Whew…Another Close
Deadline Met!
At the Annual Meeting on March 5 we
received our 523 owner quorum just before
the 1:00 meeting was to start. Every year it’s
a close call but somehow our Villagers pull it
off. For those of you who did register to vote,
Thank You! For those of you who thought
it unnecessary, well…. all I can say is I am
glad that I got the chance to be “one of the
ones” picking the people that represent me
and my pocketbook. Make a note to “yourself
“to register every year for the Annual Meeting & Election so your voice can be heard.
The Board of Directors not only enforces the
existing By-laws and Declarations it also requests new purchasing quotes and sets the
scope of work for large projects. Needless to
say those are very important duties not to be
taken lightly. It is equally important that the
Board function well together to get the job
done! This year’s newly elected Board has a
lot of work ahead of them. Please offer them
congratulations on their appointments and
a “Thank You” for volunteering for this timeconsuming and often thankless job.

LIV says “CANCER SUCKS!”
On Saturday, Feb. 27th, the residents &
friends of LIV participated in the 3rd annual
Cancer Rally Golf Tournament & Luncheon.
A total of 128 golfers and friends raised an
all-time high of $15,142.50 to be donated for
cancer research. The success of this rally was
made possible by the generosity of local businesses and personal donations.
Ruth Galow & Lil O’Donnel started this rally as
a breast cancer “Rally for the Cure” in 2006.
It grew and changed over the years finally
becoming a Rally for all Cancers focusing on
research in 2014.
The fun filled day consisted of the golf
tournament, buffet lunch, 34 raffle baskets,
live auctions & door prizes. The outpouring
of support was overwhelming. Everyone,
including Aramark, opened up their hearts and
their wallets for a great cause: To Find A Cure
For Cancer! The money raised will be divided
between the American Cancer Society and St.
Jude Children’s Research Hospital.
The current coordinators, Traci Walzer & Jennie McBride would like to sincerely thank all of
the businesses and individuals who made this
Rally such a huge success.

DREDGING UPDATE
Most villagers are aware that an assessment mandated by the Board of Directors for a dredging project
to be carried out by Derrick Construction Company has been nullified because the dredging company
refused to honor a contract under the terms of a bid that was over two years old. A few years ago,
owner M O Berry sued LIV in order to force the village to dredge canal A so that his sailboat could leave
its dock and travel into the intercoastal waterway. Berry won the lawsuit, with some provisions being
contested by appeal. Since then another owner has filed a similar suit which essentially would seem
to require that all of canal H also be dredged. Directors Waller and Champion are now on the dredging
committee tasked with implementing this project.
Many factors will need to be considered by the board. How many canals should be dredged? Some of
the costs incurred when a dredging company carries out its work are fixed and would need to be paid
every time they are called upon to clear our waterways. These include mobilization and installation of
all equipment, and construction of a site where the dredging spoils will be deposited. Each of these
expenses amount to roughly $100,000 apiece. Maybe it would be cheaper in the long run to dredge all
canals and avoid periodically paying these fees. The bulk of the remaining cost relates to the amount
of dredging material removed, approximately $10 per cubic yard. Could some money be saved by not
fully clearing canals that may not need it, only attending to problem areas in these places? Dredging all
the canals would require the removal of about 45,000 to 50,000 cubic yards. Areas in the intercoastal
waterways directly outside the mouths of the canals also need to be cleared, adding to the expense.
Should we also dredge along the properties on the intercoastal? The mathematics seem to show that
we are looking at $600,000 or more for the complete project.
Freeland has granted LIV permission to deposit dredging spoils on their property. However, they require
us to pay for 2 years of liability insurance to do so. The cost to LIV for this policy is $60,000 to $85,000.
Could it be possible to find an alternate site that would not require this added expense?
Recently owner Eddie Montalvo presented the board with a possible alternative. LIV could purchase its
own dredge at a one-time cost of about $765,000. The company would train someone to operate it at no
additional cost. However, other expenses are unavoidable. A system to collect and filter the dredging
material would need to be purchased (about $130,000). A structure to house the dredger would need to
be built, and there would be costs to maintain the equipment. Since the craft would need to enter commercial shipping lanes, an arguably expensive insurance policy would be required. The dredging material would still need to be transported by truck to a dumping site. Mr. Montalvo noted ways to mitigate
the costs. We could partner with the city of Port Isabel to buy and maintain the equipment, since they
have places like the Fingers that also require dredging. Also, LIV could contract with other local entities
that need waterways cleared and charge a fee for the service.
At February’s BOD meeting, Dir. Weaver asked the board to enter into a contract with a company called
Belaire to whom LIV has already paid $15,000 to survey the canals. Essentially, this new agreement
would pay Belaire to oversee the project, making sure all requirements of several regulatory agencies
are met, as well as the provisions of the lawsuit(s). This is a cost plus proposal by Belaire with an estimated fee of $65,00 to $119,000. Dir. Weaver felt that the board is not capable of tackling the dredging
enterprise on its own, thus needing Belaire’s expertise. Could LIV save money by taking on the project
without this help?
The dredging committee is now entertaining bids from more than one company. Director Waller would
like all owners to know that he is open to listening to anyone’s opinion to help guide him through this
difficult process. He can be reached by cell phone, email, or face to face at the coffee with the directors.

