Mullen of Catholic University’s Columbus School of Law ended in 1QFY11. Through this Fellowship, Professor Mullen and her staff provided invaluable support in increasing Access to Justice at OAH, including developing informational materials and forms, facilitating several OAH stakeholder focus group meetings, and conducting surveys and analyses of the impact of certain OAH procedures on selfrepresented litigants. Although her Fellowship has now ended, Professor Mullen continues to offer her expertise and assistance in the development of the OAH Resource Center and the OAH website, as well as placing volunteer law students. Upon the completion of her first year of the Fellowship in 2009, Professor Mullen submitted an interim report summarizing her activities to date. A copy of that report is attached. Professor Mullen expects to complete her final report on or about April 30, 2011. 15. The Committee report for PR 18-694 included a number of tasks for OAH with specified deadlines. The Committee has been concerned whether the OAH would have enough space, and whether it would be able to expand. Please comment, in detail, on the move, the adequacy of the space, what is left to be done, and what else should be done. Phased Relocation On January 14, 2011, OAH and DRES convened a status meeting to discuss the phased relocation approach. During this meeting, OAH reiterated the operational inefficiencies associated with a two-phased move, particularly since the second phase of the move had not been determined at the time. OAH currently occupies temporary space on four disparate floors (5, 7, 8 and 10) of OJS. OAH communicated concern with the negative impact to agency operations that would result, particularly when the agency is already temporarily displaced. DRES agreed to consolidate the proposed phased move approach to one move. The original date for Phase 1 relocation was scheduled for February 18, 2011 with Phase 2 still yet to be determined. DRES committed to honoring the agency’s request and revised the move date to July 22, 2011. Phase 1 construction continued as planned and was completed on February 25, 2011. OH and DRES agreed that after this date, the Suite (450N) would remain locked and inaccessible until Phase 2 is complete. DRES communicated that Phase 2 construction is slated to start on May 15, 2011 and conclude no later than July 7, 2011. Adequacy of Space When completed, Phases 1 and 2 of the construction will be adequate to meet OAH’s current space needs, but not its needs in the immediate future. OAH wants to ensure that the new location will not only be able to accommodate FTEs, but also the significant number of volunteers that complement our staff. Although our agency is understaffed, we have made every effort to identify free resources to augment our staff. This includes high school, undergraduate and law school interns, ex-offender volunteers through DOES’ Project Empowerment program and a Capital City Fellow. Committee on Public Safety and the Judiciary March 14, 2011 Page 20 of 20 Throughout the selection process for OAH’s consolidated hearing facility, a recurring concern raised by this Committee was whether the selected space would permit for expansion of OAH’s operations. Whether by legislation or requests from sister agencies, OAH is continually expanding the scope of its caseload. In addition, future initiatives relating to foreclosure mediation and increasing Access to Justice for litigants will require additional space. DRES repeatedly represented that OAH could expand on the 4th floor as needed. Given the delays associated with the build-out of Phase 2 of the consolidated project – delays due primarily to the need to relocate and build-out facilities for existing tenants – the flexibility envisioned with expanding OAH’s operations at this location is less clear. OAH stands ready to cooperate with the Executive and Council to resolve these space issues. Outstanding Items OAH is currently engaged with the Office of the Chief Technology Officer’s (OCTO) Server Operations (Server Architecture), IT Servus (IT Support) and DC NET (Voice/Data Connectivity) groups to define requirements, verify costs and services and establish an MOU for the provision of services. OAH anticipates the execution of the MOUs no later than the end of March 2011 to ensure that the agency will be fully operational by the July 22, 2011 move date.