MARCH BOARD MEETING HIGHLIGHTS
The newly seated board got off to a good start at the Wed., March 23rd. meeting. Management reported
the workout equipment would be repaired by the coming weekend, granite counter tops had been ordered
for the activity center & pro shop, and locks had been ordered for water shut off valves. Chris Wooten also
asked the BOD to consider contracting with “One Call Now”, a company that would facilitate contacting
owners with late notices, emergency warnings, news flashes, & newsletters to name a few.
Bridge Board President, Mac Sweeden, asked he BOD to select a member to represent LIV. Joe
Long was elected. Pres. Sweeden was also seeking a full time person with some mechanical knowledge
to apply for an opening on the Bridge Board. He mentioned that there was a liability problem with boats
tying up to any part of the bridge to fish and that the Coast Guard would have to be called if it continued.
The board passed motions to follow protocols found in Chapter 82 of the TX Condominium Act, for
running executive sessions and to keep minutes of those sessions and during committee meetings.
The board also agreed to seek bids for village attorney, repair the street alongside the Guard
Shack, and to allow beer & wine to be sold at the pool again. A motion was tabled to pay Belaire Environmental, Inc. between $65,000 and $119,000 to repeat a canal survey, seek bids, and oversee dredging.
The board instead chose to consult with owners about specific needs and how they wanted it done.

Charlie Brown, 173 W. Bonnet Cr., L.I.V. lost one of its favorite
son’s March 7, 2016 in the early morning. Charlie Brown succumbed to a valiant battle with cancer leaving behind his loving
family and so many admiring friends. Charlie had a personality that
made him friends quickly and a character to keep those friends
forever. He will be greatly missed by all. Semper Fidelis
Regular Board Meeting Minutes

Mac Sweeden, Bridge Board President, informed everyone that there
was a position open on the Bridge Board and that they were looking
for a full time resident with mechanical knowledge to apply. The Bridge
Board Annual Meeting will be held on April 2, 2016. Applications for the
Bridge Board are available at the Welcome Center & the Activity Center.
Motion – Dir Burke – to approve the expenditure of appx. $2,600 to have
the floor of the Rec. Hall, & Arts & Crafts room finished. 2nd Dir. Holdeman. Discussion took place. The motion was amended to include the
Activity Center, Grill, & hallway. Dir. Waller voted against, Dir. McBride
abstained, Dir. Burke, Holdeman & Weaver voted for the motion. Motion
passed.
Motion – Dir Holdeman to approve the minutes. 2nd Dir Weaver. Motion
passed unanimously.
Motion – Dir. Weaver – to enter into a contract with BelAir Environmental Services to perform the work outlined in their February 10th preliminary work plan summary. The environmental & regulatory consulting
services, US Army Corps of Engineers nationwide permit #35 and
proposed maintenance, dredging and disposal at LIV. Furthermore, with
the direction that the request be for a proposal to be on a performance
bid basis. The scope of the work is to include all canals A-H, the lake
area and into the intracoastal as necessary to comply with the court order ultimately giving all other canals the same benefit as the court order.
Furthermore, any other consideration the dredging shall be designed
as to not compromise the integrity of existing seawalls. The proposal
is a cost plus proposal with an estimated cost of $67,519 to $119,500.
2nd Dir Burke. Open discussion took place. Dir Burke made a motion to
table this discussion. 2nd by Dir McBride. Dir. Weaver abstained. Motion
passed by all remaining BOD.
Motion – Dir. Burke that the Treasurer of the BOD check to make sure
every board member is in compliance with Section 4 of the LIV Bylaws and to notify the BOD of any member not in compliance prior to
the monthly BOD meetings. 2nd by Dir Weaver. Open discussion took
place. Dir.’s Burke, Weaver, & Holdeman for. Dir.’s McBride & Waller
opposed. Motioned passed.
Motion – Dir. McBride to waive the late fees incurred on an owner’s
condo fees due to the death of his wife. Pres. Guerra established who
the owner was, Dir. Burke, Holdeman, & Weaver opposed. Dir. Waller &
McBride in favor. Motion failed.

FEBRUARY LIV Patrol
2/1/16 – The owner of Lot 338 reported to Security
that they noticed foot prints & a bad odor on their
pontoon boat that had not been there the day
before & thought someone had been sleeping on
it. Security promised to check the boat during each
patrol (appx. every 2 hrs.)
2/1/16 – A woman reported to Security that there
was broken glass in one of the indoor pool showers. Security investigated, spotted some glass, but
found nothing broken. Maintenance was called to
clean it up.
2/6/16 – EMS was called for lot 34. The renter was
transported to a hospital in Brownsville.
2/7/16 – The owner of lot 597A arrived to find a
trailer parked on her lot. The owner of lot 598 was
contacted & a contractor was called to remove his
trailer from Lot 597A and to clean up that lot and fix
a broken sewer cap.
2/8/16 – The arm of the owner’s gate stopped working and the electricity was turned off to the guard
house for appx. 3.5 hours while it was being fixed.

when the owner of SC111 was accidently hit while

injured. Both parties chose not to be transported to

helped him and he chose not to seek medical assistance.
2/21/16 – The owner of Lot 338 called about a red
truck parked on his lot the last 2 nights. The resident of Lot 337 was notified and moved his truck.
2/22/16 – Security was notified about a broken
window at Lot 212. It was determined that the sliding door was shattered when rocks flew up from the
weed eater. Arrangements were made to replace
the door.
2/23/16 – The owner of Lot 712 notified Security
that the slide out on his neighbor’s RV was over the
property easement. The renter was advised of this
and agreed to move the RV to be in compliance.
2/25/16 – EMS was called to Lot 666 and the owner
was taken to a hospital in Brownsville.
2/25/16 – The owner of SC96 reported to Security
that a vehicle with Colorado license plates did not
stop at a stop sign and almost hit her. Security attempted to make contact with the driver.
2/28/16 – Security noticed a broken sprinkler head
near Lot 716. Maintenance was called.

SAND DOLLAR QUILTERS It’s been a FUN season for the Sand Dollar Quilters.
In Jan. we had a PJ party and all day sew-in, topped off with a wonderful pot-luck lunch. We made 65 “Blessing” tote bags, 34 children’s PJ bottoms-all
sizes, crib sheets, receiving blankets and pillow cases for donation to local women’s and children’s care facilities.
Our Valentine’s celebration was a fun luncheon at the Shrimp Haus planned by the social committee. We enjoyed games and special accordion music.
The highlight event in Feb. was the annual quilt show. There were many beautiful quilts in the show and miscellaneous items in the “mini” raffle. The
quilt show winners were:
• Large quilts: Sheryl Vaughn (1st place); Barb Kolu (2nd place); Sandra Etter (3rd place)
• Small quilts: Linda Dettmann (1st place); Sheryl Vaughn (2nd place); Donna Weaver (3rd place)
• Miscellaneous: Linda Dettmann (1st place); Randi York (2nd lace); Mary Downing (3rd place).
We congratulate our winners and thank everyone who came to the show and voted for their favorites.
Our prized memorial Arrowhead quilt was raffled off this year, with the drawing at the annual owners meeting, and was won by Pat Chesney. Again we
thank everyone who bought tickets.
